To permit erection of service station island canopies within an existing service station and car wash facility pursuant to S.9482 (d) of the Huntington Beach Ordinance Code located on the southeast corner of Beach Blvd., and Warner Ave. in a C-4, highway commercial district. Mr. Dick Sass, representing the applicant, was present. The Chairman informed the Board that this application is a categorical exemption, class 1, California Environmental Quality Act, 1970. The Chairman opened the public hearing. The Chairman informed the Board that the Planning Department has viewed the proposal and came to the conclusion that the proposal is not an expansion of a non conforming use, but simply providing more comfort for the customer. Mr. Sass addressed the Board and stated that the proposed canopies would enhance the service station plus providing more comfort for the employees and customers. The applicant's representative stated that he had no plans for signing on the proposed canopies at this time. Dedication of right-of-way was discussed, and it was agreed upon that Warner Avenue has been realigned and will not affect the proposal. Minutes: HOB. Conditions of approval and findings were discussed. ON MOTION BY CROSBY AND SECOND BY EADIE USE PERMIT NO. 74-28 WAS APPROVED WITH THE FOLLOWING CONDITIONS AND FINDINGS BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan and elevations received June 17, 1974 shall be the approved layout. 2. Soil and compaction reports shall be submitted by a certified soils engineer. Said report shall be sub- mitted to the Department of Building and Community Development and shall be subject to approval by that Department. B. TO BE COMPLETED PRIOR TO RELEASE FOR OCCUPANCY: 1. Any uses existing on -site which have not been allowed by an approved application from the City, shall cease and desist operations. FINDINGS: 1. Addition of canopy is for public convenience and comfort and is not viewed as an expansion of the existing use. 2. Addition conforms to service station suffix standards for construction of canopies. ON MOTION BY SPENCER AND SECOND BY CROSBY, THE BOARD OF ZONING ADJUSTMENTS ADOPTED ENVIRONMENTAL IMPACT REPORT NO. 73-16 BY THE FOLLOWING VOTE: AYES: Eadie, Spencer, Crosby NOES: None ABSENT: None Board discussed plans with applicant. It was agreed upon by the Board members that the applicant work with the Fire Department to obtain a proper turnaround radius. It was pointed out to the applicant that all conditions of Tentative Tract 6948 covering the Lusk Industrial Park must be complied with. Board discussion followed. Conditions of approval were discussed. ON MOTION BY SPENCER AND SECOND BY EADIE ADMINISTRATIVE REVIEW NO. 74-105 WAS APPROVED WITH THE FOLLOWING CONDITIONS AS OUTLINED BY THE FOLLOWING VOTE: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The revised conceptual plot plan and elevations received July 8, 1974 shall be the approved layout subject to the modifications described herein: a. Physical maneuvering capabilities on site shall be subject to approval of the Fire Department. A plan delineating said modifications shall be submitted to the Secretary of the Board. If such plan complies with the modifications outlined by the Board, said plan shall be approved and made a permanent part of the administrative file. 2. The following plans shall be submitted to the Secretary of the Board: a. Landscape and irrigation plan complying with Article 979 of the Huntington Beach Ordinance Code and landscaping specifications on file in the Department of Public Works. b. Rooftop mechanical equipment screening plan. Said plan shall indicate screening of all rooftop mechanical equipment and shall deliniate the type of material proposed to screen said equipment. Fire protection systems, including automatic sprinkler systems, fire hydrants, fire alarms, and any required fire protection devices shall comply with the speci- fications of the Uniform Fire Code. Plans for such systems shall be submitted to the Fire Department and shall be subject to approval by the Departments of Fire and Public Works. GENERAL: 1. All applicable conditions of Tentative Tract 6948 shall be complied with. AYES: Eadie, Spencer, Crosby NOES: None ABSENT: None DIVISION OF LAND NO. 74-23 Applicant: Edgar B. Bolstad To permit the consolidation of three parcels of land into two parcels of land pursuant to S.9811.3 of the Huntington Beach Ordinance Code located on the east side of Computer Lane, approximately 248 feet south of McFadden Avenue in a 100 Ml-A, 20,000 restricted industrial district. The applicant was not present. The Chairman informed the Board that this application is exempt from Environmental Review Board requirements due to the adoption of