Paschall To permit an encroachment of four (4) feet into the minimum yard setback in lieu of S.9166.5 of the Huntington Beach Ordinance Code, located on Bay View Drive, approximately 75 ft. southeast of Broadway in an R-2, medium density residential district. -2- 6/5/74 - BZA 1 iJ Minutes: H.B. Board of Zoning Adjustments Wednesday, June 5, 1974 Page 3 The Chairman opened the public hearing. Mr. Max Moore, representing the applicant, addressed the Board. He stated the 4 foot encroachment would decrease the driveway to 18 feet. However, parking would not be hindered. He further stated that the encroachment would give much needed additional living space to the applicant. He stated that when the property was originally bought it was part of the County and that the average setback for other houses on the street was 5 feet. The Chairman informed the Board that this application is a categorical exemption, Class 5, California Environmental Quality Act, 1970. Ms. Dorothy Wallace, who lives two doors east of applicant, addressed the Board and spoke in favor of granting the Conditional Exception in view of the fact that the other homes did not set back 22 ft. She stated that she felt it would look much better and that she had no objections to it. Mr. Art Knox, President of Huntington Harbour Property Owners Association, spoke against the granting of the Conditional Exception. He stated that he was a member of the Citizens Zoning and Variance Association. He stated that he felt the granting of the Conditional Exception would constitute the granting of a special privilege and would be in violation of the City Charter. Mr. Moore spoke on equality to other properties and stated that when all other houses have an average setback of 5 feet, the granting of 4 foot encroachment to Mr. Paschall would not be a special privilege. He stated that by requiring a 22 foot setback the dwelling would achieve a tunnel -like appearance when considering development on either side of the property. As there were no further persons to address the Board, the Chairman closed the public hearing. The Chairman noted that Conditional Exception No. 73-61 was formerly denied on this property to applicant B. Subbiondo. It was the feeling of the Chairman and Mr. Spencer that certain hardships existed on the property ,in view of the current plans for construction and lot size. However, it was the consensus of the Board that the encroachment of 4 feet posed on -site parking problems. ON MOTION BY SPENCER AND SECOND BY'EADIE CONDITIONAL EXCEPTION NO. 74-39 WAS DENIED FOR THE FOLLOWING REASONS AND BY THE FOLLOWING VOTE: 1. The Chairman stated that due to applicant's absence from the meet- ing and the fact that his plans were inadequate a continuance or denial would be in order. ADMINISTRATIVE REVIEW NO. 74-72 (Cont. from 5/29/74) Applicant: Hilton Phillip Bowen To permit the care of six (6) non -related persons pursuant to S.9730.27 of the Huntington Beach Ordinance Code located on the north side of Tucana Avenue, approximately 94 f t. west of Golden - west Street in an R-1 low density residential district. The Chairman opened the hearing to the public. The applicant was not present, and there was no one present to speak for or against the application. The public hearing was closed. The Chairman stated that applicant had submitted plans which met code requirements for this usage, and Captain Vanderlaan stated that the Fire Department had found the applicant to be in compliance with their requirements. However, it was noted by the Board that applicant has not submitted proof of certification. The Chairman stated that he felt this should be a final continuance. Board of Zoning Adjustments Wednesday, June 5, 1974 Page 5 CONDITIONAL EXCEPTION NO. 74-30 (Cont. from 5/29/74) Applicant: K-D Venture To permit an offsite pole sign in a parking area in lieu of S.9760.1.1 and to permit waiver of said pole sign to be contained within a landscaped planter in lieu of S.9761.9.3 of the Huntington Beach Ordinance Code located on the east side of Beach Boulevard, approximately 50 ft. south of Atlanta Avenue in a C-4 highway commercial district. The Chairman opened the hearing to the public. Mr. Guy Thull, Occidental Land, Inc., representing the applicant, addressed the Board, and stated that the proposed plan for pole sign presented an attractive and harmonious appearance and was in alignment with other signs. Mr. Art Knox addressed the Board and stated that he was opposed to the sign inasmuch as it would constitute a special privilege and it was possible for the developer to conform to code in erecting the sign. The Chairman noted that this application is a categorical exemption, Class 5, under the California Environmental Quality Act - 1970. He stated that there is ample opportunity to put the pole sign within a logical area. The Chairman closed the public hearing. Board discussion followed. Corporation To permit the reduction of the six (6) percent landscaping require- ment in lieu of S.9792.2.2 of the Huntington Beach Ordinance Code located 600 ft. south of Talbert Avenue, east of the Southern Pacific Railroad right-of-way, in an M-1 light industrial district. To permit an amendment of the approved plan (T.5419) pursuant to S.9811.4 of the Huntington Beach Ordinance Code located generally on the northwest corner of Atlanta and Magnolia in an R-1, low density residential district. The Chairman opened the hearing to the public. Mr —Jeff Holm, representing Signal Landmark, was present. He stated that the amendment resulted in reducing the walking areas in assign- ments of parking spaces. Density was not changed, and more open space was created. Board discussed the plans and noted that they were in conformance with PRD requirements. The Chairman closed the public hearing. ON MOTION BY EADIE AND SECOND BY CROSBY PLOT PLAN AMENDMENT NO. 74-1 WAS APPROVED WITH THE FOLLOWING FINDINGS BY THE FOLLOWING VOTE: Findings: 1. The use remains the same. 2. The density is not increased. 