Dalton To permit the consolidation of seventy-seven (77) encyclopedia lots and a portion of thirty-one (31) encyclopedia lots into one (1) parcel of land, pursuant to S.9811.3 of the Huntington Beach Ordinance Code, located on the west side bf Beach Boulevard, approximately 370 feet south of Talbert Avenue, in a C4, Highway Commercial District. The Chairman informed the Board that this application is within the area covered by Exemption Declaration No. 74-86, granted to Administrative Review No. 74-82 on June 25, 1974. The applicant was not represented at the meeting. The Board reviewed the proposal and discussed Conditions of Approval. ON MOTION BY CROSBY AND SECOND BY SPENCER, DIVISION OF LAND NO. 74-38 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: A. TO BE COMPLETED PRIOR TO USE OR OCCUPANCY OF SAID PARCEL FOR ANY PURPOSE: 1. This Division of Land shall not be effective until a Covenant and Agreement furnished by the Huntington Beach Planning Department is signed and recorded with the Orange County Recorder, agreeing to these Conditions of Approval. AYES: EADIE, SPENCER, CROSBY NOES: NONE ABSENT: NONE ADMINISTRATIVE REVIEW NO. 74-217 (Continued from 12-26-74) Applicant: Jack Dean Olson To permit the installation of overhead utilities, pursuant to S.9730.9 of the Huntington Beach Ordinance Code, located on the north side of Williams Street, approximately 205 feet east of the center line of Florida Street in an R2, Medium Density Residential District. The Chairman informed the Board that this application is a Categorical Exemption, Class I, California Environmental Quality Act, 1970. The applicant was not present. The Chairman noted that, at the initial hearing of this application, the Board members had concurred that the application should be denied unless further justification could be provided; the applicant had requested a one -week con- tinuance in order to allow him to recontact the Edison Company in an effort to provide additional justification. During subsequent discussion by Board members following the meeting, however, it was noted that other residences in the area were serviced by overhead utilities; further, that if utilities were undergrounded at this point in time, it would be necessary to relocate same at such time as new undergrounding is installed under the assessment district plan. In view of these facts, the Board concurred that there was sufficient justification to warrant approval of the request. The plot plan received December 12, 1974 shall be the approved layout. 2. The applicant shall install a service panel to facilitate conversion to underground utilities at a future date, pursuant to 5.9730.11 of the Huntington Beach Ordinance Code. FINDINGS OF THE BOARD: The Board has considered all guidelines for approval of overhead utilities, and all criteria has been satisfied, pursuant to Section 9730.10 of the Huntington Beach Ordinance Code. •AYES: EADIE, SPENCER, CROSBY NOES: NONE ABSENT: NONE ADMINISTRATIVE REVIEW NO. 74-209 Applicant: Patscheck/Veiga Construction Company To permit the construction of an office building, pursuant to S.9430 of the Huntington Beach Ordinance Code, located on the east side of Brookhurst Street, approximately 225 feet south of the center line of Atlanta Avenue, in a C2, Community Business District. The Chairman informed the Board that this application was granted Exemption Declaration No. 74-168 by the Environmental Review Board on December 17, 1974. Mr. Ray Patscheck represented the applicant. The Board discussed the recommendations of the Environmental Review Board, in particular, the recommendation regarding enclosure of the open stairway leading to the second story; Mr. Patscheck stated that he was amenable to screening the stairway. Further Board discussion centered on reciprocal access; Mr. Patscheck stated that he had contacted the adjacent property owner regarding same, but had been unable to obtain approval from him. The Chairman stated that there may be record of an agreement for reciprocal access pertaining to this property, and requested that the applicant further pursue the matter with the owner. Captain Vanderlaan stated that a maneuvering area at the easterly terminus of the parking lot would be required in the event that a reciprocal agreement is not obtained. Bruce Crosby stated that the developer would be required to participate in the Orange County Sanitation District #3 Sewer Annex District. Conditions of Approval were discussed. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan received December 2, 1974 shall be the approved layout, subject to the modifications described herein: a. The open stairway leading to the second story shall be screened. ' b. The two parking spaces adjacent to the driveway entrance shall be eliminated and replaced with landscaping. A plan delineating said modifications shall be submitted to the Secretary of the Board. If such plan complies with the modifica- tions outlined by the Board, said plan shall be approved and made a permanent part of the administrative file. The following plans shall be submitted to the Secretary of the Board: a. Landscape and irrigation plan complying with Article 979 of the Huntington Beach Ordinance Code and landscaping specifications on file in the Department of Public Works. b. Rooftop mechanical equipment screening plan. Said plan shall indicate screening of all rooftop mechanical equipment and shall delineate the type of material proposed to screen said equipment. 