BOARD MEMBERS PRESENT: Eadie, Spencer, Crosby BOARD MEMBERS ABSENT: None MINUTES FOR APPROVAL: None REGULAR AGENDA ITEMS: CONDITIONAL EXCEPTION NO. 74-62 (Continued from 11-13-74) Applicant: Pacific City Bank CA To permit a two (2) foot reduction in the minimum ground clearance of ten feet to an existing pole sign, in lieu of S.9765.5.2 of the Huntington Beach Ordinance Code located on the west side of Goldenwest approximately 100 feet south of Edinger Avenue. The Chairman informed the Board that this application is a Categorical Exemption, Class V, California Environmental Quality Act. The Chairman further informed the Board that the applicant had requested a one -week continuance; the Board concurred with the applicant's request. The Chairman informed the Board that this application was granted Exemption Declaration No. 74-158 by the Environmental Review Board on November 5, 1974. 1. 11/27/74 BZA Minutes: H.B. Board of Zoning Adjustments Wednesday, November 27, 1974 Page 2 Mrs. Ray Johnson represented the applicant. The Board reviewed the revised plans submitted by the applicant and noted that 90 degree perpendicular parking had not'been provided; Chairman Eadie explained to Mrs. Johnson that the hammerhead turnabout as depicted on the revised plans would not provide adequate circula- tion for the project. Pat Spencer stated that any parking arrange- ment other than the perpendicular parking would be contrary to established policy and, therefore, unacceptable. The Board concurred that the requirement for perpendicular parking would be incorporated as a Condition of Approval upon approval of the plan. The Board discussed the Environmental Review Board's recommendation regarding a storm drain facility and explained this requirement to Mrs. Johnson. Conditions of Approval were discussed. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The revised conceptual plot plan and elevations received November 21, 1974, shell be the approved layout, subject to the modifications described herein. a. A Division of Land application shall be submitted to the Board to consolidate the property. b. The proposed buildings shall be reduced in width to accommodate 90 degree parking stalls on the north portion of the property and a driveway width which meets minimum standards of the Huntington Beach Ordinance Code. C. Conformance to landscaping requirements, including placement of three (3) fifteen gallon trees on site within the parking area. The precise location shall be subject to approval of the Planning Department. A plan delineating said modifications shall be submitted to the Secretary of the Board. If such plan complies with the modifications outlined by the Board, said plan shall be approved and made a permanent part of the administrative file. 2. The following plans shall be submitted to the Secretary of the Board: a. Landscape and irrigation plan complying with Artice 979 of the Huntington Beach Ordinance Code and landscaping specifications on file in the Department of Public Works. b. Rooftop mechanical equipment screening plan. Said plan shall indicate screening of all rooftop mechanical equipment and shall delineate the type of material proposed to screen said equipment. 3. Soil and compaction reports shall be submitted by a certi- fied soils engineer. Said reports shall be submitted to the Department of Building and Community Development and shall be subject to approval by that department, 4. Fire protection systems, including automatic sprinkler systems, standpipe systems, fire hydrants, fire alarm systems, and any other required fire protection and detection devices or systems, shall comply with the specifications of the Huntington Beach Fire Code. Plans for such systems and devices shall be submitted to the Fire Department and shall be subject to approval by the Fire Department and Department of Public Works. 5. The developer shall participate in the Orange County Sanitation District #3 Sewer Annexation District. 6. In accordance with the City's Master Plan of Arterial Streets and Highways, an additional 10 feet of right-of- way on Gothard Street shall be dedicated. 7. A ten foot wide easement shall be dedicated for storm drain purposes (location to be determined by the Public Works Department). B. TO BE COMPLETED PRIOR TO FINAL INSPECTION: 1. Gothard Street and Palmdale Avenue shall be improved to the centerline of such right-of-way. The developer shall participate in the local drainange assess- ment district. 3. A recorded parcel map shall be submitted to the Planning Depart- ment. C. GENERAL CONDITIONS: 1. Applicant to construct a storm drain facility of sufficient size to accommodate drainage across the :property. This storm drain shall meet the requirements of the City Engineer and shall be designed -to eliminate erosion and siltation, both during and after construction. If necessary, this drainage facility shall be located in an easement and dedicated to the City. 2. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them. 3. If the future building site is to be a separate entity and on a separate parcel of land, a reciprocal agreement for ingress/ egress, parking, and circulation shall be submitted to the Planning Department, the form and content to be approved by the City Attorney. FINDINGS: The proposed plan, with the modifications imposed by the Conditions of Approval, would be consistent with the policy plan of the City of Huntington Beach. The Conditional Exception No. 73-58 request is to permit zero side and rear yard setbacks in lieu of S.9163,2.1 and S.9163.3 of the Huntington Beach Ordinance Code. To permit model homes in conjunction with a subdivision, pursuant to S.9730.18 of the Huntington Beach Ordinance Code located at the southwest corner of Artista Drive and Gypsy Moth Lane in an R2, Medium Density Residential District. The Chairman informed the Board that this application is covered by Exemption Declaration No. 73-172 granted to Tentative Tract 7899 on September 5, 1974 by the Environmental Review Board. Charles Evans attended the meeting to represent the applicant. The Board reviewed the plot plan and discussed Conditions of Approval. ON MOTION BY CROSBY A14D SECOND BY EADIE, ADMINISTRATIVE REVIEW NO. 74-195 WAS APPROVED WITH THE FOLLOWING CONDITIONS BY THE FOLLOWING VOTE: 1. The conceptual plot plan received November 11, 1974 shall be the approved layout. 2. All areas delineated within the yellow border shall be land- scaped and fully improved. 3.. Board of Zoning Adjustments Wednesday, November 27, 1974 Page 6 PLOT PLAN AMENDMENT NO. 74-12 (Continued from 11/20/74) Applicant: North Pacific Construction Company To permit the conversion of two carport spaces into an office and storage room, pursuant to S.9811.4 of the Huntington Beach Ordinance Code located on the north side of Heil Avenue, approximately 210 feet west of the centerline of Bolsa Chica Street, in an R2, Medium Density Residential District. The Chairman informed the Board that this application is a Categorical Exemption, Class III, California Environmental Quality Act, 1970. The Chairman opened the public hearing. Mr. Gregg Lang, representing the applicant, addressed the Board and presented a brief overview of the proposal. There being no parties present to speak for or against the proposal, the Chairman closed the public hearing. Board discussion centered on the fact that the conversion of two carport spaces, as proposed, would reduce the available parking spcaes; by present standards, the -_ development is lacking in parking spaces by sixty-six (66), therefore, the Board concurred that the adjustment would compound an undesirable situation and would not result in an improved plan. Mr. Lang stated that there were other areas available in the develop- ment which could be utilized as parking spaces to replace the two which they proposed to convert. The Board concurred that it would be amenable to approval of the plan if two additional parking spaces could be accommodated to replace those being converted; Mr. Lang was requested to submit a revised plan indicating the locations of the parking spaces being added to the development. The applicant concurred and requested a one week continuance to allow for submittal of the revised plans. Moody To permit a subdivision sales office, pursuant to S.9730.18 of the Huntington Beach Ordinance Code located on the north side of Pearce Street, approximately 235 feet west of the centerline of Bolsa Chica Street, in an R2, Medium Density Residential District. Board discussion centered on the fact that the Ordinance Code states that subdivision sales offices and model homes in conjunc- tion with subdivisions are permitted; however, the applicant's proposal is to establish a sales office within an area that has been previously subdivided. The Board concurred that the proposal did not meet the intent of the code and had been improperly filed; it, therefore, recommended that the application be withdrawn and the applicant be sent a'letter of explanation, together with a reimbursement of the application fee. Board discussion centered on the fact that there is a Conditional Use Permit application pending before the Planning Commission concerning this property; in view of the fact that the Commission has not yet approved the ultimate use proposed for the property, the Board rgcommended that this application be referred to the Planning Commission, to be heard in conjunction with the applicant's Conditional Use Permit application. Mr. Nye concurred with this recommendation.
