Eadie, Spencer, Crosby None Captain Vanderlaan Fire Department ADMINISTRATIVE REVIEW NO. 74-145 (Continued from 10/9/74) Applicant: William S. Buck To permit the construction of a professional office building pursuant to S.9401 of the Huntington Beach Ordinance Code located on the south- east corner of Main Street and Huntington Avenue in an R-5, Office Professional District. The Chairman informed the Board that the applicant has not as yet complied with the Environmental Review Board's requirements. He has been required to submit a supplementary hydrology and drainage study for the project. In view thereof, he recommended a two - week continuance and stated that the applicant will be sent a communication notifying him that the Board must take definitive action at a hearing in the near future. ON MOTION BY CROSBY AND SECOND BY SPENCER, ADMINISTRATIVE REVIEW NO. 74-145 WAS CONTINUED TO NOVEMBER 13, 1974 BY THE FOLLOWING VOTE: AYES: Eadie, Spencer, Crosby NOES: None ABSENT: None IMPROVEMENT POSTPONEMENT Applicant: John K. Eardley & Associates To permit postponement of installation of street improvements, pursuant to S.9730.6.1 of the Huntington Beach Ordinance Code located at 16811 Magnolia Street, Huntington Beach, California. The applicant, Mr. John Eardley, was present. He addressed the Board, delineating his reasons for requesting the postponement of the improve- ments on the project, these being the time factor involved in the preparation of designs and construction drawings for the improvements, as well as the need for obtaining approval actions from the Highway a Minutes: H.B. Board of Zoning Adjustments Wednesday, October 30, 1974 Page 2 Department and the Orange County Flood Control District, in view of the fact that abutting properties involved are under the jurisdiction of these bodies. Bruce Crosby stated that the reasons as cited by the applicant were not limited solely to this project, but were problems of the same nature as experienced by other developers. The Chairman stated that he would be amenable to approving a six-month postponement if the applicant would agree to posting of a bond. The applicant and the Board concurred with this recommendation. ON MOTION BY EADIE AND SECOND BY SPENCER, A POSTPONEMENT FOR STREET IMPROVEMENTS WAS APPROVED, WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: 1. An agreement is entered into with the City agreeing to install said improvements within six (6) months. 2. Said agreement shall be secured by a good and sufficient bond. 3. Said bond shall be in an amount equal to the cost of improvements as established by the Director of Public Works. 4. At the end of the six month period, additional Board of Zoning Adjustments consideration will be necessary should the applicant demonstrate further impracticabilities which would warrant further postponement of the improvements. AYES: Eadie, Spencer, Crosby NOES: None ABSENT: None CONDITIONAL EXCEPTION NO. 74-62 Applicant: Pacific City Bank To permit a two (2) foot reduction to an existing pole sign, in lieu of S.9765.5.2 of the Huntington Beach Ordinance Code located on the west side of Goldenwest, approximately 100 ft. south of Edinger Avenue. The Chairman informed the Board that this application is a categorical exemption, class V, California Environmental Quality Act, 1970. The Chairman opened the public hearing. 1 Minutes: H.B. Board of Zoning Adjustments Wednesday, October 30, 1974 Page 3 The Chairman noted that there was no one present at the meeting to represent the applicant; he further stated that representation of the applicant at a hearing for a Conditional Exception is imperative, and therefore recommended a one -week continuance. Board discussion followed. Relating to the justification of the Conditional Exception, it was the consensus of the Board that no hardships existed. The Board instructed the Secretary to discuss this with the applicant and seek further input from him. ON MOTION BY EADIE AND SECOND BY SPENCER, CONDITIONAL EXCEPTION NO. 74-62 WAS CONTINUED TO NOVEMBER 6, 1974 BY THE FOLLOWING VOTE: AYES: Eadie, Spencer, Crosby NOES: None ABSENT: None USE PERMIT NO. 74-51 Applicant: Fredericks Development Company To permit the construction of a sixty (60) unit apartment complex, pursuant to 5.9202.3.1.3 of the Huntington Beach Ordinance Code located on the north end of Keelson Lane, approximately 999 feet north of Slater Avenue, in an R-3, Medium High Density Residential District. The Chairman informed the Board that this application is