BOARD MEMBERS PRESENT: Dave Eadie Bruce Crosby Chuck Gerarden MINUTES FOR APPROVAL: None REGULAR AGENDA ITEMS: USE PERMIT NO. 74-54 (Continued from 11-20-74) Applicant: Shelter Associates The Chairman informed the Board that this application is within the area covered by Environmental Impact Report No. 73-7 which was approved by the City Council on December 10, 1973. The Chairman opened the Continued Public Hearing; he further stated that a written communication had been received from the applicant requesting a one week continuance; the Board concurred with the applicant's request. ON MOTION BY CROSBY AND SECOND BY GERARDEN, USE PERMIT NO. 74-54 WAS CONTINUED TO DECEMBER 18, 1974 BY THE FOLLOWING VOTE: AYES: EADIE, CROSBY, GERARDEN NOES: NONE ABSENT: NONE BZA 12/11/74 Page 1 Minutes: Huntington Beach Board of Zoning Adjustments December 11, 1974 Page 2 ADMINISTRATIVE REVIEW NO. 74-191 Applicant: Gerald Jones To permit the construction of an industrial building, pursuant to S.9530 of the Huntington Beach Ordinance Code, located on the south side of Slater Avenue, approximately 460 feet east of Gothard Street, in an M1-CD, Light Industrial Civic District. The Chairman informed the Board that this application is covered by Exemption Declaration No. 73-229 which was granted to Administrative Review No. 73-219 by the Environmental Review Board on December 19, 1973. The applicant was not present. The Board reviewed the revised plans and noted that the proposed building would be utilized for warehouse purposes. The Chairman stated that the plan could be approved, but would be subject to several conditions in order to satisfy code requirements; he further stated that the applicant would be given the option of pursuing the modified plan for the project as proposed by the Planning Department. Conditions of Approval were discussed. ON MOTION BY CROSBY AND SECOND BY EADIE, ADMINISTRATIVE REVIEW NO. 74-191 WAS APPROVED WITH THE FOLLOWING CONDTIONS, BY THE FOLLOWING VOTE: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The revised conceptual plot plan and elevations received December 6, 1974 shall be the approved layout, subject to the modifications described herein: a. Deletion of the proposed driveway on future street to the west, and implementation of landscaping from the west wall of the building to the west property line, to attain the minimum code requirement. b. Reorientation of the landscaped areas as shown on the approved plan. A plan delineating said modifications shall be submitted to the Secretary of the Board. If such plan complies with the modifications outlined by the Board, said plan shall be approved and made a per- manent part of the administrative file. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: BZA 12/11/74 Page 2 Minutes: Huntington Beach Board of Zoning Adjustments December 11, 1974 Page 3 Administrative Review No. 74-191 (Continued) Traffic circulation and drives; Parking layout; Lot area; Lot width and lot depth; Type of use and its relation to property and improvements in the immediate vicinity; Past administrative action regarding this property; Precise plan of alignment (proposed). 2. The following plans shall be submitted to the Secretary of the Board: a. Landscape and irrigation plan complying with Article 979 of the Huntington Beach Ordinance Code, and landscaping specifications on file in the Public Works Department. b. Rooftop mechanical equipment screening plan. Said plan shall indicate screening of all rooftop mechanical equipment and shall delineate the type of material proposed to screen said equipment. 3. In accordance with the City's Master Plan of Streets and Highways and Proposed Precise Plan of Alignment, 20 feet shall be dedicated on Slater Avenue. In addition, a 32 foot radius shall be dedicated at the corner of Slater Avenue and the proposed new street. 2.5 feet shall be dedicated for the proposed new street to the west. A five (5) foot wide public utility easement shall be provided on the west portion of the property. 4. Soil and compaction reports shall be submitted by a certified soils engineer. Said reports shall be submitted to the Department of Building and Community Development and shall be subject to approval by that department. 