Mr. Jim Palin addressed the -Commission and gave a brief history
of the applications. He discussed the Subdivision Committee
meeting and the three alternatives that the applicant had
prepared, renderings of which were on display.

Mr. Lynch, representing Kendall Development Co., addressed the _
Commission and discussed the three Alternatives. He stated that
it was inidcated that Alternative A, the original plan, would re-
quire costly maintenance of landscaping and for this reason the
developers did not prefer this plan. The density in all three
plans is approximatley the same. There was a discussion on parking
and circulation patterns.
The public hearing was closed.,
Commissioner Porter stated that he did not like any of the Alternatives
on display and Commissioner Finley concurred with him. Commissioners
Boyle, Higgins, Bazil, and Kerins preferred Alternative B. There
was a discussion on the legality of the Alternatives being classified
as a Planned Development project. Deputy City Attorney O'Connor
was requested to obtain an opinion on this question.

CONDITIONAL USE PERMIT NO. 74-04 and

Applicant: Ring Brothers Corporation
Tentative Tract Map No. 5664 and Conditional Use Permit No. 74-04,
filed on April 10, 1974, are requests to permit a 154 unit planned
development on a 13.5 acre parcel of land pursuant to Article 931
of the Huntington Beach Ordinance Code. Subject property is located
on the northwest corner of the intersection of Bushard and Brookhurst
Streets.
Mr. Jim Palin addressed the Commission and discussed the history of
the application. Vugraphs and slides were shown and maps were on
display for viewing by the Commission.
The Chairman opened the public hearing.
Mr. Gary Thompson, Vice President of Planning for Ring Brothers,
stated that he would like to respond to any questions the Commission
might have. He further stated thatthe developers had been negotiating
with Ayres, owner of abutting property, and had been unable to acquire
their parcel. There was a discussion on fencing and the option of
electrical cooking units being available to buyer.

Mr. Dave Diamond addressed the Commission and spoke in
opposition to the project, citing that it could not be
approved in June 1975 because it would not comply with
flood control laws. He noted that it would also put a
burden on the schools.
Mr. Ken Reynolds, resident of adjoining property, addressed
the Commission and gave a history of zoning and past proposed
developments which had not materialized. He stated that the
area as it exists is unsightly and used as a dumping ground.
He stated that schools are now operating on a normal class
room basis, with the temporary structures_ abandoned, and
the students generated from the proposed development would
not place a burden on the schools. He stated that he, as
a long time resident of the neighborhood, would recommend
the development of'the property.
The public hearing was closed.
Commission discussed the flood danger, acquisition of adjoining
property, and need for firm commitment about oil drilling, as
well as reorientation of the six plexes on the proposed plan,
which had been suggested earlier by Mr. Reynolds.

CONDITIONAL USE PERMIT NO. 74-20
Applicant: Presley of Southern California
Conditional Use Permit No. 74-20 is a request to permit construction
of 69 residential units on 5.4+ acres on the southwest corner of
Garfield and Seventeenth in an R-2 district. It was filed to allow
an amendment to a project which was filed and approved`in 1973.
Mr. Jim Palin addressed the Commission and gave a brief history
of the application. Vugraph and aerial slides were shown.
The Chairman opened the public hearing.
Mr. Gary Gitts, Project Coordinator for the applicant, addressed
the Commission and briefly described the project through the use
of architectural renderings and landscape plans on display. Land-
scaping was discussed and the use of berming in landscaping.
Mr. James Yeag, architect, addressed the Commission and discussed
the size of the units and bedroom and bath count on the different
units.
The Chairman closed the public hearing.
Conditions of approval were discussed.
ON MOTION BY BOYLE AND SECOND BY GEIGER CONDITIONAL USE PERMIT NO.
74-20 WAS APPROVED WITH THE FOLLOWING CONDITIONS BY THE FOLLOWING
VOTE:
1. The Precise Plan received November 15, 1974 shall be the approved
layout.
2. All streets shall be improved in compliance with standard plans
and specifications on file with the Department of Public Works.
3. Vehicular access rights to Delaware Street and Garfield Avenue
shall be dedicated to the City except at the intersection of private
drives with such streets.
4. Drainage for the development shall be approved by the Department
of Public Works prior to the issuance of the grading permit and/or
recordation of a final map for the project. This drainage system
shall be designed to provide for siltation -and erosion control, both
during and after construction of the project.
5. The project shall participate in"the local drainage assessment
district.
6. Water supply shall be through the City of Huntington Beach's water
system.

