Long To permit the establishment of a wholesale lumber yard, utilizing an existing building, pursuant to S.9530 of the Huntington Beach Ordinance Code, located on the west side of Nichols Avenue, approxi- mately 970 feet north of Slater Avenue, in an Ml, Light Industrial District. The Chairman informed the Board that this application was granted Exemption Declaration Number 74-139 on September 24, 1974 by the Environmental Review Board. Messrs. Harrington, Clarence Hall, and Tracy Campbell, representing the applicant, were present. They addressed the Board and outlined their plans for converting the existing building into a lumber yard, and the demolition of certain structures on the site. Board discussion followed; Conditions of Approval were discussed. TO BE COMPLETED PRIOR TO THE ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan received October 21, 1974 shall be the approved layout, subject to the modifications described herein: a. The perimeter travel lanes on -site shall have a minimum width of not less than thirty (30) feet. Further description of the operations area located to the front of the subject site as shown on the approved plot plan shall be part of the precise plot plan. b. A revised plan showing the area of the sawing operations and further describing the area indi- cated as operations area on the approved plan shall be submitted to the Secretary of the Board of Zoning Adjustments for review and approval. 2. The following plans shall be submitted to the Board for a. approval action: Landscape and irrigation plans complying with Article 979 of the Huntington Beach Ordinance Code and landscaping specifications on file in the Department of Public Works. Said plans shall reflect landscaping within the parking areas delineated on the plot plan. b. A rooftop mechanical equipment screening plan shall be submitted to the Board. 3. The fire hydrant layout shall be subject to approval by the Fire Marshal. 4. Automatic sprinkler plans shall be subject to all codes and ordinances and shall be reviewed by the Fire Department. 5. All driving surfaces shall be designed to support Fire Department emergency vehicles and shall meet or exceed Department of Public Works standards. A plan for said driving surfaces shall be submitted to the Department of Public Works for approval action. Soil and compaction reports shall be submitted by a certified soils engineer on any new construction. Said report shall be submitted to the Department of Building and Community Development, and shall be subject to approval by that Department. 7. All fire protection systems and any required fire pro- tection devices shall comply with the specifications of the Huntington Beach Fire Code and the Uniform Building`Code. Plans for such systems shall be sub- mitted to the Huntington Beach Fire Department and shall be subject to approval by the Departments of Fire and Public Works and shall comply with the Uniform Building Code. 8. The conceptual sign plans as submitted to the Board, stamped "Approved, Exhibit B", shall be the only identification for the development. Said sign shall meet all Ordinance Code requirements. 9. Developer, lessor, and its heirs, successors, and assignees, and all lessees and sub -lessees -of the development agree that no saws and blowers shall be operated during the hours from 10:00 p.m. to 6:00 a.m. 10. An additional 12 feet of dedication shall be required off of Nichols Street. 11. Property shall participate in local drainage assessment district. 12. Elevation plans shall be submitted, indicating what im- provements are proposed to the existing buildings. Said plans shall depict materials to be used. 13. All existing structures, except those shown on approved plot plan, shall be removed. 14. Applicant shall furnish an engineer's report which will provide structural analysis of the entire building, specifically addressing structural conditions and fire resistant ratings within the buildings. Nichols Street shall be improved to the center line of such right-of-way. Said improvements shall include curbs, gutters, sidewalks, paving, street trees, street lights, street signs, street drainage, and sewer extensions in full compliance with the City of Huntington Beach standards and requirements. 2. A 12"-A.C. water main shall be constructed in Nichols Street_ from Slater Avenue to Belsito Lane. (See Public Works Department in regard to reimbursement). 3. Vacant undeveloped land must be perpetually maintained in a safe and clean manner. 4. Applicant shall submit a set of street improvement plans. C. GENERAL: 1. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be,disposed of at an off -site facility equipped to handle them. 2. The maximum permissible noise level to be generated by blowers, hoppers, saws, etc., shall be 55 dBA at the easterly property line or ultimate right-of-way of Nichols Street. This consideration follows the .Environmental Review Board's approval of the Exemption Declaration based on the fact that the sawing operation would be on the inside of the building. 3. All lumber stored on the site shall be stored in accor- dance with the Fire Marshal's recommendations for safety. 4. The insulation to be used shall be as stipulated by the applicant within the Exemption Declaration request. 