To permit the alteration of a residence having a non -conforming

The Chairman informed the Board that Conditional Exception
No. 74-48 and Use Permit No. 74-38 were categorical exemption,
class 5, California Environmental Quality Act, 1970.
The Chairman further informed the Board that the applicant
had requested a two week continuance to allow him time to
revise his plans. Board concurred with continuance.

Code located on the north side of Pearce Street, approximately
103 ft. west of Green Street, in an R-2, medium density
residential district.
Mr. Paul Schuman, representing the applicant, was present.
The Chairman informed the Board that this application is a
categorical exemption, class 5, California Environmental
Quality Act, 1970.
The Chairman opened the public hearing.
Mr. Schuman addressed the Board and requested a six week
continuance of this application to allow him time to resolve
legal problems. Board concurred with continuance of two weeks.
Mr. Thomas Kardos addressed the Board and stated his opposition
to the proposal and also submitted a written document to the
Board reflecting same.
As there were no further parties present to speak in favor of
or opposition to Conditional Exception No. 74-51, the Chairman
called for a motion.

ADMINISTRATIVE REVIEW NO. 74-139 (Continued from 8/21/74)
Applicant: Byron M. Tarnutzer
To permit the construction of an industrial complex pursuant
to 5.9511 of the Huntington Beach Ordinance Code located
on the south side of Hamilton Avenue, approximately 840 ft.
east of the center line of Newland Street, in an M1-A-O
restricted manufacturing district combined with oil production.
Mr. Tarnutzer, the applicant, was present.
The Chairman informed the Board that the Environmental Review
Board granted Exemption Declaration No. 74-127 September 3,
1974 with the following additional information:
1. The City should pursue with the applicant the construction
of street improvements across the Edison right-of-way
on Hamilton.

2. The City should coordinate between the applicant and the
Edison Company planting in the Edison right-of-way.
3. All building spoils should be disposed of at an offsite
facility equipped to handle them.
4. Insulation of the project should be as stipulated by the
applicant in his description form.
Board discussed recommendations of the Environmental Review
Board and implemented Numbers 3 and 4 as conditions of approval.

The applicant outlined his proposal to the Board. Captain
Hosmer of the Fire Department discussed turning radius and
access to the proposal with the applicant.
The Board encouraged the applicant to pursue street improvements
across the Edison right-of-way and further requested the
applicant to work with the Edison Company regarding the landscaping
and street improvements of the Edison right-of-way.

NO. 74-139 WAS APPROVED WITH THE FOLLOWING CONDITIONS AS OUTLINED
BY THE FOLLOWING VOTE:
A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS:
1. The conceptual plot plan and elevations received 8/9/74
shall be the approved layout subject to the modifications
described herein.
Precise configuration of the driveway entrance and widths
of drives for emergency vehicle access shall be subject
to approval by the Fire Department.
A plan delineating said modifications shall be submitted
to the Department of Building and Community Development.
If such plan complies with the modifications outlined by
the Board, said plan shall be approved and made a permanent
part of Administrative Review No. 74-139.
2. The following plans shall be submitted to the Secretary
of the Board:
a. Landscape and irrigation plan complying with Article 979
of the Huntington Beach Ordinance Code and landscaping
specifications on file in the Department of Public Works.
b. Screening wall (32") adjacent to parking areas.
3. In accordance with the City's master plan of arterial
streets and highways, an additional 50 feet of right-of-way
on Hamilton Ave. shall be dedicated.
4. Soil and compaction reports shall be submitted by a
certified soils engineer. Said report shall be submitted
to the Department of Building and Community Development
and shall be subject to approval by that Department.
5. Fire protection systems, including automatic sprinkler
systems, fire hydrants, fire alarms, and any required
fire protection devices shall comply with the speci-
fications of the Uniform Fire Code. Plans for such
systems shall be submitted to the Fire Department and
shall be subject to approval by the Department of Fire and
Public Works.

B. TO BE COMPLETED PRIOR TO FINAL INSPECTION:
1. Hamilton Avenue shall be improved to the center line of
such right-of-way. Said improvement shall include
curbs, gutters, sidewalks, paving, street trees, street
lights, street signs, street drainage, and sewer and water
main extensions in full compliance with the City of
Huntington Beach street standards and requirements.
GENERAL:
1. The flood control channel shall be fenced to flood Control
District standards and City standards.
2. Landscaping and irrigation shall be installed by
applicant to be approved by the Department of Public Works
and Planning Department. A document shall be filed
with the City agreeing to maintain all landscaping
along arterial highways.
3. All building spoils should be disposed of at an
offsite facility equipped to handle them.
4. Insulation of the project should be as stipulated by the
applicant in his description form.
In its approval action, the Board of Zoning Adjustments
considered the following issues relating to the conceptual
plan
Traffic circulation and drives
Parking layout
Lot area
Lot width and lot depth
Type of use and its relation to property and improvements
in the immediate vicinity
Past administrative action regarding this property
The Department of Building and Community Development will
perform a comprehensive plan check relating to all ordinance
code requirements upon submittal of your completed structural
drawings.
Please be advised that the Board of Zoning Adjustments
reviews the conceptual plan as a basic request for entitlement
of the use applied for in relation to the vicinity in which
it is proposed. The conceptual plan should not be construed
as a precise plan reflecting conformance to all ordinance

