COMMISSIONERS PRESENT: Bazil, Higgins, Kerins, Boyle, Finley Commissioner Porter arrived at 7:10 P.M. COMMISSIONERS ABSENT: Geiger NOTE: A TAPE RECORDING OF THIS MEETING IS ON FILE IN THE PLANNING DEPARTMENT OFFICE. Chairman Kerins introduced and welcomed Commissioner Ruth Finley to the Planning Commission. Commissioner Finley was appointed to serve on the Planning Commission by the City Council on September 9, 1974, to serve until June 30, 1976, to fill the unexpired term of Katherine Wallin. CONSENT CALENDAR ON MOTION BY HIGGINS AND SECOND BY BAZIL THE FOLLOWING ITEMS WERE APPROVED AS RECOMMENDED BY THE FOLLOWING VOTE: Minutes: The Minutes of August 20, 1974 and September 4, 1974 were approved as transcribed and mailed. TENTATIVE TRACT NO. 5189 (Cont. from 7/16/74) Subdivider: Robert Stellrecht Tentative Tract No. 5189 was continued, with the consent of the applicant, to November 19, 1974. TENTATIVE TRACT 8687 & CONDITIONAL USE PERMIT NO. 74-10 Applicant: Graziadio Development Co. Tentative Tract 8687 and Conditional Use Permit No. 74-10 were continued, with the consent of the applicant, to October 15, 1974. Planning Commission Tuesday, September 17, 1974 Page 2 REGULAR AGENDA ITEMS SEISMIC -SAFETY ELEMENT OF THE GENERAL PLAN Monica Florian.gave a brief overview of the work that has been done in preparation of the Seismic -Safety Element. Commissioner Porter arrived at 7:10 P.M. Staff indicated to Commission that an Addendum to the Environmental Impact Report was handed out for their review prior to Commission meeting. It was the consensus of the Commission that a review should be made of the Environmental Impact Report and Addendum before action should be taken on the Seismic -Safety Element of the General Plan. A - vugraph of map was shown as well as aerial slides of -the -property described above.. The Chairman opened the public hearing... Ed Selich addressed the Commission and gave a brief history of the zoning of,.the property. There was a discussion on changing the General Plan at which time action could be taken on changing the zone. It was noted that under the new state law when there is a change to the Master Plan of the City it can only be done three times a year. A MOTION WAS MADE BY BAZIL AND SECONDED BY HIGGINS TO APPROVE ZONE CASE NO. 74-4. VOTE: AYES: Bazil, Higgins, Kerins, Boyle, Porter NOES: None ABSENT: Geiger ABSTAIN: Finley THE MOTION PASSED. Deputy City Attorney John O'Connor addressed the,,Commission and discussed some of the procedures that must be followed.in changing the zoning on property that is not in conformance with the present General Plan designation. A MOTION WAS MADE BY BAZIL AND SECONDED BY PORTER TO RECONSIDER ACTION ON ZONE CASE NO. 74-4. VOTE: AYES: Bazil, Higgins, Kerins, Boyle, Porter NOES: None ABSENT: Geiger ABSTAIN: Finley THE MOTION PASSED. ON MOTION BY BAZIL AND SECOND BY KERINS ZONE CASE NO. 74-4 WAS CONTINUED TO DECEMBER 3, 1974,-PENDING APPROVAL OF MASTER PLAN, WITH CONCURRENCE OF APPLICANT, BY THE FOLLOWING VOTE: AYES: Bazil, Higgins, Kerins, Boyle, Porter NOES: None ABSENT: Geiger ABSTAIN: Finley ZONE CASE NO.. 74-13 Applicant: Michael J_ Major Zone Case No. 74-13 is a request for a change of zone from C4, Highway Commercial, to R3, Medium High Density Residential District, located on the east side of Beach Boulvard on Constantine Drive. Planning Commission Tuesday, September 17, 1974 Page 4 Vugraph and aerial slides of the property were shown and it was noted that this property abuts that described in Zone Case No. 74-4. Commissioner Bazil advised the Commission that he would abstain on this hearing. Chairman Kerins opened the public hearing. Mr. Michael Major addressed the Commission and discussed his plans for four four-plexes. Commissioner Porter discussed the stables which are in existence on adjoining property. Mr. Major stated that the stables would be removed in March. Mr. -"Potter stated that this was correct. The public hearing was closed. ON MOTION BY BOYLE AND SECOND BY PORTER ZONE CASE NO. 74-13 WAS CONTINUED TO DECEMBER 3, 1974 MEETING, WITH CONCURRENCE OF THE APPLICANT, AND STAFF WAS DIRECTED TO INCLUDE THIS PROPERTY IN PHASE 1 LAND USE ELEMENT, BY THE FOLLOWING VOTE: AYES: Higgins, Kerins, Boyle, Porter NOES: None ABLENT: Geiger ABSTAIN: Finley, Bazil Commissioner Porter requested that the Minutes reflect the