COMMISSIONERS ABSENT: Boyle MINUTES: ON MOTION BY WALLIN AND SECOND BY HIGGINS MINUTES OF MAY 28, 1974, AND JUNE 4, 1974 WERE APPROVED AS AMENDED BY THE FOLLOWING VOTE: AYES: Geiger, Higgins, Kerins, Wallin, Porter NOES: None ABSENT: Bazil, Boyle REGULAR AGENDA ITEMS: ZONE CASE NO. 73-25 (Continued from 5/7/74) Applicant: Building Concepts, Inc. Zone Case No. 73-25 is a request for a change of zone from RA-0 to M1-A located on the east side of Brookhurst Street, 1000 ft. north of Pacific Coast Highway. Mr. Ed Selich addressed the Commission and briefly summarized the background information on this Zone Change. A vugraph was presented. Mr. Selich indicated that a letter had been received from the County Sanitation Districts dated June 14 requesting the City of Huntington Beach to defer any change of zoning that would enhance the value of the parcels under consideration. Mr. Selich further stated that the staff had studied the recreational potentials for the property. The property is presently designated as a "Planning Reserve" area in the Land Use Element of the General Plan. It -was the.staff's recommendation that with applicant's concurrence the application should be continued pending appraisal of the property by the Sanitation District. Chairman Kerins reopened the public hearing. Mr. Harry Rinker, owner of the property, addressed the Commission and stated that he felt it was unfair to continue the application based on the Sanitation District's recommendation. A MOTION WAS MADE BY PORTER AND SECONDED BY KERINS TO RECONSIDER ACTION ON ZONE CASE NO. 73-25 BECAUSE REASONS FOR DENIAL HAD NOT BEEN INCLUDED IN THE PREVIOUS MOTION TO DENY. VOTE: AYES: Geiger, Higgins, Kerins, Wallin, Porter NOES: None ABSENT: Boyle ABSTAIN: Bazil THE MOTION PASSED. Commissioner Bazil stated that he abstained because the application had been discussed prior to his arrival and he did not feel qualified to vote on it. ON MOTION BY PORTER AND SECOND BY WALLIN ZONE CASE NO. 73-25 WAS DENIED FOR THE FOLLOWING REASONS AND BY THE FOLLOWING VOTE: 1. The property is of insufficient depth to allow industrial development compatible with commercial and residential areas across from the subject property. 2. The property is situated in a location better designed to provide commercial support for beach and recreational trail activities in Santa Ana River greenbelt plan. 3. Because of its size and configuration and location, the only compatible industrial use for this property is its inclusion in the sanitation plant. AYES: Geiger, Higgins, Kerins, Wallin, Porter NOES: None ABSENT: Boyle ABSTAIN: Bazil ZONE CHANGE NO. 74-7 Applicant: Initiated by Planning Commission This is a proposal initiated by the Planning Commission to rezone four.(4) 54 ft. The Chairman opened the hearing to the public. Mr. Al Heptig, 520 Huntington Avenue, addressed the Commission and spoke in opposition to the proposed change. He stated that the change would result in downgrading the value of his property. Mr. Loyd McFee, 602 Huntington, addressed the Commission and stated that he had bought the property because of its zoning and that he had planned on putting more units on the property than the proposed zone change would permit. Mr. James Brown, 601 Huntington Avenue, addressed the Commission and stated that he had foundations in for a two story building and that he did not feel there should be a zone change. Mr. Don Jenner, 608 Huntington Avenue, spoke in favor of permitting single family dwellings in the area and stated that he did not object to multiple family dwellings either. Colonel Raymond F. Hays addressed the Commission and stated that he merely wanted to be permitted to erect a single family dwelling and did not object to multiple family dwellings in the area. He did feel, however, that he should be permitted to build a single family dwelling on the property which he owned, and that it would not downgrade the area at all. The public hearing was closed. ON MOTION BY HIGGINS AND SECOND BY PORTER ZONE CHANGE NO. 74-7 WAS APPROVED FOR THE FOLLOWING REASON AND BY THE FOLLOWING VOTE: The zone change would result in making the property development more