5. This plot plan shall not be effective for any purpose until such time as the applicant submits a letter to the Secretary of the Board of Zoning Adjustments stating the applicant understands and accepts the conditions of this approval. Smith To permit the construction of a liquor store, pursuant to S.9472 of the Huntington Beach Ordinance Code, located on the east side of Goldenwest Street, approximately 220 feet north of the center line of Warner Avenue, in a C4, Highway Commercial District. The Chairman informed the Board that this application is covered by Exemption Declaration No. 74-134 granted to Use Permit No. 74-45 by the Environmental Review Board of September 10, 1974. The Chairman noted that the Public Hearing had been continued from October 16, 1974. Mr. Howard Smith, applicant, and Mr. Landis, owner of the property, were present. A revised plan delineating suggested improvements was discussed. Conditions of Approval were discussed. ON MOTION BY CROSBY AND SECOND BY EADIE, EXEMPTION DECLARATION NO. 74-134 WAS ADOPTED BY THE FOLLOWING VOTE: AYES: EADIE, SPENCER, CROSBY NOES: NONE ABSENT: NONE ,ON MOTION BY CROSBY AND SECOND BY EADIE, USE PERMIT NO. 74-50 WAS APPROVED WITH THE FOLLOWING CONDITIONS AND FINDINGS, BY THE FOLLOWING VOTE: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. A reciprocal parking agreement for ingress, egress, and circulation shall be submitted to the Planning Department, the form and content to be approved by the City Attorney. 2. The revised conceptual plot plan and elevations re- ceived October 23, 1974 shall be the approved layout, subject to the modifications described herein. A thirty-two (32) inch decorative masonry wall shall be required to screen the parking area adjacent to Goldenwest Street. Said wall shall be designed according to Article 979 of the Huntington Beach Ordinance Code. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: MINUTES: Board of Zoning Adjustments October 23, 1974 Page 6 USE PERMIT NO. 74-50 (Continued) Traffic circulation and drives Parking layout Lot area Lot width and lot depth Type of use and its relation to property and improvements in the immediate vicinity. Past administrative action regarding this property. A plan delineating said modifications shall be submitted to the Secretary of the Board. If such plan complies with the modifications outlined by the Board, said plan shall be approved and made a permanent part of the administrative file. 3. The following plans shall be submitted to the Secretary of the Board: Landscape and irrigation plan complying with Article 979 of the Huntington Beach Ordinance Code, and landscaping specifications on file in the Department of Public Works. Rooftop mechanical equipment screening plan. Said plan shall indicate screening of all rooftop mechanical equipment and shall delineate the type of material proposed to screen said equipment. 4. Soil and compaction reports shall be submitted by a certified soils engineer. Said report shall be submitted to the Department of Building and Community Development and shall be subject to approval by that Department. 5. Fire protection systems, including automatic sprinkler systems, fire hydrants, fire alarms, and any required fire protection devices shall comply with the specifi- cations of the Uniform Fire Code. Plans for such systems shall be submitted to the Fire Department and shall be subject to approval by the Departments of Fire and Public Works. 6. The developer shall participate in the local drainage assessment district. B. TO BE COMPLETED PRIOR TO FINAL INSPECTION: 1. Goldenwest Street shall be improved to the center line of such right-of-way. Said improvement shall include curbs, gutters, sidewalks, paving, street trees, street lights, street signs, street drainage, and sewer and water main extensions in full compliance with the City of Huntington Beach street standards and requirements. 1 11 MINUTES: Board of Zoning Adjustments October 23, 1974 Page 7 USE PERMIT NO. 74-50 (Continued) C. GENERAL CONDITIONS: 1. No structures other than those shown on the approved plan shall be constructed prior to subsequent Board of Zoning Adjustments review. FINDINGS: 1. The proposed plan will not be detrimental to planning efforts on the adjacent properties. 2. By virtue of the information received from the Department of Public Works regarding the future median construction, the existing driveway approaches will not cause a safety hazard. 3. The subject proposal will not be detrimental to the health and general welfare of the surrounding properties. 4. The proposal is consistent with the City's policy plan. However, in view of the proposed liquor store location in relation to 'the school site south of Warner Avenue, further review of the use itself will take place when a license for liquor sales is applied for. To permit the consolidation of three parcels of land into two parcels, pursuant to Section 9811.3 of the Huntington Beach Ordinance Code, located on the northeast corner of Heil Avenue and Bolsa Chica Street, in a C2, Community Business District and MH - Mobile Home District. The Chairman informed the Board that this application is a Categorical Exemption, Class V., California Environmental Quality Act, 1970. Dr. Hubbell, representing the applicant, was present and addressed the Board. Conditions of Approval were discussed. ON MOTION BY CROSBY AND SECOND BY SPENCER, DIVISION OF LAND NO. 74-36 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: MINUTES: Board of Zoning Adjustments October 23, 1974 Page 8 DIVISION OF LAND NO. 74-36 (Continued) TO BE COMPLETED PRIOR TO USE OR OCCUPANCY OF SAID PARCELS FOR ANY PURPOSE: 1. This Division of Land shall not be effective until a Covenant and Agreement furnished by the Huntington Beach Planning De- partment is signed and recorded with the Orange County Recorder, agreeing to these Conditions of Approval. 