Olson, Inc. To permit the consolidation of two legal parcels of land into one parcel pursuant to S. 9811.3 of the Huntington Beach Ordinance Code located on the west side of Brookhurst Street, approximately 742 ft. south of Garfield Avenue in a C-2, Community Business District. In Conjunction With: ADMINISTRATIVE REVIEW NO. 74-110 (Continued from August 28, 1974) To permit the expansion of an existing commercial building pursuant to S. 9430.1 of the Huntington Beach Ordinance Code. The Chairman informed the Board that the Environmental Review Board had granted this application Exemption Declaration No. 74-102 on July 30, 1974. He further informed the Board that the applicant has two additional applications coming before the Board on September 25, 1974; in view of the fact that all of the applications are "in conjunction," he recommended a one -week continuance on the two presently before the Board. Board of Zoning Adjustments Wednesday, September 11, 1974 Page 2 DIVISION OF LAND NO. 74-29 (Continued from August 28, 1974) Applicant: Jerry L. Heideman To permit the division of one legal parcel of land into two parcels into two parcels pursuant to S. 9811.3 of the Huntington Beach Ordinance Code located on the southwest corner of McFadden Avenue and Product Lane in a 100-M1-A-20,000 Restricted Manufacturing District. In Conjunction With: ADMINISTRATIVE REVIEW NO. 74-118 (Continued from August 28, 1974) To permit the construction of an industrial building pursuant to S. 9511 of the Huntington Beach Ordinance Code. The Chairman informed the Board that this application was within the area covered by Environmental Impact Report No. 73-16 which was approved by the City Council on March 18, 1974. The Chairman further informed the Board that the applicant had requested a two -week continuance in order to allow time for necessary revisions of the plot plan; the Board concurred with the applicant's request. ON MOTION BY CROSBY AND SECOND BY SPENCER, DIVISION OF LAND NO. 74-29 AND ADMINISTRATIVE REVIEW NO. 74-118 WERE CONTINUED TO SEPTEMBER 25, 1974, BY THE FOLLOWING VOTE: AYES: Eadie, Crosby, Spencer NOES: None ABSENT: None USE PERMIT NO. 74-33 (Continued from August 28, 1974) Applicant: Mr. and Mrs. L. Carl Wieland To permit the construction of a .six unit apartment building by partially converting an existing residence with a nonconforming yard area pursuant to S. 9320 (apartment standards) and S. 9719 of the Huntington Beach Ordinance Code (Alterations to buildings having nonconforming yards). Property is located on the south side of Pearce Street, approximately 443 ft. east of Bolsa Chica Street in an R2, Medium Density Residential District. The Chairman informed the Board that the Environmental Review Board had granted this application Exemption Declaration No. 74-109 on July 30, 1974. The applicant, Mr. Carl Wieland, was present; also present was the applicant's architect, Mrs. Doris Martinez, who addressed the Board and presented an overview of the revised plot plan for the project. The Chairman opened the public hearing. The Chairman expressed the Board's desire for additional landscaping, and stated the need for a change in the configuration of the driveway in order to allow for same. Mrs. Martinez concurred and stated that this would be possible. BZA 9/11/74 F� Minutes: H.B. Board of Zoning Adjustments Wednesday, September 111 1974 Page 3 Pat Spencer questioned whether the driveway, being less than the 25 ft. width required by Fire Ordinance, would meet with Fire Department approval. Captain Vanderlaan, representing the Fire Department stated that the 20 ft. width would be acceptable, however, it would be necessary for "No Parking" signs to be posted. There being no parties present to speak in favor of, or opposition to Use Permit No. 74-33, the Chairman closed the public hearing. Conditions of Approval were discussed. ON MOTION BY EADIE AND SECOND BY CROSBY, USE PERMIT NO. 74-33 WAS APPROVED WITH THE FOLLOWING CONDITIONS AND FINDINGS, BY THE FOLLOWING VOTE: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The revised conceptual plot plan as amended, received September 9, 1974, shall be the approved layout, subject to the modifications described herein. a. Modification to driveway entrance reflective of the approved conceptual plan as amended. b. Five foot landscaped buffer on the westerly property line, extending fifteen (15) feet in length. A plan delineating said modifications shall be submitted to the Secretary of the Board. If such plan complies with the modifications outlined by the Board, said plan shall be approved and made a permanent part of the administrative file. 2. The following plan shall be submitted to the Secretary of the Board: landscape and irrigation plan. 3. Soil and compaction reports shall be submitted by a certified soils engineer. Said report shall be submitted to the Department of Building and Community Development and shall be subject to approval by that Department. 