BOARD MEMBERS PRESENT: Pat Spencer John Cope Bruce Crosby OTHER CITY DEPARTMENTS Captain Vanderlaan, REPRESENTED: Fire Department MINUTES: ON MOTION BY SPENCER AND SECOND BY CROSBY, MINUTES OF SEPTEMBER 4, 1974 WERE APPROVED AS TRANSCRIBED BY THE FOLLOWING VOTE: AYES: Spencer, Crosby NOES: None ABSENT: None ABSTAIN: Cope REGULAR AGENDA ITEMS: USE PERMIT NO. 74-46 (Continued from 9-18-74) Applicant: Rick Annigoni To permit the construction of a five-(5) unit apartment complex, pursuant to S.9162.3.1 of the Huntington Beach Ordinance Code, located on the west side of Delaware Avenue, approximately 84 feet from the centerline of Frankfort Street, in an R-2, Medium Density Residential District. John Cope informed the Board that this application is covered by Exemption Declaration No. 74-101 granted to Zone Change No. 74-12 on July 23, 1974. The Vice -Chairman re -opened the Public Hearing. The applicant, Rick Annigoni, was present and addressed the Board, presenting a brief overview of the revised plans for the project. Colonel Russell B. Weinemer was present and expressed his approval of the revised plan. The Vice Chairman closed the Public Hearing. The Board reviewed the plan and determined that there were no deficiencies in same and that it complied with City Ordinance requirements. The Board further reviewed the Exemption Decla- ration granted to the project and noted that there were no re- commendations from the Environmental Review Board. ON MOTION BY CROSBY AND SECOND BY SPENCER, EXEMPTION DECLARATION NO. 74-101 WAS ADOPTED BY THE BOARD OF ZONING ADJUSTMENTS BY THE FOLLOWING VOTE: AYES: SPENCER, COPE, CROSBY NOES: NONE ABSENT: NONE ON MOTION BY CROSBY AND SECOND BY SPENCER, USE PERMIT N0. 74-46 WAS APPROVED WITH THE FOLLOWING CONDITIONS AND FINDINGS, BY THE FOLLOWING VOTE: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan and elevations received Sep- tember 23, 1974 shall be the approved layout. 2. In accordance with the City's Master Plan of Streets and Alleys, an additional 2h feet of right-of-way on the alley shall be dedicated. 3. Soil and compaction reports shall be submitted by a certified soils engineer. Said report shall be sub- mitted to the Department of Building and Community Development and shall be subject to approval by that Department. 4. Fire protection and detection systems, including automatic sprinkler systems, standpipe systems, fire hydrants, fire alarm systems, and any other required,, fire protection and detection devices or systems shall comply with the specifications of the Huntington Beach Fire Code. TO BE COMPLETED PRIOR TO ISSUANCE & CERTIFICATE OF OCCUPANCY: Parcel Map (Division of Land No. 74-31) shall be recorded with the County Recorder's Office and a copy of such recorded map shall be filed with the Planning Department. FINDINGS: 1. The establishment, maintenance, and operation of -the use will not be detrimental to: .a. The general welfare of persons residing or working in the vicinity. b. Property and improvements to the vicinity of such use or building. 2. The granting of a Use Permit will not adversely affect the Master Plan of the City of Huntington Beach. 3. The proposal is consistent with the City's policy plan. 4. Reduction of the plan -from five units to four units allows more open space than required. Pitt To permit the construction of a carport, in lieu of a garage, pursuant to S.9106 of the Huntington Beach Ordinance Code, located at the northwest corner of Bushard,Street'and Greenwich Drive, in an R-1, Low Density Residential -District. John Cope informed the Board that this application is a Catego- rical Exemption, Class III, California Environmental Quality Act, 19 70 . He further informed the Board that the applicant had requested a one -week continuance in order to allow him additional time for revision of plans. The Board concurred with the applicant's request. Heidemann To permit the division of one legal parcel of land into two parcels, pursuant to S.9811.3 of the Huntington Beach Ordinance Code, located at the southwest corner of McFadden Avenue and Product Lane, in a 100-M1-A, 20,000 restricted manufacturing district. In conjunction with: ADMINISTRATIVE REVIEW NO. 74-118 (Continued from September 