Cowles, Jr. Tentative Tract No. 8703 is a request to permit a 19 lot subdivision located on the northeast corner of Slater and Nichols in a R3 zone. Minutes: H.B. Planning Commission Tuesday, August 6, 1974 Page 2 Mr. James Palin addressed the Commission and discussed the conditions of approval offered by staff. Mr. Cowles, the applicant, was present, and stated that the developer was agreeable with all conditions of approval recommended by staff. ON MOTION BY GEIGER AND SECOND BY HIGGINS TENTATIVE TRACT NO. 8703 WAS APPROVED WITH THE FOLLOWING CONDITIONS AND BY THE FOLLOWING VOTE: 1. The Tentative Map received August 1, 1974 shall be the approved layout. 2. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an offsite facility equipped to handle them. 3. Natural gas and electricity shall be stubbed in at the location of clothes dryers, and natural gas only shall be stubbed in at the locations of cooking facilities, water heaters, and central heating units. 4. Double paned windows shall be installed in that portion of all units that side or back -on to Slater Avenue. 5. All utilities shall be installed underground. 6. The existing 3 course block wall with grapestake fence located on the existing alley to the east shall be replaced with a 6 ft. high masonry wall per City standards. Property to the north, abutting the existing sbhool, shall receive the same treatment. 7. If the developer proposes to provide air conditioning, the insulation in ceilings and exterior walls shall be a minimum of R-19 and R-11, respectively. If no air conditioning is to be provided, the insulation in ceilings and exterior walls shall be a minimum of R-13 and R-7 respectively. 8. Access rights along arterial highways, except at street inter- sections, shall be dedicated to the City of Huntington Beach. 9. Sewer and water systems shall be constructed by the developer and dedicated to the City of Huntington Beach. 10. Water supplies shall be through the City of Huntington Beach's water system. 11. Sewage disposal shall be through the City of Huntington Beach's sewage system. 7 13. Street sections shall be determined by soil R value and traffic index. 14. Street lighting shall be provided to City standards. 15. Drainage of the subdivision shall be approved by the Depart- ment of Public Works prior to submitting any final map to the City Council for acceptance of any part of the approved subdivision. 16. Said property shall participate in the local drainage assess- ment district. 17. All buildings on lots abutting a city easement shall be set back 5 ft. from the edge of such easement. 18. Fire alarm system and conduit and appurtenances shall be installed by the developer at locations and to specifications provided by the Fire Department. 19. Decorative masonry walls shall be constructed to City speci- fications along those lots that side -on to Slater and back -on to Nichols Street. Said wall shall be 6 inches wide and 6 feet high. The height of said wall shall be measured from whichever side is higher at finished grade. The architectural design of said wall shall be approved by the, Planning Department. Structural designs shall be approved by the -Department of Public Works and shall be included as a part of the street improvement plans. The intent of this condition is to improve the street scene along such streets. 20. The architectural design of the perimeter walls and the type and placement of street trees shall create unity and interest in the street scene. 21. Landscape planters shall be provided along Slater Avenue and at the entrance to the proposed subdivision from Nichols Street. Such planter shall conform to the plans and specifications on file in the Department of Public Works and the requirements of the Planning Commission. It is the developer's responsibility to landscape such planters and provide irrigation facilities in conformance with the Department of Public Works specifications and requirements., TO BE SPECIFICALLY COMPLETED PRIOR TO THE ISSUANCE OF BUILDING PERMITS: 22. Preliminary and final soil reports shall be submitted by a certified soils engineer to the Department of Public Works prior to issuance of building permits. -3- 8/6/74 - PC Minutes: H.B. A licensed engineer shall be engaged to compile calculations for footings and structural members of the facility to withstand these G-factors. 25. A soils engineer and/or geologist familiar with local seismic conditions shall be engaged to indicate the G-factors due to seismic movement for this location. AYES: Geiger, Higgins, Kerins, Porter NOES: None ABSENT: Bazil, Wallin, Boyle TENTATIVE TRACT NO. 8723 Applicant & Subdivider: Huntington Beach Industrial Park Tentative Map Number 8723 is a request to permit a subdivision of land into a three lot (three -phased) condominium development. Subject property is located at the northeast corner of Research Drive and Producer Lane, approximately 275 feet south of McFadden Street and on the west side of the flood control channel adjacent to Springdale Street. Mr. Palin stated that staff had met with developer to attempt to resolve problems on the conceptual plan regarding emergency access throughout the development. Conditions of approval were discussed with Commission. Mr. Don Steffensen, representing the applicant, addressed the Commission. He stated that he had reviewed the site plan with Mr. Mandrell and -would not object to filing a revised plan with the City for review. He stated that he did not object to the conditions of approval. Commissioner Bazil arrived at 7:25 P.M. Staff and Commission discussed the filing of a new Administrative Review. ON MOTION BY HIGGINS AND SECOND BY GEIGER TENTATIVE TRACT NO. 8723 WAS APPROVED WITH THE FOLLOWING CONDITIONS AND BY THE FOLLOWING VOTE: 1. The Tentative Tract Map received July 26, 1974 shall be the approved layout. 