Buccella To permit the construction of a 38 unit apartment building pursuant to S. 9202.3.1.3 of the Huntington Beach Ordinance Code located on the west side of Lynn Street, approximately 450 ft. north of Warner Avenue in a R3, medium high density residential district. Mr. Buccella, the applicant, was present. The Chairman informed the Board that the Environmental Review Board granted Exemption Declaration No. 74-42 on April 16, 1974, with the following additional information: The Board offers the following recommendations to mitigate the cumulative effect of successive construction projects of this nature: Minutes: H.B. If the developer proposes to provide air conditioning, the insulation in the exterior ceilings shall be a minimum of R-19 and that in the exterior walls shall be a minimum of R-11; if no air conditioning is to be provided, the insulation in the exterior ceilings shall be a minimum of R-13 and that in the exterior walls shall be a minimum of R-7. 2. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an offsite facility equipped to handle them. 3. Gas and electric outlets for appliances shall be stubbed in to comply with the "Concern Award" specifications. 4. Because the project is located on a fault line, it is recommended that the foundations and footings be designed to withstand earthquake stresses, as determined by the Building Department. The Chairman opened the public hearing. Mrs. Susan Newman and Mrs. Korleen Bogdonavich addressed the Board and stated their opposition to the project. Mrs. Bogdonavich presented a written communication to the Board stating her opposition to Use Permit No. 74-13 for the following reasons: Seismic Density, school overcrowding, lack of open space, traffic congestion, piece- meal building which serves to detract from instead of enhance area and lack of master planning to provide for open space, schools, etc. Mrs. Bogdonavich feels that the cumulative effect of so many individual apartments going in this area is already causing a blighted look, and will bring all the overcrowding problems associated with high density. Mrs. Newman expounded on Mrs. Bogdonavich's reasons for opposing the project. The Chairman informed the applicant, Mrs. Newman. and Mrs. Bogdona- vich that the Environmental Review Board found no signficant adverse impacts will occur on this special project. Board discussed plans with applicant. Mr. Buccella, the applicant, was informed that a shortage of open space exists on the plan and for him to further pursue bringing the plans within ordinance code conformance. As there were no further parties present to speak in favor or opposition to Use Permit No. 74-13, the Chairman closed the public hearing. Board discussion followed. It was the consensus of the Board that in light of additional information received regarding density and recent City Council action regarding the Sunset Heights area to continue Use Permit No. 74-13 Minutes: H. B. Board of Zoning Adjustments Wedneday, May 29, 1974 Page 4 for two weeks to allow time for further input from the Environmental Impact Team of the Advanced Planning Group. Mr. George Hammond, Builder, and Mr. Russel Jednick, applicant were present. The Chairman informed the Board that this application is a categorical exemption, class 3, California Environmental Quality Act, 1970. The Board discussed plans with applicant and his representative. Mr. Jednick stated that he wished to build a single family home although the plans showed a duplex. He stated that the Coastal Commission only allowed a duplex to be built on his lot and that by building a duplex he has a shortage of parking according to the Coastal Commission. Tandem parking was discussed. The Board proposed a two week continuance to allow applicant time to revise his plans to meet ordinance code requirements. IN CONJUNCTION WITH: DIVISION OF LAND NO. 74-13 Applicant: Huntington Beach Industrial Park To permit the consolidation of three (3) parcels of land into one lot pursuant to S. 9811.3 of the Huntington Beach Ordinance Code located on the northeast corner of Producer Lane and Research Drive in a M1-A, 20,000 restricted industrial district. Mr. Harding, representing the applicant, was present. The Chairman informed the Board that these applications are exempt from Environmental Review Board requirements due to the adoption of Environmental Impact Report No. 73-16 adopted by the City Council on March 18, 1974. Screening wall, curbing, future reciprocal agreements and curb turns instead of driveways was discussed. Elevations were discussed. It was agreed upon that revised elevations were to come back to the Board of Zoning Adjustments for approval. The Division of Land application was discussed. It was agreed upon that the proposal meets ordinance code requirements. Conditions of approval were,discussed. Board discussion followed. ON MOTION BY EADIE AND SECOND BY SPENCER, ADMINISTRATIVE REIVEW NO. 74-65 WAS APPROVED WITH THE FOLLOWING CONDITIONS AS OUTLINED BY THE FOLLOWING VOTE: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan received May 2, 1974, shall be the approved layout. 