L. Anderson To permit a five (5) foot encroachment into the minimum interior side yard setback in lieu of S.9103.2.1 of the Huntington Beach Ordinance Code located on the south side of Adams Avenue, approximately 50 ft. east of Park Street in an R-1, low density residential district. Miss Anderson, the applicant, and Mr. Miller, owner of the property, were present. The Chairman opened the public hearing. The Chairman informed the Board that this application is a categorical exemption, class 5, California Environmental Quality Act, 1970. Miss Anderson addressed the Board and outlined her proposal. She felt that the Board members should take a field check on the proposed encroachment. It was the consensus of the Board, that in order to make a proper determination of the encroachment, a field check would be mandatory. The Chairman suggested a one week continuance to allow staff to make a site inspection of the proposed encroachment. 1 Minutes: H.B. ON MOTION BY EADIE AND SECOND BY SPENCER CONDITIONAL EXCEPTION NO. 74-43 WAS CONTINUED TO JULY 31, 1974 BY THE FOLLOWING VOTE: AYES: Eadie, Spencer, Crosby NOES: None ABSENT: None PLOT PLAN AMENDMENT NO. 74-4 Applicant: Mansion -Hall Company To permit the realignment of a boundary line and the relocation of the recreation area within Tract 8248 pursuant to S.9811.4 of the Huntington Beach Ordinance Code located approximately 200 ft. south of Seacliff Lane and east of Deep Harbor Drive. IN CONJUNCTION WITH: DIVISION OF LAND NO. 74-27 Applicant: Mansion -Hall Company To permit a realignment of property lines pursuant to S.9811.3 of the Huntington Beach Ordinance Code located approxiamately 200 ft. south of Seacliff Lane and east of Deep Harbor Drive. Mr. Ron. Dickason, representing the applicant, was present. The Chairman opened the public hearing on Plot Plan Amendment No. 74-4. The Chairman informed the Board that Plot Plan Amendment No. 74-4 and Division of Land No. 74-27 are exempt from environmental review due to the adoption of Environmental Impact Report No. 73-3 by the Environmental Review Board cn June 5, 1973. Mr. Dickason outlined his proposal to the Board. He stated that the proposal was designed to save 5 of 7 existing Cypress trees. He stated that he would hesitate removing these trees for the purpose of constructing a new building on that site. The Chairman informed the applicant's representative that all ordinance code requirements pertaining to his proposal must be complied with. Page 6 It was the consensus of the Board that the proposed Plot Plan Amendment does not constitute a substantial change in the overall plan. As there were no parties present to speak in favor of or opposition to Plot Plan Amendment No. 74-4, the Chairman closed the public hearing. Board discussed Division of Land No. 74-27 with the applicant's representative. Board found proposal to be within ordinance code conformance. Conditions of approval and findings were discussed. ON MOTION BY CROSBY AND SECOND BY SPENCER PLOT PLAN AMENDMENT NO. 74-4 WAS APPROVED WITH THE FOLLOWING FINDINGS BY THE FOLLOWING VOTE: 1. The amendment does not constitute a substantial change in the overall plan. 2. The proposed use of the property is remaining the same. 3. Dwelling unit density has not increased through this amendment. 4. An approved plan has resulted by virtue of this amendment as evidenced by saving of the existing trees. AYES: Eadie, Spencer, Crosby NOES: None ABSENT: None ON MOTION BY CROSBY AND SECOND BY SPENCER DIVISION OF LAND NO. 74-27 WAS APPROVED WITH THE FOLLOWING CONDITIONS AS OUTLINED BY THE FOLLOWING VOTE: A. TO BE COMPLETED PRIOR TO USE OR OCCUPANCY OF SAID PARCEL FOR ANY PURPOSE: 1. This Division of Land shall not be effective until a covenant and agreement furnished by the Huntington Beach Planning Department is signed and recorded with the Orange County Recorder agreeing to these conditions of approval. 2. The tentative parcel map received by the Planning Department on June 18, 1974 shall be the approved layout. 