Buck To permit the construction of a professional office building, pursuant to Section 9401 of the Huntington Beach Ordinance Code, located on the southeast corner of Main Street and Huntington Avenue, in an R5, Office Professional District. The applicant was not present. The Chairman informed the Board that the applicant had verbally requested withdrawal of this application and would subsequently submit a written communication to that effect; the Board concurred with the applicant's request. ON MOTION BY EADIE AND SECOND BY CROSBY, ADMINISTRATIVE REVIEW NO. 74-145 WAS WITHDRAWN BY THE FOLLOWING VOTE: AYES: EADIE, NOES: NONE ABSENT: NONE SPENCER, CROSBY Huntington Beach Board of Zoning Adjustments November 13, 1974 Page 2 CONDITIONAL EXCEPTION NO. 74-62 (Continued from 11-6-74) Applicant: Pacific City Bank To permit a two (2) foot reduction in the minimum ground clearance of ten feet to an existing pole sign, in lieu of S.9765.5.2 of the Huntington Beach Ordinance Code, located on the west side of Goldenwest, approximately 100 feet south of Edinger Avenue. The Chairman informed the Board that this application is a Categorical Exemption, Class V, California Environmental Quality Act, 1970. The Chairman indicated that Conditional Exception No. 74-62 was a Continued Public Hearing. Mr. D. Walters, president of Pacific City Bank, addressed the Board. He cited an oversight in his organization's planning as the reason for the present situation, which necessitates the application for a Conditional Exception. As justification for hardship, he cited the fact that lack of exterior identification for prospective tenants in the upper portion of the building would prove to be a definite detriment in the possibility renting or leasing, thereby causing his organization a substantial economic hardship. There being no other parties present to speak for or against the proposal, the Chairman closed the Public Hearing. Board discussion centered on the previous approval of the original sign request; Pat Spencer noted that at that time, the applicant had indicated that no additional sign space would be required other than the maiquee sign, which was approved: It was the consensus of the Board that the applicant's justification for hardship relating to economic reasons was valid, however did not constitute sufficient reason for approval of the exception, and that granting of same could set a precedent not beneficial to the City. The Board further concurred that the applicant and staff should meet in order to discuss possible alternatives to the proposal. Mr. Walters concurred with this suggestion, and requested a two -week continuance for same. The Chairman informed the Board that this application is a Categorical Ex- emption, Class III, California Environmental Quality Act, 1970. The applicant, Mr. Arthur Esquibel, was not present. The Chairman informed the Board that a communication had been received from Manning's Restaurant agreeing -to allow the applicant use of eight of Mannings' parking spaces during the period of operation of the Christmas tree lot. The Board concurred that further clarification should be ob- tained as to the document's validity. In view thereof, the Chairman recommended a one -week continuance. Boutwell To permit the establishment of a Christmas tree lot, pursuant to S.9730.16 of the Huntington Beach Ordinance Code, located on the southeast corner of Slater Avenue and Gothard Street, in an M1-CD, Light Industrial - Civic District. The Chairman informed the Board that the applicant had submitted a written communication requesting withdrawal of this application; the Board con- curred with the applicant's request. ON MOTION BY EADIE AND SECOND BY CROSBY, ADMINISTRATIVE REVIEW NO. 74-170 WAS WITHDRAWN BY THE FOLLOWING VOTE: AYES: EADIE, SPENCER, CROSBY NOES: NONE ABSENT: NONE C Huntington Beach Board of Zoning Adjustments November 13, 1974 Page 4 CONDITIONAL EXCEPTION NO. 74-63 Applicant: Robert Brown To permit a three (3) foot encroachment into the minimum required ten (10) foot rear yard setback, in lieu of Section 9103.3 of the Huntington Beach Ordinance Code, located on the east side of DeLong Circle, approximately 393 feet south of the center line of Price Drive, in an R1, Low Density Residential District. The Chairman informed the Board that this application is a Categorical Exemption, Class V,_California Environmental Quality Act, 1970. The Chairman opened -the Public Hearing. The applicant, Mr. Robert Brown, addressed the Board and stated that he proposed to build a one-story addition to his home; however, due to the irregular size and'shape of his lot, an encroachment was unavoidable; he further stated that the encroachment as proposed is the most logical. Mr. Myron Jackson, adjoining property owner, addressed the Board and re- quested clarification