4. Fire protection systems, including automatic sprinkler systems, fire hydrants, fire alarms, and any required fire protection devices shall comply with the specifications of the Uniform Fire Code. Plans for such systems shall be submitted to the Fire Department, and shall be subject to approval by the Departments of Fire and Public Works. B. TO BE COMPLETED PRIOR TO FINAL INSPECTION: Pearce Street shall be improved to the center line of such right-of-way. Said improvement shall include curbs, gutters, sidewalks, paving, street trees, street lights, street signs, street drainage, and sewer and water main extensions in full compliance with the City of Huntington Beach street standards and requirements. The establishment, maintenance, and operation of the use will not be detrimental to: a. The general welfare of persons residing or working in the vicinity. b. Property and improvements to the vicinity of such use or building. 2. The granting of a Use Permit will not adversely affect the Master Plan of the City of Huntington Beach. 3. The proposal is consistent with the City's policy plan. AYES: Eadie, Crosby, Spencer NOES: None ABSENT: None CONDITIONAL EXCEPTION NO. 74-50 (Continued from September 4, 1974) Applicant: A & E. Melven Genser Outdoor To permit the construction of a nonconforming identification sign which is not affixed to a masonry wall at the entrance street in lieu of S. 9764.1.1 of the Huntington Beach Ordinance Code located at the corner of 17th Street and Aqua Street, in an Rl-O, Low Density Residential District Combined with Oil Production. The Chairman informed the Board that this application is a Categorical Exemption, Class 5, California Environmental Quality Act, 1970. Mr. Raymond L. Dendy, representing the A.J. Hall Corporation, was present. The Chairman opened the public hearing. Pat Spencer expressed the opinion that the sign was too large, particularly in view of the fact that its purpose was primarily for identification and and location, rather than advertising. He further stated that the scaling down of the sign need not mean cutting the 18" size of the letters. The Board concurred with this opinion. Discussion followed between the Board and the applicant as to the avail- able alternatives: the applicant submitting a scaled -down plan, or the Board approving the present plan with the condition that it be scaled down. The applicant expressed preference for the latter. There being no parties present to speak in favor of, or opposition to, Conditional Exception No. 74-50, the Chairman closed the public hearing. ON MOTION BY EADIE AND SECOND BY CROSBY, CONDITIONAL EXCEPTION NO. 74-50 WAS APPROVED WITH THE FOLLOWING CONDITION, BY THE FOLLOWING VOTE: All dimensions typified on the sign plan submitted to the Board and received September 11, 1974, shall be reduced in scale by one-third, i.e., length to be reduced from 21 feet to 14 feet, etc. AYES: Eadie, Crosby, Spencer NOES: None ABSENT: None CONDITIONAL EXCEPTION NO. 74-52 Applicant: Covington Brothers To permit the inclusion of common drives between properties within a four-plex development (Tentative Tract 8698), thus reducing the minimum turning radius required (25 ft.) per lot in lieu of S. 9166.4 of the Huntington Beach Ordinance Code located on the north side of Heil, approximately 700 ft. west of Bolsa Chica Street in an R2, Medium Den.5ity Residential District. The Chairman informed the Board that Environmental Review Board action was not necessary on this application. He further informed the Board that a determination had been made by the Planning Department to the effect that a Conditional Exception is not necessary for the circum- stances, therefore, the application is being withdrawn at the request of the Planning Department. The Board concurred with this determination. ON MOTION BY CROSBY AND SECOND BY SPENCER, CONDITIONAL EXCEPTION NO. 74-52 WAS WITHDRAWN BY THE FOLLOWING VOTE: AYES: Eadie, Crosby, Spencer NOES: None ABSENT: None ADMINISTRATIVE REVIEW NO. 74-143 Applicant: Patscheck/Veiga Construction Company To permit the construction of a professional office building pursuant to S. 9411.2 of the Huntington Beach Ordinance Code located on the east side of Brookhurst Street, approximately 220 feet north of Atlanta Avenue in a C2, Community Business District. The Chairman informed the Board that final action by the Environmental Review Board on this application is pending; he, therefore, recommended a one week continuance. The Board concurred. ON