The applicant was not present. The Chairman opened the public hearing. The Chairman informed the Board that this application is a categorical exemption, class 1, California EnvironmentalfQuality Act, 1970. The applicant was not present. It was the consensus of the Board to table this application indefinitely to allow the applicant to obtain his license for the proposed care of non -related persons from the State of California. Board of Zoning Adjustments Wednesday, June 26, 1974 Page 2 AYES: Eadie, Spencer, Crosby NOES: None ABSENT: None To permit the construction of a four unit apartment building pursuant to S.9201.2 of the Huntington Beach Ordinance Code located on the west side of 19th Street, approximately 100 ft. north of Orange Avenue in an R-3, medium -high density residential district. Mr. Ron Montgomery, representing the applicant, was present. The Chairman informed the Board that this application is a categorical exemption, Class 3, California Environmental Quality Act, 1970. Board discussed proposal with applicant's representative. Alternatives to the open space shortage were discussed. Board discussed turning radius with applicant's representative as well as required dedication of streets and alleys. Board noted that building plans would be required to show carports in lieu of garages. Setback requirements were also discussed. Board discussion followed. Conditions of approval were discussed. ON MOTION BY CROSBY AND SECOND BY EADIE ADMINISTRATIVE REVIEW NO. 74-92 WAS APPROVED WITH THE FOLLOWING CONDITIONS AS OUTLINED BY THE FOLLOWING VOTE: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan received June 11, 1974 shall be the approved layout. 2. A revised plan shall be submitted to the Building Department for approval action. Said plan shall incorporate the following amendments: . a. Reallocation of open space to meet ordinance code requirements. b. Revised floor plan to reflect setbacks of second story to meet ordinance code requirements. C. Redesign plans to indicate carports instead of garages. 3. 19th Street and alley right-of-way shall be dedicated to City standards at the time each parcel is developed. 4. Soil and compaction reports as required by the Building Department and the Department of Public Works shall be submitted and approved by the City. MINUTES: H.B. TO BE COMPLETED PRIOR TO FINAL INSPECTION: 1. 19th Street and alley shall be fully improved including street trees, street signs, street lights, fire hydrants, sewer and water main extensions. 2. All utilities shall be installed underground. 3. Water supply shall be through the City of Huntington Beach's water supply system. 4. Sewage disposal shall be through the City of Huntington aeach's sewage system. -5. No structures, other than those shown on the approved plot plan, shall'be constructed within the project. 6. The sewer system shall be approved by the Department of Public Works and Fire Department. General: 1. All required fire hydrants shall be installed, accessible and operable prior to the construction of any permanent structure using combustible material. 2. If the developer proposes to provide air conditioning, the insulation in the exterior ceilings shall be a minimum of R-19 and that in the exterior walls shall be a minimum of R-11; if no air conditioning is to be provided, the insulation in the exterior ceilings shall be a minimum of R-13 and that in the exterior walls shall be a minimum of R-7. 3. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an offsite facility equipped to handle them. 4. Natural gas and electricity shall be stubbed in at the location of clothes dryers, and natural gas only shall be stubbed in at the locations of cooking facilities, water heaters, and central heating units. Maynard To permit the construction and operation of a waste paper recycling yard pursuant to S.9530.2 (c) of the Huntington Beach Ordinance Code located on the east side of Gothard Street, approximately 800 ft. south of Slater Avenue in an MI -CD light industrial civic district. MINUTES: H.B. Board of Zoning Adjustments Wednesday, June 26, 1974 Page 4 Messrs. Menning, Metzler, Lane, representing the applicant, were present. The Chairman informed the Board that the Environmental Review Board granted Exemption Declaration No. 74-68 with the following additional information: No environmental impact report has been prepared for this project, and the Negative Declaration issued for the project has been properly posted in the office of the City Clerk. Findings are based upon information contained in the exemption declaration request and discussion at the Board meeting. The Chairman opened the public hearing. Board discussed plans with applicant's representatives. The Chairman informed the applicant's representatives that several members of the