direction that the Environmental Review Board assess the existing horse stables adjacent to the subject property and their possible effect on such proposal. ZONE CASE NO. 74-10 (Continued from August 20, 1974) Applicant: Jerry J._Galich__ Zone Case No. 74-10 is a request for a change of zone from RA-O, Residential Agriculture District, to Ml, Light Industrial. The applicant proposes to construct two industrial buildings on the subject property. Mr. Ed Selich addressed the Commission and gave a brief background on the history of the property's zoning. Vugraphs and slides of the area were shown. The public hearing was reopened. Commission discussion followed. Commissioner Porter indicated that no decisions have been made yet on alignment of Gothard Street. It was noted by the Commission that the Land Use Element is being postponed until September 24, 1974, and if applicant concurred they felt a continuance to October 1, 1974 would be the preferred action. ON MOTION BY BOYLE AND SECOND BY HIGGINS ZONE CASE NO. 74-10 WAS CONTINUED, WITH CONCURRENCE OF APPLICANT, TO OCTOBER 1, 1974, BY THE FOLLOWING VOTE: AYES: Bazil, Higgins, Kerins, Boyle, Porter NOES: None ABSENT: Geiger ABSTAIN: Finley ZONE CASE NO. 74-11 (Continued from August 20, 1974) Applicant: Charles Hermansen Zone Case No. 74�11 is a request for a change of zone from RA-0, Residential Agriculture District, to Ml, Light Industrial, located on the north side of Garfield Street between Crystal and Stewart. The applicant proposes to construct a plumbing shop and storage yard. Vugraphs and slides of the area were shown. The Chairman opened the public hearing. Mr. Charles Hermansen addressed the Commission and stated that he would concur with Commission's recommendation on Zone Case No. 74-10 which is adjoining property. The public hearing was closed. ON MOTION BY BOYLE AND SECOND BY PORTER ZONE CASE NO. 74-11 WAS CONTINUED TO OCTOBER 1, 1974, WITH CONCURRENCE OF APPLICANT, BY THE FOLLOWING VOTE: AYES: Bazil, Higgins, Kerins, Boyle, Porter NOES: None ABSENT: Geiger ABSTAIN: Finley CONDITIONAL EXCEPTION NO. 74-43 - APPEAL Applicant: E. L. Anderson Appellant: A. P. Miller Conditional Exception No. 74-43 is a request to allow patio encroachment into side yard setback located at 317 Adams. The Appeal to the Board of Zoning Adjustments' decision on Conditional Exception No. 74-43 was continued from the September 4, 1974 Planning Commission meeting to facilitate readvertisement. Mrs. Anderson, applicant, addressed the Commission. She stated that the use of the patio was very important to Mr. Miller and that she, as his nurse, was in a position to know this. She further stated that the addition of the patio had enhanced the property. The public hearing was closed. The Commission viewed photographs of the property which Mrs. Anderson had handed out. There was a discussion on whether the encroachment could be termed an architectural treatment, and there was a discussion on the actual property line in relation to the fence. It was the consensus of the Commission that a site check for property line should be made before action could be taken. ON MOTION BY PORTER AND SECOND BY BAZIL APPEAL TO CONDITIONAL EXCEPTION NO. 74-43 WAS CONTINUED TO OCTOBER 1, 1974 BY THE FOLLOWING VOTE: AYES: Bazil, Higgins, Kerins, Finley, Boyle, Porter NOES: None ABSENT: Geiger TENTATIVE TRACT NO. 6948 Subdivider: Donald W. Shaw Tentative Tract Map 6948, filed on July 30, 1974 is a request to permit the subdivision of approximately 36 acres of land into a 39 lot industrial subdivision. The property is located at the northwest intersection of Graham and McFadden. Aerial slides and vugraphs of the map were shown. Commission discussed the suggested conditions of approval, the walkways, the screening wall, drainage. ON MOTION BY BOYLE AND SECOND BY KERINS TENTATIVE TRACT NO. 6948 WAS APPROVED WITH THE FOLLOWING CONDITIONS BY THE FOLLOWING VOTE: 1. Tentative Map received August 28, 1974 shall be the approved layout. 2. A determination on the deletion of McFadden Avenue from the Master Plan of arterial streets and highways on that portion between Graham Street and Bolsa Chica shall be made prior to the recordation of a final map on this subdivision. 1 Ll Minutes: H.B. Planning Commission Tuesday, September 17, 1974 Page 7 3. All required setbacks shall be measured from the property line and/or easement line whichever is greater. 