Planning Commission December 3, 1974 Page 2 REGULAR AGENDA ITEMS TENTATIVE TRACT 5664 In Conjunction With CONDITIONAL USE PERMIT NO. 74-04 Applicant: Ring Brothers Corporation Tentative Tract Map No. 5664 and Conditional Use Permit No. 74-04 are requests to permit a 146 unit planned development on a 13.5 acre parcel of land pursuant to Article 931 of the Huntington Beach Ordinance Code. Subject property is located on the northwest corner of the intersection of Bushard and Brookhurst Streets. Mr. Jim Palin addressed the Commission and reviewed the maps which were on display. He indicated that the applicant had worked with the Fire Department in improving emergency access, and that the received plans met with the approval of the Fire Department. He noted that the applicant is willing to structure the CC&R's to restrict parking and to have the City adopt all driveways as access fire lanes. Commissioners discussed the dangers of flooding, and the disposition of the two Not -a -Part Parcels. The Chairman reopened the public hearing. Mr. Gary Thompson, representing Ring Brothers, addressed the Commission. He discussed the Conditions of Approval suggested by Staff and questioned the use of thermal pane windows. He stated that they had cut the number of units from 163 to 146, and would be willing to comply with Conditions of Approval. Ring Brothers plan to import 50,000 cubic yards of material onto the property and flood insurance will be available to the owners. He stated that amendments have been made on the plan which met with approval of Fire, Public Works, and Planning Departments. He discussed including in CC&R's restriction against parking in non -designated areas. The Chairman closed the public hearing. Commission discussed the problem presented by applicant's being unable to acquire the two adjoining parcels. Mr. Palin stated that the applicant had discussed with Ayres & Co. the purchase of their property and had been unable to acquire the property at a price that Ring Brothers felt was equitable. There was a discussion on condemnation of the Not -A -Part Parcel at the intersection of Bushard and Brookhurst. Commissioner Bazil concurred with Commissioner Higgins in that the developer should not be forced as a Condition of Approval to acquire the property adjoining him. Mr. Hartge discussed the condemnation procedure. Conditions of approval were discussed and amended. PC 12/3/74 -2- Minutes: H.B. Planning Commission December 3, 1974 Page 3 ON MOTION BY GEIGER AND SECOND BY BAZIL CONDITIONAL USE PERMIT NO. 74-04 WAS APPROVED WITH THE FOLLOWING CONDITIONS BY THE FOLLOWING VOTE: 1. The Tentative Map 5664 and Precise Plan received and dated November 8, 1974 shall be the approved layout except that the revised plan submitted and approved for a total of 146 dwelling units within the project and an increased setback for the four units fronting on Bushard within the northeasterly portion of the development shall be the approved layout. 2. The developer shall submit to the Planning Department a revised Precise Plan prior to the recordation of a final tract map which shall include the following: a. An emergency fire accessway shall be incorporated into this revised plan, providing inner circulation along the westerly portion of the development as shown on a conceptual plan reviewed by the Planning Commission at its December 3 meeting. The Fire Department shall approve the final design on this accessway prior to the issuance of any building permits on any phase of the development. b. This revised plan shall incorporate the tri-pad open parking spaces at the end of each secondary driveway, as discussed and shown on a conceptual plan as reviewed by the Planning Commission at its December 3 meeting. There shall also be additional open parking spaces provided within the southwesterly portion of the complex at critical locations as discussed and reviewed by the Planning Commission. 3. All streets shall be improved in compliance with plans and specifications on file with the Department of Public Works. 4. Should the City be able to provide right-of-way for street improvements on the not -a -part parcel at the intersection of Bushard and Brookhurst Streets, the developer shall be required to install full street improvements on this parcel in compliance with plans and specifications on file with the Department of Public Works. 5. Vehicular access rights to Bushard and Brookhurst shall be dedicated to the City of Huntington Beach except at the private drive entrance. PC 12/3/74 -3- Minutes: H.B. Planning Commission December 3, 1974 Page 4 6. All private driveways within the project shall be adopted by the City Council as emergency fire lanes. 7. All garage doors shall be equipped with automatic garage door openers. 8. Drainage for the subdivision shall be approved by the Department of Public Works prior to the issuance of grading permits and/or recordation of a final map for the project. Drainage facilities shall take into consideration siltation and erosion control, both during and after construction of the project. 9. The developer shall submit to the City a detailed and comprehensive drainage study, including how the tract grading in conjunction with the grading conveyance systems(including adequate swales, channels, street flows, catch basins, storm drains, and flood water retardant), will allow building pads to be safe from inundation from all rainfall runoff. 10. A permit shall be obtained from the Orange County Flood Control District for any work within.the Talbert Channel right-of-way. 11. The developer shall construct a minimum five (5) foot high chain link fence or equivalent along that portion of the tract adjacent to the Talbert Channel in a manner meeting with the approval of the Chief Engineer of the Orange County Flood Control District. 