compatible with surrounding properties. AYES: Geiger, Bazil, Higgins, Kerins, Wallin, Porter NOES: None ABSENT: Boyle ZONE CASE NO. 74-4 Applicant: Robert R. Potter Zone Case No. 74-4 is a request to change the zone from C4, highway commercial, to R3 located on the east side of Beach Boulevard 135 ft. north of Constantine Lane. Mr. Ed Selich addressed the Commission and noted that a correction in General Information, Section 1.0 of the staff report, should be noted, namely that Division of Land No. 74-6 was withdrawn -3- 6/18/74 - PC Minutes: H.B. Planning Commission Tuesday, June 18, 1974 Page 4 at April 10, 1974 meeting of the Board of Zoning Adjustments. Mr. Selich gave a brief summary of the background of the assess- ment district. A vugraph was shown. There was a discussion on the Land Use Element of the General Plan and the recommendations of the staff. It was the recommendation of the staff that as part of the Phase II effort of the Land Use Element, the entire quarter section bound by Ellis, Newland, Garfield, and Beach Boulevard be reanalyzed and included in Phase II Element, particularly in reference to the deletion of the Route 39 Freeway, and that Zone Case No. 74-4 should be continued pending adoption of the Phase II Element. The hearing was opened to the public. Mr. Robert Potter, applicant, addressed the Commission and gave a summary of what had transpired on the property. Mr. Wm. Bailey, Administrative Assistant to owners of property to the south of Mr. Potter's property, addressed the Commission and stated that he would be opposed to spot zoning on Mr. Potter's property and that he would like to see the property zoned at the proper time to R3. He endorsed the staff report and asked that the zone case not be denied but continued. The public hearing was closed. Mr. Potter concurred with staff's recommendation for a continuance based on reasons contained in the staff report. . ON MOTION BY BAZIL AND SECOND BY HIGGINS ZONE CASE NO. 74-4 WAS CONTINUED TO AUGUST 20, 1974 AND STAFF WAS DIRECTED TO REPORT BACK TO COMMISSION WITH RECOMMENDATIONS BASED ON THEIR STUDY OF THIS PROPERTY IN RELATION TO PHASE II ELEMENT BY THE FOLLOWING VOTE: AYES: Geiger, Bazil, Higgins, Kerins, Wallin, Porter NOES: None ABSENT: Boyle ADMINISTRATIVE REVIEW NO. 72-111 - APPEAL Applicant: Huntington Capital Corporation Appellant: Commissioner Kerins On May 15, 1974 the Board of Zoning Adjustments approved a variation to the screening wall requirement for parking areas of Huntington Executive Park located on the east side of Beach Boulevard, south of Edinger, north of Stark. This approval was appealed on May 23, 1974 by Commissioner Kerins. Chairman Kerins reiterated his reasons for appealing the decision of the Board of Zoning Adjustments which were substantiated upon the fact that the ordinance section enabling the Board to allow 1 -4- 6/18/74 - PC Minutes: H.B. Planning Commission Tuesday, June 18, 1974 Page 5 architectural variation to the screening wall requirements does not waive the requirement to screen the parking areas with some type of construction material. Slides of the area were shown. The Chairman opened the hearing to the public. Mr. Everett Dodge addressed the Commission and presented pictures of the parking area. He stated that within the complex there were a number of types of architecture used and that it would be very difficult to use a fencing material that would be compatible with the various types of architecture. He further stated that he had allowed for a 5 ft. planting area rather than the 3 ft. required by Ordinance, and that he felt that greenery added more to the screening than fencing material. The public hearing was closed. Commission discussion followed. It was the consensus that this application should be referred back to the Board of Zoning Adjustments in order that they could work with the applicant on the type of fencing materials and design of fencing. ON MOTION BY PORTER AND SECOND BY BAZIL ADMINISTRATIVE REVIEW NO. 72-111 WAS REFERRED BACK TO THE BOARD OF ZONING ADJUSTMENTS FOR THE FOLLOWING REASON AND BY THE FOLLOWING VOTE: The Board of Zoning Adjustments acted outside