within the area covered by Exemption Declaration No. 73-148 granted to Use Permit No. 73-51 on March 12, 1974. The Chairman opened the Public Hearing. Mr. Waite Cable, representing Fredericks Development Company, addressed the Board and presented a brief description of the proposal; he stated that the project would consist of six buildings, each containing ten 1-bedroom apartments. Mrs. Ballinger, adjacent property owner, addressed the Board and questioned the cul-de-sac on Elm Street as proposed on the plan, and how it would relate to her property. The Chairman responded that a previously approved street alignment plan determines the location of the cul-de-sac, and the applicant's plan conforms to standard plans and specifications of the City of Huntington Beach. The Chairman closed the Public Hearing. The Chairman stated that the plan conforms to code regulations except in the areas of driveway widths, minimum setbacks on Elm, and minimum parking requirements; he further stated that approval action would be conditional to modifications regarding same. It was noted that the location aspect of the signs might prove to be a problem, and pointed out that the developer should pursue compliance with Ordinance Code regulations on same. Conditions of Approval were discussed. ON MOTION BY CROSBY AND SECOND BY EADIE, EXEMPTION DECLARATION NO. 74-148 WAS ADOPTED BY THE BOARD OF ZONING ADJUSTMENTS BY THE FOLLOWING VOTE: AYES: Eadie, Spencer, Crosby NOES: None ABSENT: None ON MOTION BY CROSBY AND SECOND BY EADIE, USE PERMIT NO. 74-51 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan, elevations, and sign plan received October 10, 1974 shall be the approved layout, as amended, subject to the modifications described herein. a. The minimum setback for buildings on Elm Street shall conform to Ordinance Code requirements. b. Driveway dimensions shall be revised to conform to the amended conceptual plan. c. At least ten (10) parking spaces shall be provided in each of the main buildings to meet minimum standards, as shown on Exhibit "A". In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: . Traffic circulation and drives . Parking layout . Lot area • Lot width and lot depth . Type of use and its relation to property and improvements in the immediate vicinity . Past administrative action regarding this property • Apartment standard guidelines (S.9320.25) A plan delineating said modifications shall be submitted to the Secretary of the Board. If such plan complies with the modifications outlined by the Board, said plan shall be approved and made a permanent part of the administrative file. Minutes: H.B. The following plan shall be submitted to the Secretary of the Board: Landscape and irrigation plan complying with Article 979 of the Huntington Beach Ordinance Code and landscaping specifications on file in the Department of Public Works. Said plan shall be subject to approval by the Secretary of the Board. 3. In accordance with the City's Master Plan of Streets and Precise Plans, right-of-way on Keelson and Elm Streets shall be dedicated. 4. Soil and compaction reports shall be submitted by a certified soils engineer. Said report shall be submitted to the Department of Building and Community Development and shall be subject to approval by that Department. 5. Fire protection systems, including automatic sprinkler systems, fire hydrants, fire alarms, and any required fire protection devices shall comply with the specifications of the Huntington Beach Fire Code. Plans for such systems and devices shall be submitted to the Fire Department and shall be subject to approval by the Fire Department and Department of Public Works. 6. The developer shall participate in the local drainage assessment district. 7. Orange County Sanitation District #3 sewer fees shall be paid. 8. A Division of Land shall be filed to consolidate the two existing parcels into one lot. B. TO BE COMPLETED PRIOR TO FINAL INSPECTION: Keelson and Elm shall be improved to the center line of such right-of-way. Said improvement shall include curbs, gutters, sidewalks, paving, street trees, street lights, street signs, street drainage, and sewer and water main extensions in full compliance with the City of Huntington Beach street standards and requirements. C. GENERAL CONDITIONS: 1. If the developer proposes to provide air conditioning, the insulation in the ceilings shall be a minimum of R-19 and that in the exterior walls shall be a minimum of R-11; if no air conditioning is to be provided, the insulation in the ceilings shall be a minimum of R-13, and that in the exterior walls shall be a minimum of R-7. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them. 3. Natural gas outlets shall be stubbed in at the locations of clothes dryers, cooking facilities, water heaters, and central heating units to alleviate the possible drain on any one energy source. The Department of Building and Community Development will perform a comprehensive plan check relating to all ordinance code require- ments upon submittal of your completed structural drawings. Please be advised that the Board of Zoning Adjustments reviews the conceptual plan as a basic request for entitlement of the use applied for in relation to the vicinity in which it is proposed. The conceptual plan should not be construed as a precise plan re- flecting conformance to all ordinance code requirements. FINDINGS OF THE BOARD OF ZONING ADJUSTMENTS: 1. The establishment, maintenance, and operation of the use will not be detrimental to: a. The general welfare of persons residing or working in the vicinity. b. Property and improvements in the vicinity of such use or building. 2. All appearance guidelines stipulated by Apartment Standards have been substantially complied with. 3. The applicant has attempted to provide a quality living environment. 4. The granting of a Use Permit will not adversely affect the Master Plan of the City of Huntington Beach. 5. The proposal is consistent with the City's policy plan. Board of Zoning Adjustments Wednesday, October 30, 1974 Page 7 IN CONJUNCTION WITH: CONDITIONAL EXCEPTION NO. 73-58 Applicant: Larmor Development Company To permit zero side and rear yard setbacks in lieu of S.9163.2.1 and 5.9163.3 of the Huntington Beach Ordinance Code located on the Northeast corner of Delaware Avenue and Utica Street, in an R-2, Medium Density Residential District. The Chairman informed the Board that a communication had been received from the applicant requesting a three-week continuance in order to allow for revision of plans to meet code requirements. The Board concurred with the applicant's request. ON MOTION BY EADIE AND SECOND BY SPENCER, USE PERMIT NO. 73-79 WAS CONTINUED TO NOVEMBER 20, 1974 BY THE FOLLOWING VOTE: AYES: Eadie, Spencer, Crosby NOES: None ABSENT: None ON MOTION BY EADIE AND SECOND BY SPENCER, CONDITIONAL EXCEPTION NO. 73-58 WAS CONTINUED TO NOVEMBER 20, 1974 BY THE FOLLOWING VOTE: AYES: Eadie, Spencer, Crosby NOES: None ABSENT: None DIVISION OF LAND NO. 74-37 Applicant: Tait and Associates To permit the division of one legal parcel of land into two parcels, pursuant to S.9811.3 of the Huntington Beach Ordinance Code located on the southeast corner of Adams Avenue and Magnolia Street, approximately 310 feet east and south of the centerline of the intersecting streets, in a C-21 Community Business District. The Chairman informed the Board that this application is a Categorical Exemption, Class V, California Environmental Quality Act, 1970. Mr. H. McClard, representing Tait and Associates, addressed the Board and presented a brief overview of their proposal. Board discussion centered on reciprocal agreements and the possible need for revision of same; it was decided that a decision on this matter would be made following review of the existing agreements by the City Attorney's Office. Board of Zoning Adjustments Wednesday, October 30, 1974 Page 8 The Chairman stated that, in view of the existing development, the 20 foot access strip fronting on Magnolia Street would be deemed approved access by the Board, therefore validating the subject Division of Land. ON MOTION BY EADIE AND SECOND BY CROSBY, DIVISION OF LAND NO. 74-37 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: TO BE COMPLETED PRIOR TO USE OR OCCUPANCY OF SAID PARCELS FOR ANY PURPOSE: 1. This Division of Land shall not be effective until a Covenant and Agreement furnished by the Huntington Beach Planning De- partment is signed and recorded with the Orange County Recorder agreeing to these Conditions of Approval. 2. The tentative parcel map received by the Planning Department on October 11, 1974 shall be the approved layout. 3. A parcel map shall be filed with and approved by the Department of Public Works and recorded with the Orange County Recorder, (prior to issuance of a Certificate of Occupancy). 4. A copy of the recorded parcel map and Covenant and Agreement shall be submitted to the Planning Department. 