Lee Brown/R. J. Zinnqrabe To permit the elimination of a six-foot wall dividing commercial property from residential property, in lieu of S.9730.25 of the Huntington Beach Ordinance Code located on the west side of Florida Avenue, approximately 600 feet north of Garfield Avenue, in an R-5, Office Professional District. The Chairman informed the Board that this application is a Categorical Exemption, Class 5, California Environmental Quality Act, 1970. The Board noted that applicant has requested a continuance indefinitely to work toward a modified buffer, such as wood, rather than masonry, to be located on adjacent property. It was noted that adjacent property owners will have to be renotified upon reactivation of the request. Chalabian To consolidate two lots into one lot pursuant to S.9811.3 of the Huntington Beach Ordinance Code located on the east side of Commerce Lane, approximately 232 feet north of Research Drive, in an 100-Ml-A 20,000 Light Industrial District. Mr. Jack Chalabian, applicant, was present and addressed the Board. Applicant and Board members discussed the proposed application. ON MOTION BY CROSBY AND SECOND BY SPENCER DIVISION OF LAND No. 74-35 WAS APPROVED WITH THE FOLLOWING CONDITIONS BY THE FOLLOWING VOTE: TO BE COMPLETED PRIOR TO USE OR OCCUPANCY OF SAID PARCEL(S) FOR ANY PURPOSE: 1. This Division of Land shall not be effective until a covenant and agreement furnished by the Huntington Beach Planning Department is signed and recorded with the Orange County Recorder agreeing to these Conditions of Approval. 2. The tentative parcel map received by the Planning Department on October 16, 1974 shall be the approved layout. In its approval action the Board of Zoning Adjustments considered the following issues relating to the tentative map: Lot area Lot width and Lot Depth Past administrative action regarding his property. 3. A parcel map shall be filed with and approved by the Department of Public Works and recorded with the Orange County Recorder (prior to issuance of a Certificate of Occupancy). 4. A copy of the recorded parcel map and covenant and agreement shall be submitted to the Planning Department. 5. The property shall participate in the local drainage assess- ment district at the time said parcel(s) is developed. (Contact the Department of Public Works for more information.) AYES: Eadie, Spencer, Crosby NOES: None ABSENT: None PLOT PLAN AMENDMENT NO. 74-11 Applicant: Louis & Dolores Bales To permit a 4k foot extension of a living rocm into a patio area, and to addition of a fireplace, pursuant to S.9811.4 of the Huntington Beach Ordinance Code. located on north side of Harbor Point Circle, approxirately 47 feet east of Carribean Lane, in an R-2, Medium Density Residential District. Minutes: H.B. Boara of Zoning Adjustments Wednesday, October 16, 1974 Page 3 The Chairman stated that the application is a Categorical Exemption, Class III California Envirom ntal Quality Act, 1970. The Chairman opened the public hearing. Dolores Bales, applicant, was present and addressed the Board. She discussed the plans for extending the living room and the addition of a fireplace. It was noted that the condominium had been built prior to the time the present code became effective. The Chairman noted that there should be a condition that the architecture depicted on the plan submitted would have to be consistent with the existing architecture of the plan received September 20, 1974. The public hearing was closed. ON MOTION BY SPENCER AND SECOND BY CROSBY PLOT PLAN AMENDMENT NO. 74-11 WAS APPROVED WITH THE FOLLOWING FINDINGS BY THE FOLLOWING VOTE: 1. The amendment is not a substantial change. 2. The proposed use of the property remains the same. 3. The dwelling unit density has not been increased. 