12. The project shall participate in the local drainage assessment district. 13. Water supply shall be through the City of Huntington Beach's water system. 14. The sewer and water system shall be constructed by the developer and dedicated to the City of Huntington Beach. 15. Sewage disposal shall be through the City of Huntington Beach's sewage system. 16. -The water and fire hydrant system shall be approved by the Department of Public Works and Fire Department. 17. A decorative masonry wall shall be constructed to City specifications along Brookhurst and Bushard Streets. Said wall shall be six inches wide and six feet high. The height of said wall shall be measured from whichever side is higher at finished grade. The architectural design of said wall shall be approved by the Planning Department. The structural design shall be approved by the Department of Public Works and shall be included as a part of the street improvement plan.. 1 PC 12/3/74 -4- Minutes: H.B. Planning Commission December 3, 1974 Page 5 18. The architectural design of the perimeter wall and the type and placement of street trees shall create unity and interest in the street scene. 19. Landscape planters shall be provided along arterial highways. Such planters shall conform to the plans and specifications on file in the Department of Public Works and the requirements of the Planning Commission. It is the developer's responsi- bility to landscape such planters and provide irrigation facilities in accordance with the specifications of the Department of Public Works. 20. The CC&R's and Association rules for the project shall contain provisions to restrict both of the following: a. Storage and/or parking of recreational vehicles shall be prohibited from being placed within any open parking spaces within the complex. b. No motor vehicles shall be parked within any areas of the complex other than those areas specifically designed and constructed to provide for the parking of such vehicles. 21. If there is any change in the status of the FIA program approved for flood insurance within the City of Huntington Beach prior to the developer's starting construction, the project shall comply with those standards and requirements in effect at the time the project is constructed. 22. If the developer proposes to provide air conditioning, the insulation in ceilings and exterior walls should be a minimum of R-19 and R-11, respectively. If no air conditioning is to be provided, the insulation in ceilings and exterior walls should be a minimum of R-13 and R-7 respectively. 23. All building spoils, such as unusable lumber, wire, pipe and other surplus or unusable material, should be disposed of at an offsite facility equipped to handle them. 24. Natural gas and 220V electricity should be stubbed in at the location of clothes dryers. Natural gas should be stubbed in at the locations of cooking facilities, water heaters, and central heating units. 25. Double -paned windows or a similar substitute with accompanying data from an acoustical engineer indicating the degree of attenuation of such substitute shall be submitted to the City for evaluation and all units facing onto Bushard or Brookhurst Streets shall be constructed with this double - paned window or similar substitute, to attenuate noise levels of all habitable quarters within this project. A 35 ft. setback should be provided from the living quarters of the units facing the adjacent arterial highway to the nearest travel lane of that arterial. 27. A soils engineer and/or geologist familiar with local seismic conditions shall prepare a comprehensive foundation and soils report, to include possible liquefaction conditions, to indicate the G-factors of ground accelleration for this project. This report shall include a comprehensive chemical analysis of the soils on the project location. 28. Calculations for footings and structural members to withstand anticipated G-factors shall be submitted to the City for review and approval prior to the issuance of building permits. All structures constructed within the complex shall comply structurally with these calculations on footings and structural members. 29. The Board recommends, in addition to the double -paned windows, or similar substitute, and block wall construction to attenuate noise, that the project comply with the adopted State Acoustical Standards, or should the Noise Element be adopted prior to construction of the project that the developer be required to comply with City and/or State requirements, whichever are more restrictive. Planning Commission December 3, 1974 Page 10 CODE AMENDMENT NO. 73-30 Initiated By: Planning Department Code Amendment No. 73-30 is intended to clarify and revise procedures and areas of jurisdiction of the Design Review Board. The Chairman opened the public hearing. There was no one present to speak for or against the proposed Code Amendment, and the public hearing was closed. Commission discussed the proposed Code Amendment. ON MOTION BY FINLEY AND SECOND BY BOYLE CODE AMENDMENT NO. 73-30 WAS APPROVED BY THE FOLLOWING VOTE: AYES: Geiger, Bazil, Higgins, Kerins, Finley, Boyle, Porter NOES: None ABSENT: None WRITTEN COMMUNICATIONS: TENTATIVE TRACT NO. 8788 "X" Applicant & Subdivider: Gordon & Richard Mountjo_y The Chairman noted that a letter dated November 27, 1974 from Mountjoy Construction Company had been received, requesting amendments to Conditions of approval items 1, 3, 6 and 12. Commission discussed the conditions and noted the letter of approval on file from Mr. Hartge on Item 6. ON MOTION BY BOYLE AND SECOND BY HIGGINS THE FOLLOWING REVISED CONDITIONS OF APPROVAL WERE APPROVED BY THE FOLLOWING VOTE: 1. The tentative map received September 11, 1974, shall be the approved layout in concept for future parcel maps to be recorded thereon. All streets proposed, and as shown on the tentative map shall be fully improved prior to recordation of a parcel map for any one parcel on the proposed subdivision except those fronting Gothard Street, specifically Lots 1, 6, 7, 10, 15 and 16. Such streets shall conform with standard plans and specifications on file with the Department of Public Works. 