5. Fire protection systems, including automatic sprinkler systems, standpipe systems, fire hydrants, fire alarm systems, and any other required fire protection and detection devices or systems shall comply with the specifications of the Huntington Beach Fire Code. Plans for such systems and devices shall be submitted to the Fire Department and shall be subject to approval by the Fire Department and Department of Public Works. 6. The developer shall participate in the local drainage assessment district. 7. The developer shall participate in the Orange County Sanitation District Sewer #3 Annexation District. 8. The building shall be reduced in width to accommodate a parking stall meeting minimum code requirements which does not encroach into the landscaping area. Administrative Review No. 73-219 is null and void upon approval of this application. B. TO BE COMPLETED PRIOR TO FINAL INSPECTION: Slater and the proposed Precise Plan of Alignment shall be improved to the center line of such right-of-way. Said improvement shall include curbs, gutters, sidewalks, paving, street trees, street lights, street signs, street drainage, and sewer and water main extensions, in full compliance with the City of Huntington Beach street standards and requirements. C. GENERAL CONDITIONS: In view of the magnitude of the structure and its location at an entrance to a future industrial area, detached identification signs shall be limited to a monument type sign. Smith To permit the construction of a retail tire sales and service building, pursuant to S.9472 of the Huntington Beach Ordinance Code, located on the west side of Beach Boulevard, approximately 110 feet north of the center line of Ellis Avenue, in a C4, Highway Commercial District. The Chairman informed the Board that this application was granted Exemption Declaration No. 74-162 by the Environmental Review Board on November 26, 1974. The Chairman opened the Public Hearing. The applicant, Mr. Chester C. Smith, was present and offered the Board a brief overview of the proposal, stating that its primary function would be that of tire sales, with a secondary function of minor automobile adjustments. Mr. Jim Turner, adjoining property owner (18421 Beach Boulevard) addressed the Board and stated that he was in favor of the proposal. Mr. Jerry Jeeves, representing Denny's Restaurant, addressed the Board and questioned whether the 10' wall along the property line would be removed. Mr. Smith responded that there is a possibility of this action being taken; the Chairman then noted that this did not enter within the Board's juris- diction and should be handled between the applicant and Denny's. BZA 12/11/74 Page 4 Minutes: Huntington Beach Board of Zoning Adjustments December 11, 1974 Page 5 Use Permit No. 74-57 (Continued) The applicant requested permission to relocate the driveway further to the south; Bruce Crosby responded that the Traffic Engineer had approved the location of the driveway on the glan, however, would have preferred that it be located further to the north in order to remove it from the median strip. In view of this, the applicant's request for relocation further to the south was not approved. The Chairman closed the Public Hearing. Board discussion centered on landscaping and setback requirements, as well as review of the recommendations of the Environmental Review Board. Conditions of Approval were discussed. ON MOTION BY EADIE AND SECOND BY GERARDEN, THE BOARD ADOPTED EXEMPTION DECLARATION NO. 74-162 BY THE FOLLOWING VOTE: AYES: EADIE, CROSBY, GERARDEN NOES: NONE ABSENT: NONE ON MOTION BY EADIE AND SECOND BY GERARDEN, USE PERMIT NO. 74-57 WAS APPROVED WITH THE FOLLOWING CONDITIONS AND FINDINGS, BY THE FOLLOWING VOTE: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The revised conceptual plot plan received December 10, 1974 shall be the approved layout, subject to the modifications described herein: a. A decorative masonry wall provided with a solid gate shall encompass the trash area shown on the approved plan. b. Modification to the areas delineated to be landscaped. c. Incorporation of a 32" high masonry wall or equivalent, for purposes of screening of the parking area. d. Implementation of additional landscaping to attain 6% of lot area in the areas delineated on the approved plan. e. Conformance to setback requirements by placing the building further to the west. f. Deletion of the angular parking spaces at the southeasterly property line. A plan delineating said modifications shall be submitted to the Secretary of the Board. If such plan complies with the modifications outlined by the Board, said plan shall be approved and made a permanent part of the administrative file. Said reports shall be submitted to the Department of Building and Community Development and shall be subject to approval by that department. 