3. A parcel map shall be filed with and approved by the Department of Public Works and recorded with the Orange County Recorder. (prior to issuance of a Certificate of Occupancy) Minutes: H.B. Ludwick To permit the construction of a room addition along existing non -conforming setback lines in lieu of the provisions required by 5.9719 (alteration of building having non -conforming yard) of the Huntington Beach ordinance Code located on the north side of 12th Street, approximately 60 ft. east of Park Street* in an R-1, low density residential district. IN CONJUNCTION WITH: USE PERMIT NO. 74-31 Applicant: Lanny E. Ludwick To permit the construction of room additions to an existing residence containing non -conforming setbacks pursuant to S.9719 of the Huntington Beach Ordinance Code located on the north side of 12th Street, approximately 60 ft. east of Park Street in an R-1, low density residential district. Mr. Lanny Ludwick, the applicant, was present. The Chairman opened the public hearing on Conditional Exception No. 74-42 and Use Permit No. 74-31. The Chairman informed the Board that Conditional Exception No. 74-42 is a categorical exemption, class 5, California Environmental Quality Act, 1970 and Use Permit No. 74-31 is a categorical exemption, class 1, California Environmental Quality Act, 1970. Mr. Ludwick outlined his proposals to the Board. Mr. Ludwick stated that his residence was built a number of years back and this was justification for a Conditional Exception as it is logical to continue with the straight lines of the house for his proposed additions. He further stated that he would like a professional looking job instead of a zig-zag effect. Mr. Ludwick felt that a one foot encroachment would not be detrimental to his neighbors, and felt no one in his neighborhood had objections to the proposed encroachment. The Board received and filed a petition in favor of the proposal from adjoining property owners. Minutes: H.B. Board of Zoning Adjustments Wednesday, July 24, 1974 Page 8 Mr. Crosby stated that due to the additional 1000 sq. ft. of addition to Mr. Ludwick's residence, 2-1/2 ft. of additional dedication is re- quired for the Alley in the rear of the applicant's residence. It was the consensus of the Board that the Use Permit application meets ordinance code requirements except that portion where the Conditional Exception is being requested. It was the consensus of the Board that the room additions could be built without the encroachment of one extra foot. As there were no further parties present to speak in favor of or opposition to Conditional Exception No. 74-42 or Use Permit No. 74-31, the Chairman closed the public hearing. ON MOTION BY SPENCER AND SECOND BY EADIE CONDITIONAL EXCEPTION NO. 74-42 WAS DENIED FOR THE FOLLOWING REASON BY THE FOLLOWING VOTE: 1. Applicant has failed to demonstrate a justifiable hardship. Applicant shall comply with all provisions of the Huntington Beach Ordinance Code. AYES: Eadie, Spencer, Crosby NOES: None ABSENT: None PLOT PLAN AMENDMENT NO. 74-5 Applicant: Rex B. Link, Agent To modify an existing parking layout pursuant to S.9811.4 of the Huntington Beach Ordinance Code located on the northeast corner of Indianapolis Avenue and Magnolia Street in an R-1, low density residential district. Mr. Rex B. Link, the applicant, and Mr. Don Gibas and Mrs. Jean Paul -Jean, representing the Church, were present. The Chairman opened the public hearing. The Chairman informed the Board that this application is a categorical exemption, class 1, California Environmental Quality Act, 1970. Minutes: H.B. Board of Zoning Adjustments Wednesday, July 24, 1974 Page 9 Mr. Link outlined the proposal to the Board. He stated that the new layout is a considerably safer parking layout for the children playing in that area and for the parishioners. He stated that the new layout would contain uniform parking and would disallow for any criss-crossing across the parking lot. He further stated that he wished to carry 90 degree parking with double lines between each parking stall. Mrs. Paul -Jean and Mr. Gibas spoke in favor of the proposed plot plan amendment. The