its authority in approving the screening wall variation contained in Administrative Review No. 72-111. They must comply with and take appropriate action in compliance with Ordinance Code. AYES: Geiger, Bazil, Higgins, Kerins, Wallin, Porter NOES: None ABSENT: Boyle CONDITIONAL USE PERMIT NO. 74-05 Applicant: Gerhard Kohn This is a request to permit erection of a prefabricated, re - locatable office/classroom building of type 5 construction located at 8102 Ellis Avenue south side of Ellis Avenue 500.49 ft. from Beach Boulevard. Mr. John Cope discussed the staff report and gave a brief back- ground of present land use and zoning, and indicated subsequent to approval of Administrative Review No. 72-68, which provided for a 1900 square foot classroom addition, that private schools had since been amended to be considered an unclassified use subject to a Conditional Use Permit. -5- 6/18/74 - PC Minutes: H.B. Mr. David Elliot, representing the applicant, addressed the Commission, and stated that he would be pleased to answer any questions the Commission might have. There was a discussion on landscaping in the area and it was determined that landscaping was already in. Conditions of approval were discussed and the 17 items listed on the Plot Plan were discussed. ON MOTION BY PORTER AND SECOND BY HIGGINS CONDITIONAL USE PERMIT NO. 74-05 WAS APPROVED WITH THE FOLLOWING CONDITIONS BY THE FOLLOW- ING VOTE: 1. Soil reports as required by the Building Department and the Department of Public Works shall be submitted to the City prior to issuance of building permits. 2. All utilities shall be installed underground at the time of development. 3. Fire alarm system conduit and appurtenances shall be installed at locations and to specifications provided by the Fire Depart- ment at the time of initial development. 4. The conceptual plot plan received April 25, 1974 shall be the approved layout including the 17 items listed under "General Notes". For the applicant's information, all applicable development standards shall be complied with. AYES: Geiger, Bazil, Higgins, Kerins, Wallin, Porter NOES: None ABSENT: Boyle TENTATIVE TRACT NO. 8688 Applicant: Kaiser -Aetna In Conjunction With TENTATIVE TRACT NO. 8694 Applicant: Kaiser -Aetna Tentative Tract No. 8688 is a request to permit a 26 lot industrial park on 103.19 acres located south of Bolsa Avenue between Bolsa Chica and Graham Streets. It is zoned M1-A. Tentative Tract No. 8694 is a request to permit a 40 lot industrial park on 156.48 acres located north of McFadden Avenue between Graham and Springdale Streets. Property is zoned MI -A and C4. Both areas are included as Light Industrial in the General Plan. A vugraph was shown. -6- 6/18/74 - PC 1 Minutes: H.B. Planning Commission Tuesday, June 18, 1974 Page 7 Secretary Harlow addressed the Commission and stated that the Environmental Impact Report was originally prepared by Lusk and was expanded to include this area when Kaiser -Aetna filed their applications. He noted that the Commission had been provided previously with comprehensive brochures on (1) Declaration of Covenants, Conditions and Restrictions for Huntington Beach Business Park, and (2) Development Guidelines for Huntington Beach Business Park. The staff report was discussed and it was noted that should a railroad spur become a reality that it would have to be submitted to the Environmental Review Board for approval. There was a discussion on sidewalks and the conditions of approval. Landscaping was discussed and it was noted by Commission and staff that tree planting proposed by Kaiser -Aetna exceeded the standards set by the City. Secretary Harlow discussed the processing of the maps. It was felt that Tentative Tract map provided the greatest degree of flexibility, and that it will be recorded as an "X" map or parcel map. The hearing was opened to the public. Mr. Tom Waller, representing Kaiser -Aetna, addressed the Commission. He stated that he concurred with the proposed recommendations of the staff and that it was their intention to create a first class industrial development with a park -like atmosphere. Planning Commission Tuesday, June 18, 1974 Page 8 ON MOTION BY HIGGINS AND SECOND BY BAZIL TENTATIVE TRACT 8688 AND TENTATIVE TRACT 8694 WERE APPROVED WITH THE FOLLOWING CONDITIONS OF APPROVAL AS AMENDED: 1. Tentative Tract Maps received June 14, 1974 shall be the approved layout for the street system. 