4. All vehicular access rights along Graham Street shall be dedicated to the City of Huntington Beach except at street intersections. 5. A, B, and C Streets shall be constructed having a 45 ft. street section. A 5 ft. easement shall be provided on both sides of such streets for utilities and sidewalks when needed. 6. Graham Street shall be constructed at the existing 84 ft. right-of-way having no sidewalk on the west side of the street section. 7. All areas within the standard street section which have been reserved for future walkway purposes shall be flat and planted with a turf grass to accomplish pedestrian circulation. 8. Drainage for the subdivision shall be approved by the Department of Public Works prior to recordation of a final map. The drainage system shall be designed to provide for siltation and erosion control both during and after con- struction of the industrial park. 9. A landscape plan depicting the required landscape buffer between the proposed industrial development and existing residential properties, which is to the west of lots 1 through 5 of Tract 6948, shall be submitted to the Planning Department for approval prior to development of lots 1 through 5 10. Soils and compaction reports shall be submitted to the Department of Building and Community Development and Department of Public Works prior to the issuance of building permits. Such report shall be submitted by qualified soils engineers. 11. A 6 ft. masonry wall of either slumpstone or split face material measured from the highest grade on either side of said wall shall be constructed prior to any industrial development of lots 1 through 5. The total length of said wall shall be constructed as one project. 12. Plans for the 6 to 8 ft. sidewalk, adjacent landscaping and treatment for the termination of McFadden within the existing right-of-way shall be submitted to the Department of Public Works and Planning Department for approval prior to recordation of a final map on the subdivision. Planning Commission Tuesday, September 17, 1974 Page 8 WRITTEN COMMUNICATIONS: TOWNLOT DEVELOPMENT REGULATIONS Dave Eadie presented ground and aerial slides and vugraphs of map of, townlot area, exhibits B, C, D, E, F, G, & H were shown on vugraph. Exhibit A consisted of analysis information which addressed development regulations applicable to the townlot that are significant to the design of a project. Parking, drives, set- backs, open space and lot coverage were discussed. COMMISSIONERS' COMMENTS Commissioner Finley Stated that she felt the availability of additional staff reports for the general public at Commission meetings was a good idea and commended staff for having such reports available. Commissioner Bazil inquired when Code Amendment 74-15, 'which deals with alterations of single family residences having non -conforming yards, would be coming before the Commission for review. John Cope informed him that Code Amendment 74-15 had been advertised for the October 1, 1974 meeting. Commissioner Porter inquired why the Board of Zoning Adjustments had been continuing so many items on their agenda. Dave Eadie informed Commissioner Porter that many items that had been continued -in the past were a result of a deficiency in the Code which requires that certain items be brought before the Board within a specified period of time even though environmental documentation has not been completed. Mr. Eadie further indicated that with the "Time of Hearing Revision" Code Amendment, this conflict will be alleviated. Chairman Kerins inquired of staff as to the width,of the access driveway for the new commercial shopping center on the southeast corner of Magnolia and Adams and further inquired as to why the parking spaces were not striped. Mr. Eadie indicated that he did not have any information on the center at this time but would research it and report back to the Commission. 1 Chairman Kerins informed the Commission that Mr. Frank Buccella addressed the City Council and had requested reconsideration of the approved land use Alternative 3A for the Sunset Heights study area. Chairman Kerins indicated that the City Council did in fact reconsider and approve Alternative 3B. Chairman Kerins appointed Commissioner Finley to the Subdivision Committee. I 1 Mintues: H.B.