Chairmain outlined the history of this particular site, and was in agreement that the new proposal would be a safer situation. It was the consensus of the Board that the proposed plan is a definite improvement over previous parking layout, thereby eliminating major traffic problems. Landscaping was discussed. It was noted that the amount of landscaping would not be decreased by the proposed amendment. As there were no parties present to speak in favor of or opposition to Plot Plan Amendment No. 74-5, the Chairman closed the public hearing. Findings were discussed. ON MOTION BY EADIE AND SECOND BY CROSBY PLOT PLAN AMENDMENT NO. 74-5 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITION BY THE FOLLOWING VOTE: 1. The amendment does not constitute a substantial change in the overall plan. 2. The proposed use of the property is remaining the same. 3. The proposed plan is an improvement over the previous parking layout as major traffic problems are eliminated. 4. The amount of landscaping has not been decreased. CONDITION OF APPROVAL: 1. All previous conditions of approval of Plot Plan Amendment No. 72-6 shall be complied with. AYES: Eadie, Spencer, Crosby NOES: None ABSENT: None Minutes: H.B. The applicant was not present. The Chairman opened the public hearing. The Chairman informed the Board that this application is a categorical exemption, class 3 , California Environmental Quality Act, 1970. It was the consensus of the Board to continue this application to allow the applicant to be present. ON MOTION BY EADIE AND SECOND BY SPENCER USE PERMIT NO. 74-32 WAS CONTINUED TO JULY 31, 1974 BY THE FOLLOWING VOTE: AYES: Eadie, Spencer, Crosby NOES: None ABSENT: None Mr. Langston, the applicant, arrived. ON MOTION BY EADIE AND SECOND BY CROSBY USE PERMIT NO. 74-32 WAS RECONSIDERED BY THE FOLLOWING VOTE: AYES: Eadie, Spencer, Crosby NOES: None ABSENT: None Mr. Langston outlined his proposal to the Board. The applicant stated that he did not wish to expand onto the existing Mazda Dealership but rather would like to establish a separate lot for an Oldsmobile Agency. Driveway cuts were discussed. It was the consensus of the Board to continue this application for one week to allow a field check of the proposed site and to further check for environmental status of this application. Mr. De Lacuesta, a neighbor, addressed the Board and stated that he had no objections to the proposal, for he was mistaken previously as to the location of the proposal. To permit the construction of a model home complex and sales office pursuant to S.9730.18 of the Huntington Beach Ordinance Code located on the northwest corner of Springdale Street and Talbert Avenue in an R-1, low density residential district. Mr. John Littmann, representing the applicant, was present. The Chairman informed the Board that this application is exempt from Environmental Review Board requirements due to the adoption of Environmental Imnact Report No. 73-26 on July 2, 1974. Mr. Littmann outlined his proposal to the Board. Access of Springdale was discussed. It was the consensus of the Board that the proposal provided ample parking and proper circulation. Landscaping was dis- cussed. Signing was discussed. It was pointed out to the applicant that a 6 ft. masonry wall adjacent to the models must be built prior to exhibiting the models for sale. Conditions of approval were discussed. ON MOTION BY CROSBY AND SECOND BY SPENCER ADMINISTRATIVE REVIEW NO. 74-111 WAS APPROVED WITH THE FOLLOWING CONDITIONS BY THE FOLLOWING VOTE: 1. The conceptual plot plan received July 12, 1974 shall be the approved layout reflecting the following amendments. a. The 6 ft. decorative masonry perimeter wall adjacent to the models shall be built prior to exhibiting models for sale. NOTE: In considering the conceptual plan approved, the Board considered the parking layout, walls, signs (theme), circulation and the models relation to the immediate vicinity. Applicant shall pursue specific requirements of the Huntington Beach Ordinance Code at the Dept. of Building and Community Development. Minutes: H.B.