Environmental Impact Report No. 73-16 adopted by the City Council on March 18, 1974. It was the consensus of the Board to continue this application for one week to allow the applicant to be present and for further investigation on the site. Carl Wieland To permit the installation of overhead utilities pursuant to S.9730.9 of the Huntington Beach Ordinance Code located on the northwest corner of Canberra Lane and Lurline Drive in an R-1, low density residential district. Mr. Carl Wieland, the applicant, was present. The Chairman informed the Board that this application is a categorical exemption, class 3, California Environmental Quality Act, 1970. A field check by the Board members revealed that the applicant is proposing to enlarge the existing use. Board discussion followed. Condition of approval was discussed. ON MOTION BY SPENCER AND SECOND BY EADIE ADMINISTRATIVE REVIEW NO. 74-106 WAS APPROVED WITH THE FOLLOWING CONDITION AS OUTLINED BY THE FOLLOWING VOTE: 1. Applicant shall comply with all aspects of S.9730.11 of the Huntington Beach Ordinance Code as follows: Conversion of Overhead Utilities: Any new overhead service which is permitted by these provisions shall have installed a service panel to facilitate conversion to underground utilities at a future date. Mr. Carl Wieland, representing the applicant, and Mr. Flores, the applicant, were present. Mr. Stagliano, the applicant, was present. The Chairman informed the Board that this application is exempt from Environmental Review Board requirements due to the adoption of Environmental Impact Report No. 73-16 adopted by the City Council on March 18, 1974. ON MOTION BY CROSBY AND SECOND BY SPENCER, THE BOARD OF ZONING ADJUSTMENTS ADOPTED ENVIRONMENTAL IMPACT REPORT NO. 73-16 BY THE FOLLOWING VOTE: AYES: Eadie, Spencer, Crsoby NOES: None ABSENT: None Board discussed plans with applicant. It was pointed out to the appliant that the proposed plans were lacking in parking and landscaping. Alternatives for correcting these problems were discussed. Mr. Stagliano stated that the proposed use was to be storage for a moving and storage company. It was pointed out to the applicant that all conditions of Tentative Tract 6948 covering the Lusk Industrial Park must be complied with. Minutes: H.B. ON MOTION BY CROSBY AND SECOND BY SPENCER ADMINISTRATIVE REVIEW NO. 74-109 WAS APPROVED WITH THE FOLLOWING CONDITIONS AS OUTLINED BY THE FOLLOWING VOTE: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan and elevations received July 2, 1974 shall be the approved layout subject to the modifications described herein. a. Implement landscaping to attain 6 percent. b. Driveway width to be 25 feet. A plan delineating said modifications shall be submitted to the Secretary of the Board. If such plan complies with the modifications outlined by the Board, said plan shall be approved and made a permanent part of the administrative file. 2. The following plans shall be submitted to the Secretary of the Board. a. To permit the construction of a four unit apartment building pursuant to S.9231.6 of the Huntington Beach Ordinance Code located on the east side of 7th Street, approximately 100 ft. from Walnut Avenue in an R-4, high density residential district. The applicant was not present. The Chairman informed the Board that this application is a categorical exemption, class 3, California Environmental Quality Act, 1970. Board discussed plans. It was noted that the applicant was lacking open space and will be requested to submit revised plans showing revision to open space allocations to meet ordinance code requirements. Proper dedication of right-of-way was discussed. And it was further noted that the applicant shall show reflection of side yard setback treatment to meet ordinance code requirements on his revised plans. Conditions of approval were discussed. ON MOTION BY SPENCER AND SECOND BY CROSBY ADMINISTRATIVE REVIEW NO. 74-84 WAS APPROVED WITH THE FOLLOWING CONDITIONS AS OUTLINED BY THE FOLLOWING VOTE: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan and elevations received June 7, 1974 shall be the approved layout subject to the modifications described herein. a. Fire protection -systems, including automatic sprinkler systems, fire hydrants, fire alarms, and any required fire protection devices shall comply with the specifications of the Uniform Fire Code. All building spoils, such as unusable lumber, wire, pipe and other surplus or unusable material, shall be disposed of at an offsite facility equipped to handle them. 3. Natural gas and electricity shall be stubbed in at the location of clothes dryers, and natrual gas only shall be stubbed in at the locations of cooking facilities, water heaters, and central heating units.
