COMMISSIONERS ABSENT: None NOTE: A TAPE RECORDING OF THIS MEETING IS ON FILE IN THE PLANNING DEPARTMENT OFFICE. CONDITIONAL USE PERMIT NO. 74-10 (Continued from 10/15/74) In Conjunction With: TENTATIVE TRACT 8687 Applicant: Graziadio Development Co. Tentative Tract No. 8687 and Conditional Use Permit No. 74-10 filed on June 25, 1974, are requests to permit an approximate 10 acres --- of land to be developed as a 79 unit statutory condominium develop-- ment pursuant to Article 931 of the Huntington Beach Ordinance Code. Subject property is located on the southeast corner of Chapel Lane and Ellis Avenue in the R1 and R3 districts. Mr. James Palin addressed the Commission and discussed the recom- mendations of the Environmental Review Board from the original staff report reviewed by the Planning Commission on September 4, 1974. Mr. Palin stated that the staff had prepared suggested conditions of approval. Mr. Palin further stated that the applicant had submitted revised maps, whereby he now meets all suggested amended conditions of approval of the Environmental.Review Board. Commission discussed proposed plans with staff. Aerial slides of the proposal and surrounding properties were shown. Commissioner Porter inquired about a description of the elevations. Mr. Palin answered Commissioner Porter describing the elevations as a cut and fill balance operation. Chairman Kerins opened the public hearing on Conditional Use Permit No. 74-10. Mr. Louis Graziadio, the applicant, addressed the Commission to answer any questions the Commission may have of him'. Minutes:. H.B. Planning Commission Tuesday, -Oct. 22, 1974 Page 2 Mr. Andrew Kotavary addressed the Commission and explained the proposed grading in full detail. Mr. Kotavary also presented Elevations and the proposed drainage for the development. Chairman Kerins inquired about possible Tot Lots to be a part of the development. Mr. Graziadio stated that he had no plans at the present for,any Tot Lot proposal. Slides of architectural renderings were presented by Mr. Graziadio. The applicant indicated which trees were to remain. Types of roofs we're discussed. The size of the proposed units were discussed as well as the generation of additional students for the immediate school district. Commissioner Higgins stated that it was his feeling that the Commission had not been presented with sufficient material whereby the Commission could take action on the application. He further stated that mere elevations or a'rendering is not sufficient material for the Commission to base its action on. The Commission concurred with Commissioner Higgins and requested the applicant to submit further landscaping plans, plans showing types of units, types of patios, etc. Mr. Dave Diamond of the HOME Council addressed the Commission and stated the HOME Council's opposition to the proposal. He stated that although he personally approves of the quality of the proposal, the granting of Conditional Exception 74-02 as it relates to the project by the City Council, in his words, "without sufficient hardship" may possibly provoke a lawsuit against the City of Huntington Beach by the HOME Council. Mr. Diamond stated that the HOME Council felt that the proposal would create problems on overloading of schools and that patio walls should be brought into conformance with the ordinance. Therefore, Mr. Diamond requested the Commission to continue Conditional Use Permit No. 74-10 and Tentative Tract 8687 until such time as litigation considerations are completed. At there were no further parties to speak in favor or opposition to Conditional Use Permit No. 74-10 or Tentative Tract 8687, the Chairman closed the public hearing. It was the consensus of the Commission to continue these applications on the basis of insufficient information and not due to HOME Council's legal concerns. Minutes: H.B. Planning Commission Tuesday, Oct. 22, 1974 Page 3 ON MOTION BY BOYLE AND SECOND BY HIGGINS CONDITIONAL USE PERMIT NO., 74-10 WAS CONTINUED TO NOVEMBER 5, 1974 WITH THE CONCURRENCE OF THE APPLICANT TO ALLOW COMPLIANCE WITH S.9310.3 OF THE HUNTINGTON BEACH ORDINANCE CODE REQUIRING ALL PLANS TO BE SUBMITTED TO THE PLANNING COMMISSION FOR REVIEW. Commission discussion followed. In response to a question asked by the applicant, Mr. O'Connor, Deputy City Attorney, stated that it was the Attorney's office and the Department of Public Works Office opinion that the Homeowners Association is to maintain the walls surrounding the proposal. AYES: Geiger, Bazil, Higgins, Kerins, Finley, Porter, Boyle NOES: None ABSENT: None ON MOTION BY KERINS AND SECOND BY BAZIL TENTATIVE.TRACT 8687 WAS CONTINUED TO NOVEMBER 5, 1974 WITH THE CONCURRENCE OF THE APPLICANT BY THE FOLLOWING VOTE: AYES: Geiger, Bazil, Higgins, Kerins, Finley, Porter, Boyle NOES: None ABSENT: None DISCUSSION - CODE AMENDMENT NO. 74-6 "Article 979 Revision" John Cope addressed the Commission and stated that the major revisions which would be effectuated by the amendment involved new provisions for the screening of parking areas; a new minimum turning radius for both commercial and industrial parking areas, new off-street parking requirements for medical and dental offices, and provisions for the joint use of parking areas. Discussion ensued regarding further changes and revisions to the Code Amendment. It was Commissioner Porter's feeling that additional landscaping should be distributed among the parking area. Commissioner Bazil felt that bumper stops should be placed further from the fence to avoid damage to the fence should a car back into the parking space. The possibility of dropping