4. The adjustment results in an improvement plan as said modification will entail general upgrading of the existing building. AYES: Eadie, Spencer, Crosby NOES: None ABSENT: None USE PERMIT NO. 74-50 Applicant: Howard I. Smith To permit the construction of a liquor store, pursuant to 5.9472 of the Huntington Beach Ordinance Code located on the east side of Goldenwest Street, approximately 220 feet north of the centerline of Warner Avenue, in a C-4, Highway Commercial District. The Chairman informed the Board that Exemption Declaration No. 74-134 was granted on this application on September 10, 1974. The Chairman opened the public hearing. Mr. Howard I. Smith, applicant, was present. Mr. Edward Wallin, representing owners of adjoining property, spoke in opposition to the proposed use. He stated that there are adequate liquor stores on this corner and there was no need for another. He stated his clients were concerned about the detrimental effect this use might have on future development of adjoining property. Minutes: H.B. Board of Zoning Adjustments Wednesday, October 16, 1974 Page 4 Mr. Landis, owner of the property, addressed the Commission and stated that he was aware that Mr. Wallin's clients were interested in developing the property as residential. He cited other corners in the City which had a single structure adjoining a service station and felt that it would in no way be detrimental to future development of adjoining properties. It was the consensus of the Board that a conference should be arranged with the Advance Planning Division as well as a Police Department representative to determine future planning and the proximity of the location to a school where such usage is proposed. Mr. Wallin requested that he be advised of the time and location of such meeting. ON MOTION BY CROSBY AND SECOND BY EADIE USE PERMIT NO. 74-50 WAS CONTINUED TO OCTOBER 23, 1974 WITH CONCURRENCE OF APPLICANT BY THE FOLLOWING VOTE: AYES: Eadie, Spencer, Crosby NOES: None ABSENT: None DIVISION OF LAND NO. 74-34 Applicant: To permit American Medical Building the consolidation of two Guild legal parcels of land into one parcel, pursuant to S.9811.3 of the Huntington Beach Ordinance Code located on the northeast corner of Cameron Street and Newman Avenue, in an R5, Office Professional District. In Conjunction With ADMINISTRATIVE REVIEW NO. 74-155 Applicant: American Medical Building Guild To permit the construction of a medical office building, pursuant to S.9401 of the Huntington Beach Ordinance Code. The Chairman informed the Board that this application had been granted Exemption Declaration No. 74-152 on October 8, 1974. Mr. Robert Rosenthal, Architect of the proposed project, addressed the Board. He stated that there would not be facilities for more than four doctors in the building. The Board noted that the parking requirements conformed to the Code. There was a discussion on the existing trees and the Board suggested that all trees be saved wherever possible if they were in healthy condition. Mr. Rosenthal presented photographs of the trees on the property. The Board suggested that the applicant attempt to negotiate with adjoining medical facility to use a common driveway and work toward a reciprocal parking and drive agreement for ingress and egress. This would result in a reduction of driveways. Conditions of approval were discussed. Conditions of approval of Division of Land were discussed. Minutes: H.B. Board of Zoning Adjustments Wednesday, October 16, 1974 Page 5 ON MOTION BY EADIE AND SECOND BY CROSBY EXEMPTION DECLARATION NO. 74-152 WAS ADOPTED BY THE FOLLOWING VOTE: AYES: Eadie, Spencer, Crosby NOES: None ABSENT: None ON MOTION BY EADIE AND SECOND BY CROSBY ADMINISTRATIVE REVIEW NO. 74-155 WAS APPROVED WITH THE FOLLOWING CONDITIONS BY THE FOLLOWING VOTE: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan and elevations received September 18, 1974 shall be the approved layout subject to the modifications described herein. a. Implementation of an enclosed trash disposal area. b. Implementation of a 6 ft. masonry wall pursuant toOrdinance Code requirements along the north property line. c. Conformance to Code regarding building setback at the corner of Newman Avenue and Cameron Street. In its approval action the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: • Traffic circulation and drives . Parking layout • Lot area . Lot width and lot depth . Type of use and its relation to property and improve- ments in the immediate vicinity . Past administrative action regarding this property . Landscaping 2. The following plan(s) shall be submitted to the Secretary of the Board: Landscape and irrigation plan complying with Article 979 of the Huntington Beach Ordinance Code and landscaping specifications on file in the Department of Public Works. 