MINUTES: May 21, 1974 ON MOTION BY PORTER AND SECOND BY HIGGINS THE MINUTES OF MAY 21, 1974 WERE APPROVED AS AMENDED BY THE FOLLOWING VOTE: AYES: Bazil, Higgins, Kerins, Boyle, Porter NOES: None ABSENT: None USE PERMIT NO. 74-11 APPEAL (Continued from 5/21/74) Applicant: David E. Lorenzini, C.S.I. Use Permit No. 74-11 is a request to permit the construction of a three story dwelling unit located at 16787 Bolero Lane. Dave Eadie addressed the Commission and stated that failure of Commission to reach a consensus had resulted in a continuance of the application. A vugraph was presented. The chairman reopened the hearing to the public. Mr. David Lorenzini, the applicant, addressed the Commission and stated that he had with him new renderings which were on display for viewing of the Commission or members of the audience. He stated that though the proposed structure was for a three story dwelling, the height limit met the two story requirement on height limitation. Mr. Fred Grother, a resident of 16795 Bolero, addressed the Commission and spoke against the proposed'dwelling,unit, stating that 98% of the island was developed with one or two'tstory dwellings and he would not be in favor of a three story dwelling being permitted. Ms. Susan Newman addressed the Commission and spoke against the proposed dwelling unit. It was noted by Commission that there are in existence a small number of three story dwellings in the area but exact number was not ascertained. Minutes: H.B. Planning Commission Tuesday, June 4, 1974 Page 2 Mr. Lorenzini displayed the renderings which showed proposed dwelling in comparison with existing dwellings on either side. The public hearing was closed. Commissioner Bazil stated that he was opposed to upholding the CC & R's of the Huntington Harbour Property Owners Association which were imposed at the time the tract was developed. Commissioner Porter referred to Section 9801.2, Private Agreements, and stated that he would not approve the Use Permit based on this section of the Code. ON MOTION BY HIGGINS AND SECOND BY BAZIL USE PERMIT NO. 74-11 APPEAL WAS DENIED AND USE PERMIT NO. 74-11 WAS APPROVED BY THE FOLLOWING VOTE: AYES: Bazil, Higgins, Kerins, Boyle NOES: Porter ABSENT: Geiger, Wallin ZONE CASE NO. 73-26 (Continued from 5/7/74) Applicant: Frank H. Ayers & Son Zone Case No. 73-26 is a request for a zone change from R5 and R5-0 to R2-PD, located at northeast corner of Memphis Avenue and Delaware Ave. A map was on display and slides were shown. Mr. Ed Selich addressed the Commission and stated that the area contains many natural amenities which could be preserved through a planned development, the R5 zoning presently on the property is inappropriate as it would compete with the Civic Center, and that R2-PD is consistent with the General Plan. The hearing was opened to the public. Mr. John Rourke, representative of the applicant, addressed the Commission and stated that he was prepared to answer any questions which the Commission might wish to direct. The public hearing was closed. Commission discussed density and it was determined that there would be less than 10 units per acre. Chairman Kerins stated that a review of the Land Use Plan had shown this zone change would be in concert with it. -2- 6/4/74 - PC 1 Minutes: H.B. Planning Commission Tuesday, June 4, 1974 Page 3 ON MOTION BY BOYLE AND SECOND BY BAZIL ZONE CASE NO. 73-26, A CHANGE FROM R5 AND R5-0 TO R2-PD-10, WAS APPROVED ON THE BASIS OF STUDIES MADE OF LAND USE BY THE FOLLOWING VOTE: AYES: Bazil, Higgins, Kerins, Boyle, Porter NOES: None ABSENT: Geiger, Wallin ZONE CASE NO. 73-28 (Continued from May 21, 1974) Applicant: Classic Development Corporation Zone Case No. 73-28 is a request for change of zone from MH to R1 in order to subdivide a parcel into 70 R1 lots (6000 sq. ft. minimum) located at the northwest corner of Garfield Avenue and Newland Street. A vugraph was shown. Mr. Ed Selich addressed the Commission and presented a chronology of the application. Slides of the area were presented. Mr. Bill Hartge, Director of Public Works, discussed the soil condition. He stated that once surcharge has taken place monuments are installed and readings taken. The applicant was able to level off areas of property and use for fill and hence did not have to truck the material in to improve the soil condition. The Chairman opened the hearing to the public. Mr. Jim Chaffin, representative of Classic Development, addressed the Commission. He stated that he felt it was not valid for staff to recommend a R1 PD for the