Board visited a wastepaper recycling site in the Santa Ana area, and found unsightly debris surrounding the area caused by the nature of the business. Further traffic problems were anticipated, the Board did not concur permitting a similar business of this type in --a CD suffix district. Mr. Menning stated that he would be able to control the amount of debris on the proposed site assured the Board that the modern facilities would not duplicate the nuisance created in the Santa Ana plant. It was the Board's further concern the proposed site, being located near the new Central Park, would not be compatible with the surrounding area. Possible traffic problems entering the proposed site off of Gothard was discussed. Easement rights to the adjoining properties was discussed and it was the City Attorney's opinion that the City Qreate a precise plan of alignment, indicating that the surrounding properties are entries to proper ingress and egress to their parcel of land. As there were no further present to speak in favor or opposition to Use Permit No. 74-21, the Chairman closed the public hearing. Board discussion followed. It was the consensus of the Board to disallow this proposal due to the fact that such a use would create an undesirable amount of debris in a CD suffix district. ON MOTION BY EADIE AND SECOND'BY SPENCER USE PERMIT NO. 74-21 WAS DENIED FOR THE FOLLOWING REASONS AND FINDINGS BY THE FOLLOWING VOTE: FINDINGS FOR DENIAL MINUTES: H.B. Board of Zoning Adjustments Wednesdays June 26, 1974 Page 5 1. Denial is predicated upon observed conditions of a similar operation of this type, and further, that establishment, maintenance and operation of the use in relation to its proximity to the Central Park and containment within a civic district would be injurious to property and improvements in the city. 2. Proper location of such a use is an M-2 district or perhaps M-1 district with adjacent land uses which would accommodate said use. Other portions of the City could accomodate this use more appropriately. 3. Approval of said project may jeopardize access to lots within the area generally within the southwest corner of Gothard and Talbert. 4. This specific use is not provided for in zoning regulations. the Board of Zoning Adjustments has determined to deny this request aftet considering land use factors indigenous to the area. 5. The site layout and design of the proposed use would constitute a major safety hazard in view of the traffic generation observed at similar sites in Santa Ana. Steel To permit the establishment of a firewood storage and sales facility pursuant to 5.9530 of,the Huntington Beach Ordinance Code located on the east side of Gothard, approximately 250 ft. south of Cain Avenue in an M-1, light industrial district. The Applicant was not present. The Chairman informed the Board that the Environmental Review Board granted Exemption Declaration No. 74-66 on May 28, 1974. It was the consensus of the Board to continue this application for one week and renotify the applicant to be present at his hearing. Board of Zoning Adjustments Wednesday, June 26, 1974 Page 6 USE PERMIT NO. 74-25 Applicant: Vincent J. Stagliano To permit the installation of loading facilities fronting on a public street pursuant to S. 9518 of the Huntington Beach Ordinance Code located on the northeast and northwest corner of Container Street and Research Drive and the northwest corner of Industry Street and Research Drive in a 100-M1-A, 20,000 restricted manufacturing district. Mr. Stagliano, the applicant, was present. The Chairman informed the Board that this application is a categorical exemption, class 1, California Environmental Qualitv,act. The Chairman opened the public hearing. Board discussed plans with applicant. The applicant stated that the proposed doors entering into the building would make the industrial building more flexible. The Board informed the applicant that all ordinance code re- quirements regarding setbacks must be maintained. As there were no parties present to speak in favor or opposition to Use Permit No. 74.25, the Chairman closed the public hearing. Board discussion followed. Conditions of approval were discussed. ON MOTION BY CROSBY AND SECOND BY EADIE USE PERMIT NO. 74-25 WAS APPROVED WITH THE FOLLOWING FINDINGS BY THE FOLLOWING VOTE: 1. The location of the doors in relation to the street and the surrounding street scene meets the intent of the Ordinance Code. 2. The proposal would not be detrimental to the surrounding facility. The Chairman informed the Board that this application is a Class 5 Categorical Exemption, California Environmental Quality Act, 1970. The Chairman opened the public hearing. Following calculations made by the Board, it was the consensus of the Board that the filing of this application was