To permit the construction of two five unit apartment buildings
pursuant to S.9202.3.1.3 of the Huntington Beach Ordinance Code
located on the north side of Holt Street, approximately 180 ft.
west of Beach Blvd. in an R-3 medium high density residential
district.
Mr. Rex Hoover, representing the applicant, was present.
The Chairman opened the public hearing.
The Chairman informed the Board that the Environmental Review
Board granted Exemption Declaration No. 74-115 September 3, 1974
with the following additional information:
1.
The applicant should provide at least one -for -one replacement
of trees removed by the proposed project.
2.
The plan and design of the project should be constructed in
full compliance with Articles 916 and 932 of the Huntington
Beach Ordinance Code.
3.
If the developer proposes to provide air conditioning, the
insulation in ceilings and exterior walls should be a minimum
of R-19 and R-11, respectively. If no air conditioning is
to be provided, the insulation in ceilings and exterior walls
should be a minimum of R-13 and R-7 respectively.
4.
All building spoils, such as unusable lumber, wire, pipe,
and other surplus or unusable material, should be disposed of
at an offsite facility equipped to handle them.
5.
Natural gas and electricity should be stubbed in at the locations
of clothes dryers, and natural gas only should be stubbed in
at the locations of cooking facilities, water heaters, and
central heating units.

pursuant to 5.9231.6 of the Huntington Beach Ordinance Code
located on the west side of llth Street, approximately
100 feet north of Walnut Street, in an R-4, high density
residential district.
Mr. Rex Hoover, representing the applicant, was present.
The Chairman informed the Board that the Environmental Review
Board granted Exemption Declaration No. 74-119 on August 27,
1974 with the following additional information:
1. A soils engineer and/or geologist familiar with local
seismic conditions should be engaged to indicate the
G-factorsidue to earth movement at this location.
2. A structural engineer should be engaged to compile
calculations for footings and structural members of
the facility to withstand these G-factors. .

CONDITIONAL EXCEPTION NO. 74-50 (Continued from 8/28/74)
Applicant: A & E Melven Genser Outdoor
To permit the construction of a non -conforming identification sign
which is not affixed to a masonry wall at the entrance street and
has raised letters in excess of the 18" height limitation, in lieu
of S.9764.1.1 and S.9764.1.4 of the Huntington Beach Ordinance Code,
located at the corner of 17th Street and Aqua Street, in an R1-0,
low density, residential district combined with oil production.

Mr. Ray Dinde, representing the applicant, was present.
The Chairman opened the public hearing.
The Chairman informed the Board that this application is a
categorical exemption,lclass 5, California Environmental Quality
Act, 1970.
Mr. Dinde addressed the Board and stated his justification as
being that in 1971 the applicant submitted drawings to the Planning
Commission of their intent to erect the subject sign and that the
Planning Commission at that time approved the sign. He further
stated that the entire development was designed with the proposed
sign in mind. He felt that if the sign would have to be relocated
it would necessitate the removal of several trees.
Mr. Spencer felt that the sign itself and the location of the sign
would not be hazardous to traffic or pedestrian traffic.
Mr. Crosby felt that a hardship existed, that being, should it
be necessary to relocate the sign, the existing trees would
have to be removed.
Mr. Eadie felt that the size of the sign is too large, and further
felt that the sign could be reduced in size. The applicant agreed
to reduce the letters themselves, and the sign to a smaller scale
and proposed a continuance to allow him time to submit a rendering
depicting precise copy and size of the proposed sign.
As there were no further parties present to speak in favor of or
opposition to Conditional Exception No. 74-50, the Chairman
closed the public hearing.

To permit the addition of two drive -up islands to an existing
bank, pursuant to Section 9430.5 of the Huntington Beach
Ordinance Code located on the south side of Edinger Avenue,
approximately 280 feet west of the centerline of Beach Boulevard,
in a C-2, community business, district.
Mr. Robert E. Faxon, the applicant, and Mr. Higgley, Manager
of the Bank, were present.
The Chairman informed the Board that this application is a
categorical exemption, class 3, California Environmental Quality
Act, 1970.
Mr. Faxon outlined his proposal to the Board.
It was the consensus of the Board that the plan was within
ordinance code requirements.
Circulation was discussed. Emergency vehicle access was
discussed between the applicant and Captain Hosmer of the
Fire Department.
It was the consensus of the Board to leave the jurisdiction
of the traffic control devices to the Fire Department.
The Board informed the applicant that the proposed canopies
must be compatible in architectural design with that of the
existing bank.