area. Commission discussed the fault line. Public hearing was closed. A MOTION WAS MADE BY HIGGINS AND SECONDED BY BAZIL TO APPROVE ZONE CASE NO. 73-28 BASED ON INFORMATION SUPPLIED BY BILL HARTGE THAT A GEOLOGIST WILL BE ENGAGED TO HELP DETERMINE DEVELOPMENT CRITERIA AND THAT THEY WILL COMPLY WITH UPCOMING STATE LAW RELATIVE TO SEISMIC WORK. VOTE: AYES: Kerins, Boyle, Porter NOES: Bazil, Higgins ABSENT: Geiger, Wallin THE MOTION FAILED. Chairman Kerins stated that per the by-laws of the City of Huntington Beach Ordinance Code, the matter is automatically continued to the next regular meeting when a consensus cannot be reached. However, since the time period in which action must be taken had expired, it was necessary for the applicant to agree to the continuance, otherwise no action on the part of the Commission would result in an automatic recommendation for denial. Mr. Jim Chaffin, representative for the applicant, stated that he would not agree to a continuance for decision. Mr. Chaffin was advised that he could appeal the decision at the City Clerk's office at 9:00 A.M. Wednesday, June 5, 1974 and be heard at the June 17, 1974 City Council meeting. Commissioner Porter requested that staff prepare a transmittal that relates to discussion on votes that were taken. ZONE CASE NO. 74-4 Applicant: Robert R. Potter This Zone Case is a request of zone change from C4 to R3 located on the east side of Beach Blvd. 135' north of Constantine Lane. ON MOTION BY PORTER AND SECOND BY BOYLE ZONE CASE NO. 74-4 WAS CONTINUED TO JUNE 18, 1974 PENDING LEGAL NOTIFICATION BY THE FOLLOWING VOTE: AYES: Bazil, Higgins, Kerins, Boyle, Porter NOES: None ABSENT: Geiger, Wallin TENTATIVE TRACT NO. 7596 (Continued from May 21, 1974) Applicant: Donald L. Bren Co. This is a request for one year of extension of time of the conditions of approval for Tentative Tract No. 7596 commencing July 5, 1974. Mr. Selich addressed the Commission and stated that this application had been continued pending determination from City Attorney's office on whether the City can incur liability for approval of projects in known earthquake fault areas. He stated Minutes: H.B. Planning Commission Tuesday, June 4, 1974 Page 5 that the Commission may wish to impose conditions from the Geotechnical Report. Mr. Richard Holz, representative of Donald L. Bren Co., addressed the Commission and cited the reason for request for extension of time, i.e., the agreement between the City and the participating land owners for the construction of the storm drain on Newland Ave. may not be executed and accepted by all parties in sufficient time to submit and secure proper approvals and recordation of the map. Conditions of approval to be imposed were discussed by Commission. ON MOTION BY HIGGINS AND SECOND BY BAZIL A ONE YEAR EXTENSION OF TIME FROM JULY 5, 1974 WAS GRANTED FOR TENTATIVE TRACT NO. 7596 WITH THE FOLLOWING CONDITIONS AND BY THE FOLLOWING VOTE: 1. The tentative map received June 23, 1972, shall be the approved layout. 2. The area north of Yorktown Avenue, except the 12 acres east of Edison right-of-way, shall not be developed until an agreement is reached regarding the method of constructing major drainage facilities for this area. 3. A soil report prepared by an approved soils engineer shall be submitted to the Department of Public Works prior to recordation of any portion of the tract. All portions of the land not satisfactory for building shall be excluded. 4. The median along Garfield Avenue shall be landscaped and improved to Planning Department and Department of Public Works' requirements. Such landscaping shall include the bulb at the intersection of "AA" Street. 5. The street right-of-way along Garfield Avenue, across the Southern California Edison Company easement, shall be fully improved to Department of Public Works' requirements. 6. A 6 ft. high masonry wall shall be constructed along the rear of the lots backing onto the Newland School site. Also a concrete strip shall be installed between the existing chain link fence and the new wood frame or wall. 7. Access rights along arterial highways, except at street intersections, shall be dedicated to the City of Huntington Beach. -5- 6/4/74 - PC Minutes: H.B. Planning Commission Tuesday, June 4, 1974 Page 6 8. The water and fire hydrant system shall be approved by the Department of Public Works and Fire Department. 