Applicant: Anthony Bartoli
To permit the division of one parcel of land into four parcels,
pursuant to S.9811.3 of the Huntington Beach Ordinance Code,
located on the northeast corner of Ellis Avenue and Huntington
Street, in an R-3, Mediur. High Density Residential District.
John Cope nformed the Board that this application was granted
Exemption Declaration No. 74-103 by the Environmental Review
Board on October 1, 1974; the Exemption Declaration included
five rec::,-nm.::!rc-!ations from the Environmental Review Board.
Mr. Don Baker of Valley Consultants represented the applicant
and presenl:•A a brief overview of the proposal. Mr. Baker stated
that the application was incorrect in that the request was to
permit the division of two parcels, rather then one, into four
parcels.
The Board discussed access to the property from Ellis Avenue,
as well as the fact that off-street parking woukd be necessary
due to Ellis being a bicycle trail.

FOR ANY PURPOSE:
1. This Division of Land shall not be effective until
a Covenant and Agreement furnished by the Huntington
Beach Planning Department is signed and recorded with '
the Orange County Recorder, agreeing to these Condi-
tions of Approval.
2. The tentative parcel map received by the Planning De-
partment on July 3, 1974 shall be the approved layout.
3. A parcel map shall be filed with, and approved by,
the Department of Public Works and recorded with the
Or,nnge County Recorder, prior to issuance of a Certi-
fi^ate of Occupancy.
4. A .;opy of the recorded parcel map and Covenant and

street drainage, and sewer and water main exten-
sions in full compliance with the City of Huntington
Beach street standards and requirements.

B. PRIOR TO THE ISSUANCE OF BUILDING PERMITS ON EACH PARCEL:
1. If the developer proposes to provide air condition-
ing, the insulation in ceilings and exterior walls
shall be a minimum of R-19 and R-11, respectively.
If no air conditioning is to be provided, the insu-
lation in the ceilings and exterior walls shall be
a minimum of R-13 and R-7 respectively.
2. Natural gas and electricity shall be stubbed in at the
location of clothes dryers, and natural gas only shall
be stubbed in at the locations of cooking facilities,
water heaters, and central heating units.
3. A soils engineer and/or geologist familiar with local
seismic conditions shall be engated to indicate the
g-factors due to earth movement for this location.
4. A structural engineer shall be engaged to compile
calculations for footings and structural members of
the facility to withstand these g-factors.
5. All building spoils, such as unusable lumber, wire,
pipe, and other surplus or unusable material, shall
be disposed of at an off --site facility equipped to
handle them.

John Cope informed the Board that this application is a
Categorical Exemption, Class I, California Environmental
Quality Act, 1970.
The Vice Chairman opened the Public Hearing.
The applicant, Warren Pitt, addressed the Board and presented
a brief overview of his revised plans. The applicant was
questioned rea_arding the 20 foot front yard setback on his
plans; it was determined that the tract was originally
approved with a 20 foot setback rather than the 22 foot

setback as presently required by code. The applicant was
further questioned regarding the cubic measurement of the
storage area, and was informed that a minimum of 400 cubic
feet is required; the applicant responded that the plan
would meet this requirement. The applicant was informed
that the inside of the carport area, including the ceiling,
would require complete finishing.
There being no parties present to speak for or against the
proposal, the Vice Chairman closed the Public Hearing.
Conditions of Approval were discussed.
ON'MOTION BY SPENCER AND SECOND BY CROSBY, USE PERMIT NO.
74-48 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CON-
DITIONS, BY THE FOLLOWING VOTE:

1. The establishment, maintenance, and operation of the

To permit the division of one legal parcel of land into two
parcels, pursuant to S.9811.3 of the Huntington Beach Ordi-
nance Code, located on the southwest corner of McFadden
Avenue and Product Lane, in a 100-M1-A, 20,000 Restricted
Manufacturing District.
John Cope informed the Board that this application is within
the area covered by Environmental Impact Report No. 73-16 which
was approved by the City Council on March 18, 1974.
The applicant, Jerry L. Heidemann, was present; also present
were Guy Heidemann and Mike Pontius.
Board discussion centered on the recordation of the parcel
map; applicant was informed that the reciprocal driveway
between parcels #1 and #2 would need to be specified on same.
Bruce Crosby stated that three prints of the parcel map should
be submitted t,; the Public Works Department for a plan check.