2. "A" Street, Bolsa Avenue, Bolsa Chica Street, and Graham Street shall be dedicated to the City prior to the recordation of a parcel map or maps in Tract 8688. 3. "B" Street, "C" Street, "D" Street, McFadden Avenue, Bolsa Avenue, and Springdale Street shall be dedicated to the City prior to recordation of a parcel map or maps in Tract 8694. 4. Full street improvements as required by these conditions of approval shall be constructed on each of the streets as contained in Condition #2 and #3 of these conditions prior to the recordation of a parcel map or maps on the property that abuts such streets. 5. "A" Street shall be constructed to secondary arterial standards with no sidewalk at the time of initial construction. 6. "B" Street shall be constructed having a 48 ft. street section. A 5 ft. easement shall be provided on both sides of such street for utilities and sidewalks when needed. 7. "C" and "D" Streets shall be constructed having a 45 ft. street section. A 5 ft. easement shall be provided on both sides of such streets for utilities and sidewalk when needed. 8. McFadden Avenue shall be constructed having a 94 ft. street section with standard requirements at time of initial construction. 9. Graham Street shall be constructed at the existing 84 ft. right-of-way having no sidewalk on the west side of street section and having a 4 ft. wide meandering sidewalk on the east side of the street section. 10. Springdale shall be constructed to City standards. 11. Bolsa Avenue shall be constructed having a standard street section of 120 ft. with a 4 ft. wide meandering sidewalk on the south side of street between Graham and the commercial property at the intersection of Bolsa Avenue and Springdale Street. A temporary sidewalk shall be installed on the commercial frontage on Bolsa Avenue until such time as property development commences. Final sidewalk design shall be determined when a plan for commercial development is submitted for approval. The street section on Bolsa Avenue between Graham Street and Bolsa Chica Street shall be constructed having no sidewalk at time of initial construction. -8- 6/18/74 - PC Minutes: H.B. At the time of initial construction, Bolsa Chica Street shall be constructed having standard 120 ft. street section with no sidewalk on the east side. 13. All areas within the standard street section which have been reserved for future walkway purposes shall be flat with a turf grass to accommodate pedestrian circulation. 14. Drainage for the subdivision shall be approved by the Department of Public Works prior to the recordation of a parcel map or maps. Said drainage system shall be designed to provide for siltation and erosion control, both during and after construction of the industrial park. 15. On street parking shall be prohibited and all streets within the park shall be posted with "No Parking" signs. 16. Signs identifying the industrial park shall be subject to the approval of the Planning Department. 17. The irrigation system and plant material for the raised median within Bolsa Avenue between Bolsa Chica Street and Graham Street shall be provided by the developer prior to recordation of a parcel map or maps in Tract 8688. 18. The irrigation system and plant material for the raised median within Bolsa Avenue between Graham Street and Springdale Street shall be provided by the developer prior to recordation of a parcel map or maps in Tract 8694. 19. The developer shall install a traffic signal at the inter- section of "A" Street and Bolsa Chica prior to Certificate of Occupancy on any industrial building or use in the industrial park. 20. A conceptual landscaping plan shall be submitted to the Planning Department for approval prior to issuance of any building permit on any parcel within the industrial park. 21. Vehicular access to any parcel from arterial highways shall be reviewed and approved by the Department of Public Works and Planning Department prior to recordation of any parcel map or maps. This review is to minimize the number of access points through the use of common driveways. 