7. The sewer and water system shall be constructed by the
developer and dedicated to the City of Huntington Beach.
B. Sewage disposal shall be through the City of Huntington
Beach's sewage system.
9. The water and fire hydrant system shall be approved by
the Department of Public Works and Fire Department.
10. A minimum of six foot high masonry wall (measured from
the highest elevatio4 shall be constructed on all interior
boundary lines of the proposed project where abutting
other properties.
11. The landscaping and wall treatment along 17th Street shall
be constructed in conformance with the plans reviewed by
and approved by the Planning Commission at the time of
action on Conditional Use Permit No. 74-20.
12. The CC&R's shall prohibit the storage of recreation vehicles
within the development.
13. Any existing capped oil wells on the property shall'be verified
as to compliance with present oil codes of the City of
Huntington Beach and State of California.
14. If the developer proposes to provide air conditioning, the
insulation in ceilings and exterior walls shall be a minimum
of R-19 and R-11, respectively. If no air conditioning is
to be provided, the insulation in ceilings and exterior walls
shall be a minimum of R-13 and R-7, respectively.
15. All building spoils, such as unusable lumber, wire, pipe, and
other surplus or unusable material, shall be disposed of
at an off -site facility equipped to handle them.
16. Natural gas and 220V electrical shall be stubbed in at the
location of clothes dryers. Natural gas shall be stubbed in
at the locations of cooking facilities, water heaters, and
central heating units.
17. Double -paned windows or a similar substitute, with accompanying
data from an acoustical engineer, shall be installed within the
units facing onto Garfield Avenue and Delaware Street.
18. An engineering geologist shall be engaged to submit a report
indicating the ground surface acceleration from earth move-
ment for the project property.

19. Calculations for footings and structural members to withstand
anticipated g-factors shall be submitted to the City for review.
20. A chemical analysis, as well as tests for physical properties of
the soil on subject property shall be submitted to the City for
review prior to the issuance of building permits.

Applicant: Huntington Beach.Industrial Park
Tentative Map No. 8746 is a request to permit the subdivision of
approximately 40.4 gross acres of land into a 47 lot industrial
subdivision located on the west side of'Graham north of Edinger
Avenue.
Zone Change No. 74-19 is a requast for change of zone from M1A
to 100-M1A-20,000 located on the south side of McFadden Avenue
west of Graham Street, 1160 feet west of McFadden/Graham and
1320 ft. south of McFadden/Graham.
Mr. James Palin showed slides of the property.
Mr. Don Steffensen, representing the applicant, addressed the Commission
and commended the Staff in their review of the project. Conditions
of approval were discussed.
Ms. Barbara Losonti addressed the Commission and requested clari-
fication of the applications, and after some discussion stated she
had Do pbject'ons to the applications. Ms. Janice Cannon addressd the
Commission anA expressed objections to the applications.
Conditions of approval were discussed. Mr. John Cope stated that
the Zone Change would be consistent with the Land Use Element of
the General Plan.

ON MOTION BY BOYLE AND SECOND BY PORTER TENTATIVE TRACT NO.
8746 WAS APPROVED WITH THE FOLLOWING CONDITIONS AND BY THE
FOLLOWING VOTE:
1. The tentative map received September 27, 1974 shall be
the approved layout.
2. A determination on the deletion of McFadden Avenue from the
Master Plan of Arterial Streets and Highways on the portion
between Graham Street and Bolsa Chica shall be made prior to
the recordation of a final map on the subdivision.
3. All required setbacks shall be measured from the property
line and/or easement line whichever is greater.
4. All vehicular access rights along Graham Street shall be
dedicated to the City of Huntington Beach except at street
intersections.
5. All street improvements on McFadden, Graham and the local
streets within the proposed subdivision shall be accomplished
in compliance with the standard plans and specifications on
file in the Department of Public Works. The plan for
termination of McFadden Avenue shall be reviewed for approval
action prior to any street improvements being installed
adjacent to Lot one.
6. Drainage for the subdivision shall be approved by the
Department of Public Works prior to recordation of a final
map. The drainage system shall be designed to provide for
siltation and erosion control both during and after con-
struction of the industrial park.
7. A conceptual landscaping plan shall be submitted to the Planning
Department for approval prior to the issuance of any building
permit on parcels 1 through 22 inclusive, to provide for a
buffer landscaping strip between the industrial properties
and Rl properties to the west.
8. Soils and compaction reports shall be submitted to the
Department of Building and Community Development and
Department of Public Works prior to the issuance of
Building permits. Such report shall be submitted by
a qualified soils engineer.
9. An eight foot high decorative masonry wall shall be
constructed along the westerly property line of Lots 1
through 22. Such wall shall be constructed at the time
of initial development of the subdivision and shall be
installed as one project to eliminate the intrusion upon
the R1 areas to the west.

10. The vacation of the 13.5 ft. on the west side of Graham
Street shall be acomplished prior to the recordation
of a final map on this subdivision.
11. No final map shall be recorded prior to Zone Change 74-19
becoming effective.
12. A six foot high masonry wall measured from the highest
side shall be constructed along the south property line.