2. Producer Lane and Research Drive right-of-way shall be dedicated to City standards at the time each parcel is developed. 3. Elevations of the proposed plan shall be submitted to the Board of Zoning Adjustments for review and approval action. 4. All buildings on lots abutting a City easement shall be set back five (5) feet from the edge of such easement. 5. Soil and compaction reports as required by the Building Department and the Department of Public Works shall be sub- mitted and approved by the City. 6. Plans depicting the fire protection systems including auto- matic sprinkler systems, fire hydrants, fire alarms and any required fire protection device shall be approved by the Fire and Public Works Departments. 7. TO BE COMPLETED PRIOR TO FINAL INSPECTION: 1. A parcel map shall be filed with and approved by the Department of Public Works and recorded with the Orange County Recorder. 2. Producer and Research shall be fully improved including street trees, street signs, street lights, fire hydrants, sewer and water main extensions. 3. All utilities shall be installed underground. 4. There shall be no fence, structure or landscaping constructed or maintained over 32 feet high within a 10 ft. by 10 ft. triangular area at the intersection of driveways and streets or within a 25 ft. by 25 ft. triangular area at the inter- section of streets. 5. Water supply shall be through the City of Huntington Beach's water supply system. 6. Sewage disposal shall be through the City of Huntington Beach's sewage system. 7. The flood control channel shall be fenced to Flood Control District standards. 8. The property shall participate in the local drainage assessment district. (Contact Dept. of Public Works) 9. All signs for the proposed development shall be submitted to the Board of Zoning Adjustments for approval. The Board of Zoning Adjustments encourages signs which reflect a common theme with respect to design materials and colors which are compatible with the architectural theme of the proposed project. 2. All required fire hydrants shall be installed, accessible and operable prior to the construction of any permanent structure using combustible material. 3. All applicable conditions of Tentative Tract 6948 shall be complied with. This Division of Land shall not be effective until a covenant and agreement furnised by the Huntington Beach Planning Department is signed and recorded with the Orange County Recorder agreeing to these Conditions of Approval. 2. Board of Zoning Adjustments Wednesday, May 29, 1974 Page 9 AYES: Eadie, Spencer, Crosby NOES: None ABSENT: None CONDITIONAL EXCEPTION NO. 74-36 Applicant: Derby Land Company To permit the exclusion of curbs around landscaped areas in lieu of S. 9792.2.4 of the Huntington Beach Ordinance Code located on the west side of Newland Street, approximately 300 ft. north of Talbert Avenue in a R2-PD (12) medium density residential district, planned development ;(12 unit per acre). Mr. Mark Hooper, of Derby Land Co. and Mr. H.D. Daily of Derby Land Company were present. The Chairman informed the Board that this application is a categorical exemption, class 5, California Environmental Quality Act, 1970. The Chairman opened the public hearing. Mr. Hooper presented his proposal to the Board. He stated that his building plans had been approved and that the exclusion of curbs around landscaped areas had not been noticed at the time of plan checking. He felt if he had known about the discrepancy at that time, he would have been able to meet ordinance code requirements in regards to curbs around landscaped areas. Mr. Hooper further stated that in order to correct the situation, fully grown trees would have to be removed and that it would cause a substantial financial hardship on the applicant. Alternatives were discussed. The Board did not feel that alternatives presented such as redwood headers were acceptable. It was the consensus of the Board that the applicant did not demonstrate a justifiable hardship. As there were no parties to speak in favor or opposition to Conditional Exception No. 74-36, the Chairman closed the public hearing. Board discussion followed. ON MOTION BY EADIE AND SECOND BY CROSBY, CONDITIONAL EXCEPTION NO. 74-36 WAS DENIED FOR THE FOLLOWING REASONS AND WITH THE FOLLOWING FINDINGS BY THE FOLLOWING VOTE: Minutes: H.B. Board of Zoning Adjustments Wednesday, May 29, 1974 Page 10 REASONS FOR DENIAL: 1. Applicant failed to demonstrate a justifiable hardship. 