9. Decorative masonry walls shall be constructed to City speci- fication along lots siding or backing onto arterial highways. Said wall shall be six (6) inches wide and six (6) feet high. The height of said wall shall be measured from whichever side is higher at finished grade. The architectural design of said wall shall be approved by the Planning Department. Structural design shall be approved by the Department of Public Works and shall be included as a part of the Street Improvement Plans. The intent of this condition is to improve the street scene along arterial highways. NOTE: Photographs indicating the various types of wall materials and designs which are desirable are on file in the Planning Department. 10. The architectural design of the perimeter wall and the type and placement of street trees shall create unity and interest in the street scene. 11. Landscaped planters shall be provided along all arterial high- ways. Such planters shall conform to the plans and speci- fications on file in the Department of Public Works and the requirements of the Planning Commission. It is the developer's responsibility to landscape such planters and provide irrigation facilities in accordance with the Department of Public Works' specifications and requirements. 12. Said property shall participate in the local drainage assess- ment -district. 13. Right-of-way for street widening on all parcels not included within the proposed subdivision, held under the same ownership as the subdivision, shall be dedicated to the City of Huntington Beach and fully improved. This provision shall not apply to property upon which a division of land has been approved by the City, recorded, and all conditions of approval have been fulfilled. 14. Fire alarm system conduit and appurtenances shall be installed by the developer at locations and to specifications provided by the Fire Department. 15. Except where otherwise specified, a six (6) foot high decorative masonry wall shall be constructed along the exterior side lot line of all corner lots. -6- 6/4/74 - PC Minutes: H.B. The exterior elevations of all buildings constructed on lots that side -on or back -on an arterial highway shall be subject to approval by the Planning Department. The intent of this requirement is to improve the street scene by having the developer provide architectural features and variations in building materials on the exterior surfaces of buildings that are viewed from an arterial highway. 17. The rear exterior corner of a reverse corner lot shall be modified to exclude the ten (10) foot by ten (10) foot triangular area that abuts the side lot line of the adjacent lot. Such area shall be included as a portion of the adjacent lot. 18. The developer shall be required to install full insulation in all exterior walls and ceilings of the dwellings to minimize the burden on heating and cooling systems. 19. The developer shall be required at the time of construction to stub out for both electrical and natural gas utilities the following facility: clothes dryers. He shall also be required to provide gas for water heaters and central heating. This condition is imposed to minimize possible overburden on any one energy source. 20. The developer shall be required to dispose of all building spoils, such as unusable lumber, tar paper, wire, pipe and other excess or unusable waste, at an off -site facility that is equipped to handle them. 21. The developer shall be required to remove all peat deposits from the lots in the project which have been designated in the report as areas having a serious peat problem. 22. The developer shall be required to locate all dwelling units at a minimum setback of 35 feet from the travel lane of the arterial highway to reduce and attenuate the sound pressure level to an acceptable level of between 45 and 50 dBa reading within the dwelling units. 23. The developer shall be required to afford access to the adjoining Edison right-of-way on Garfield to make it available for bicycle traffic down to the high school. 24. The developer shall be required to furnish a list of plant materials that would be acceptable in the project area, such list to be prepared by a qualified consultant, and shall furnish a statement to be made available to the buyers of the units regarding possible earth settling in the area. -7- 6/4/74 - PC Minutes: H.B. The Parks and Recreation fees in effect at the time Planning Commission grants an extension of time on the Tentative Tract map shall be the approved fees. 26. The developer shall be required to stockpile all topsoil as it is removed for construction and replace and restore it within the project after construction. 