Applicant & Subdivider: Gordon & Richard Mountjoy
Tentative Tract Map 87-88 "X" filed on September 11, 1974 is a
request to permit the subdivision of approximately 14.09 acres
of land into 18 individual parcels for industrial development.
The property is located on the east side of Gothard approximately
630 feet south of Talbert Avenue.
Mr. Jim Palin addressed the Commission. Slides of the subject
property were shown.
Commission discussed conditions of approval and recommendations
of the Environmental Review Board.
ON MOTION BY PORTER AND SECOND BY HIGGINS TENTATIVE TRACT NO.
8788 "X" WAS APPROVED WITH THE FOLLOWING CONDITIONS BY THE
FOLLOWING VOTE:
1. The tentative map received September 11, 1974 shall be the
approved layout in concept for future parcel maps to be recorded
thereon. All streets proposed and as shown on the tentative
map shall be fully improved prior to recordation of a parcel
map for any one parcel on the proposed subdivision. Such
streets shall conform with standard plans and specifications
on file with the Department of Public Works.
2. A detailed hydrology study shall be completed and submitted to
the Director of Public Works for approval action prior to
installation of the streets as shown upon the tentative map.
This study shall include the method and system proposed to
properly handle surface drainage for this proposed development.
The drainage system shall also include a design to provide for
siltation and erosion control both during and after construction
of the project.

3. All vehicular access rights along Gothard Street shall be
dedicated to the City of Huntington Beach except at street
intersections and one location on the common property line
between Lots 7 and 10 as shown on the tentative map.
4. Soils and compaction reports shall be submitted to the Depart-
ment of Building and Community Development and Department
of Public Works prior to the issuance of building permits.
Such reports shall be submitted by a qualified soils engineer.
All structures constructed within this project shall comply
with these report recommendations.
5. Detailed site plans for each parcel to be developed shall be
submitted to the Board of Zoning Adjustments for review and
action. These plans shall be approved prior to the recordation
of any parcel map for any parcel within the proposed project.
6. Access shall be limited on Gothard Street to one driveway only,
to afford access to Lots 7 and 10. All other vehicle access
rights shall be dedicated to the City, except at street inter-
sections. This will prohibit driveways onto Gothard from Lots
1, 6, 15, and 16. This will facilitate traffic flow, thereby
reducing impacts upon the ambient air quality.
7. Applicant shall consider, through design and location, the
impacts that may be generated by air compressors and/or
pumps within the project to reduce the impacts of noise by
the use of additional walls and/or orientation of the
facilities to the buildings.
8. All building spoils, such as unusable wire, pipe, or.other
surplus or unusable materials, shall be disposed of at an
offsite facility equipped to handle them.
9. Street improvements shall be constructed as one project to
eliminate the adverse impacts of phases construction work.
10. No rail service shall be provided to the use on Lot No. 18.
11. A subsequent review shall take place on any or all uses
proposed within the project at the time of the Administrative
Review application if such uses do not fall within the norm
for environmental effects, as assessed by the Environmental
Review Board.
12. The proposed CC&R's shall be submitted to the Planning
Commission for review at the time that body takes action on
the Tentative Tract Map.
13. Building materials of the proposed structures shall be as
indicated by the applicant at•the time of this review (to be
of masonry type, of tilt -up and/or concrete block construction)

14. The developer shall attempt to encourage whenever possible
the use of public transportation by employees of the
industrial uses (this will comply with a mitigating measure
set forth in the above mentioned Lusk Industrial Park Environ-
mental Impact Report 73-16, to alleviate impact upon air
quality).

CONDITIONAL EXCEPTION 74-60 - APPEAL
Applicant and Appellant: D'Ambra, Inc.
Conditional Exception No. 74-60 is a request to permit a reduction
in the minimum open space requirement, in lieu of S.9103.3.11.3,
as the result of a proposed 300 ft. room addition located on the
south side of Silverhead Circle, approximately 300 ft. east of
Collins, in an Rl, Single Family Residential District.
The Board of Zoning Adjustments denied this application at its
October 9, 1974 meeting for the reason that the encroachment
into the open space area is substantial and justification
presented to the Board failed to demonstrate hardship.
Dave Eadie addressed the Commission and showed aerial slides
of the area.
The Chairman opened the public hearing.
Mr. Muxo, owner of the property, addressed the Commission and
presented a letter of approval of the proposed addition signed
by his neighbors. He stated that he needed the room to improve
the environment for raising his family.
Mr. D'Ambra addressed the Commission and stated that the con-
figuration of the lot presented a hardship, that Mr. Muxo had
been advised at the time of the purchase of the property that he
could add on to the property, and for this reason he had obtained
his loan before attempting to acquire permission from the -City to
build.
Mr. Alex Stewart, adjoining property owner, addressed the Commission
and stated that he had known the Muxo family for two and one-half
years, they were a close family, and the neighbors had no objection
to their adding on to their home to make it a better living environment.
He stated that he felt the Appeal should be approved.

