Herrick To permit the division of two parcels into three parcels pursuant to S.9811.3 of the Huntington Beach Ordinance Code located on the west side of Edwards Street, approximately 135 ft. north of McFadden Avenue in a C-4, highway commercial district. The Chairman informed the Board that the Environmental Review Board granted Exemption Declaration No. 74-65 on June 18, 1974, with the following additional information: 1. Findings are based upon the fact that noise concerns are not a major factor due to the number of dog runs contained within the building and the distance of those runs from the residential uses adjoining this property; the existing 6 ft. block wall; the location of the dog runs at the northernmost portion of the building; and the use of insulation within the masonry con- struction of the building. 2. Construction shall be as outlined in the supplementary in- formation submitted in the Conditional Use Permit application. It was the consensus of the Board to refer this application to the Planning Commission to be heard in conjunction with Con- ditional Use Permit No. 74-07 pending action by the Planning Commission. Seel To permit the establishment of a firewood storage and sales facility pursuant to S.9530 of the Huntington Beach Ordinance Code located on the east side of Gothard, approximately 250 feet south of Cain Avenue in an M-11 light industrial district. The applicant was not present. The Chairman informed the Board that the Environmental Review Board granted Exemption Declaration No. 74-66 on May 28, 1974, with the following additional information: No environmental impact report has been prepared for this project, and the Negative Declaration issued for the project has been properly posted in the office of the City Clerk. It was the consensus of the Board to continue this application for one week to allow the applicant to be present to explain his proposal. Kingston To permit the construction of an industrial warehouse pursuant to S.9530 of the Huntington Beach Ordinance Code located on the south side of Talbert Avenue, approximately 385 ft. east of Gothard Street in an Ml-CD light industrial civic district. Mr. Ron Jurgensen, representing the applicant, was present. The Chairman informed the Board that the Environmental Review Board granted Exemption Declaration No. 74-77 on June 18, 1974 with the following additional information: No environmental impact report has been prepared for this project, and the Negative Declaration issued for the project has been properly posted in the office of the City Clerk. ON MOTION BY CROSBY AND SECOND BY SPENCER BOARD OF ZONING ADJUSTMENTS ADOPTED EXEMPTION DECLARATION NO. 74-77 BY THE FOLLOWING VOTE: AYES: Eadie, Spencer, Crosby NOES: None ABSENT: None Board discussed plans with applicant's representative. Access to the proposed property for emergency access purposes was discussed. Landscaping was discussed. It was pointed out to the applicant that he should pursue the possibility of consolidating the parcels which he proposes to build on into one parcel. It was agreed upon by the applicant's representative and_the Board that the applicant shall file for a Division of Land to consolidate all parcels into one. The applicant's representative stated that he did not wish to pursue signs for the proposed development at this time. Board discussion followed. Conditions of approval were discussed. ON MOTION BY CROSBY AND SECOND BY SPENCER ADMINISTRATIVE REVIEW NO. 74-75 WAS APPROVED WITH THE FOLLOWING CONDITIONS AS OUTLINED BY THE FOLLOWING VOTE: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan received June 19, 1974, shall be the approved layout. 2. Talbert Avenue right-of-way shall be dedicated to City standards at the time each parcel is developed. 3. A Division of Land application, consolidating these parcels with the remaining properties held under the same ownership shall be submitted to the Planning Department. Said application shall be subject to approval by the Board of Zoning Adjustments. 4. Plans depicting the fire protection systems including automatic sprinkler systems, fire hydrants, fire alarms, and any required fire protection device shall be approved by the Fire and Public Works Departments. Water supply shall be through the City of Huntington Beach's water supply system. 5. Sewage disposal shall be through the City of Huntington Beach's sewage system. 6. No structures, other than those shown on the approved plot plan, shall be constructed within the project. 8. The sewer system shall be approved by the Department of Public Works and Fire Department. Access to the development via Harriman Avenue shall be subject to the approval of the Department of Public Works. 3. If additional signs are proposed, said signs shall be subject to wall signs only. Buccella To permit the construction of a 38 unit apartment building pur- suant to S.9202.3.1.3 of the Huntington Beach Ordinance Code located on the west side of Lynn Street, approximately 450 ft. north of Warner Avenue in an R-3, medium high density residential district. Minutes: H.B. Board of Zoning Adjustments Wednesday, June 19, 1974 Page 5 The applicant was not present. The Chairman opened the public hearing. The Chairman informed the Board that the Environmental Review Board granted Exemption Declaration No. 74-42 April 16, 1974, with the following additional information: 1. If the developer proposes to provide air conditioning, the insulation in the exterior ceilings shall be a minimum of R-19 and that in the exterior walls shall be a minimum of R-11; if no air conditioning is to be provided, the insulation in the exterior ceilings shall be a minimum of R-13 and that in the exterior walls shall be a minimum of R-7. 2. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an offsite facility equipped to handle them. 3. Gas and electric outlets for appliances shall be stubbed in to comply with the "Concern Award" specifications. 4. Because the project is located on a fault line, it is recommended that the foundations and footings be designed to withstand earthquake stresses, as determined by the Building Department. Board discussed findings of the Environmental Review Board regard- ing Exemption Declaration No. 74-42, and wished to implement the recommendations as conditions of approval. ON MOTION BY EADIE AND SECOND BY CROSBY THE BOARD OF ZONING ADJUSTMENTS ADOPTED EXEMPTION DECLARATION NO. 74-42 BY THE FOLLOWING VOTE: AYES: Eadie, Spencer, Crosby NOES: None ABSENT: None The Board discussed plans. The Chairman informed the Board that this application had been previously continued for further input from the Planning Staff regarding the moratorium on the Sunset Heights district. The Chairman further informed the Board that the open space shortage has been corrected on the plot plan, and that the front patios have been eliminated. As there were no parties present to speak in favor of or opposition to Use Permit No. 74-13, the Chairman closed the public hearing. Minutes: H.B. ON MOTION BY EADIE AND SECOND BY SPENCER USE PERMIT NO. 74-13 WAS APPROVED WITH THE FOLLOWING CONDITIONS AS OUTLINED AND WITH THE FOLLOWING FINDINGS BY THE FOLLOWING VOTE: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The revised conceptual plot plan received June 19, 1974 shall be the approved layout. 