COMMISSIONERS PRESENT: Higgins, Kerins, Finley, Boyle, Porter Commissioner Bazil arrived at 7:10 p.m. Commissioner Geiger was excused. CONSENT CALENDAR: ON MOTION BY BOYLE AND SECOND BY HIGGINS THE FOLLOWING CONSENT CALENDAR WAS APPROVED AS RECOMMENDED BY THE FOLLOWING VOTE: MINUTES The minutes of January 7, 1975 were approved. ZONE CASE NO. 74-4 Applicant: Robert R. Potter Continued to February 18, 1975, with concurrence of applicant. ZONE CASE NO, 74-13 Applicant: Michael J. Major Continued to February 18, 1975, with concurrence of applicant. TENTATIVE TRACT NO. 5189 Applicant: Robert Stellrecht Continued to February 4, 1975. AYES: Higgins, Kerins, Finley, Boyle, Porter NOES: None ABSENT: Geiger, Bazil Commissioner Bazil arrived at 7:10 p.m. REGULAR AGENDA ITEMS: CONDITIONAL USE PERMIT NO. 74-19 Applicant: Danielian, Moon, Sampieri & Ilg This is a proposal to develop a day care center with a capacity for care of up to 200 children and infants which will include six classrooms with indoor play areas, two toddler rooms, two nursery rooms, administrative offices, lounge area, kitchen facilities, off-street parking, and outdoor play areas, located on the east side of Beach Boulevard approximately one-half block north of Yorktown Avenue. 1. Planning Commission Tuesday, January 21, 1975 Page 2 Mr. John Cope addressed the Commission and stated that he had been working with the applicant on alternatives to the plan. He discussed the noise which would be generated from such an activity and the tax revenue loss to the City, and cited them as reasons for the Staff's recommendation of denial. The Chairman opened the public hearing. Mr. Alex Osachoff, representing the applicant, addressed the Commission and discussed the operation of the school and other such schools which had been established. He felt that they had met code require- ments and, in some cases, had exceeded them. He did not feel that the noise factor was of great significance inasmuch as the children would be under the age of six and would be using the playground area in staggered shifts with no morning or late afternoon activity. He felt that the proposed day care center would provide a much needed service to the community and that such service could not be measured in terms of revenue it might cost the City. Mr. Joe Squel, also representing the applicant, addressed the Commission and discussed the basis used for determining where a school site would be needed. Ms. Kay Pole, Regional Administrator, stated that they had been quite successful in assisting parents to set up car pools to alleviate traffic problems, and further that they planned to have an attendant on duty to assist children in and out of cars to help the traffic situation. The Commission discussed landscaping for buffering noise, fence treat- ment, and the need for such a service in the area. The public hearing was closed. ON MOTION BY BOYLE AND SECOND BY BAZIL CONDITIONAL USE PERMIT NO: 74-19 WAS CONTINUED TO FEBRUARY 4, 1975, FOR FURTHER REPORT FROM THE STAFF. AYES: Bazil, Higgins, Kerins, Finely, Boyle, Porter NOES: None ABSENT: Geiger CODE AMENDMENT NO. 74-6 "Article 979 Update" John Cope addressed the Commission and discussed the changes in the Code Amendment which had been made since the November 26, 1974 meeting. The Chairman opened the public hearing. Mr. Chris Williams, Huntington Executive Park, addressed the Commission and expressed concerns over the width of the 6 ft. land- scaped area referred to in S.9792.1.1 as being excessive. He felt that four or five feet would be more appropriate. He stated that landscaping could best be used around the buildings -or dispersed PC 1/21/75 2. 