2. All conditions of Tentative Tract 6948 shall be complied with. 3. A new Administrative Review shall be filed to supersede Administrative Review No. 74-65 and that shall be filed prior to recordation of final map for the project. -4- 8/6/74 - PC Minutes: H.B. Prior to the recordation of a condominium map on each of the three lots, a precise plan shall be submitted to the Planning Department for review and approval action. The subsequent condominium map shall be in full compliance with this site plan, approved by the City. 5. The CC&R and Association Rules shall be approved by the City Attorney's office and the Planning Department prior to recordation of the condominium maps. 6. If this map is recorded in phases, each phase of the project shall be annexed to the preceding phase so that the end project is one condominium development with one property owners association. AYES: Geiger, Higgins, Kerins, Porter NOES: None ABSTAIN: Bazil ABSENT: Wallin, Boyle CONDITIONAL USE PERMIT NO. 74-08 Applicant: Kip Gajada The applicant is proposing to construct an additional 630 square feet of classroom area to an existing church and school facility which will be provided by enclosing the existing breezeway between the chapel and the school building. The existing facility was established through Use Permit No. 65-20 conditionally approved by the Board of zoning Adjustments on March 3, 1971. The property is located on the south side of Hamilton, 5401+ west of Brookhurst Avenue. Commissioner Porter stated that he would be abstaining since he was a member of this Church, but would offer comments after the hearing. Mr. John Cope addressed the Commission and outlined staff's reasons for recommending approval. Conditions of approval were discussed. Chairman Kerins opened the public hearing. Mr. Kip Gajada addressed the Commission and stated that he had no comments to make other than he was willing to comply with all recommendations of the staff. Chairman Kerins closed the public hearing. Commission discussed the recommended conditions of approval. ON MOTION BY GEIGER AND SECOND BY BAZIL CONDITIONAL USE PERMIT NO. 74-08 WAS APPROVED WITH THE FOLLOWING CONDITIONS BY THE FOLLOWING VOTE: • -5- 8/6/74 - PC Minutes: H.B. Planning Commission Tuesday, August 6, 1974 Page 6 1. The conceptual plot -plan received June 21, 1974 shall be the approved layout. For the applicant's information, all applicable development standards shall be complied with. 2. The masonry screening wall, fronting on Hamilton Avenue, shall be repaired where damaged, and the landscaping areas in front of such wall shall be refurbished and replaced where necessary due to damage and lack of maintenance. Such work shall be completed prior to occupancy of the new building and shall be subject to Planning Department approval. CONDITIONAL USE PERMIT NO. 74-09. Applicant: Liberty Christian School This is a request to use two relocatable classrooms as temporary additional classroom area. The property is located on the east side of Nichols Street approximately.300 ft. north of Warner in an R2 zone. A vugraph was shown. The Chairman opened the public hearing. Mr. Bill McClean, representing the applicant, addressed the Commission and stated that they were in agreement with recommendations of the staff and were willing to comply with them. The staff indicated to Mr. McClean that Warner and Nichols will have to be dedicated. Mr. Hartge stated that street improvements may be delayed by submission of a bond with requirement that improve- ment be installed upon direction of the Director of Public Works. The Chairman closed the public hearing. By minute action the staff was directed to advise applicant of his responsibilities regarding conformance with the City of Huntington Beach Ordinance Code. For the applicant's information, all applicable development standards, including Uniform Building Code provisions shall be complied with. 2. The building location as indicated on the plot plan dated June 25, 1974 as "first choice", shall be the approved location of the relocatable classrooms. 3. The permit for the relocatable structures shall become null and void, and all such relocatable structures shall be completely removed by August 6, 1976. 