11, 1974) Applicant: Jeffy L. Heidemann To permit the construction of an industrial building, pursuant to Section 9511 of the Huntington Beach Ordinance Code, located at the southwest corner of McFadden Avenue and Product Lane in a 100- M1-A, 20,000 restricted manufacturing district. John Cope informed the Board that these applications are within the area covered by Environmental Impact Report No. 73-16 which was approved by the City Council on March 18, 1974. He further informed the Board that the applicant had requested a one -week continuance in order to allow time for further revision of plans and subsequent discussion with staff. The Board con- curred with the applicant's request. John Cope informed the Board that this application has been tabled by the Environmental Review Board pending submittal by the appli- cant of a supplementary hydrology and drainage study; he there- fore recommended a two -week continuance. John Cope informed the Board that this application is a.Catego- rical Exemption, Class I, California Environmental Quality Act, 1970. The Vice Chairman opened the Public Hearing. Mr. Melvin Sargent, representing the applicant,`was present and addressed the Board, presenting a brief overview of the proposed project. There being -no parties present to speak in favor of, or oppo- sition to the proposal, the Vice Chairman closed the Public Hearing. The Board discussed the project and determined that it was in compliance with code requirements. ON MOTION BY COPE AND SECOND BY CROSBY, PLOT PLAN AMENDMENT NO. 74-8 WAS APPROVED WITH THE FOLLOWING.CONDITIONS AND.FINDINGS, BY THE FOLLOWING VOTE: MINUTES: Huntington Beach Board of Zoning Adjustments Wednesday,'September 25, 1974 Page 6 A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan and elevations received August 22, 1974 shall be the approved layout. 2. All past Conditions of Approval for Area Variance No. 67-8 shall be fully complied with. FINDINGS: 1. The amendment as shown will not be detrimental to the general welfare of persons residing or working in the vicinity. 2. The use remains the same. 3. The amendment results in an approved plan and provides for additional storage area. AYES: SPENCER, COPE, CROSBY NOES: NONE ABSENT: NONE 1 CONDITIONAL EXCEPTION NO. 74-53 Applicant: Huntington Beach Congregation -of Jeho'yah's Witnesses To permit the construction of a 6 foot high fence within the front yard setback, in lieu of S.9614 of the Huntington Beach Ordinance Code, located on the north side of, Talbert, approxi- mately 75 feet west of Bell Circle, in an R-2, Medium Density Residential District. John Cope informed the Board that this application is a Categorical Exemption, Class I, California Environmental Quality Act, 1970. The Vice Chairman opened the Public Hearing. Melvin Sargent, representing the applicant, was present and addressed the Board, citing vandalism as the primary justifi- cation for the exception request. There being no parties present to speak in favor of, or opposition to the proposal, the Vice Chairman closed the Public Hearing. The Board discussed the proposal and the hardship as presented by the applicant. It was noted that the sign presently on the pre- mises would be obscured should the construction of the fence be permitted; the applicant's representative was questioned as, to where the sign would then be placed, however, Mr. Sargent was unable to respond definitively. 1 1� MINUTES: Huntington Beach Board of Zoning adjustments Wednesday, September 25, 1974 Page 7 John Cope expressed the opinion that the fence,would present the effect of a solid mass, which would be detrimental to the vista perspective; he further expressed the opinion that the applicant had not demonstrated sufficient hardship to warrant the request, in view of the fact that the problems of vandalism and security are not limited solely to this property. Pat Spencer and John Cope suggested alternative plans for the applicant's consideration; Pat Spencer recommended a conti- nuance in order to allow time for the applicant to consider the alternatives and to meet with staff regarding same. The applicant concurred. ON MOTION BY SPENCER AND SECOND BY COPE, CONDITIONAL EXCEPTION NO. 74-53 WAS CONTINUED