IN CONJUNCTION WITH: Conditional Exception No. 7;c-58 (Continued from 10-30-74) Applicant: Larmor Development Company To permit zero side and rear yard setbacks in lieu of S.9163.2.1 and S.9163.3 of the Huntington Beach Ordinance Code, located on the northeast corner of Delaware Avenue and Utica Street, in an R2, Medium Density Residential District. The Chairman informed the Board that these applications were granted Exemption Declaration No. 73-207 by the Environmental Review Board on October 16, 1974. He further informed the Board that the applicant had failed to respond to our correspondence of November 15, 1974 requesting revised plans for the applica= tions, or a withdrawal of same. The Chairman recommended a one -week continuance of the applications; he further stated that the applicant would be notified that, unless the Board receives some input prior to the next hearing of these applications, it would be forced to render a definitive decision of denial without prejudice. The Chairman informed the Board that this application is a Categorical Exemption, Class III, California Environmental Quality Act, 1970. Mrs. Marie Esquibel represented the applicant. The Board discussed the letter of authorization from Manning`s Restaurant granting permission for the,applicant to utilize eight (8) of their parking spaces during operation of the lot, and concurred that the letter could be accepted as authentic. Mr. David Thatcher represented the applicant. 3 The Board reviewed the plan and noted that the applicant had requested permission for on -street parking; Mr. Thatcher was advised that code regulations prevented the Board from granting this request. Alternative methods for providing parking were discussed; the Board recommended that the applicant obtain an obstruction permit from the Public Works Department to permit the installation of material, i.e. pipe and asphalt, thus pro- viding a temporary driveway for access to the property and parking. The applicant concurred with this recommendation. The Board discussed Conditions of Approval. ON MOTION BY EADIE AND SECOND BY SPENCER, ADMINISTRATIVE REVIEW NO. 74-190 WAS APPROVED WITH THE FOLLOWING CONDITION AND FINDINGS, BY THE FOLLOWING VOTE: CONDITION OF APPROVAL: The applicant shall install a service panel to facilitate conversion to under- ground utilities at a future date, pursuant to S.9730.11 of the Huntington Beach Ordinance Code. FINDINGS OF THE BOARD: The Board has considered all criteria for approval of overhead utilities, and all criteria has been satisfied, pursuant to Section 9730.10 of the Huntington Beach Ordinance Code. The Chairman informed the Board that this application is covered by Exemption Declaration No. 73-172, granted to Tentative Tract 7899 by the Environmental Review Board on September 5, 1973. In view of the fact that a representative for the applicant was not present at the meeting, the Chairman recommended a one -week continuance. Robinson To permit the construction of two industrial buildings, pursuant to S.9511 of the Huntington Beach Ordinance Code, located on the south side of Research Drive, intersecting at Container Lane, in a 100 M1-A-15,000 Restricted Manufacturing District. The Chairman informed the Board that this application is within the area covered by Environmental Impact Report No. 73-16, which was approved by the City Council on March 18, 1974. The applicant, Mr. Edwin A.'Robinson, was present; also present was Mr. Bob Harding. The Board reviewed the plot plan. Discussion centered on the need for a 25' setback from the property line, as well as the need for improved traffic maneuverability; the Board recommended a reduction in the trash storage area in order to accommodate larger parking stalls, thereby providing the improved maneuverability. Conditions of Approval were discussed. ON MOTION BY CROSBY AND SECOND BY SPENCER, ADMINISTRATIVE REVIEW NO. 74-181 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan received November 6, 1974 shall be the approved layout, subject to the modifications described herein: a. Reflection of a 25 foot setback from the property line. b. The trash storage area shall be reduced in area to accommodate larger parking stalls facing the rear property line, to facilitate better maneuverability. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: Traffic circulation and drives; Parking layout; Lot area; Lot width and lot depth; Type of use and its relation to property and improvements in the immediate vicinity; Past administrative action regarding this property. If such plan complies with the modi- fications outlined by th'e Board, said plan shall be approved and made a permanent part of the administrative file. 2. The following plans shall be submitted to the Secretary of the Board: a. Landscape and irrigation plan complying; with Article 979 of the Huntington Beach Ordinance Code and landscaping specifications on file in the Department of Public Works. Said plan shall incorporate placement of fifteen gallon trees (three) within each off-street parking area adjacent to each main building, pursuant to Article 979. b. Rooftop mechanical equipment screening plan. Said plan shall indicate screening of all rooftop mechanical equipment and shall delineate the type of material proposed to screen said equipment. c. A front elevation depicting the width of the concrete arches and their projection into the front yard area. 3. Soil and compaction reports shall be submitted by a certified soils engineer. Said reports shall be submitted to the Department of Building and Community Development and shall be subject to approval by that Department. 4. Fire protection systems, including automatic sprinkler systems, stand- pipe systems, fire hydrants, fire alarm systems, and any other required fire protection and detection devices or systems, shall comply with specifications of the Huntington Beach Fire Code. Plans for such systems and devices shall be submitted to the Fire Department and shall be subject to approval by the Fire Department and Department of Public Works. Mr. Jack Fraser, representing the Huntington Seacliff Homeowner's Association, addressed the Board and presented a petition from adjoining property owners requesting denial of the application; the letter was submitted to,the Chairman for placeinent in the permanent file.