4. Landscaping shall be provided around the perimeter of the building. Said landscaping plan shall be submitted to the Planning Department for approval prior to the issuance of building permits or the installation of the buildings on the site. The map was originally approved by the Planning Commission on August 21, 1973. The applicant directed a letter to the City requesting a one year extension of time for the approval of Tentative Tract No. 8367. A vugraph was shown. The applicant was not present. Commission discussed the request. Planning Commission Tuesday, August 6, 1974 Page 8 CODE AMENDMENT NO. 74-7 Retail Nurseries as an Unclassified Use The Chairman opened the public hearing. Mr. Dave Diamond addressed the Commission and discussed the Home Council problems with nurseries which had been brought before the City Council. Her referred to the use of insecticides, fertilizer, other products, as well as traffic problems, which did not improve R1 residences in the area. There was a discussion on the difference between retail and whole- sale nurseries. ON MOTION BY BAZIL AND SECOND BY GEIGER CODE AMENDMENT NO. 74-7 WAS APPROVED BY THE FOLLOWING VOTE: AYES: Bazil, Geiger, Kerins, Higgins, Porter NOES: None ABSENT: Wallint Boyle DISCUSSION - Code Amendment No. 72-21: Multi -Story Suffix Mr. Dave Eadie stated that on the July 30th meeting of the Planning Commission the Commission voted to reconsider, and the City Council took the item off the agenda and requested the Planning Commission move as expeditiously as possible and provide for as much flexibility as possible. Commission discussed flexibility versus more control in the multi- story suffix. Mrs. Martin and Mrs. Loraine Faber, High Rise Committee members, addressed the Commission and questioned the use of "Specific Plan" being included in the Code Amendment. ON MOTION.BY GEIGER AND SECOND BY PORTER CODE AMENDMENT NO. 72-21 WAS REVISED TO EXCLUDE REFERENCE TO "SPECIFIC PLAN" BY THE FOLLOWING VOTE: AYES: Bazil, Higgins, Kerins, Geiger, Porter NOES: None ABSENT: Wallin, Boyle DISCUSSION: Gothard Street Realignment. Deletion of Talbert Avenue between Sprinqdale and Bolsa Chica Streets. Secretary Harlow stated that staff had been unable to complete the work necessary for a presentation and that it would be placed on a future agenda. J -8- 8/6/74 - PC Minutes: H.B. Planning Commission Tuesday, August 6, 1974 Page 9 MISCELLANEOUS Request for Policy Direction: Code Amendment No. 1 - "Minimum Lot Area Revision - Rl Districts" Code Amendment No. 2 - "Low -Moderate Income Requirements" Code Amendment No. 3 - "Maximum Density per Gross Acre - Rl-4, R2-12, R3-18, R4-28" Mr. Dave Eadie addressed the Commission and requested direction from them regarding the above proposed code amendments. It was the consensus of the Commission that No. 1 and No. 3. should' be combined and that No. 2 should be deleted. ON MOTION BY BAZIL AND SECOND BY HIGGINS STAFF WAS DIRECTED TO PROCEED ON PREPARATION OF COMBINED NO. 1 AND NO. 3.AND DELETE NO. 2. BY A UNANIMOUS VOTE. The Commission directed staff to change maximum number of units per gross acre in the R1 from previously designated 4.0 to 4.7 units per gross acre. -Staff indicated that they will be pursuing this combination into one Code Amendment and will report on its ramifications either through a negative declaration process or through further study. Code Amendment No. 2 was deleted in view of the discussion held regarding what other cities are doing at this time. WRITTEN COMMUNICATIONS: Letter from Kaufman and Broad requesting reconsideration of Conditional Exception No. 74-36. Mr. Hooper addressed the Commission and outlined his reasons for requesting reconsideration by the Commission. Secretary Harlow stated that Mr. Hooper had been advised in a telephone conversation of his right to appeal the decision of the Planning Commission to the City Council within the 10 day filing period, but since he had failed to do so, it was not mandatory that the Planning Commission reconsider. Staff was directed to receive and file the letter from Kaufman and Broad. Attorney's Memo regarding Senate Bills 1982 and 1983 and Assembly Bill 3571 Received and filed. ON MOTION BY BAZIL AND SECOND BY GEIGER STAFF WAS DIRECTED TO PREPARE A PRECISE STREET ALIGNMENT PLAN AND SET FOR PUBLIC HEARING BY THE FOLLOWING VOTE: AYES: Bazil, Geiger, Higgins, Kerins, Porter NOES: None ABSENT: Wallin, Boyle ON MOTION BY KERINS AND SECOND BY BAZIL STAFF WAS DIRECTED ON FUTURE CODE AMENDMENTS TO MAKE COMPREHENSIVE STUDY TO GET TOTAL NUMBER OF PEOPLE THAT WOULD BE GENERATED FROM DEVELOPMENT BASED ON UNIT AND BEDROOM COUNTS BY THE FOLLOWING VOTE: AYES: Bazil, Geiger, Higgins, Kerins, Porter NOES: None ABSENT: Wallin, Boyle Commission noted that this type of information is the type that would be generated in environmental documents. Commissioner Porter stated that he had requested Ed Selich to draw up a map of bus schedules and service in the County with number of route line miles per population in the City and number of routes. Chairman Kerins requested that a Resolution be prepared commending Commissioner Wallin for her service on the Planning Commission. ON MOTION BY PORTER AND SECOND BY GEIGER STAFF WAS DIRECTED TO PREPARE A RESOLUTION COMMENDING COMMISSIONER WALLIN FOR HER SERVICE ON THE PLANNING COMMISSION OF THE CITY OF HUNTINGTON BEACH BY THE FOLLOWING VOTE: AYES: Bazil, Geiger, Higgins, Kerins, Porter NOES: None ABSENT: Boyle, Wallin Commission discussed the ending of moratorium in the Sunset Heights area and staff indicated that it would expire sixty days from June 17, 1964.