MOTION BY CROSBY AND SECOND BY SPENCER, ADMINISTRATIVE REVIEW NO. 74-143 WAS CONTINUED TO SEPTEMBER 18, 1974, BY THE FOLLOWING VOTE: BZA 9/11/74 Minutes: H.B. Board of Zoning Adjustments Wednesday, September 11, 1974 Page 6 AYES: Eadie, Spencer, Crosby NOES: None ABSENT: None ADMINISTRATIVE REVIEW NO. 74-144 Applicant: David E. Elliott To permit the construction of a modular building pursuant to S. 9430.4 of the Huntington Beach Ordinance Code, located on the south side of Ellis Avenue, approximately 500 ft. east of Beach Blvd. in a C4, Highway Commercial District. The Chairman informed the Board that the Environmental Review Board granted this application Exemption Declaration No. 74-114 on August 27, 1974. The applicant, Mr. David Elliott, was present. Dave Eadie pointed out to Mr. Elliott the code requirements regarding a 10 ft. interior side yard setback. The applicant questioned the possibility of obtaining a variance; Mr. Eadie replied that the present application could be conditionally approved, and that the applicant could apply for a deviance from the code at a later date. Conditions of approval were discussed. ON MOTION BY CROSBY AND SECOND BY SPENCER, ADMINISTRATIVE REVIEW NO. 74-144 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan received August 29, 1974 shall be the approved layout. For the applicant's information, all applicable development standards shall be complied with, including the mandatory interior side yard setback provision. 2. Soil reports as required by the Building Department and the Department of Public Works shall be submitted to the City prior to issuance of building permits. 3. All utilities shall be installed underground at the time of development. 4. Fire alarm system conduit and appurtenances shall be installed at locations and to specifications provided by the Fire Department at the time of initial development. 5. If not precluded by the requirements for light, air, and venti- lation, the easterly wall of the proposed structure shall be a solid masonry type of construction, for the purpose of sound attenuation. 1 11 BZA 9/11/74 1 Minutes: H.B. TO BE COMPLETED PRIOR TO FINAL INSPECTION: Ellis shall be improved to the centerline of such right-of-way. Said improvement shall include curbs, gutters, sidewalks, paving, street trees, street lights, street signs, street drainage, and sewer and water main extensions in full compliance with the City of Huntington Beach street standards and requirements. Buck To permit the construction of a professional office building pursuant to S. 9401 of the Huntington Beach Ordinance Code, located at the southeast corner of Main Street and Huntington Avenue in an R5, Office Professional District. The Chairman informed the Board that the Environmental Review Board had tabled Exemption Declaration action on this application on September 10, 1974, in order to allow the applicant time to meet with the Board of Zoning Adjustments to discuss revisions in plot plan layout and design. In view thereof, the Chairman recommended a one -week continuance. The Board concurred. ON MOTION BY CROSBY AND SECOND BY SPENCER, ADMINISTRATIVE REVIEW NO. 74-145 WAS CONTINUED TO SEPTEMBER 18, 1974,BY THE FOLLOWING VOTE: AYES: Eadie, Spencer, Crosby NOES: None ABSENT: None MISCELLANEOUS: ADMINISTRATIVE REVIEW NO. 74-127 Applicant: Leonard Lindborg To permit the construction of a six -unit apartment building, pursuant to S. 9231.E of the Huntington Beach Ordinance Code located on the east side of Ninth Street, approximately 87 feet south of Orange Avenue, in an R4, High Density Residential District. BZA 9/11/74 Minutes: H.B. Board of Zoning 'Adjustments Wednesday, September 11, 1974 Page 8 The Chairman informed the Board that this application erroneously received Conditional Approval by the Board of Zoning Adjustments on September 4, 1974. It was subsequently noted that the Environmental Review status on the application was incomplete. In view thereof, the Chairman recommended a motion to rescind the approval and an indefinite continuance pending final Exemption Declaration determination. ON MOTION BY EADIE AND SECOND BY CROSBY, A MONUMENT IDENTIFICATION SIGN FOR THE COAST CONTACT LENS COMPANY WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: 1. The precise copy and proper building materials should be as per the plan received by the Board on September 11, 1974. 2. The building materials and architecture shall be consistent with the main building. 3. This plan has received conceptual approval from the Board and must comply with all Ordinance Code requirements. Further, you are encouraged to meet with Ordinance Code requirements as expeditiously as possible through the Department of Building and Community Development.
