wash pursuant to 5.9430.7 of the Huntington Beach Ordinance Code
located on the south side of Garfield Avenue, approximately
200 ft. west of Brookhurst Street in a C-2, community business
district.
Mr. Frank Brent, the applicant, and Mr. Bill Harrison, property
owner, were present.
The Chairman opened the public hearing.
The Chairman informed the Board the Environmental Review Board
granted Exemption Declaration No. 74-37 on April 2, 1974
with the following additional information:
No environmental impact report has been prepared for this
project, and the Negative Declaration issued for the project
has been properly posted in the office of the City Clerk.
Findings are based upon information contained in the exemption
declaration request as well as upon statements made by the
applicant at the Environmental Review Board's meeting.
The Board discussed the additional information transmitted
by the Environmental Review Board.

The Chairman outlined the history of this proposal and stated
this application had been previously continued indefinitely.
Possible developments for the rear of the property were discussed.
It was noted that the rear of the proposal would be difficult
to develop due to the immediate drop of 8 or 9 feet of the property.
Traffic flow of the proposal was discussed. It was the consensus
of the Board that no traffic problems would be created.
As there were no further parties present to speak in favor or opposition
to Use Permit No. 74-12, the Chairman closed the public hearing.

ON MOTION BY EADIE AND SECOND BY SPENCER USE PERMIT NO. 74-12
WAS APPROVED WITH THE FOLLOWING CONDITIONS AND FINDINGS AS OUTLINED
BY THE FOLLOWING VOTE:
A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS:
1. The conceptual plot plan received March 13, 1974 shall
be the approved layout as amended indicating deletion
of property line to the rear of the property.
2. A revised plot plan shall be submitted to the Planning
Department for approval action. Said plan shall
incorporate a plan encompassing the total parcel.
3. Soil and compaction reports as required by the Building
Department and the Department of Public Works shall be
submitted and approved by the City.
4. Plans depicting the fire protection systems including
automatic sprinkler systems, fire hydrants, fire alarms
and any required fire protection device shall be approved
by the Fire and Public Works Departments.
5. A landscaping and irrigation plan shall be submitted to
the Planning Department for review and approval action.
B. TO BE COMPLETED PRIOR TO FINAL INSPECTION:
1. All utilities shall be installed underground.
2. Water supply shall be through the City of Huntington
Beach's water supply system.
3. Sewage disposal shall be subject to approval by City
Engineer.
4. The property shall participate in the local drainage
assessment district. (Contact Dept. of Public Works)
5. No structures, other than those shown on the approved
plot plan, shall be constructed within the project.
6. The sewer system shall be approved by the Department of
Public Works and Fire Department.
GENERAL:
1. All signs for the proposed development shall be submitted
to the Board of Zoning Adjustments for approval. The Board
of Zoning Adjustments encourages signs which reflect a
common theme with respect to design materials and colors
which are compatible with the architectural theme of the
proposed project.
2. All required fire hydrants shall be installed, accessible
and operable prior to the construction of any permanent
structure using combustible material.

FINDINGS:
1. The project is not adverse to the General Plan.
2. All aspects of S.9811.2 of the Huntington Beach Ordinance
Code have been established.
3. The proposal is consistent with the City's Policy Plan to
provide better building construction and good design.
4. The plan efficiently utilizes the narrow portion of'the
total conforming lot while not limiting the development
possibly of the remainder of the parcel.

To permit the construction of a 38 unit apartment building
pursuant to S.9203.1.3 of the Huntington Beach Ordinance Code
located on the west side of Lynn Street, approximately 450 ft.
north of Warner Avenue in an R-3, medium high density residential
district.
The applicant was not present.
The Chairman opened the public hearing.
The Chairman informed the Board that the Environmental Review
Board granted Exemption Declaration No. 74-42 April 16, 1974
with the following additional information:
The Board offers the following recommendations to mitigate
the cumulative effect of successive construction projects of
this nature:
1. If the developer proposes to provide air conditioning, the
insulation in the exterior ceilings shall be a minimum of
R-19 and that in the exterior walls shall be a minimum of
R-11; if no air conditioning is to be provided, the
insulation in the exterior ceilings shall be a minimum of
R-13 and that in the exterior walls shall be a minimum of
R-7.
2. All building spoils such as unusable lumber, wire, pipe, and
other surplus or unusable material, shall be disposed of at
an offsite facility equipped to handle them.

