Buck To permit the construction of a professional office building pursuant to Section 9401 of the Huntington Beach Ordinance Code located on the southeast corner of Main Street and Huntington Avenue in an R-5, Office Professional District. The Chairman informed the Board that this application was continued by the Environmental Review Board at its meeting of October 8, 1974 pending receipt of supplementary information regarding a hydrology and drainage study. He therefore recommended a three-week continuance by this Board, pending Environmental Review determination. Johnson To permit the division of one legal parcel of land into four (4) parcels, pursuant to S.9811.3 of the Huntington Beach Ordinance Code located on the south side of Slater Avenue, approximately 333 feet west of the centerline of Hanau Lane, in an M-1, light industrial district. The Chairman informed the Board that this application is within the area covered by Exemption Declaration No. 74-39 granted to Division of Land No. 74-8 by the Environmental Review Board on May 7, 1974. The applicant, Charles A. Johnson, was present. The Board reviewed the plan with the applicant, pointing out that the division of land as submitted is not detrimental, however, the feasibility of subsequent development on the lots is doubtful; the applicant was advised that any future plans for development on the parcels would need to be reviewed by the Board for approval. The applicant was advised that the Public Works Department would require submittal of a precise plan of street alignment at the time of development; also, three copies of the parcel map must be submitted to that department for a plan check. Conditions of approval were discussed. ON MOTION BY CROSBY AND SECOND BY EADIE, EXEMPTION DECLARATION NO. 74-39 WAS ADOPTED BY THE BOARD OF ZONING ADJUSTMENTS, BY THE FOLLOWING VOTE: AYES: Eadie, Crosby, Lipps NOES: None ABSENT: None ON MOTION BY CROSBY AND SECOND BY EADIE, DIVISION OF LAND NO. 74-33 WAS APPROVED, WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: TO BE COMPLETED PRIOR TO USE OR OCCUPANCY OF SAID PARCELS FOR ANY PURPOSE: 1. This Division of Land shall not be effective until a Covenant and Agreement furnished by the Huntington Beach Planning Department is signed and recorded with the Orange County Recorder, agreeing to these Conditions of approval. 2. The tentative parcel map received by the Planning Department on September 13, 1974 shall be the approved layout. 3. A parcel map shall be filed with, and approved by, the Department of Public Works and recorded with the Orange County Recorder. Minutes: H.B. Speer Avenue and Slater Avenue shall be dedicated to City standards at the time said parcels are developed. 6. Prior to recordation of a parcel map, the applicant shall file in the Department of Public Works an agreement to offer to dedicate additional land on Speer Avenue for the construction of a knuckle at the terminus of Crab Lane and Speer Avenue. 7. The property shall participate in the local drainage assessment district at the time said parcels are developed. (Contact Department of Public Works for additional infor- mation.) In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: Lot area. Lot width and lot depth. Past administrative action regarding this property. Future development proposals. The Department of Building and Community Development will perform a comprehensive plan check relating to all ordinance code requirements upon submittal of your completed structural drawings. Please be advised that the Board of Zoning Adjustments reviews the conceptual plan as a basic request for entitlement of the use applied for in relation to the vicinity in which it is proposed. The conceptual plan should not be construed as a precise plan re- flecting conformance to all ordinance code requirements. Long To permit the establishment of a wholesale lumber yard, utilizing an existing building, pursuant to S.9530 of the Huntington Beach Ordinance Code located on the west side of Nichols Avenue, approximately 970 feet north of Slater Avenue, in an M-1 Light Industrial District. The Chairman informed the Board that this application was granted Exemption Declaration No. 74-139 on September 24, 1974 by the Environmental Review Board. Minutes: H.B. ON MOTION BY CROSBY AND SECOND BY LIPPS, ADMINISTRATIVE REVIEW NO. 74-151 WAS CONTINUED TO OCTOBER 23, 1974 BY THE FOLLOWING VOTE: AYES: Eadie, Crosby, Lipps NOES: None ABSENT: None CONDITIONAL EXCEPTION NO. 74-56 (Continued from 10/2/74) Applicant: W. Lee Brown / R. J. Zinngrabe To permit the elimination of a six-foot wall dividing commercial property from residential property, in lieu of'S.9730.25 of the Huntington Beach Ordinance Code located on the west side of Florida Avenue, approximately 600 feet north of Garfield Avenue in an R-5, Office Professional District. The Chairman informed the Board that this application is a Categorical Exemption, Class 5, California Environmental Quality Act, 1970. He further informed the Board that the applicant had requested a one -week continuance in order to allow for further justifica- tion of his request; the Board concurred with the applicant's request. ON MOTION BY CROSBY AND SECOND.BY LIPPS, CONDITIONAL EXCEPTION NO. 74-56 WAS CONTINUED TO OCTOBER 16, 1974 BY THE FOLLOWING VOTE: AYES: Eadie, Crosby, Lipps NOES: None ABSENT: None