ON MOTION BY GEIGER AND SECOND BY PORTER CONDITIONAL EXCEPTION
NO. 74-60 APPEAL WAS APPROVED FOR THE FOLLOWING REASONS AND
WITH THE FOLLOWING CONDITION BY THE FOLLOWING VOTE:
1. Granting this conditional exception will not constitute
a grant of special privilege inconsistent with other
properties in the vicinity and under the same identical
zone classification in that the shape and size of other
properties involved would allow the type of construction
proposed without a conditional exception.
2. Special circumstances are applicable to the subject
property in that it is at the end of a cul-de-sac and
of an unusual shape unlike the majority of other properties
in the surrounding area and strict application of the
zoning ordinance would deprive the subject property of the
same privileges enjoyed by other properties in the vicinity.
3. Granting of this conditional exception is necessary to allow
this property to develop in the same manner as the
majority of surrounding properties and to preserve the
right of the occupants to a dwelling of sufficient size
to accommodate family needs.
4. Granting of this conditional exception will not be materially
detrimental to the public welfare or injurious to property
in this same zone classification in that it involves only a
minor intrusion on required open space.
5. Granting of this conditional exception will not have any
effect on the master plan of the City of Huntington Beach.
CONDITION:
All other applicable provisions of the Huntington Beach Ordinance
Code shall be complied with.

Proposed CODE AMENDMENT NO. 73-30 (Design Review Board)
Dave Eadie addressed the Commission and outlined the Code
Amendment. He stated that it would give the Design Review
Board final approval on civic districts which they did not have
before. Commission discussion followed.
Staff was directed to set for public hearing.
WRITTEN COMMUNICATIONS:
Letter from Robert J. Zinngrabe and Joe Schaffer requesting
modification to the conditions of approval for Tentative
Tract 8471
Mr. Zinngrabe addressed the Commission and showed slides of
the partially completed wall between Mr. Zinngrabe's and Mr.
Schaffer's property. He suggested that perhaps a wall could
be built of 42" height rather than a six foot high wall, or
that a wall be placed inside Mr. Schaffer's property line with
landscaping jointly planted and maintained for a more pleasing
effect.
Commission expressed concern over the safety factor of a 42"
wall insofar,as safety of children is concerned.
ON MOTION BY HIGGINS AND SECOND BY BAZIL PROBLEM WAS REFERRED
TO STAFF WITH RECOMMENDATION THAT CONSIDERATION BE GIVEN TO
SAFETY FACTOR INSOFAR AS CHILDREN ARE CONCERNED.

Commissioner Boyle discussed the 33 page report prepared by
South Coast Regional Commission which outlined certain powers
which would overrule City Council and Planning Commission and
requested Staff to procure copies for Commission's perusal.

Commissioner Geiger discussed the safety factor on the bicycle
trails, and expressed his concern. Staff was'directed to set
for discussion on November,26, 1974 Study Session.

Commission discussed the problem of dumping on vacant land through-
out the City, Mr. Spencer stated that he would check .Yorktown and
Adams near Newland Home. Secretary Harlow stated that he, Mr.
Behrens, and Mr. Hartge had plans to check throughout the City for
those areas where this -problem exists which had also been of concern
to Councilwoman Wieder.
Commissioner Porter discussed the report from a Deputy City Attorney
on Billboards. John O'Connor stated that he wquld request from
Mr. Bonfa a report on this issue.
Chairman Kerins requested that at the November 26 meeting the staff
would bring information concerning zone change on Garfield School
Site.
Commission and Staff discussed the Work Program and priorities.
There was a discussion on the effect that the Housing and Community
Development program, EPA regulations and F.I.A. program would have
on the Planning Department`Work Program.
Commissioner Geiger discussed the Transportation Subcommittee Meeting
and stated that this Committee reached a consensus that Secretary
Harlow should initiate correspondence to OCTD-requesting information
on what level of service that may be available and would hope to
have response prior -to next meeting with OCTD. He noted that Sub-
committee felt the City should pursue Dial -A -Ride and an Alpha type
route or route down Warner.'
Chairman Kerins directed a member of Staff to contact Margaret
Carlbert, Environmental Council, concerning bicycle trails.
Commissioner Geiger will work with Ed Selich and Margaret Carlberg.
STAFF COMMENTS:
Mr. Jim Palin discussed action of City Council at their'November 18, 1974
meeting.