22. Soils and compaction reports shall be submitted to Building and Community Development Department and Department of Public Works prior to the issuance of building permits. PUBLIC HEARING - Code Amendment No. 74-2 PRD Revisions - off-street parking for low density planned residential developments, vehicular storage, and definition of open and public land amendments. Mr. John Cope addressed the Commission and discussed the Code Amendment. He stated that ED 74-84 was granted June 18, 1974 at the Environmental Review Board meeting. Commission discussed number of parking spaces per unit. The Chairman opened the hearing to the public. There being no one to speak for or against the Code Amendment, the public hearing was closed. ON MOTION BY HIGGINS AND SECOND BY GEIGER CODE AMENDMENT NO. 74-2 WAS APPROVED BY THE FOLLOWING VOTE: AYES: Geiger, Bazil, Higgins, Kerins, Wallin, Porter NOES: None ABSENT: Boyle PUBLIC HEARING - Code Amendment No. 74-1: "BZA and Planning Commission Filing Fees" Mr. Dave Eadie discussed the change in fees and reasons therefor. He stated that the Administrative Review fee would remain at $10.00 since it was the intention of staff to make it more minor in nature as it was originally intended. Mr. Eadie stated that the proposed fees are in line with other cities throughout the area. The hearing was opened to the public. There was no one present to speak for or against the Code Amendment and the Chairman closed the public hearing. ON MOTION BY WALLIN AND SECOND BY HIGGINS CODE AMENDMENT NO. 74-1 WAS APPROVED BY THE FOLLOWING VOTE: AYES: Geiger, Bazil, Higgins, Kerins, Wallin, Porter NOES: None ABSENT: Boyle TENTATIVE TRACT NO. 7155 Subdivider: A. Planning Commission Tuesday, June 18, 1974 Page 11 This is a request for a one year extension of time for Tentative Tract No. 7155 located between 17th and Goldenwest Street north of Palm Avenue. It is zoned R1-O and the General i Plan includes this property as low density. Mr. John Cope addressed the Commission and stated that this tract had been approved twice and had a number of extensions in the past to allow for phasing. Staff recommended approval subject to all past conditions of approval. Commission discussion followed. ON MOTION BY GEIGER AND SECOND BY BAZIL REQUEST FOR ONE YEAR EXTENSION OF TIME FOR TENTATIVE TRACT NO. 7155 WAS APPROVED SUBJECT TO ALL PREVIOUS CONDITIONS OF APPROVAL WHICH HAVE BEEN IMPOSED BY THE FOLLOWING VOTE: AYES: Geiger, Bazil, Kerins, Wallin, Porter NOES: None ABSENT: Boyle ABSTAIN: Higgins MISCELLANEOUS: Discussion of revised guidelines of environmental procedures and amendments to Article 972 (Commission received this information in the April 30, 1974 packet). John O'Connor, Deputy City Attorney, agreed to report back to Commission at a meeting in July. RESOLUTION 1140 - A Resolution of intent of the Planning Commission recommending approval to a non -conforming use. John O'Connor, Deputy City Attorney, is to report back on this Resolution on June 25, 1974. Planning Commission Tuesday, June 18, 1974 Page 12 Commissioners requested that VTN provide Commission with a report on their findings. Mr. Selich stated that he would try to arrange for VTN to be present at meeting in the near future to bring staff up to date on their findings. Chairman Kerins noted .that Environmental Council had submitted a transmittal to City Council regarding Resolution on Property Tax Assessment. It was noted at the meeting that a similar Resolution was approved by the Planning Commission and recommended that the Council adopt a similar Resolution. Chairman Kerins requested that staff investigate recent press reports on labor camps and determine if there are more than two in the area, also to proceed expeditiously on adding labor camps to unclassified uses. STAFF COMMENTS: Ed Selich gave a brief resume of action of City Council at their June 17 meeting. Ed Selich noted that there would be an election of officers at the first meeting in July.