2. A revised Plot Plan shall be submitted to the Planning Department for approval action. Said plan shall incorporate the following amendments: Treatment of the primary drive access to conform with ordinance code requirements. Said plan shall be subject to the approval of the Departments of Building and Community Development and Fire. 3. Lynn Street right-of-way shall be dedicated to City standards at the time each parcel is developed. 4. Elevations of the proposed plan shall be submitted to the 5. Planning Department for review and approval action. Soil and compaction reports as required by the Building Department and the Department of Public Works shall be submitted and approved by the City. 6. Plans depicting the fire protection systems including automatic sprinkler systems, fire hydrants, fire alarms, and any required fire protection device shall be approved by the Fire and Public Works Departments. 7. A landscaping and irrigation plan shall be submitted to the Planning Department for review and approval. An Appearance Review Application is available in the Planning Department for your convenience. 8. Easements for utilities or walkways shall be provided to Department of Public Works standards. B. All required fire hydrants shall be installed, accessible and operable prior to the construction of any permanent structure using combustible material. 3. If the developer proposes to provide air conditioning, the insulation in the exterior ceilings shall be a minimum of R-19 and that in the exterior walls shall be a minimum of R-11; if no air conditioning is to be provided, the insulation in the exterior ceilings shall be a minimum of R-13 and that in the exterior walls shall be a minimum of R-7. 4. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an offsite facility equipped to handle them. 5. FINDINGS: 1. The proposed apartment complex is consistent in construction and architecture with other dwellings in the area. 2. The dwelling maintains quality control regarding seismisity through the applicants' acceptance to implement the Conditions of Approval regarding G-factor construction. Minutes: H.B. Maynard To permit the construction and operation of a waste paper recycling yard pursuant to S.9530.2 (c) of the Huntington Beach Ordinance Code located on the east side of Gothard Street, approximately 800 ft. south of Slater Avenue in an Ml-CD light industrial district. Mr. Maynard, the applicant, Messrs. Menning and Metzler, representing the applicant, were present. The Chairman informed the Board that the Environmental Review Board granted Exemption Declaration No. 74-68 on June 4, 1974, with the following additional information. No environmental impact report has been prepared for this project, and the Negative Declaration issued for the project has been properly posted in the office of the City Clerk. Findings are based upon information contained in the exemption declaration request and discussion at the Board meeting. The Chairman opened the public hearing. Board disucssed plans with applicant and his representatives. Easements to obtain entrance to adjoining properties were discussed. The Board was concerned with landlocking adjacent parcels if this plan were approved. The proposed use of a recycling yard in an M1-CD district was discussed. As there were no parties present to speak in favor of or opposition to Use Permit No. 74-21, the Chairman closed the public hearing. Board discussion followed. It was the consensus of the Board to continue this application for one week to allow time for the City Attorney's office opinion on the easement rights. The applicant concurred with the continuance. Board of Zoning Adjustments Wednesday, June 19, 1974 Page 9 ADMINISTRATIVE REVIEW NO. 74-81 Applicant: Vincent J. Stagliano To permit the construction of three industrial buildings pursuant to S.9511 of the Huntington Beach Ordinance Code located on the east and west sides of Container Lane and Industry Lane respectively in a 100-M1-A, 20,000 restricted industrial district. Mr. Stagliano, the applicant, was present. The Chairman informed the Board that this application is exempt from Environmental Review Board requirements by previous adoption of Environmental Impact Report No. 73-16 by the City Council on March 18, 1974. The Board discussed plans with the applicant. The relocation of the trash bins due to circulation problems was discussed. Board discussion followed. ON MOTION BY SPENCER AND SECOND BY CROSBY ADMINISTRATIVE REVIEW NO. 74-81 WAS APPROVED WITH THE FOLLOWING CONDITIONS BY THE FOLLOWING VOTE: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plan received June 19, 1974 shall be the approved layout as amended deleting reference to'loading doors facing a public street. 2. Soil and compaction reports as required by the Building Department and the Department of Public Works shall be submitted and approved by the City. 3. 'Plans depicting the fire protection systems including automatic sprinkler systems, fire hydrants, fire alarms and any required fire protection device shall be approved by the Fire and Public Works Departments. 4. ON MOTION BY EADIE AND SECOND BY CROSBY ADMINISTRATIVE REVIEW NO. 74-86 WAS APPROVED WITH THE FOLLOWING CONDITIONS BY THE FOLLOWING VOTE: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan received June 10, 1974, shall be the approved layout. 2. 15th Street and Alley Way right-of-way shall be dedi- cated to City standards at the time each parcel is developed. 3. If a 25 ft. turning radius cannot be accomplished by the approved plan, an additional 2 ft. 6 in. of dedication shall take place oh the subject property. 4. ON MOTION BY EADIE AND SECOND BY CROSBY ADMINISTRATIVE REVIEW NO. 74-87 WAS APPROVED WITH THE FOLLOWING CONDITIONS BY THE FOLLOWING VOTE: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan received June 10, 1974 shall be the approved layout. 2. 19th Street and Alley Way right-of-way shall be dedicated to City standards at the time each parcel is developed. 3.
