The Chairman opened the hearing to the public.
Mr. Ed Ross, representing the applicant, was present and
addressed the Board. There was a discussion on the turning
radius and location of trash bin. Conditions of approval
were discussed. There was also a discussion of the Environmental
Review Board recommendations.
The Chairman closed the hearing to the public.

1. The conceptual plot plan received July 1, 1974 shall
be the approved layout.
2. A revised plot plan shall be submitted to the Planning
Department for approval action. Said plan shall in-
corporate the following amendments:

gate to preclude its view.
b. Balcony relocation as described by applicant (further

B. TO BE COMPLETED PRIOR TO FINAL INSPECTION:
1. 10th Street and Alleys shall be fully improved including
street trees, street signs, street lights, fire hydrants,
sewer and water main extensions.
2. All utilities shall be installed underground.
3. There shall be no fence, structure or landscaping
constructed or maintained over 3 1/2 feet high within
a 10 ft. by 10 ft. triangular area at the intersection
of driveways and streets or within a 25 ft. by 25 ft.
triangular area at the intersection of streets.
4. Water supply shall be through the City of Huntington
Beach's water supply system.
5. Sewage disposal shall be through the City of Huntington
Beach's sewage system.
6. No structure, other than those shown on the approved plot
plan, shall be constructed within the project.
7. The sewer system shall be approved by the Department of
Public Works.
GENERAL:
1. All required fire hydrants shall be installed, accessible
and operable prior to the construction of any permanent
structure using combustible material.
2. If the developer proposes to provide air conditioning,
the insulation in the exterior ceilings shall be a minimum of
R-19 and that in the exterior walls shall be a minimum of
R-11; if no air conditioning is to be provided, the
insulation in the exterior ceilings shall be a minimum of
R-13 and that in the exterior walls shall be a minimum of
R-7.
3. All building spoils, such as unusable lumber, wire, pipe, and
other surplus or unusable material, shall be disposed of at
an offsite facility equipped to handle them.
4. Natural gas and electricity shall be stubbed in at the
location of clothes dryers, and natural gas only shall be
stubbed in at the locations of cooking facilities, water
heaters, and central heating units.
5. A soils engineer shall be engaged to indicate the G-factor
due to earth movement for this location.
6. A structural engineer shall be engaged to compile
calculations for footings and structural members of the
facility to withstand these G-factors.

CONDITIONAL EXCEPTION NO. 74-39
Applicant: Hearn J. Paschall
To permit a reduction in the minimum open space requirement in
lieu of S.9163.3.1.1; an increase in the maximum number of
garages allowed to face a street in lieu of S.9166.7; and an
encroachment of 4 ft. into the required 10 ft. rear yard setback
in lieu of S.9163.3 and to permit an encroachment of 3 ft. into
the maximum allowable projection for architectural features
(balconies) in lieu of S.9163.4.2.2 et sequence, of the Huntington
Beach Ordinance Code located on Bay View Drive, approximately
75 ft. southeast of Broadway in an R-2, medium density residential
district.
The public hearing was opened.
Mr. and Mrs. Paschall and their architect, Mr. Dean Davidson,
were present. Mr. Davidson stated that he did not feel his
plan violated the intent of the code. There was a discussion
on balconies.
As no further parties were present to discuss this application,
the Chairman closed the public hearing.
The Board discussed the garages and the bottom story and
it was the consensus of the Board that the bottom floor was
acceptable, but that the plans as presented for the second
floor would have to be changed and the balcony moved back.
It was suggested that the second floor cantilever over the
garage and then the balcony could be accomodated in the rear.
ON MOTION BY EADIE AND SECOND BY SPENCER CONDITIONAL EXCEPTION
NO. 74-39 WAS APPROVED WITH THE FOLLOWING CONDITIONS, FINDINGS,
AND REASONS BY THE FOLLOWING VOTE:
CONDITIONS OF APPROVAL:
1. Open space requirements dedicated by the Huntington Beach
Ordinance Code shall be complied with.
2. The proposed balcony encroachment was not addressed under the
Board hearing of July 3, 1974. Therefore, all balconies shall
comply with the provisions of the Huntington Beach Ordinance
Code.
FINDINGS:
1. The Conditional Exception would not be detrimental to property,
improvements, or the general welfare of persons working and
residing in the general vicinity.