3. Gas and electic outlets for appliances shall be stubbed in
to comply with the "Concern Award" specifications.
4'. Because the project is located on a fault line, it is recom-
mended that the foundations and footings be designed to
withstand earthquake stresses,.as determined by the Building
Department.
Mrs. Bogdonovich, Mrs. Mitchel and Mrs. Kreuder addressed the
Board and stated their opposition to the proposal. Mrs. Bogdonovich
stated that the proposal should not be constructed due to seismic,
density, lack of park and school sites and road problems. She
requested the Board to continue this application until the Planning
Department had concluded studies in that area relating to seismic,
density, lack of park and school site, etc.
The Chairman informed the Board and the residents of Huntington
Harbour present, that the City Council has approved Tract 8000
to be built in that vicinity.
As there were no further parties present to speak in favor or
opposition to Use Permit No. 74-13, the Chairman closed the public
hearing.
The Board discussed the proposal.
Conditions of existing streets in the vicinity were discussed.
Mr. Crosby stated that the Department of Public Works had plans to
commence street improvement by the end of July, 1974 including
improvements of streets, curbs and gutters.
It was noted that the proposed plot plan was lacking in open
space. The Chairman stated that the applicant had proposed
dropping a unit to meet open space requirements.
The Board proposed a one week continuance to allow the applicant
to be present and to discuss the open space requirements.

Applicant: Warren E. Ten Eyck
To permit the construction of a 60 unit apartment project
pursuant to S.9203.3.1.3 of the Huntington Beach Ordinance
Code located on the southwest corner of Constantine Dr. and
Carolyn Lane, approximately 150 ft. west of Lister Lane in
an R-3, medium -high density residential district.
Mr. Ten Eyck, the applicant, and Mr. Jim Thomas, representing
the applicant, were present.
The Chairman opened the public hearing.
The Chairman informed the Board that the Environmental Review
Board granted Exemption Declaration No. 74-52 on May 15, 1974
with the following additional information:
The Board offers the following recommendations to mitigate the
cumulative effect of successive construction projects of this
nature:
1. If the developer proposes to provide air conditioning, the
insulation in the exterior ceilings shall be a minimum of
R-19 and that in the exterior walls shall be a minimum of
R-11; if no air conditioning is to be provided, the
insulation in the exterior ceilings shall be a minimum

stand these G-factors.
The Board discussed the additional information transmitted by the
Environmental Review Board and adopted them as conditions of approval.

Mrs. Doniger presented a list of several homes in the vicinity
that had been granted similar variances.
Board discussed each home selected by Mrs. Doniger, individually
as to certain circumstances why these homes were granted variances.
The Chairman stated that a code amendment would be recommended
to allow a greater variation in setback requirements for walls,
but stated that the applicant had failed to demonstrate a
justifiable hardship at this time relating to the premise of
a Conditional Exception.

The Board questioned Mr. Doyle of the amount of manufacturing
to be done on the proposed site. Mr. Doyle stated that he
is doing most of the manufacturing on site now and that he
is in business to sell camper parts, repair work, fishing
related items, the manufacturing of custom poles, sinkers, etc.
Parking was discussed.

4. Sewage disposal shall be through the City of Huntington
Beach's sewage system.
5. The property shall participate in the local drainage

GENERAL:
1. All required fire hydrants shall be installed, accessible
and operable prior to the construction of any permanent
structure using combustible material.
2. If additional dedication across the alley from subject
site can not be obtained, the applicant shall set back
2'6" further in order to attain a 25 ft. turning radius
into garages.
3. If the developer proposes to provide air conditioning, the
insulation in the exterior ceilings shall be a minimum of
R-19 and that in the exterior walls shall be a minimum of R-11;
if no air conditioning is to be provided, the insulation in
the exterior ceilings shall.be a minimum of R-13 and that in
the exterior walls shall be a minimum of R-7.
4. All building spoils, such as unusable lumber, wire, pipe, and
other surplus or unusable material, shall be disposed of at
an offsite facility equipped to handle them.

Mr. Maynard, the applicant, and Mr. Menning, representing

The Chairman opened the public hearing.
The Chairman informed the Board that the Environmental Review
Board granted Exemption Declaration No. 74-21 on June 4, 1974
with the following additional information:
No environmental impact report has been prepared for this
project, and the Negative Declaration issued for the project
has been properly posted in the office of the City Clerk.
Findings are based upon information contained in the
exemption declaration request and discussion at the
Board meeting.
Board discussed additional information transmitted by the
Environmental Review Board.
Board discussed plans with applicant and his representative.
The existance of a private easement was discussed versus the
accessibility to the proposed project.
The appropriate use of the proposal for the location was discussed.
Also, landscaping and street alignment were discussed.

Mr. Henley of the La Solana Corporation and Mr. Ed Smith of
17092 Pacific Coast Highway were present to inquire about the
proposed amendments to the plot plan. After an explanation
by Mr. Duncan of the proposed amendments, neither of the
gentlemen were in opposition to the proposed project.
As there were no further parties present to speak in favor or
opposition to Plot Plan Amendment No. 74-3, the Chairman closed
the public hearing.
It was the consensus of the Board that the proposal meets ordinance
code requirements.