2. The tentative parcel map received by the Planning Department on October 3, 1974 shall be revised to reflect the three (3) actual parcels that are being consolidated and realigned. Said plan shall be submitted to the Departments of Planning and Public Works. 3. A parcel map shall be filed with, and approved by, the Department of Public Works, and recorded with the Orange County Recorder (prior to issuance of a Certificate of Occupancy). 4. A copy of the recorded parcel map and Covenant and Agreement shall be submitted to the Planning Department. 5. The property shall participate in the local drainage assess- ment district at the time said parcels are developed. Applicant: Charles Cook Construction Company To permit a five.foot.encroachment into the required ten foot exterior side yard setback,,in lieu of S.9103.2.2 of the Huntington Beach Ordinance Code, located on the north side of Longford Circle, approximately 490 feet east of Carrie Lane, in an R1, Low Density Residential District. The Chairman informed the Board that this application is a Categorical Exemption, Class V, California Environmental Quality Act, 1970. The Chairman opened the Public Hearing. Mr. Martin Steigner, representing the applicant, addressed the Board and discussed the plans. Mrs. Alley, the owner, was present. Mrs. Sukalak, her neighbor, addressed the Board and stated that she had no objections to the encroachment. The Chairman closed the Public Hearing. 1 MINUTES: Board of Zoning Adjustments October 23, 1974 Page 9 CONDITIONAL EXCEPTION NO. 74-61 (Continued) ON MOTION BY EADIE AND SECOND BY SPENCER, CONDITIONAL EXCEPTION NO. 74-61 WAS APPROVED WITH THE FOLLOWING FINDINGS AND FOR THE FOLLOWING REASON, BY THE FOLLOWING VOTE: FINDINGS: 1. The required minimum open space is not reduced with the proposed addition. 2. In view of the orientation of the building on the subject lot, i.e. minimal lot coverage on a lot which exceeds minimum square footage requirements, the proposed addition cannot logically be placed anywhere else on the lot. 3. Adequate setback has been maintained from the adjacent residential property. 4. The room addition would not be detrimental to the living environment in regard to noise from Edwards Street, as it is buffered by a six foot high masonry wall and is not a bedroom. REASON: The lot coverage is minimal and this, in conjunction with the placement of existing structure on the lot,poses justifiable hardship concluded from the above findings. Darling To permit the establishment of a Christmas tree lot, pursuant to Section 9730.16 of the Huntington Beach Ordinance Code, located on the east side of Brookhurst Street, approximately 490 feet south of the center line of Adams Avenue, in a C4, Highway Commercial District. The Chairman informed the Board that this application is a Categorical Exemption, Class III, California Environmental Quality Act, 1970. The applicant stated that he did not anticipate any problems with residents of the adjoining area. ON MOTION BY CROSBY AND SECOND BY SPENCER, ADMINISTRATIVE REVIEW NO. 74-167 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: 1. Revised plot plan shall be submitted which reflects entrances and exits. 2. Requirements of Fire Department and Department of Public Works shall be complied with to satisfaction of Fire Marshal and City Engineer. 3. Section 9730.16 shall be complied with. Mandic To permit the installation of overhead utilities, pursuant to S.9730.9 of the Huntington Beach Ordinance Code, located on the east side of Main Street, approximately 150 feet north of Orange Avenue, in a-_C3, General Business District. The Chairman informed the Board that this application is a Categorical Exemption, Class I,-California,Environmental Quality Act, 1970. -- Mr. Mandic, the applicant, was present and addressed the Board. He briefly summarized his request to install overhead utilities. Board members discussed the plans with the applicant. ON MOTION BY SPENCER AND SECOND BY EADIE, ADMINISTRATIVE REVIEW NO- 74-165 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: 1. The Board discussed the request. ON MOTION BY EADIE AND SECOND BY CROSBY, A REQUEST FOR A FESTIVAL OF CRAFTS WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: 1. Access and safety,precautions shall be reviewed and approved by the Fire Marshal and the Department of Public Works, prior to commencement of said special event. 2. The festival shall not violate the rules and regulations indicated by the Festival of Crafts Manager. Precise Copy shall be reviewed by the Board of Zoning Adjustments.- 2. Color scheme of future tenant should be the same as Carl's Junior sign.
