The Chairman informed the Board that the applicant wished to

that the applicant has made a request to continue Use Permit

plans. Board concurred with applicant's request.

Mr. Don Baker, of Valley Consultants, representing the applicant,
was present.
The Chairman informed the Board that the Environmental Review
Board granted Exemption Declaration No. 74-93 August 6, 1974
with the following additional information.

No environmental impact report has been prepared for this project,
and the Negative Declaration issued for the project has been pro-
perly posted in the office of the City Clerk.
Findings are based upon information contained in the Exemption
Declaration Request, and supplementary information submitted by
the proponent.
Board recommended that the Board of Zoning Adjustments pursue
the alternative layout submitted, showing and providing for a
private alley for ingress and egress.
Board discussed additional information transmitted by the Environmental
Review Board.

1. This Division of Land shall not be effective until a
covenant and agreement furnished by the Huntington Beach

2. The tentative parcel map received by the Planning Department
on July 31, 1974 shall be the approved layout.

CONDITIONAL EXCEPTION NO. 74-43 (Cont. from 7/31/74)
Applicant: E. L. Anderson
To permit a five (5) foot encroachment into the minimum
interior side yard setback in lieu of S.9103.2.1 of the
Huntington Beach Ordinance Code located on the south side
of Adams Avenue, approximately 50 ft. east of Park Street
in an R-1, low density residential district.
Mrs. Anderson, the applicant, Mr. Richard, representative,
and Mr. Miller, owner of the property, were present.
The Chairman opened the public hearing.
The Chairman informed the Board that this application is a
categorical exemption, class 5, California Environmental
Quality Act, 1970.
Mrs. Anderson addressed the Board and stated her justification
as follows: She stated that her neighbors are in full agreement
of the project and presented a petition signed by several
neighbors in favor of the project. Mr. Richard stated that
the proposal upgraded the property value and is a very good
home improvement. He further stated that Mr. Miller, the
owner, is an elderly person and a patio would afford him _
a pleasant, shady area to relax in.
Mrs. Anderson further stated that it was her opinion that several
other homes in the vicinity had similar encroachments with similar
patios built.
A check through the records showed that no other homes in that
vicinity had been granted Conditional Exception applications.

Mr. Gerarden presented the background of this property to the
Board and stated that a building permit had been issued in 1965
for this structure but the structure was never built, and subsequently
the building permit expired by statute of limitations. Subsequently,
on or about the middle of October, 1971 construction was commenced
on the patio cover.
On November 1, 1971, the Dept of Building and Community Development
issued a stop work order for the partially completed construction
for the reasons that no building permit was in effect and that
the structure violated yard requirements, i.e. S.9103.2.1 of the
Huntington Beach Ordinance Code.
On or about November 3, 1971, the construction of the patio cover
was completed in violation of the stop work order and remained in
violation of yard requirements.
On November 4, 1971, the Dept. of Building and Community Development
filed requests with the City Attorney's office to pursue criminal
complaint proceedings against the owner, Edith L. Anderson as deter-
mined by the Huntington Beach City Attorney's office.
Since November of 1971 to the present time, the property has remained
in legal prosecution proceedings through the municipal court.
Mr. Tom Lawrence and Mr. Douglas Craig addressed the Board and
stated their approval of the project.
There being no further parties present to speak in favor of or
opposition to Conditional Exception No. 74-43, the Chairman closed
the public hearing.
Board discussion followed. It was the consensus of the Board that
the applicant had failed to demonstrate a justifiable hardship.
ON MOTION BY CROSBY AND SECOND BY EADIE CONDITIONAL EXCEPTION
NO. 74-43 WAS DENIED FOR THE FOLLOWING REASON AND_FINDINGS BY THE
FOLLOWING VOTE:
REASON FOR DENIAL
1. Applicant failed to justify request and conforming to code
requirements would not pose physical hardships on the site.

CONDITIONAL EXCEPTION NO. 74-48
Applicant: Wilbur W. Caldwell
To permit a six (6) inch encroachment of a proposed open
unenclosed stairway into the interior side yard setback
in lieu of S.9163.4.2.3 of the Huntington Beach Ordinance
Code located on the east side of 13th Street, approximately
130 ft. south of the center line of Acacia Avenue, in an
R-2, medium density residential district.

Applicant: Wilbur W. Caldwell
To permit the alteration of a residence having a non -conforming
interior side yard pursuant to S.9719 of the Huntington Beach
Ordinance Code located on the east side of 13th Street, approximately
130 ft. south of the center line of Acacia Avenue, in an R-2,
medium density residential district.

opened the public hearing on Conditional Exception

The

informed the Board that both applications are class
5 exemptions,
California Environmental Quality Act, 1970. .
Board discussed plans with applicant. The amount of required
parking versus the floor plan was discussed.
Alterations to,the proposal was discussed. Mr. Caldwell addressed
himself to the conditional exception application and stated by
placing the stairs per drawing, the overall plan would be more
functional as well as better looking.
The Board addressed itself to the Use Permit application and pointed
out to Mr. Caldwell that the plan does not show proper access to
the proposed project. Turning radius was discussed for use by
emergency vehicles. The possibility of additional dedication
from the alley was discussed.
It was the consensus of the Board with the concurrence of the
applicant to continue this application to allow applicant time
to revise his plans showing another parking space on the site,
and to further allow staff time to acquire code interpretation
pertaining to access to the proposed project.