2. The following plans shall be submitted to the
Secretary of the Board:
a. Landscape and irrigation plan complying with
Article 979 of the Huntington Beach Ordinance
Code, and landscaping specifications on file
in the Department of Public Works.
b. Rooftop mechanical equipment screening plan.
Said plan shall indicate screening of all
rooftop mechanical equipment and shall
delineate the type of material proposed to
screen said equipment.
3. Soil and compaction reports shall be submitted by a
certified soils engineer. Said report shall be sub-
mitted to the Department of Building and Community
Development and shall be subject to approval by that
Department.
4. Fire protection and detection systems, including
automatic sprinkler systems, standpipe systems, fire
hydrants, fire alarm systems, and any other required
fire protection and detection devices or systems,
shall comply with the specifications of the Huntington
Beach Fire Code. Plans for such systems and devices
shall be subject to approval by the Fire Department
and Department of Public Works.

Ordinance Code, located on the north side of Talbert, approxi-
mately 75 feet west of Bell Circle, in an R-2, Medium Density
Residential District.

John Cope informed the Board that this application is a
Categorical Exemption, Class I, California Environmental
Quality Act, 1970.
The Vice Chairman re -opened the Public Hearing.
Present to represent the applicant were: Mr. L. Bell, Mr.
J. Gildenson, Mr. John Atrich, Mr. Mike McGorry, Mr. M.
Marriot, and Mr. M. Sargent.
Mr. Bell addressed the Board, stating that his organization
had discussed and -considered the alternative plans which had
been suggested by John Cope and Pat Spencer at the previous
hearing of this application, and that it was their consensus
that they should pursue the application for the Conditional
Exception due to the hardships previously cited, i.e. vul-
nerability of the property in the areas of vandalism, lia-
bility, and theft. He also stated that he did not feel a
wrought iron fence as requested would impair the vista of
the property, and presented photographs of other similar
fences to substantiate same.
There being no parties present to speak for or against the
proposal, the Vice Chairman closed the Public Hearing.
The Board again reviewed the alternatives as presented at the
previous hearing, and discussed the justifications for hard-
ship. John Cope re -state" ais previous opinion that the
applicant had not demonstrated sufficient hardship to
warrant the exception, and that the fence, as proposed would
present the effect of a solid mass, thus causing a detrimental
vista prespective. Bruce Crosby stated that the items cited
by the applicant as hardships were of the same nature as
those that can occur at any development, were not limited
solely to this property, and therefore did not substantiate
hardship. Pat Spencer stated that he could not recommend
approval of the request due to the fact that sufficient hard-
ship had not been demonstrated; however, he recommended appro-
val of the plan with modifications, i.e. additional landsca-
ping, and a 20 foot setback of the fence. Captain Vanderlaan,
representing the Fire Department, stated that the fence should
be secured by a chain and that no locking device should be
utilized.

ON MOTION BY SPENCER AND SECOND BY CROSBY, CONDITIONAL
EXCEPTION NO. 74-53 WAS APPROVED WITH THE FOLLOWING
FINDINGS AND CONDITION, BY THE FOLLOWING VOTE:
FINDINGS:
Because of special circumstances on the particular property
and the nature of the use, a protective fence is warranted
and needed, and the required setback of fifteen feet would
create an on -site parking problem.
CONDITION OF APPROVAL:
Applicant to provide a minimum six-foot landscape area across
the front with a decorative fence gate at points of ingress
and egress, said gate to set back 20 feet from the ultimate
right-of-way line. Gate to be secured by chain; no locking
device to be utilized.

PLOT PLAN AMENDMENT NO. 74-9
Applicant: Toups Corporation
To permit a revision to a1L proposed buildings within an
approved planned residential development, pursuant to
S.9811.4 of the Huntington Beach Ordinance Code. The
revision involves the replacement of the unit types with
completely redesigned units; the property is located on the
southwest corner of 17th Street and Garfield Street, in an
R-2, Medium Density Residential District.
John Cope informed the Board that this application is within
the area covered by Exemption Declaration No. 73-107, granted
to Tentative Tract No. 5642 on July 3, 1973.
The Vice Chairman opened the Public Hearing.
Representing the applicant was Mr. Pat Capp; also present was
Mr. Gary Grits, representing Presley of Southern California.
Mr. Capp addressed the Board and presented a brief overview
of the proposed revisions to the project.