5. If the existing reciprocal agreements for ingress/egress parking and circulation encompass the proposed Division of Land and are approved as to content by the City Attorney, said agreement on file shall satisfy approval of this Division of Land. If said agreement needs to be modified to insure the City that all parcels within the shopping center have mutual agreements, said agreement shall be modified and re -submitted for recordation, the form and content to be approved by the City Attorney. 6. No signs, other than those previously approved under the sign theme for the entire shopping center, shall be constructed. The applicant, Mrs. Susan Neill, was present. The Board discussed the application and Conditions of Approval. ON MOTION BY CROSBY AND SECOND BY EADIE, ADMINISTRATIVE REVIEW NO. 74-168 WAS APPROVED, WITH THE FOLLOWING CONDITION, BY THE FOLLOWING VOTE: 1. All requirements of Section 9730.14 of the Huntington Beach Ordinance Code shall be complied with. AYES: Eadie, Spencer, Crosby NOES: None ABSENT: None USE PERMIT NO. 74-52 Applicant: Alex Stavropoulds To permit the establishment of a warehouse, utilizing a portion of the building as an ancillary operation pursuant to S.9530 and 5.9530.2 of the Huntington Beach Ordinance Code located on the east side of Gothard Street, approximately 180 feet north of the center line of Heil Avenue, in an M-1, Light Industrial District. The Chairman informed the Board that this application is a Categorical Exemption, Class 3, California Environmental Quality Act, 1970. The applicant, Mr. Alex Stavropoulds, addressed the Board and presented a brief overview of his proposal. He stated that he is in need of additional warehouse space for the purpose of storing mattresses, chest beds, and corner groups. He further stated that, at some future date, he would like to utilize the front eight feet of the property for merchandise display purposes, however, at the present time, the primary function of the project will be for storage. Mr. Eadie questioned the applicant as to whether he planned to utilize the property for manufacturing purposes; the applicant responded affirmatively. I 1 Minutes: H.B. Board of Zoning Adjustments Wednesday, October 30, 1974 Page 10 Captain Vanderlaan, representing the Fire Department, outlined that department's requirements in relation to the proposal, i.e. layout of fire extinguishers, an interior layout sketch, and a depiction of the stacking pattern of the mattresses. The Chairman closed the Public Hearing. Conditions of Approval were discussed. ON MOTION BY EADIE AND SECOND BY CROSBY, USE PERMIT NO. 74-52 WAS APPROVED WITH THE FOLLOWING CONDITIONS AND FINDINGS, BY THE FOLLOWING VOTE: 1. A floor plan showing the physical layout of the mattress storage and heights will be submitted to the Fire Department prior to issuance of a Certificate of,Occupancy. 2. All requirements of Section 9530.1 of the Huntington Beach Ordinance Code shall be complied with. FINDINGS OF THE BOARD OF ZONING ADJUSTMENTS: 1. The applicant has agreed to comply with Ordinance Code requirements. 2. The use is consistent with other uses within the area. 3. All intents of the Ordinance Code have been established. 4. The proposal would not deplete parking regulations for the entire industrial development. AYES: Eadie, Spencer, Crosby NOES: None ABSENT: None MISCELLANEOUS: ADMINISTRATIVE REVIEW NO. 74-169 Applicant: Arthur Esquibel To permit the sale of Christmas trees, pursuant to 5.9730.16 of the Huntington Beach Ordinance Code located on the south side of Edinger Avenue, approximately 286 feet east of Gothard, in a C-4, Highway Commercial District. The Chairman informed the Board that this application is a Categorical Exemption, Class 3, California Environmental Quality Act, 1970. The applicant, Mr. Arthur Esquibel, was present. 1 Minutes: H.B. Board of Zoning Adjustments Wednesday, October 30, 1974 Page 11 Board discussion centered on the fact that the proposal did not meet requirements relating to off-street parking. The applicant stated that he had made several attempts to contact the owner of the adjacent property in order to attempt to lease some space for parking purposes, however, he stated that his attempts had been negative. The Board recommended that he continue his attempts and/or arrange for other off-street parking; the Chairman further advised the applicant that the plan could probably receive Board approval at its next meeting if he could provide proof of an agreement for a short term lease of the adjoining property for parking purposes; he further recommended a one - week continuance.