27. The developer shall be required to construct all arterial highway improvements, including perimeter walls and land- scaping, prior to release or connection of utilities for occupancy. 28. No structure for human occupancy shall be permitted to be placed across the trace of an active fault. Furthermore, the area within fifty (50) feet of an active fault shall be assumed to be underlain by active branches of that fault unless and until proven otherwise by an appropriate geologic investigation and submission of a report by a geologist registered in the State of California. 29. Applications for all real estate developments and structures for human occupancy shall be accompanied by a geologic report prepared by a geologist registered in the State of California, and directed to the problem of potential surface fault dis- placement through the site. AYES: NOES: ABSENT: Bazil, Higgins, Kerins, Boyle Porter Geiger, Wallin Commissioner Boyle stated that his reason for voting yes on the request for extension of time was that he did not want to hold up the processes, and in no way should his vote be construed as approval of the project. DISCUSSION: Negative Declaration CODE AMENDMENT NO. 73-9 - Consolidated Apartment Standards To consolidate the apartment standards to encourage better land planning techniques with maximum use of landscaping, site layout and building design. CODE AMENDMENT NO. 73-13 - Apartment Density Reduction To reduce the density on apartment developments, to encourage better land planning, and to increase open space. Commission discussed net and gross acreage. Commission was informed that a density reduction code amendment package was being prepared by staff and will be presented at the July 23 study session. -8- 6/4/74 - PC Minutes: H.B. Planning Commission Tuesday, June 4, 1974 Page 9 ON MOTION BY BOYLE AND SECOND BY PORTER NEGATIVE DECLARATION COVERING CODE AMENDMENT NO. 73-9 AND CODE AMENDMENT NO. 73-13 WAS APPROVED AND WAS TO BE TRANSMITTED TO CITY COUNCIL WITH RECOMMENDATION THAT CODE AMENDMENT NO. 73-13 BE TABLED BECAUSE IT IS BEING INCORPORATED INTO A DENSITY REDUCTION CODE AMENDMENT PACKAGE BY THE FOLLOWING VOTE: AYES: Bazil, Higgins, Kerins, Porter, Boyle NOES: None ABSENT: Geiger, Wallin DISCUSSION - Sunset Heights Study: Discussion of priority rating in work program. Ed Selich addressed the Commission and discussed the study which had been made on the Sunset Heights area. Chairman directed that staff along with members of other departments within the City get together and prepare a brief summary of recommendations for presentation at June 18 meeting. WRITTEN COMMUNICATIONS 1. Proposed concept utilizing subterranean parking plan was displayed and Commissioners' comments requested by staff. Staff directed to pursue study of the concept so long as top of parking area does not exceed 42" in height. 2. Application for Variance Permit in Sunset Beach area. Staff was directed to transmit letter to Orange County indicating objections to the parking on the Pacific Coast Highway. 3. Letter from Cornelus Adriaans requesting addition to a garage in non -conforming use area. Purpose of request is to provide sufficient storage for recreation equipment and garden tools. Letter from Mrs. Ramon Boesch to Commissioner Boyle concerning population density and the development of Warner Avenue into apartment complex and the development of Sunset Heights land. Staff was directed to prepare a reply to Mrs. Boesch. COMMISSIONERS' COMMENTS Chairman Kerins presented Commission and Secretary Harlow with copies of Planning Commissioners' conference trip report which was attended by Chairman Kerins, Commissioner Porter, and Commissioner Boyle. Staff directed to transmit copies to various departments within the City. Staff was directed to prepare a letter of transmittal for Chairman's signature to the City Council. Chairman Kerins discussed capital improvements budget and directed Secretary Harlow to set up meeting with City Administrator and Bill Hartge to discuss capital improvements as it relates to land use. Staff directed to prepare a letter of transmittal for Chairman's signature to City Council requesting review by Planning Commission of capital improvements as they relate to land use, quoting from the section of the law which is applicable. Chairman Kerins appointed Commissioner Bazil to serve on the Equestrian Committee. Commissioner Boyle suggested that each of the Commissioners be furnished a copy of The Job of the Planning Commissioner by Albert Solnit, University Extension, University of California, Berkeley.