The Chairman informed the Board that this application is exempt
from Environmental Review Board review due to the adoption of
Environmental Impact Report No. 73-16• adopted by the City Council
on March 18, 1974.
Board discussed plans with applicant. A shortage of landscaping
was discussed. The possibility of removing parking space #1
to facilitate better maneuvering capabilities was discussed
and agreed upon.
The Board addressed itself to the Use Permit application and
discussed truckwell location dimensions with the applicant.
The possibility of flipping the plan over to accomodate a better
over-all street scene was discussed.
As there were no parties present to speak in favor of or opposition
to Use Permit No. 74-36, the Chairman closed the public hearing.

The Chairman opened the public hearing on Use Permit No. 74-37.
The Chairman informed the Board that this application was exempt
from Environmental Review Board review due to the adoption of
Environmental Impact Report No. 73-16 adopted by the City
Council on March 18, 1974.
Mr. Fast addressed the Board and presented his proposal to the
Board. Board discussed plans with applicant's representative.
A shortage of landscaping was noted. The deletion of parking
space #21 and replacing it with landscaping and the deletion
of the driveway on McFadden and replacing it with a modified
parking layout was discussed.
The possible use of the proposed building was discussed. It was
noted that the building would contain light manufacturing, i.e.
computer related and would contain storage of same.
The Board addressed itself to the Use Permit application and found
that there are no other truck doors facing Computer Lane, and
therefore, would not be detrimental to individual use.
As there were no parties present to speak in favor of or
opposition to Use Permit No. 74-37, the Chairman closed the
public hearing.

The Chairman indicated the Planning staff wishes to pursue a
realignment of Redondo Circle in light of the problem of an
existing water pipe along Redondo Circle as it is presently
planned. For this reason, the Department of Public Works is
working on an alternative alignment which coincides with the
plan submitted to the Board.
The staff will be presenting the proposed realignment of Redondo
Circle and recommending deletion of the existing precise plan of
alignment to the Planning Commission and City Council.
It was noted that if for some reason the City Council chooses not
to delete the precise plan of alignment the previously approved
plot plan reflecting the existing plot plan amendment would apply.
The Board indicated that if adjacent property owners do not agree
with the alternate plot plan amendment they would reconsider their
action on this application as amended at their next regular meeting
of August 14, 1974, and rescind approval. Thus, the previous
approval of the lumber yard having frontage at the terminus of the
cul-de-sac portion of Redondo Circle would still apply.
It was the consensus of the Board that the proposed amendment to
the previously approved plan would be a better layout. Rearrange-

and shall be subject to approval by that Department.
5. Fire protection systems, including automatic sprinkler
systems, fire hydrants, fire alarms, and any required
fire protection devices shall comply with the specifi-
cations of the Uniform Fire Code. Plans for such systems
shall be submitted to the Fire Department and shall be
subject to approval by the Departments of Fire and Public
Works.
6. All signs shall be reviewed by the Traffic Engineer in
order to insure proper vision and disallow any traffic
hazards.
B. TO BE COMPLETED PRIOR TO FINAL INSPECTION:
1. Edinger Avenue and Goldenwest Street shall be improved
to the center line of such right-of-way. Said improve-
ment shall include curbs, gutters, sidewalks, paving,
street trees, street lights, street signs, street drain-
age, and sewer and water main extensions in full compliance
with the City of Huntington Beach street standards and
requirements.
NOTE:
In its approval action, the Board of Zoning Adjustments considered
the following issues relating to the conceptual plan:
Traffic circulation and drives
Parking layout
Lot area
Lot width and lot depth
Type of use and its relation to property and improvements in
the immediate vicinity
Past administrative action regarding this property
Sign location (copy not addressed - must meet code)
The Department of Building and Community Development will perform
a comprehensive plan check relating to all ordinance code require-
ments upon submittal of the completed structural drawings.

Please be advised that the Board of Zoning Adjustments reviews the
conceptual plan as a basic request for entitlement of the use applied
for in relation to the vicinity in which it is proposed. The
conceptual plan should not be construed as a precise plan reflect-
ing conformance to all ordinance code requirements.
It is recommended that the applicant immediately pursue completion
of the conditions of approval and address all requirements of the
Huntington Beach Ordinance Code in order to expedite the processing
of the total application.
