REGULAR AGENDA ITEMS: USE PERMIT NO. 74-54 (Continued from 12-18-74) ADDlicant: Shelter Associates To permit the construction of a 276 unit apartment complex, pursuant to S.9202.3.1.3 of the Huntington Beach Ordinance Code, located on the west side of Newland Street, approximately 190 feet south of the center line of Edinger Avenue, in an R3, Medium High Density Residential District. The Chairman informed the Board that this application is covered by Environmental Impact Report No. 73-7, which was approved by the City Council on December 19, 1973. He further informed the Board that a written communication had been received from the applicant requesting withdrawal of this application; the Board concurred with the applicant's request. ON MOTION BY GERARDEN AND SECOND BY EADIE, USE PERMIT NO. 74-54 WAS WITHDRAWN BY THE FOLLOWING VOTE: AYES: EADIE, GERARDEN, ELLSTROM NOES: NONE ABSENT: NONE BZA 12-26-74 Page 1 Minutes: Huntington Beach Board of Zoning Adjustments December 26, 1974 Page 2 CONDITIONAL EXCEPTION NO. 74-66 Applicant: Alva Wilson Company To permit the construction of an identification sign which is not affixed to a masonry wall at the entrance street, in lieu of S.9764.1.1, "Identifi- cation Signs on Residential Developments", of the Huntington Beach Ordinance Code, located on the west side of Newland Street, approximately 820 feet south of Talbert Avenue, in an R1-PD, Low Density Residential Planned Development District. The Chairman informed the Board that this application is a Categorical Exemption, Class V, California Environmental Quality Act, 1970. The Chairman opened the Public Hearing. The applicant was not represented. There being no other parties present to speak for or against the proposal, the Chairman closed the Public Hearing. The Board reviewed the request and discussed Conditions of Approval. ON MOTION BY GERARDEN AND SECOND BY EADIE, CONDITIONAL EXCEPTION NO. 74-66 WAS APPROVED WITH THE FOLLOWING CONDITIONS, FINDINGS, AND REASONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: 1. Detached tract identification sign to be located within street island planting area, as shown. 2. Size, location, design, and materials shall be as per plot and elevation plans received November 27, 1974. FINDINGS OF THE BOARD: 1. This sign will not adversely affect other lawfully erected signs in.this area. 2. The sign will not obstruct pedestrian or other vehicular traffic vision. 3. The sign design is in keeping with the architectural character of the sub- division it serves. 4. The granting of this Conditional Exception will not be detrimental to this property nor the neighboring properties. REASONS FOR APPROVAL: 1. The design of the Planned Residential Development, which was subsequently approved, did not provide the typical perimeter wall. The Ordinance Code is inflexible in this respect; therefore,strict compliance with the iden- tification sign criteria specified in Sepction 9764.1.1 is not feasible. 2. The alternate proposal submitted is in keeping with the intent and purpose of Section 9764.1.1. AYES: EADIE, GERARDEN, ELLSTROM NOES: NONE ABSENT: NONE BZA 12-26-74 Page 2 Minutes: Huntington Beach Board of Zoning Adjustments December 26, 1974 Page 3 DIVISION OF LAND NO. 74-39 Applicant: Huntington Beach Distribution Association To permit the realignment of the property lines between two parcels of land, pursuant to S.9811.3 of the Huntington Beach Ordinance Code, located on the east side of Gothard Street, approximately 1,100 feet south of Edinger Avenue, in an Ml, Light Industrial District. The Chairman informed the Board that this application is a Categorical Exemption, Class V, California Environmental Quality Act, 1970. Mr. Terry Brigham represented the applicant and offered the Board a brief overview of the intents of the proposal. The Chairman noted that Division of Land No. 72-36 established lot lines similar to the present proposal, and that Administrative Review No. 72-114 established a mini -warehouse facility to the south, on parcel #2. The Board discussed Conditions of Approval with Mr. Brigham. ON MOTION BY ELLSTROM AND SECOND BY GERARDEN, DIVISION OF LAND NO. 74-39 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: A. TO BE COMPLETED PRIOR TO USE OR OCCUPANCY OF SAID PARCELS FOR ANY PURPOSE: 1. This Division of Land shall not be effective until a Covenant and Agreement furnished by the Huntington Beach Planning Department is signed and recorded with the Orange County Recorder, agreeing to these Conditions of Approval. 