3. Revisions will result in improvement in placement of sidewalks nearer parking areas and an increase of open space. 4. There is not a substantial change in the plans. King To permit the construction of a four (4) unit apartment building pursuant to S.9201.2 of the Huntington Beach Ordinance Code located at the northeast corner of 14th Street and Orange Avenue in an R-3 medium -high density residential district. Mr. John King, applicant, was present and discussed the plans with the Board. Mr. Bruce Crosby noted that there is no dedication across the alley. The applicant stated that if more turning radius was needed he had plans for a shorter building. Mr. Eadie stated that they would prefer as much screening as possible along the arterial highway and would propose that decorative masonry wall be installed. ii ON MOTION BY CROSBY AND SECOND BY EADIE ADMINISTRATIVE REVIEW NO. 74-74 WAS APPROVED WITH THE FOLLOWING CONDITIONS BY THE FOLLOWING VOTE: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The plot plan received May 21, 1974 shall be the approved layout. 2. 14th Street, Orange and Alley right-of-way shall be dedicated to City standards at the time each parcel is developed: 3. Soil and compaction reports as required by the Building Department and the Department of Public Works shall be submitted and approved by the City. B. TO BE COMPLETED PRIOR TO FINAL INSPECTION: 1. 14th Street, Orange and Alley shall be fully improved including street trees, street lights, fire hydrants, sewer and water main extensions. 2. There shall be no fence, structure, or landscaping constructed or maintained over 3 1/2 feet high within a 10 ft. by 10 ft. triangular area at the intersection of driveways and streets or within a 25 ft. by 25 ft. triangular area at the intersection of streets. 3. A 32" decorative masonry wall shall be installed along Orange Avenue to assist in screening the parking area. GENERAL: 1. All required fire hydrants shall be installed, accessible and operable prior to the construction of any permanent structure using combustible material. 2. If the developer proposes to provide air conditioning, the insulation in the exterior ceilings shall be a minimum of R-19 and that in the exterior walls shall be a minimum of R-11; if no air conditioning is to be provided, the insulation in the exterior ceilings shall be a minimum of R-13 and that in the exterior walls shall be a minimum of R-7. 3. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an offsite facility equipped to handle them. 4. Natural gas and electricity shall be stubbed in at the locations of clothes dryers, and natural gas only shall be stubbed in at the locations of cooking facilities, water heaters, and central heating units. Mr. Doniger spoke in favor of his plan and stated that he was attempting to obtain parity, that he had no privacy with the existing dwelling. Mr. Art Knox stated that he would be opposed to the proposed encroachment unless the existing area variances in the area proved to allow this encroachment. The Chairman suggested a field check be made of the property. ON MOTION BY EADIE AND SECOND BY SPENCER CONDITIONAL EXCEPTION NO. 74-37 WAS CONTINUED TO JUNE 12, 1974 BY THE FOLLOWING VOTE: AYES: Eadie, Spencer, Crosby NOES: None ABSENT: None ADMINISTRATIVE REVIEW NO. 74-73 Applicant: Richard R. Rule To permit the construction of a Real Estate Office pursuant to S.9471 of the Huntington Beach Ordinance Code located on the south side of Warner Avenue, approximately 182 ft. east of Bolsa Chica Avenue in a C-4 highway commercial district. Mr. Richard R. Rule, the applicant, was present and discussed his plans with the Board, indicating that he plans to develop Phase 2 of the plan within two or three years. Fencing was discussed and it was determined by the Board that property abutting an R-1 area requires a 6 ft. block wall. It was noted that the Environmental Review Board had approved Exemption Declaration No. 74-71 on June 4, 1974. Conditions of approval were discussed. A soils engineer shall be engaged to indicate the G-factor due to earth movement for this location. 5. A structural engineer shall be engaged to compile calculations for footings and structural members of the facility to withstand these G-factors. Division of Land No. 74-16 is a request to permit the division of one legal parcel of land into two parcels pursuant to S.9811.3 of the Huntington Beach Ordinance Code. Mrs. Doris Martinez, applicant, was present. Board discussed a reciprocal agreement of ingress and egress in circulation of traffic. Conditions of approval were discussed. ON MOTION BY SPENCER AND SECOND BY EADIE ADMINISTRATIVE REVIEW NO. 74-77 WAS APPROVED WITH THE FOLLOWING CONDITIONS AND BY THE FOLLOWING VOTE: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan received May 28, 1974 shall be the approved layout. 2. This Division of Land shall not be effective until a covenant and agreement furnished by the Huntington Beach Planning Department is signed and recorded with the Orange County Recorder agreeing to these Conditions of Approval. 2. The tentative parcel map received by the Planning Department on May 28, 1974 shall be the approved layout. 3. A parcel map shall be filed with and approved by the Department of Public Works and recorded with the Orange County Recorder (prior to issuance of a Certificate of Occupancy). 4. A copy of the recorded parcel map and covenant and agre(%ient shall be submitted to the Planning Department. 5. A reciprocal agreement for ingress, egress and circulation shall be submitted to the Planning Department, the form and content to be approved by the City Attorney's office. Said agreement shall cover both parcels involved regarding Division of Land No. 74-16. 9. All utilities shall be installed underground at the time said parcel is developed.. 10.