3. In accordance with the City's Master Plan of Streets and Alleys, an additional 10 ft. of dedication on Cameron Street and Newman Avenue shall be required. Also, a 20 ft. radius dedication shall be required at the inter- section of Cameron Street and Newman Avenue. Minutes: H.B. Board of Zoning Adjustments Wednesday, October 16, 1974 Page 6 4. Soil and compaction reports shall be submitted by a certified soils engineer. Said report shall be submitted to the Department of Building and Community Development and shall be subject to approval by that Department. 5. Fire protection systems, including automatic sprinkler systems, fire hydrants, fire alarms, and any required fire protection devices shall comply with the speci- fications of the Uniform Fire Code. Plans for such systems shall be submitted to the Fire Department and shall be subject to approval by the Departments of Fire and Public Works. B. _TO_,BE COMPLETED PRIOR TO FINAL INSPECTION: Newman Avenue and Cameron Street shall be improved to the center line of such right-of-way. Said improvement shall include curbs, gutters, sidewalks, paving, street trees, street lights, street signs, street drainage, and sewer and water main extensions in full compliance with the City of Huntington Beach street standards and requirements. GENERAL: 1. If the developer proposes to provide air conditioning, the insulation in ceilings and exterior walls shall be a minimum of R-19 and R-11, respectively. If no air condition- ing is to be provided, the insulation in ceilings and exterior walls shall be a minimum of R-13 and R-7 respectively. 2. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an-offsite facility equipped to handle them. 3. As much of the existing domestic plant material as possible shall be retained and replanted on the property. This Division of Land shall not be effective until a covenant and agreement furnished by the Huntington Beach Planning Depart- ment is signed and recorded with the Orange County Recorder agreeing to these Conditions of Approval. AYES: Eadie, Spencer, Crosby NOES: None ABSENT: None CONDITIONAL EXCEPTION NO. 74-59 (Request for Reconsideration) Applicant: Rudolph A. Soto To permit an encroachment not to exceed 24" into the exterior side yard, in lieu of 5.9103.2.2 of the Huntington Beach Ordinance Code (not in excess of 15 sq. ft. in total) located at the southeast corner of Lewis Lane and Galipean Drive, in an Rl, Low Density Residential District. Chairman Eadie stated that Conditional Exception No. 74-59 was originally filed as a request to permit a 6 foot encroach- ment into the exterior side yard. This application was denied by the Board at their October 2, 1974 meeting. Since that meeting Mr. Soto had revised his plans and petitioned the Board for reconsideration. Prior to a motion for reconsiderat-ion,the Chairman informed the Board that a question existed as to whether or not re- consideration could take place at this meeting in view of the time lag. Board of Zoning Adjustments Wednesday, October 16, 1974 Page 8 ON MOTION BY SPENCER AND SECOND BY CROSBY RECONSIDERATION OF DENIAL OF CONDITIONAL EXCEPTION NO. 74-59 WAS GRANTED BY THE FOLLOWING VOTE: AYES: Spencer, Crosby NOES: None ABSTAIN: Eadie Chairman Eadie stated that he had abstained since he had not been present when the original request was denied. The revised plans were reviewed by the Board and it was noted that the planned addition could only be placed on lot where an encroach- ment would be necessary to make the addition practical. ON MOTION BY SPENCER AND SECOND BY CROSBY CONDITIONAL EXCEPTION NO. 74-59 WAS APPROVED FOR THE FOLLOWING REASONS AND FINDINGS BY THE FOLLOWING VOTE: REASONS: The irregular shape of the lot precludes normal building conditions. Therefore a hardship is demonstrated and would not constitute the granting of a special privilege. FINDINGS: Approval action addressed the revised plot plan submitted to the Board on October 16, 1974. AYES: Spencer, Crosby NOES: None ABSTAIN: Eadie SIGNS: Applicant: Dean Avery Sign Contractor: Orange Coast Sign Business Name: Avery Auto Air Job Location: 16941 Beach This is a request for a modification to an existing pole sign of 72 sq. feet with the dimensions of 6 x 12, total sign height of 21'. The sign is a canister type. Board discussed the sign.