the berming and wall both to 20" instead of 32" was discussed. It was Commissioner Bazil's opinion that a more aesthetically pleasing wall would be to leave the wall at 32 inches and lower the berming to 20". Minutes: H.B. Planning Commission Tuesday, Oct. 22, 1974 Page 4 It was the consensus of the Commission to direct staff to pursue additional revisions to the existing code amendment and come back to the Commission with such amendments. DISCUSSION - CODE AMENDMENT NO. 74-9 "Building Height Designation Revisions" John Cope addressed the Commission and stated that Code Amendment 74-9 is an attempt to equate building heights and height designations in terms of feet rather than number of stories. He further stated that direction to prepare this code amendment was given by the Planning Commission on May 15, 1974, with subsequent direction coming from the City Council. The proposed revision applies to all districts, and further involves some amendments to the language of various sections dealing,with building heights. Commission discussed Code Amendment No. 74-9. ON MOTION BY BOYLE AND SECOND BY BAZIL COMMISSION REQUESTED THAT CODE AMENDMENT NO. 74-9 BE SET FOR PUBLIC HEARING. SAID AMENDMENT WOULD EQUATE BUILDING HEIGHTS AND HEIGHT DESIGNATIONS IN TERMS OF FEET RATHER THAN NUMBER OF STORIES. VOTE: AYES: Geiger, Bazil, Higgins, Kerins, Finley, Boyle, Porter NOES: None , ABSENT: None DISCUSSION - CODE AMENDMENT NO. 74-12 "R-1 Rear Yard Setback Classification" Dave Eadie addressed the Commission to clarify some of the provisions of -the Code Amendment. He further stated that direction for the preparation of this Code Amendment derived from the Planning Commission's desire to incorporate a clarification'in the wording of Section 9103 Rear Yar'd'Setback as it pertains to permanent open space. The staff has reviewed the request and has incorporated the words "Open Land" in lieu of "Permanent Open Space" into the Code. In addition to this change, the staff also recommends the additional deletion of words from Section 9103.3 and Section 9103.2.1.2 which are confused and cause a lack of clarity. Commission discussed Code Amendment No. 74-12. ON MOTION BY BOYLE AND SECOND BY BAZIL COMMISSION REQUESTED THAT CODE AMENDMENT NO. 74 12BE SET FOR PUBLIC HEARING. SAID AMENDMENT WOULD CLARIFY THE TERM PERMANENT OPEN SPACE AS IT RELATES TO REAR YARD SETBACKS AND STRUCTURES WITHIN THE REAR YARD SETBACKS IN THE LOW DENSITY RESIDENTIAL DISTRICT. 1 Minutes: H.B. Variation in Garage Setbacks" Dave Eadie presented Code Amendment No. 74-13 which is an amendment to repeal the 7-1/2 ft. variation in garage set- backs. The proposed Code -Amendment originated because of problems created by the 7-1/2 ft. garage setbacks. The Police Department concurs- with the proposed code amendment regarding the creation of traffic safety and violations thereof. Commission discussed Code Amendment No. 74-13 ON MOTION BY BOYLE AND. -SECOND BY FINLEY COMMISSION REQUESTED THAT CODE AMENDMENT NO. 74-13 BE SET FOR PUBLIC HEARING. SAID AMENDMENT WOULD REPEAL THE 7-1/2 FT. VARIATION IN GARAGE SETBACKS. VOTE: AYES: Geiger, Bazil, Higgins, Kerins, Finley, Boyle, Porter NOES: None ABSENT: None DISCUSSION - PLANNING COMMISSION WORK PROGRAM 1974 Dave Eadie described and discussed the Current Planning Projects outlining current and proposed code amendments. Jim Palin described and discussed the PRD Low Density, PRD High Density and Condominium Conversions code amendments. He stated that the Low Density amendment would be brought to the Planning Commission Study Session in November and the Condominium Conversion would have priority over the PRD High Density amendment. Ed Selich discussed and updated the three Advance Planning Work Programs. He stated that top priority would be given to the General Plan. WRITTEN COMMUNICATIONS:— Dick.Harlow presented the "Large Lot _Study': to the Commission. Minutes: H.B. Planning Commission Tuesday, Oct. 22, 1974 Page 6 ORAL C014MUNICATIONS: NONE COMMISSIONERS' COMMENTS Commissioner Geiger expressed concerns over the Yorktown School Site. His concerns were over the proposed sale of the site by the School Board. Commissioner Finley stated that if the School Board decided to sell the site, it would take many different steps and would not be something that would happen too fast. She further stated that the proposed sale at this time is too much of a controversial issue. Commissioner Geiger expressed concerns over the impact of off shore drilling as it relates to affecting the recreational beach area. His concerns were not of environmental impacts but rather those of economic impacts. -Commissioner Boyle agreed to look into all impacts of off shore drilling and what effects it has on the city. Mr. Palin stated that all impacts of off shore drilling would be brought to the attention of the public through the EIR which is presently being written. Chairman Kerins stated that all impacts could be brought out at the time of the public hearing on the EIR. Chairman Kerins directed staff to investigate the latest status of off shore drilling and return with recommendations. Chairman Kerins expressed concerns over proposals before the Planning Commission not having necessary maps and information available prior to commission hearing the item. He felt staff should recommend continuance until such time that all needed information has been received and reviewed by the Commission. Commissioner Porter, being a member of the Subcommittee, stated.that he will make sure that all information required'is available at the time the application is being heard by the Planning Commission.