2. The tentative parcel map received by the Planning Department on December 12, 1974 shall be the approved layout. 3. A parcel map shall be filed with, and approved by, the Department of Public Works, and recorded with the Orange County Recorder (prior to issuance of a Certificate of Occupancy). 4. A copy of the recorded parcel map and Covenant and Agreement shall be submitted to the Planning Department. 5. The property shall participate in the local drainage assessment district at the time said parcels are developed. (Contact the Department of Public Works for additional information). AYES: EADIE, GERARDEN, ELLSTROM NOES: NONE ABSENT: NONE BZA 12-26-74 Page 3 Minutes: Huntington Beach Board of Zoning Adjustments December 26, 1974 Page. 4 ADMINISTRATIVE REVIEW NO. 74-217 Applicant: Jack Dean Olson To permit the installation of overhead utilities, pursuant to S.9730.9 of the Huntington Beach Ordinance Code, located on the north side of Williams Street approximately 205 feet east of the center line of Florida Street, in an R2, Medium Density Residential District. The Chairman informed the Board that this application is a Categorical Exemption, Class I, California Environmental Quality Act, 1970. The applicant, Mr. Jack Olson, addressed the Board, stating that a representa- tive from the Edison Company had recommended the installation of overhead utilities as underground service was not planned for the area in the near future, and also in order to maintain parity within the area. The Chairman noted that the Board, in its deliberation for rejecting or accepting requests of this nature, takes into consideration the cost involved in the undergrounding of utilities, the age of the structure involved, and the physical capability of same to accommodate underground facilities. In view of the fact that the property involved in this request is a new development capable of accommodating the underground facilities, and the fact that the cost of undergrounding as opposed to overhead utilities is not significantly more, the Board concurred that the request should be denied unless further justification can be provided. The applicant requested a continuance'to allow him to re -contact the Edison Company representative requesting him to address Section 9730.10 of the Huntington Beach Ordinance Code. The Board concurred with the applicant's request. ON MOTION BY EADIE AND SECOND BY GERARDEN, ADMINISTRATIVE REVIEW NO. 74-217 WAS CONTINUED TO JANUARY 2, 1975 BY THE FOLLOWING VOTE: AYES: EADIE, GERARDEN, ELLSTROM NOES: NONE ABSENT: NONE USE PERMIT NO. 74-61 Applicant: Ellen VerHaar To permit a take-out food establishment to service employees of the surrounding industrial complex, pursuant to S.9530.2(a) of the Huntington Beach Ordinance Code, located on the north side of Heil Avenue, approximately 216 feet east of the centerline of Gothard Street, in an Ml, Light Industrial District. The Chairman informed the Board that this application is a Categorical Exemption, Class I, California Environmental Quality Act, 1970. The Chairman opened the Public Hearing. BZA 12-26-74 Page 4 Minutes: Huntington Beach Board of Zoning Adjustments December 26, 1974 Page 5 Use Permit No. 74-61 (Continued) Mr. and Mrs. VerHaar were present; Mrs. VerHaar addressed the Board, stating that the proposed use of the property would be that of a food catering service for the adjacent industrial area. There being no other parties present to speak for or against the proposal, the Chairman closed the Public Hearing. The Chairman expressed concern regarding whether the use would be limited to industrial rather than commercial, in view of the fact that the zoning ordinance would require additional parking if the use were to be commercial. The Chairman further stated that the use could be considered industrial if it were determined to be strictly a food processing facility as opposed to a facility which would accommodate seating of customers and serving of food on the premises; the applicant responded that the facility would definitely be utilized for food processing and delivery service only. The Board concurred that it could grant approval to the proposal if the applicant agreed to submit a letter verifying the exact nature of the intended use, as discussed with the Board at this meeting; the applicant concurred. The Board discussed signs for the project and conditions regarding same. ON MOTION BY GERARDEN AND SECOND BY ELLSTROM, USE PERMIT NO. 74-61 WAS APPROVED WITH THE FOLLOWING CONDITIONS AND FINDINGS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: 1. The plot plan received December 9, 1974 shall be the approved layout. 