1 Minutes: H.B. Commission discussed the proposed Code Amendment and the Staff noted that prior to issuance of building permits the applicant had to submit landscape plans for approval. Chairman Kerins felt that landscaping plan should be approved prior to issuance of building permits. There was a discussion on the use of ground cover in parking areas rather than pavement. ON MOTION BY BOYLE AND SECOND BY HIGGINS CODE AMENDMENT NO. 74-6 WAS APPROVED AS AMENDED BY THE FOLLOWING VOTE: AYES: Bazil, Higgins, Kerins, Finley, Boyle, Porter NOES: None ABSENT: Geiger CODE AMENDMENT NO. 74-17 John Cope reviewed the amendments to the screening criteria for automobile dismantling yards which Commission had requested at their January 7, 1975 meeting. The public hearing was opened. There was no one present to speak on Code Amendment No. 74-17 and the Chairman closed the public hearing. Commission discussed the proposed Code Amendment and felt that more specific information should be in the Code Amendment. ON MOTION BY BAZIL AND SECOND BY BOYLE CODE AMENDMENT NO. 74-17 WAS REFERRED BACK TO STAFF FOR FURTHER STUDY BY THE FOLLOWING VOTE: AYES: Bazil, Higgins, Kerins, Finley, Boyle, Porter NOES: None ABSENT: Geiger EXTENSION OF TIME FOR NOISE ELEMENT OF THE GENERAL PLAN Secretary Harlow stated that Staff would like approval from the Commission to request a six month extension for completion of the Noise Element of the General Plan. Staff anticipates completion of the Noise Element by July, 1975. ON MOTION BY BOYLE AND SECOND BY PORTER STAFF DIRECTED TO REQUEST EXTENSION OF SIX MONTHS FOR COMPLETION OF THE NOISE ELEMENT TO THE GENERAL PLAN BY THE FOLLOWING VOTE: AYES: Bazil, Higgins, Kerins, Finley, Boyle, Porter NOES: None ABSENT: Geiger 3. Planning Commission Tuesday, January 21, 1975 Page 4 ENVIRONMENTAL IMPACT REPORT NO. 73-17 Applicant: Public Works Department - City of Huntington Beach Staff noted that this EIR concerned street improvements. ON MOTION BY PORTER AND SECOND BY BOYLE ENVIRONMENTAL IMPACT REPORT NO. 73-17 WAS ADOPTED BY THE FOLLOWING VOTE: AYES: Bazil, Higgins, Kerins, Finley, Boyle, Porter NOES: None ABSENT: Geiger TENTATIVE TRACT NO. 8471 - Request for Modification to Conditions of Approval Applicant: Bob Zinngrabe Commission discussed the modified Conditions of Approval presented by Mr. Zinngrabe for a separation wall between adjoining property owner, Mr. Shaffer. It was noted that Mr. Shaffer and Mr. Zinngrabe are in agreement on treatment of the wall. ON MOTION BY PORTER AND SECOND BY HIGGINS REQUEST FOR MODIFICATION TO CONDITION OF APPROVAL NO. 21 AS STATED BELOW BY THE FOLLOWING VOTE: 21. A six (6) foot high separation wall, the design and materials of which shall be subject to approval by the Planning Director prior to authorization for construction, shall be constructed along lots siding or backing onto property zoned, masterplanned, or developed professional, commercial, or industrial use. The height of said wall shall be such that the top will be six (6) feet above the highest ground surface within twenty (20) feet of the common property line. Measurements shall be taken at any given point along said wall. This requirement shall pertain to all parcels; including numbered lots, those labeled "Not A Part" and/or those parcels not within the subdivision but held under the same ownership as the property being sub- divided. Mrs. M. Carlberg addressed the Commission and discussed need for such an ordinance. PC 1/21/75 4. 1 Minutes: H,B, Planning Commission Tuesday, January 21, 1975 Page 5 Memo from Fountain Valley expressing opposition to proposed Mobile Home Park south of Ellis and west of Newland Street Commissioner Bazil felt that since mobile home zoning on the property has existed for a number of years, an analysis of resulting development should have been made prior to commencement of develop- ment. ORAL COMMUNICATIONS: None COMMISSIONERS' COMMENTS Chairman Kerins presented Commissioner Boyle a Resolution commending him for his service to the City. Commissioner Boyle expressed his regrets in leaving the City and commended the Commission on their ability to work together, while not always agreeing, toward betterment of the City. Commissioner Porter discussed the OCTD and stated that he and Commissioner Geiger would be drafting a letter and proposal at the end of the month for review by OCTD which will request bus service as opposed to Dial -A -Ride. STAFF'S COMMENTS Secretary Harlow reported on City Council meeting of January 20, 1975, and discussed the agenda for Planning Commission January 28th meeting.