un- necessary.,, The Chairman therefore proposed a withdrawal of this application. As there were no parties present to speak in favor or opposition to Conditional Exception No. 74-40, the Chairman closed the public hearing. The Chairman informed the Board that the Environmental Review Board granted Exemption Declaration No. 74-82 on June 25, 1974. The Chairman opened the public hearing. Board discussed plans with applicant's representative. Underground parking was discussed as well as the number of roofed structures to be proposed. It was the consensus of the Board to continue this application for one week in order for the applicant's representative to meet with the Planning Staff regarding further revisions to the proposed plans. Applicant's representative concurred with continuance. As there were no parties present to speak in favor or opposition to Use Permit No. 74-27, the Chairman closed the public hearing. ON MOTION BY SPENCER AND SECOND BY CROSBY USE PERMIT NO. 74-27 WAS CONTINUED TO JULY 3, 1974 BY THE FOLLOWING VOTE: AYES: Eadie, Spencer, Crosby NOES: None ABSENT: None USE PERMIT NO. 74-26 Applicant: Michael Janes To permit the construction of a 34 unit apartment building pursuant to S. 9162.3.1 of the Huntington Beach Ordinance Code located on the west side of Delaware Street, approx- imately 165 feet north of Clay Street in an R-2, medium den- sity residential district. Board of Zoning Adjustments Wednesday, June 26, 1974 Page 9 The Chairman informed the Board that the Environmental Review Board granted a former Exemption Declaration No. 7 3 - 2 4 6 on January 15, 1974 with the following additional information: 1. The construction with full insulation of all exterior walls and ceilings to reduce the burden on heating and cooling systems. 2. The disposal of all building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material at an off - site facility equipped to handle them. 3. The stubbing in of natural gas at the locations of clothes dryers, cooking facilities, water heaters, and central heating units to alleviate the possible drain on any one energy source. 4. The staggering of the buildings to provide a variation in setbacks to alleviate the visual impact of the project. Board discussed recommendations of the Environmental Review Board and implemented them as part of the conditions of approval. Board discussed plans with Mr. Alv araz. It was the consensus of the board that the proposed plans were within ordinance code regdirements. Fencing to adjacent property was discussed. Mr.Hayden, adjoining property owner addressed the Board to inquire about the nature of the application and to make certain that the proposal would add to the value of the neighborhood. The Fire Marshall discussed the proposed turn around radius with Mr. Alv are z . As there were no further parties present to speak in favor or opposition to Use Permit No. 74-26, the Chairman closed the public hearing. Board discussion followed. Conditions of approval were discussed. ON MOTION BY CROSBY AND SECOND BY EADIE USE PERMIT NO. 74-26 WAS APPROVED WITH THE FOLLOWING CONDITIONS AND FINDINGS BY THE FOLLOWING VOTE: MINUTES: H.B. The proposed apartment complex is consistent in construc- tion and architecture with other dwellings in the area. 2. The dwelling maintains quality control regarding seismi- city through the applicants acceptance to implement the Conditions of Approval regarding G-factor construction. 3. The proposal is consistent with the City's Policy Plan to provide better building construction and good design. Seleine, Architect To permit the construction of a medical office building pursuant to S. 9471.4 of the Huntington Beach Ordinance Code located on the west side of Beach Boulevard, approximately 350 feet south of Talbert in a C-4, highway commercial district. The design and construction of the building shall be such as to accomodate the G-factors as may be applicable to the property. Board discussed recommendations of the Environmental Review Board and proposed to impose them as conditions of approval. Mr. Seleine explained,the proposal to the Board that of being a family medical building equipped with modern and efficient medical equipment. The applicant stated that this facility would not accomodate any overnight care. Circulation, access to the property and landscaping were discussed. Ingress and egress and trash areas were also discussed. It was noted that the proposed facility would accomodate twelve doctors, with each doctor occupying an individual wing of the building. The applicant was not certain as to the type of signing to be used for this proposal. Board discrssion followed. Conditions )f approval were discussed. All buildings on lots abutting a City easement shall be set back five (5) feet from the edge of such easement. 5.