2. The applicant shall submit a letter describing the exact nature of the intended use, as discussed with the Board, i.e. a preparation and delivery service (food processing), rather than a facility designed to accommodate seating and consumption on site. 3. Signs will be limited in scope to the established sign theme for the project. FINDINGS OF THE BOARD: 1. The nature of the operation resembles a permitted industrial use; therefore, there is no need to provide additional parking as required by commercial facilities. 2. There is no seating space available in the facility for customers, and Board discussion with the applicant has established that the nature of the business is food processing. 3. The establishment, maintenance, and operation of the use will not be detri- mental to: a. The general welfare of persons residing or working in the vicinity. b. Property and improvements in the vicinity of such use or building. 4. The granting of a Use Permit will not adversely affect the General Plan of Land Use of the City of Huntington Beach. AYES: EADIE, GERARDEN, ELLSTROM NOES: NONE ABSENT: NONE BZA 12-26-74 Page 5 Minutes: Huntington Beach Board of Zoning Adjustments December 26, 1974 Page 6 MISCELLANEOUS ITEM: ADMINISTRATIVE REVIEW NO. 74-80 Applicant: Gargas & Gold (c/o Mountjoy Construction Company) Request: Revised Plan, Condition "A-2", and to Permit Outdoor Display. Location: The northwest corner of Beach Boulevard and Terry Drive. The Board reviewed the revised plan and discussed Conditions of Approval. ON MOTION BY EADIE AND SECOND BY GERARDEN, THE REVISED PLAN FOR ADMINISTRATIVE REVIEW NO. 74-80 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan and elevations received December 3, 1974 shall be the approved layout, subject to the modifications described herein: a. Except as otherwise noted on the approved plan, all drives shall have a 25' width for a minimum turning radius. b. Landscaping shall be increased to conform to Huntington Beach Ordinance Code requirements. c. The display pad at the intersection of Beach Boulevard and Terry Drive shall be deleted. d. As no elevations of the display pads were submitted, final approval of the location and method of display shall be discretionary with the Director of Public Works. A plan delineating said modifications shall be submitted to the Secretary of the Board. If such plan complies with the modifications outlined by the Board and receives approval from the Director of Public Works, said plan shall be approved and made a permanent part of the administrative file. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: Traffic circulation and drives; Parking layout; Lot area; Lot width and lot depth; Type of use and its relation to property and improvements in the immediate vicinity; Past administrative action regarding this property. 2. The following plans shall be submitted to the Secretary of the Board: a. Landscape and irrigation plan complying with Article 979 of the Huntington Beach Ordinance Code and landscaping specifications on file in the Department of Public Works. Said plan shall indicate screening of all rooftop mechanical equipment and shall delineate the type of material proposed to screen said equipment. 3. Soil and compaction reports shall be submitted by a certified soils engineer. Said reports shall be submitted to the Department of Building and Community Development and shall be subject to approval by that Department. 4. Fire protection systems, including automatic sprinkler systems, standpipe systems, fire hydrants, fire alarm systems, and any other required fire protection and detection devices or systems, shall comply with the specifications of the Huntington Beach Fire Code. Plans for such systems and devices shall be submitted to the Fire Department and shall be subject to approval by the Fire Department and Department of Public Works. 5. The developer shall participate in the local drainage assessment district. B. TO BE COMPLETED PRIOR TO FINAL INSPECTION Beach Boulevard and Terry Drive shall be improved to the center line of such right-of-way. Said improvement shall include curbs, gutters, side- walks, paving, street trees, street lights, street signs, street drainage, and sewer and water main extensions, in full compliance with the City of Huntington Beach and State of California street standards and requirements.