2. A detailed hydrology study shall be completed and submitted to the Director of Public Works for approval action prior to installation of the streets as shown upon the tentative map. This study shall include the method and system proposed to properly handle surface drainage for this proposed development. The drainage system shall also include a design to provide for siltation and erosion control both during and after construction of the project. PC 12/3/74 -10- Minutes: H.B. All vehicular access rights along Gothard Street shall be dedicated to the City of Huntington Beach, except at the street intersections and one location on Lot 7, and one location on Lot 10, as shown on tentative maps. 4. Soils and compaction reports shall be submitted to the Department of Building and Community Development and Department of Public Works prior to the issuance of building permits. Such reports shall be submitted by a qualified soils engineer. All structures constructed' within this project shall comply with these report recommendations. 5. Detailed site plans for each parcel to be developed shall be submitted to the Board of Zoning Adjustments for review and action. These plans shall be approved prior to the recordation of any parcel map for any parcel within the proposed project. 6. Access shall be limited on Gothard Street to two driveways only, to afford access to Lots 7 and 10. All other vehicle access rights shall be dedicated to the City, except at street intersections. This will facilitate traffic flow, thereby reducing impacts upon the ambient air quality. 7. Applicant shall consider, through design and location, the impacts that may be generated by air compressors and/or pumps within the project to reduce the impacts of noise by the use of additional walls and/or orientation of the facilities to the buildings. 8. All building spoils, such as unusable wire, pipe, or other surplus or unusable material, shall be disposed of at an offsite facility equipped to handle them. 9. Street improvements shall be constructed as one project to eliminate the adverse impacts of phases of construction work. 10. No rail service shall be provided to the use on Lot No. 18. 11. A subsequent review shall take place on any or all uses proposed within the project at the time of the Administrative Review application if such uses do not fall within the norm for environmental effects, as assessed by the Environmental Review Board. 12. The proposed CC&R's shall be submitted to the Planning Commission for review at the time that body takes action on the Tentative Tract Map. It is not required by the City of Huntington Beach that any covenants, conditions, or restrictions be imposed on the tract by the developer, and/or others. PC 12/3/74 -11- Minutes: H.B. Building materials of the proposed structures shall be as indicated by the applicant at the time of this review (to be of masonry type, of tilt -up and/or concrete block construction). 14. The developer shall attempt to encourage whenever possible the use of public transportation by employees of the industrial uses (this will comply with a mitigating measure set forth in the above mentioned Lusk Industrial Park Environmental Impact Report 73-16, to alleviate impact upon air quality). AYES: Geiger, Bazil, Higgins, Kerins, Finley, Boyle, Porter NOES: None ABSENT: None �f3 COMMISSIONERS' COMMENTS: Commissioner Boyle requested copies of Housing Report prepared by the Irvine Company for the Board of Supervisors. Mr. Ed Selich stated that copies of the report were available for Commission. It was noted that this is only a preliminary report. Commissioner Boyle requested that Commission be furnished copies of the Ford Foundation report and Jim Palin stated that he would check into this. Commission discussed with Staff relation of sea level to Pacific Coast Highway and other areas adjoining it. Commissioner Porter noted that there will be a meeting with OCTD on December 10 to discuss express bus routes and he felt a City representative should attend. Commissioners Porter and Geiger discussed the park and ride and Dial -A -Ride. Commission and Bill Hartge discussed the proposed acquisition of 32 acres north of Huntington Center, 23 acres of which is to be used for service parking. It was noted that Commissioner Geiger had originally stated that he felt this would be a good area for multi modal. Commission discussed the need for an off ramp on the San Diego Freeway possibly to tie into Center Drive. There was a discussion on annexation fees into the City of Huntington Beach. Mr. Ed Selich stated that this could be included in the Growth Study. PC 12/3/74 -12- Mintues: H.B. Planning Commission December 3, 1974 Page 13 Commissioner Kerins criticized the left turn lane going south on Bolsa Chica into Bolsa. STAFF'S COMMENTS Acting Secretary Selich stated that there would be a short course for Planning Commissioners held at University of California at Irvine on January 31 and February 1, 1975. Commissioner Finley and possibly two other Commissioners expressed an interest in attending. Staff and Commission discussed surveying the planned developments in Huntington Beach and it was agreed that Saturday, December 7, at 8:00 A.M. they would meet for breakfast and use the City van for a tour to terminate at noon.