regarding the proposed encroachment; the Chairman explained that it would consist of a three (3) foot encroachment into the ten foot rear yard setback, measured from Mr. Brown's property line There being no other parties present to speak for or against the proposal, the Chairman closed the Public Hearing. The Board discussed the proposal and concurreyo with the applicant in that the lot's irregular shape necessitated an encroachment, and that the most' logical site was as proposed by the applicant. ON MOTION BY SPENCER AND SECOND BY CROSBY, CONDITIONAL EXCEPTION NO. 74-63 WAS APPROVED WITH THE FOLLOWING FINDINGS, AND FOR THE FOLLOWING REASON: FINDINGS OF THE BOARD: 1. The granting of the Conditional Exception would not constitute a granting of a special privilege inconsistent with other properties in the vicinity. 2. The granting of the Conditional Exception is necessary to preserve the enjoyment of basic property rights. 3. The granting of the.Conditional Exception would not be materially detrimental to the public welfare, or injurious to property in the vicinity. 4. The granting of the Conditional Exception does not adversely affect the City's General Plan of Land Use. REASON: Due to the shape of the lot, the strict application of setback re- quirements was found to deprive subject property of privileges enjoyed by other properties in the vicinity. Gorman To permit the sale of Christmas trees, pursuant to S.9730.16 of the Huntington Beach Ordinance Code, located on the east side of Beach Boulevard, approximately 144 feet south of Garfield Avenue, in a C2, Community Business District. The Chairman informed the Board that this application is a Categorical Exemption, California Environmental Quality Act, 1970. The applicant, Gary Gorman, was present and offered the Board a brief overview of his proposal. Board discussion centered on the necessity for the applicant to provide off-street parking and adequate ingress/egress to the site. ON MOTION BY CROSBY AND SECOND BY SPENCER, ADMINISTRATIVE REVIEW NO. 74-176 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: 1. The plot plan received November 1, 1974 shall be the approved layout. 2. The applicant shall comply with S.9730.16 of the Huntington Beach Ordinance Code. 3. The applicant shall obtain all necessary electrical permits. 4. An on -site inspection by the Fire Department shall be required prior to opening. 5. Points of ingress and egress will be subject to inspection by the Traffic Engineer. In addition, the arrangement of the on -site parking area shall be subject to inspection by the Traffic Engineer. Gorman To permit the sale of Christmas trees, pursuant to S.9730.16 of the Huntington Beach Ordinance Code, located on the west side of Beach Boulevard, approxi- mately 245 feet north of Warner Avenue, in a C4, Highway Commercial District. The Chairman informed the Board that this application is a Categorical Exemption, Class III, California Environmental Quality Act, 1970. The applicant, Gary Gorman, was present and offered the Board a brief overview of his proposal. The Board discussed the proposal and Conditions of Approval. ON MOTION BY SPENCER AND SECOND BY CROSBY, ADMINISTRATIVE REVIEW NO. 74-177 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: Huntington Beach Board of Zoning Adjustments November 13; 1974 Page 6 Administrative Review No. 74-177 (Continued) 1. The plot plan received November 1, 1974 shall be the approved layout. 2. The applicant shall comply with S.9730.16 of the Huntington Beach Ordinance Code. 3. The applicant shall obtain all necessary electrical permits. 4. An on -site inspection by the Fire Department shall be required prior to opening. AYES: EADIE, SPENCER, CROSBY NOES: NONE ABSENT: NONE ADMINISTRATIVE REVIEW NO. 74-166 Applicant: Ray Johnson To permit the construction of an industrial building, pursuant to S.9530 of the Huntington Beach Ordinance Code, located on the east side of Gothard Street, approximately 230 feet south of the centerline of Cain Street, in an Ml, Light Industrial District. The Chairman informed the Board that this application was granted Exemption Declaration No. 74-158 by the Environmental Review Board on November 5, 1974. The applicant, Mr. Ray Johnson, was present and offered the Board a brief overview of his proposal. The Board discussed the proposal with the appli- cant and found it to require revisions in several areas, as follows: It was noted that the plan is drawn incorrectly in relation to the property line location; the plan showsa 50 foot half right of way from the center line of Gothard with a 10 foot setback; the applicant was informed that, this should be a 40 foot right of way with a ten foot setback. The plan is deficient in the areas of ingress and egress, parking, and circulation. The Board noted that it would be necessary