2. Granting of the Conditional Exception for increasing the number
of garages facing the public street would not contribute to
the existing parking problem.
3. Approval of this Conditional Exception would not be adverse
to the City's General Plan of Land Use.
REASONS FOR APPROVAL:
Regarding the increase in the number of garage doors facing the
street:
1. Positioning the parking layout in such a way to meet ordinance
code requirements would contribute to the existing traffic
problem on Bayview Drive and would pose physical hardships
on site.
2. Disallowing this portion of the request and conforming to
strict application of the ordinance code would contribute
to the additional detriment of the vicinity.
Regarding the proposed building encroachment:
Past plans proposed to encroach into the area allocated for
parking have been disallowed because of the existing traffic
problem in the area and the need for additional on -site parking.
Physical hardships dictated by the nature of the site area and
existing indigenous conditions in the field necessitate a
conditional exception to establish this development on a scale
typical to other duplexes within the City.

Applicant: J. J. Byron
To permit the construction of an industrial building pursuant
to S.9511 of the Huntington Beach Ordinance Code located on
the west side of Industry Lane, approximately 480 ft. north of
Research Drive in a 100-M1-A, 20,000 restricted manufacturing
district.
Mr. J. J. Byron, the applicant, was present.
The Chairman noted that a representative would have to be present
to sign the plans which were discussed. It was noted that there
was a shortage of parking spaces. There was a discussion in the
turnaround problem and the location of the trash area. It was
the consensus of the Board that the applicant should meet with

the Lusk Company since plans must meet with their approval prior
to approval by the Board of Zoning Adjustments.

DIVISION OF LAND NO. 74-17
Applicant: Dr. Karl S. Farnsworth
To permit the division of one legal parcel of land into two
parcels pursuant to S.9811.3 of the Huntington Beach Ordinance
Code located on the west side of Goldenwest Street approximately
1165 feet north of Edinger Avenue in an R-1, low density
residential district.
Dr. Farnsworth, the applicant, was present.
Dr. Farnsworth addressed the Board and stated that if there were any
questions he would be glad to answer them.
The Chairman noted that Exemption Declaration No. 74-65 which had
been approved would suffice for this Division of Land.
Conditions of approval were discussed.
ON MOTION BY SPENCER AND SECOND BY CROSBY DIVISION OF LAND NO.
74-17 WAS APPROVED WITH THE FOLLOWING CONDITIONS AND BY THE
FOLLOWING VOTE:
I. TO BE COMPLETED PRIOR TO USE OR OCCUPANCY OF SAID PARCEL
FOR ANY PURPOSE:
1. This Division of Land shall not be effective until a
covenant and agreement furnished by the Huntington
Beach Planning Department is signed and recorded with
the Orange County Recorder agreeing to these Conditions
of Approval.
2. The tentative parcel map received by the Planning Department
on July 3, 1974 shall be the approved layout.
3. A parcel map shall be filed with and approved by the
Department of Public Works and recorded with the Orange
County Recorder (prior to issuance of a Certificate of
Occupancy).

4. A copy of the recorded parcel map and covenant and agreement

7. Sewage disposal shall be through the City of Huntington
Beach's sewage system at the time said parcel is developed.
8. All utilities shall be installed underground at the time
said parcel is developed.
9. The property shall participate in the local drainage
assessment district at the time said parcel is developed.

Drive in lieu of S.9763.1.5.2 (c) (3) (Location of temporary
directional signs) of the Huntington Beach Ordinance Code.
The Chairman opened the public hearing.
Mr. George Dickason, representing the sign company, was present.
It was noted that it is an illegal sign and the relocation of it
would rectify problems and still make it visible to the public.
It was noted by the Board that this application would have to be
researched more before a decision could be made.
As there were no parties present to speak in favor or opposition
to the proposal, the Chairman closed the public hearing.

To permit the construction of professional offices pursuant to
S.9471.4 of the Huntington Beach Ordinance Code located at the

Mr. Jim Edwards, representing the applicant, was present.
Mr. Edwards discussed the trash disposal, need for 32" masonry
screening wall, and conditions of approval with the Board.
The Chairman noted that Exemption Declaration No. 74-88 had
been approved by the Environmental Review Board at its July
2, 1974 meeting. Mr. Wayne Stewart, representative of the
applicant, arrived and further discussion ensued.
Captain Vanderlaan requested that a representative meet with him
and a representative of the Building Department as soon as possible
concerning automatic sprinklers. There was discussion on signing
and applicant stated that they preferred a monument sign rather
than a pylon.

Board of Zoning Adjustments encourages signs which reflect
a common theme with respect to design materials and colors
which are compatible with the architectural theme of the
proposed project.

There was a discussion on parking and type of food service to be
provided. It was indicated by the applicant's representative
that this would be a pedestrian type service and would not require
parking comparable to a drive-in type establishment. It was
noted that the Fire Department had surveyed the area.