3. Soil and compaction reports shall be submitted by a certified soils engineer. Fire protection systems, including automatic sprinkler systems, standpipe systems, fire hydrants, fire alarm systems, and any other required fire protection and detection devices or systems shall comply with the specifications of the Huntington Beach Fire Code. Plans for such systems and devices shall be submitted to the Fire Department and shall be subject to approval by the Fire Department and Department of Public Works. B. TO BE COMPLETED PRIOR TO FINAL INSPECTION: Brookhurst Street shall be improved to the center line of such right- of-way. Said improvement shall include street trees, street lights, street signs, street drainage, and sewer and water main extensions, in full compliance with the City of Huntington Beach street standards and requirements. C. GENERAL CONDITIONS: 1. The applicant shall pursue a reciprocal agreement with the property to the north for ingress/egress and circulation purposes. If there is record of a requirement for reciprocal access incumbent upon the property owner to the north, this condition shall be a mandatory requirement. 2. If the developer proposes to provide air conditioning, the insulation in ceilings and exterior walls shall be a minimum of R-19 and R-11, respectively. If no air conditioning is to be provided, the insu- lation in ceilings and exterior walls shall be a minimum of R-13 and R-7, respectively. 3. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them. BZA 1-2-75 Page 5 Minutes: Huntington Beach Board of Zoning Adjustments January 2, 1975 Page 6 Administrative Review No. 74-202 The Chairman informed the Board that this application was granted Exemption Declaration No. 74-165 by the Environmental Review Board on December 17, 1974. Mr. William C. Wonacott represented the applicants. The Board discussed the Environmental Review Board's recommendation that the applicants attempt to preserve the existing trees shown on the plan by revising same. Mr. Wonacott stated that he would prefer to remove the existing eucalyptus trees and replace them with others, such as magnolias, which would be more suitable to the colonial setting of the building and which would require less upkeep and maintenance. The Board concurred, and noted that because of the specie, the location, and alternate methods of building placement, the plan as presented was more suitable. The Board recommended a minimum 20" box tree, and advised Mr. Wonacott to work in conjunction with the City's Land- scaping Department in regard to specie and exact size. Conditions of Approval were discussed. The conceptual plot plan and elevations received November 20, 1974 shall be the approved layout, subject to the modification described herein: The driveway width shall be increased to a minimum of 24 feet. A plan delineating said modification shall be submitted to the Secretary of the Board. If such plan complies with the modification outlined by the Board, said plan shall be approved and made a permanent part of the administrative file. Said reports shall be submitted to the Department of Building and Community Development and shall be subject to approval by that Department. 5. Fire protection systems, including automatic sprinkler systems, standpipe systems, fire hydrants, fire alarm systems, and any other required fire protection and detection devices or systems shall comply with the specifications of the Huntington Beach Fire Code. Plans for such systems and devices shall be submitted to the Fire Department and shall be subject to approval by the Fire Department and Department of Public Works. 6. The developer shall participate in the local drainage assessment district. 7. The developer shall participate in the Orange County Sanitation District #3 Sewer Annex District. B. TO BE COMPLETED PRIOR TO FINAL INSPECTION: Beach and Cameron shall be improved to the center line of such right-of-way. Said improvement shall include curbs, gutters, sidewalks, paving, street trees, street lights, street signs, street drainage, and sewer and water main extensions, in full compliance with the City of Huntington Beach and State of California street standards and requirements. C. GENERAL CONDITIONS: 1. If a detached sign is proposed, said sign shall be of a monument type (below 7 feet in height, with a solid base). 2. If the developer proposes to provide air conditioning, the insulation in ceilings and exterior walls shall be a minimum of R-19 and R-11, respectively. If no air conditioning is to be provided, the insulation in ceilings and exterior walls shall be a minimum of R-13 and R-7, respectively. A chemical analysis, as well as tests for physical properties of the soil on subject property,shall be submitted to the City for review prior to the issuance of building permits.