for the applicant to reduce the building dimension by four feet in order to provide the re - quired parking, a 25' turning radius, and perpendicular 90 degree parking. The applicant stated that he did not wish to reduce the size of the building, and stated that he would work out an alternative proposal. Bruce Crosby informed the applicant that, due to the master plan of storm drains, he would be required to provide a 10 foot wide easement and pipeline for storm drain purposes; however, he was further informed that the entire expense of construction of the pipeline would be 100% reimbursable by the City at such time as the City began improving the property area. The Board concurred that this application should be continued in order to allow the applicant time to revise his plans to correct the above -noted deficiencies. Bruce Crosby suggested that the applicant's architect contact the Public Works Department if assistance was required regarding the easement and storm drain portion of the plan. The applicant requested a two -week continuance. 1 . Motshagen To permit the construction of a general contractor's storage yard and office, pursuant to S.9530 of the Huntington Beach Ordinance Code, located on the southeast corner of Gothard Street and Triece Street, in an M1-CD, Light Industrial Civic District. The Chairman informed the Board that this application is a Categorical Exemption, Class I, California Environmental Quality Act, 1970. The applicant, Gary Motshagen, was present and offered the Board a brief overview of his proposal. Bruce Crosby reviewed the plot plan with the applicant, indicating the areas that would require dedication; it was noted that after all necessary dedications were accomplished, there was not sufficient property remaining to allow construction. In view of the above, the applicant requested withdrawal of his application; the Board concurred with the applicant's request. ON MOTION BY EADIE AND SECOND BY SPENCER, ADMINISTRATIVE REVIEW NO. 74-178 WAS WITHDRAWN BY THE FOLLOWING VOTE: AYES: EADIE, SPENCER, CROSBY NOES: NONE ABSENT: NONE ADMINISTRATIVE REVIEW NO. 74-179 Applicant: Von's Grocery Company To permit the establishment of a Christmas tree lot, pursuant to S.9730.16 of the Huntington Beach Ordinance Code, located on the northeast corner of Brookhurst Street and Adams Avenue, in a C2, Community Business District. The Chairman informed the Board that this application is a Categorical Exemp- tion, Class III, California Environmental Quality Act, 1970. Mr. James Stewart, representing the applicant, was present and offered the Board a brief overview of the proposal. Bowman, Jr. To permit the establishment of a Christmas tree lot, pursuant to S.9730.16 of the Huntington Beach Ordinance Code, located on the east side of Magnolia Street, approximately 415 feet south of the center line of Adams Avenue in a C2, Community Business District. The Chairman informed the Board that this application is a Categorical Exemption, Class III, California Environmental Quality Act, 1970. The applicant, William B. Bowman, Jr., was present and offered the Board a brief overview of his proposal. The Board discussed the proposal and noted that off-street parking would be required, as well as directional signs indicating same. Conditions of Approval were discussed. ON MOTION BY CROSBY AND SECOND BY SPENCER, ADMINISTRATIVE REVIEW NO. 74-182 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: 1. The plot plan received November 6, 1974 shall be the approved layout. 2. The applicant shall comply with S.9730.16 of the Huntington Beach Ordinance Code. 3. The applicant shall obtain all necessary electrical permits. 4. An on -site inspection by the Fire Department shall be required prior to opening. The Board discussed the proposal and Conditions of Approval. ON MOTION BY EADIE AND SECOND BY CROSBY, THE ABOVE -NOTED REQUEST FOR A SPECIAL EVENT WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: 1. The storage bin shall be located behind the building; or, if this is physically impossible, location shall be subject to approval by the Director of the Department of Building and Community Development. 2. All placements of storage bins shall be subject to inspection by the Department of Building and Community Development. 3. A maximum of two (2) signs shall be permitted, as follows: One (1) sign, 60 square feet or less, or Two (2) signs, 30 square feet or less. No sign dimension shall exceed ten (10) feet. 4. Placement of signs will be subject to on -site inspection by the Department of Building and Community Development. 5. No illumination of the area will be allowed, other than what is normally provided for the Standard Station sites. 6. The tire sale shall be conducted for no longer than two (2) consecutive weeks, from commencement of the sale to conclusion.