CONDITIONAL EXCEPTION NO. 74-60 Applicant: D'Ambra, Inc. To permit a reduction in the minimum open space requirement, in lieu of S.9103.3.11.3, as the result of a proposed 300 ft. room addition located on the south side of Silverhead Circle, approximately 300 ft. east of Collins, in an R-1, Single Family Residential District. The Chairman informed the Board that this application is a Categorical Exemption, Class 5, California Environmental Quality Act, 1970. The Chairman opened the Public Hearing. The applicant, Dennis D'Ambra, was present; also present were the property owners, Mr. and Mrs. Mario Muxo. Minutes: H.B. Board of Zoning Adjustments Wednesday, October 9, 1974 Page 5 Mr. D'Ambra addressed the Board and delineated the justifications for hardship as being the irregular lot configuration, the fact that the property owners had been assured by the developer that an addition to the property was possible, and the fact that the property owners were financially unable to consider the alternative method of cons- tructing over the garage. Mr. and Mrs. Muxo addressed the Board and reiterated Mr. D'Ambra's statements. There being no other parties present to speak for or against the proposal, the Chairman closed the Public Hearing. The Board discussed the application and concurred that there was not sufficient hardship to Justify the reduction in the minimum open space requirement. ON MOTION BY EADIE AND SECOND BY CROSBY, CONDITIONAL EXCEPTION NO. 74-60 WAS DENIED, WITH THE FOLLOWING FINDINGS, AND FOR THE FOLLOWING REASON, BY THE FOLLOWING VOTE: REASON FOR DENIAL: 1. The encroachment into the open space area is substantial, and justification presented to the Board failed to demonstrate hardship. FINDINGS: 1. The lot configuration is not unique or odd -shaped, i.e. a standard cul-de-sac lot. 2. The lot cannot accomodate the additional building area desired. AYES: Eadie, Crosby, Lipps NOES: None ABSENT: None PLOT PLAN AMENDMENT NO. 74-10 Applicant: Harbour Pacific Homeowner's Association To permit the conversion of an existing laundry room into an office/storage area for the Homeowner's Association, pursuant to 5.9811.4 of the Huntington Beach Ordinance Code located on Sharkfin Lane, one block north of Pacific Coast Highway, in an R-3, Medium -High Density Residential District. The Chairman informed the Board that this application'is a Categorical Exemption, Class I, California Environmental Quality Act, 1970. The Chairman opened the Public Hearing. Mr. Allen Kephart, representing Harbour Pacific Homeowner's Association, addressed the Board, presenting a brief overview Minutes: H.B. The Board discussed the amendment as proposed. ON MOTION BY EADIE;AND,SECOND BY LIPPS, PLOT PLAN AMENDMENT NO. 74-10 WAS APPROVED WITH THE FOLLOWING FINDINGS, BY THE FOLLOWING VOTE: . 1. The amendment does not constitute a substantial change. 2. The proposed use of the property remains the same. 3. The dwelling unit density has not been increased. The Chairman informed the Board that this application is a Categorical Exemption, Class III, California Environmental Quality Act, 1970. He further informed the Board that the applicant had requested a one -month continuance; the Board concurred with the applicant's request. ON MOTION BY CROSBY AND SECOND BY LIPPS, ADMINISTRATIVE REVIEW NO. 74-162 WAS CONTINUED TO NOVEMBER 5, 1974 BY THE FOLLOWING VOTE: AYES: Eadie, Crosby, Lipps NOES: None ABSENT: None ADMINISTRATIVE REVIEW NO. 74-163 Applicant: The Janes Company To permit the construction of a four-plex apartment building, pursuant to S.9231.6 of the Huntington Beach Ordinance Code located on the west side of 20th Street, approximately 135 ft. south of Olive, in an R-4, High Density Residential District. The Chairman informed the Board that this application is a Categorical Exemption, Class 3, California Environmental',Q_uality Act, 1970. He further informed the Board that the applicant had requested a one -month continuance; the Board concurred with the applicant's request. ON MOTION BY CROSBY AND SECOND BY LIPPS, ADMINISTRATIVE REVIEW NO. 74-163 WAS CONTINUED TO NOVEMBER 5, 1974 BY THE FOLLOWING VOTE: AYES: Eadie, Crosby, Lipps NOES: None ABSENT: None ADMINISTRATIVE REVIEW NO. 74-164 Applicant: Classic Development Corporation To permit the construction of model homes for Tentative Tract 8011, pursuant to S.9730.18 of the Huntington Beach Ordinance Code located on the northeast corner of Chapel Lane and Modale Drive, in an R-3, Medium.High Density Residential District. The Chairman informed the Board that this application is cover.�d by Exemption Declaration No. 7.3-06, granted to Tentative, 8011 on February 5, 1973. Minutes: H:B. The Board reviewed the plan and -determined it to be acceptable for approval. ON MOTION BY EADIE AND SECOND BY LIPPS, ADMINISTRATIVE REVIEW NO. 74-164 WAS APPROVED WITH THE FOLLOWING CONDITIONS BY THE FOLLOWING VOTE: . 1. The conceptual plot plan received October 1, 1974 shall be the approved'layout. 2. All areas delineated'on the plan as model areas shall be fully improved, including all landscaping. 3. Conceptual approval of signs'dnd location of same -requires conformance to regulations of the Huntington Beach Ordinance Code. Ornamental cedar plank covering to be applied around pole as shown on plan. 2. Sign to conform to all requirements of Article 976, Huntington Beach Ordinance Code.