2. Approval of Conditional Exception No. 74-36 would be materially detrimental to the living environment as evidenced by a field check indicating numerous areas where landscaped planters within the off-street parking areas have been damaged by motor vehicles. FINDINGS: 1. Other projects within the City containing the required curbing are an example of quality development which the City, as evidenced�by the adopted Policy Plan is striving to attain. Mr. Jeff Holm, of Signal Landmark, was present. The Chairman informed the Board that this application is a categorical exemption, class 4 , California Environmental Quality Act, 1970. Board discussed plans with applicant. The relocation of certain structures was discussed. Board discussion followed. Conditions of approval were discussed. It was recommended to the applicant that he pursue all applicable provisions of the Huntington Beach Ordinance Code. The applicant was not present. The Chairman informed the Board that this application is a categorical exemption, class 9, California Environmental Quality Act, 1970. It was the consensus of the Board to continue this application to allow applicant to be present at the hearing due to the fact that the Board had several questions of the applicant regarding the proposal. The Chairman informed the Board that the Environmental Review Board granted Exemption Declaration No. 74-63 on May 21, 1974, with the following additional information: The Board recommends to the Board of Zoning Adjustments that the applicant comply with statements as submitted in the supplementary information on this project. Board discussed recommendations of the Environmental Review Board. ON MOTION BY EADIE AND SECOND BY SPENCER, THE BOARD OF ZONING ADJUSTMENTS ADOPTED EXEMPTION DECLARATION NO. 74-63 BY THE FOLLOWING VOTE: AYES: Eadie, Spencer, Crosby NOES: None ABSENT: None The Chairman outlined the proposal to the Board. He presented a transmittal from Herb Day, Oilfield Superintendent, stating that the proposal meets Huntington Beach Ordinance Code require- ments. The Board recommended to the applicant that he pursue all applicable provisions of the Huntington Beach Ordinance Code. ON MOTION BY CROSBY AND SECOND BY SPENCER, OIL WELL ACTIVATION PERMIT NO. 74-7 WAS APPROVED BY THE FOLLOWING VOTE: AYES: Eadie, Spencer, Crosby NOES: None ABSENT: None CONDITIONAL EXCEPTION NO. 74-35 Applicant: General Maintenance Corp. To permit the construction of a pole sign in lieu of S. 9764.3.1.2 (distance between signs) of the Huntington Beach Ordinance Code located on the west side of Brookhurst Street at the intersection of Bushard Street in a C4, highway commercial district. Messrs. Carl Kjellin, John Weeks, Don Hallman, of the 7-Eleven Company, and Mr. Don Fink of General Maintenance Inc. were present. The Chairman informed the Board that this application is a categorical exemption, class 5, California Environmental Quality Act, 1970. The Chairman opened the public hearing. Minutes: H.B. Mr. Kjellin stated that the sales in the subject 7-Eleven Store are half than anticipated and feels the reason for the drop off in sales is due to improper signing, whereby people are unaware of the store location. The modification of the present sign was discussed. A monument sign in lieu of the existing sign was discussed. It was noted that by modifying the colors of the existing sign, that the sign would be more easily identifiable with the 7-Eleven Store. Applicant and his representatives felt that they would pursue modifying the existing sign and requested withdrawal of their application. The Board was in general agreement but reserved the right to review any proposal. As there were no parties present to speak in favor or opposition to Conditional Exception No. 74-35, the Chairman closed the public hearing. Mr. William Harrison, the applicant, was present. The Chairman informed the Board that this application is exempt from Environmental Review Board requirements due to the approval of a former Exemption Declaration No. 74-211 granted by the Environmental Review Board on December 19, 1973. Board discussed plans with applicant.