PLOT PLAN AMENDMENT NO. 74-9 (Continued)
Mrs. Vivian Alvarez was present and requested a brief review
of the project; Mr. Capp explained that there were no major
revisions to the plan and that those proposed involved only
replacement of unit types.
There being no other parties present to speak for or against
the proposal, the Vice Chairman closed the Public Hearing.
The applicant's representative was informed that this appli-
cation must be referred to the Planning Commission in view
of the fact that approval for the project was granted by
that Board, therefore any revisions to same must be approved
by them.
ON MOTION BY SPENCER AND SECOND BY COPE, PLOT PLAN AMENDMENT
NO. 74-10 WAS REFERRED TO'THE PLANNING COMMISSION MEETING

John Cope informed the Board that this application is a
Categorical Exemption, Class I, California Environmental
Quality Act, 1970.
The Vice Chairman opened the Public Hearing.
The applicant, Rudolph Soto, addressed the Board and presented
a brief overview of his plan for a room addition to his home;
he further cited the irregular shape of his lot as justifi-
cation for hardship to substantiate his request for a Condi-
tional Exception.
There being no parties present to speak for or against the
proposal, the Vice Chairman closed the Public Hearing.

The Board discussed the plan and alternative methods to allow
the room addition without necessitating the encroachment into
the exterior side yard. The applicant was not receptive to
the alternative methods proposed by the Board. The Board
discussed the applicant's justification for hardship, and
concurred in that sufficient justification was non -existing.
ON MOTION BY COPE AND SECOND BY SPENCER, CONDITIONAL EXCEPTION
NO. 74-59 WAS DENIED, WITH THE FOLLOWING FINDINGS AND REASON,
BY THE FOLLOWING VOTE:
FINDINGS:
The property is on a larger than average R-1 lot, which allows
for at least two alternatives for an addition to the house;
therefore it is felt that sufficient hardship has not been
shown to warrant an exception to the side yard setback re-
quirement.
REASON FOR DENIAL:
The applicant failed to justify hardship.

John Cope informed the Board that this application is a
Categorical Exemption, Class I, California Environmental
Quality Act, 1970.

garding off-street parking requirements, questioning whether he
would be required to allocate the adjoining lot for parking,
and if so, would be later be allowed to build on that lot.
Pat Spencer responded that if the lot were designated for business
purposes, it would need to remain as such unless an alternative
were later provided. It was further noted that the parking allo-
cation need not necessarily be directly adjacent to the business,
but could be provided at a site within 150 feet from same.
Mr. Pasqualino further questioned whether it would be permissable
to park the business truck inside the building; Captain Vanderlaan,
representing the Fire Department, responded that a visit to the
location would be necessary in order to make a determination.

ADMINISTRATIVE REVIEW NO. 74-152
Applicant: American Savings & Loan Association
To permit the construction of an American Savings office,
pursuant to S.9430 of the Huntington Beach Ordinance Code,
located on the southwest corner of Edinger Avenue and Parkside
Lane, in A C-2, Community Business District.
John Cope informed the Board that this application was granted
Exemption Declaration No. 74-144 by the Environmental Review
Board on September 24, 1974.
Representing the applicant were Mr. Earl Bouillon and Mr.
Leroy Velasquez.
The Board reviewed the proposed plan and determined that it
was in conformance with landscaping, open space, and parking
requirements.
Bruce Crosby informed the applicant's representative that it
would be necessary to pay assessor's fees on the entire parcel,
rather than only on that portion of land being developed; he
further stated that a Division of Land permit would negate that
requirement. Mr. Bouillon stated that these fees might have
been previously paid as a result 3f the Administrative Review
application for the temporary building on the site; he further
stated that he would investigate the matter with the Public
Works Department.

the specifications of the Huntington Beach Fire Code.
Plans for such systems and devices shall be submitted
to the Fire Department and shall be subject to approval
by the Fire Department and Department of Public Works.
B. TO BE COMPLETED PRIOR TO FINAL INSPECTION:
Edinger Avenue and Parkside Lane shall be improved, including
sidewalks, street trees, street lights, street signs, street
drainage, and sewer and water main extensions in full com-
pliance with the City of Huntington Beach street standards
and requirements.

John Cope informed the Board that this application is a
Categorical Exemption, Class I, California Environmental
Quality Act, 1970.
The applicant, Mr. Carlos E. DeArcos, was present and deli-
neated the reasons for his request; he also stated that the
Edison Company required the installation of a power pole for
the utility line. Bruce Crosby responded that installation
of power poles is not in conformance with the Huntington
Beach Ordinance Code; the Board concurred that approval of
the overhead utility line would be conditional upon deletion
of the power pole.