4. Fire protection systems, including automatic sprinkler systems, standpipe systems, fire hydrants, fire alarm systems, and any other required fire protection and detection devices or systems shall comply with the specifications of the Huntington Beach Fire Code. TO BE COMPLETED PRIOR TO FINAL INSPECTION: Beach Boulevard shall be improved to the center line of such right-of-way. Said improvement shall include curbs, gutters, sidewalks, paving, street trees, street lights, street signs, street drainage, and sewer and water main extensions, in full compliance with the City of Huntington Beach street standards and requirements. C. GENERAL CONDITION: Building identification of the project (signs) shall be limited to those shown and submitted as Exhibit "A" to the Environmental Review Board in its review of the aesthetic impact of the proposed construction. FINDINGS OF THE BOARD: 1. The establishment of the use at this location is consistent with proposals in the vicinity of Beach Boulevard, and is not in conflict with the Land Use Element to the General Plan. 2. The terms and conditions of the approval will be consistent with the City's policy plan to promote a well planned program of commercial development. 3. The proposal will not be detrimental to: a. The general welfare of persons residing or working in the vicinity. b. Property and improvements in the vicinity of such use. The Chairman informed the Board that this application is a Categorical Exemption, Class I, California Environmental Quality Act, 1970. The plot plan received November 26, 1974 shall be the approved layout. 2. The applicant shall install a service panel to facilitate conversion to underground utilities at a future date, pursuant to S.9730.11 of the Huntington Beach Ordinance Code. FINDINGS OF THE BOARD: The Board has considered all guidelines for approval of overhead utilities, and all criteria has been satisfied, pursuant to Section 9730.10 of the Huntington Beach Ordinance Code. Kent Corporation To permit the establishment of a subdivision sales office, model homes, and construction office, pursuant to S.9730.17 and S.9730.18 of the Huntington Beach Ordinance Code, located on the southeast corner of Algonquin Street and Pearce Street, in an R2, Medium Density Residential District. The Chairman informed the Board that this application is covered by Exemption Declaration No. 74-9 which was granted to Tentative Tract 8000 and Conditional Use Permit No. 74-02 by the Environmental Review Board on February 5, 1974. The applicant was not present at the meeting. The Chairman informed the Board that this application is pending submittal of revised plans for further clarification regarding the area encompassed by the model homes; in view thereof, he recommended a one week continuance. The Chairman informed the Board that this application is a Categorical Exemption, Class I, California Environmental Quality Act, 1970. The applicant, Mr. Charles McGauley, was present and offered a brief overview of his proposal. The Board reviewed the proposal and discussed Conditions of Approval. ON MOTION BY GERARDEN AND SECOND BY EADIE, ADMINISTRATIVE REVIEW NO. 74-216 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: 1. The Board reviewed the request and discussed Conditions of Approval. ON MOTION BY GERARDEN AND SECOND BY EADIE, THE ABOVE NOTED REQUEST FOR A SPECIAL EVENT WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: 1. The plot plan received December 6, 1974 shall be the approved layout. 2. The applicant shall obtain all necessary electrical permits. 3. An on -site inspection by the Fire Department shall be required prior to the event. AYES: EADIE, CROSBY, GERARDEN NOES: NONE ABSENT: NONE ADMINISTRATIVE REVIEW NO. 74-136 Applicant: Franklin Bennett Mrs. Joan Bennett addressed the Board and requested the Board's reconsideration of the Condition of Approval imposed on the project on August 14, 1974, requiring the building to remain open and unenclosed, as per her written communication to the Board dated November 20, 1974. The Board reviewed the request and decided not to pursue any methods to amend the previously imposed Condition of Approval. SIGNS: Applicant: Der Wienerschnitzel Request: 99 sq. ft.
