ROLL CALL Present: Shipley, Bartlett, Gibbs, Matney, Wieder, Duke, Coen Absent: None INFORMAL MEETING CALLED Mayor Coen called an Informal Meeting of the Council as a Committee -of -the -Whole to meet with City Department Heads. RECESS The Mayor called a recess of the Council at 9.15 A.M. RECONVENE The meeting was reconvened by the Mayor at 3:25 P.M., with Councilman Matney absent from the room. REVENUE SHARING FUNDS - USE On motion by Shipley, Council agreed to modify the revenue sharing fund policy established July 16, 1973 by Resolution No. 3718, thus allowing the possible use for general operating expenses of unencumbered or unobligated revenue sharing funds; Council further placed a freeze on all revenue sharing funds presently not encumbered or obligated, through June 30, 1975 and directed the City Attorney to prepare a res- olution rescinding Resolution No. 3716 and making the desired modifications. The motion passed by the following roll call vote: AYES: Shipley, Bartlett, Gibbs, Wieder, Duke, Coen NOES: None ABSENT: Matney FISCAL RESPONSIBILITY RESOLUTION TO BE PREPARED A motion was made by Councilwoman Wieder, to direct the City Attorney to prepare a resolution similar to.the proposed ordinance on fiscal responsibility, to include all Department Heads, with modifications proposed by the Economic Advisory Commission, and directed the City Attorney to prepare a manual containing Council rules, regulations and policy, of which the Fiscal Responsibility Resolution will be made a part thereof. The motion was passed.by the following roll call vote.- AYES- Shipley, Bartlett, Gibbs, Wieder, Duke, Coen NOES: None ABSENT: Matney Page #2 - Council Minues - 11/14/74 _ 5 _ POLICY GUIDELINES - CLEARANCE ON FUNDING Mayor Coen directed that guidelines be prepared by the Productivity Committee to implement the provisions of the proposed Fiscal Responsibility Resolution. REAL PROPERTY TRANSFER TAX COLLECTION PROCEDURE On motion by Bartlett, Council directed the City Attorney to prepare a resolution trans- ferring $6,600 from the Contingency Fund to the City Treasurer's Budget, to finance the collection of the Real Property Transfer Tax. The motion was passed by the following roll call vote: AYES: Shipley, Bartlett, Gibbs, Wieder, Duke, Coen NOES: None ABSENT: Matney ORANGE COUNTY TRANSIT DISTRICT - CITY EMPLOYEE BUS PASSES On motion on by Shipley, Council directed the cancellation of the Orange County Transit Distract agreement as of January 1, 1975, regarding bus passes for City employees. The motion was passed by the following roll call vote: AYES: Shipley, Bartlett, Gibbs, Wieder, Duke, Coen NOES: None ABSENT: Matney HARBOR PATROL Discussion was held regarding whether or not the Harbor Patrol should be taken over by the Orange County Harbor Patrol. The Mayor directed the Productivity Committee to give the item high priority, with a recommendation to Council at the December 9, 1974 meeting, if possible, due to the possible transfer of personnel from one department to another by December 16, 1974. ECONOMIC ADVISORY COMMISSION TO MEET WITH CITY COUNCIL Mayor Coen advised Mr. William Winn that Council would like to meet with the Economic Advisory Commission at 5:30 P.M., on December 9, 1974. The Mayor suggested that the Commission prepare some recommendations and possibly in 45 days, Council and the Commission could meet and discuss specifics. CITY CLERK TO ADJOURN 12/2/74 MEETING On motion by Coen, Council directed the City Clerk to adjourn the regular meeting of December 2, 1974 to Monday, December 9, 1974 at 5:30 P.M. The motion was passed by the following roll call vote: AYES: Shipley, Bartlett, Gibbs, Matney, Wieder, Duke, Coen NOES: None ABSENT: None 1 Page 03 - Council Minutes - 11/14/74 SPECIAL ELECTION DISCUSSION - MAY 27, 1975 Considerable discussion was held as to which date Council wished to set the Special Election on the Real Property Transfer Tax. Councilman fluke suggested that a poll be sent out with the water bills and allow the people to respond as to what they want in taxes or lower level of services. Shirley Commons addressed the Council and expressed the stand of many citizens with whom she had spoken. She urged strongly that it be put on the ballot at the earliest possible time. Further discussion was held by the City Attorney, Finance Director and Council. The March, 1975, ballot date was first deemed the best, if possible, by some of the Council members, but discussion was held on the possibility of one or more school districts not favoring the consolidation and precluding March as the date. The City Administrator stated that new state legislation would allow the fourth Tuesday in May of the odd years as an extra date to hold an election. Discussion was held on possible revenue producing ordinances which could be prepared should the ballot measure eliminate the transfer tax. The City Attorney gave several alternatives on this matter. Further discussion was held on the feasibility of meeting the March date. The City Clerk expressed the problems involved. A poll was taken on choices of election dates. The outcome of the poll was four for March, one for May and two neither. The revenue ordinances were again discussed. The City Attorney discussed the complications his office faced preparing a list of cutback choices for the ballot, with such limited time scheduling. Councilwoman Gibbs withdrew her poll for the March election date. CITY BALLOT PROPOSITION - 5,127174 On motion by Coen, Council directed the City Attorney to prepare a ballot proposition to enable the electorate to select the level of services they desire. The motion was passed by the following roll call vote: AYES: Shipley, Bartlett, Gibbs, Matney, Wieder, Duke, Coen NOES: None ABSENT: None REAL PROPERTY TRANSFER TAX ELECTION - 5/27/74 On motion by Coen, Council set Tuesday, May 27, 1975 as the date for a Special Muni- cipal Election on the Real Property Transfer Tax Charter Amendment., The motion passed by the following roll call vote: AYES: Shipley, Bartlett, Gibbs, Matney, wieder, Coen NOES: Duke ABSENT: None Page #4 -- Council Minutes 11/14/74 ANNOUNCEMENTS -- CITY ADMINISTRATOR Mr. Rowlands announced plans for a joint meeting on November 18, 1974 at 5:30 P.M., with the Library Board, during the adjourned meeting of the City Council. He also announced plans to -meet with the Planning Commission at the November 25, 1974 adjourned regular -meeting and possibly the Personnel Board.