TO OCTOBER 2, 1974 BY,THE FOLLOWING VOTE: AYES: SPENCER, COPE, CROSBY NOES: NONE ABSENT: NONE DIVISION OF LAND NO. 74-33 Applicant: Charles A. Johnson To permit the division of one legal parcel of -land into -four (4) parcels, pursuant to S.9811.3 of the Huntington Beach. Ordinance Code, located on the south side of Slater Avenue, approximately 333 feet west of the centerline of Hanau Lane, in an M-1,-.light industrial district. John Cope informed the Board that this application was granted Exemption Declaration No. 74-39 by.the*Environmental Review- Board'on May 7, 1974. He further informed the Board that several attempts have been made by the Planning Department staff to contact the applicant in order to request a proposed development plan from him; all attempts, however, have been negative in results. Pat Spencer recommended a two -week continuance in order to allow for further attempts to contact the applicant. ON MOTION BY SPENCER AND SECOND BY CROSBY, DIVISION OF LAND NO. 74-33 WAS CONTINUED TO OCTOBER.9, 1974, BY THE FOLLOWING VOTE: AYES: SPENCER, NOES: NONE ABSENT: NONE COPE, CROSBY MINUTES: Huntington Beach Board of Zoning Adjustments;,,_ Wednesday, September 25, 1974 Page 8 ADMINISTRATIVE REVIEW NO. 74-154 Applicant: Mechanized Science Seals, Inc. To permit the construction of an industrial building, pursuant to S.9511 of the Huntington Beach Ordinance Code, located at the southeast corner of Chemical Lane and McFadden Avenue, in a 100-M1-A, 20,000 restricted manufacturing district. John Cope informed the Board that this application is within the area covered by Environmental Impact Report No. 73-16 which was approved'by the City Council on March 18, 1974. Mr. George Whiting, representing the applicant, was present; also present was Mr. Nick Becker, project a4chitect.' Mr. Whiting addressed the'Board;.presenting_a brief overview of the proposal. The Board reviewed.the proposal, discussing the driveway turning radius and widths, sidewalks required, parking considerations to allow for turning facility in the loading area, and circulation. The Fire Department representative noted that the,circulation for the project was poor, and suggested eliminating parking spaces #3 and 44 in order to alleviate the problem... The appli- cant was. instructed to discuss.th'e driveway question,with the Department of Public Works. John Cope stated that the plan check indicates,no deficiencies other than in the area of screening wall requirements in the parking areas. ON MOTION BY COPE AND SECOND BY SPENCER, ADMINISTRATIVE REVIEW NO. 74-154 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING...PERMITS: 1. The conceptual plot plan and elevations.received Sep- tember 13, 1974 shall be the approved layout, subject to the modifications described herein•. a. Screening of the parking area. b. Improvement of the circulation of the loading door area. c. Provide a 27' turning radius for all driveways., d. Driveway widths shall be 24' with a 2'X. The top of the X shall be 2' minimum from the property line. The southerly driveway shall ,be :approved by the Department of Public Works. If such plan complies with the modifications outlined by the Board, said plan shall be approved and made a permanent part of the administrative .file. 2. The following plans shall be submitted to the Secretary of the Board. a. Landscape and irrigation plan complying,with Ar- ticle 979 of the Huntington,Beach Ordinance Code, and landscaping specifications on file'in the Department of Public Works. b. Rooftop mechanical equipment screening plan. Said plan shall indicate screening of all rooftop mechanical equipment and shall delineate the type of material proposed. -to screen said equipment. 3. Soil and compaction reports shall be submitted by a certified soils engineer. Said report shall' be'sub- mitted,to the Department of Building and Community 'Development and shall be subject to approval by that. Department. 4. Fire protection and detection systems,.including auto- maticesprinkler systems, standpipe systems, fire hy= drants, fire alarm systems, and any other required fire protection and detection devices or systems shall comply'with the specifications of .the Huntington Beach Fire Code.
