Applicant: Whitehead and Miller
To permit twelve (12) off-street parking spaces for a proposed 1800 square
foot professional office building, in lieu of fifteen (15), as required by
S.9793.1 of the Huntington Beach Ordinance Code, and to permit a five (5)
foot encroachment into the required ten (10) foot exterior side yard setback,
in lieu of S.9404.3 of the Huntington Beach Ordinance Code, located on the
northwest corner of Talbert Avenue and Bell Circle, in an R5, Office Pro-
fessional District.
The Chairman informed the Board that this application is a Categorical Exemption,
Class V, California Environmental Quality Act, 1970.
The Chairman opened the continued Public Hearing.
Dr. Bruce Miller and Mrs. Doris Martinez represented the applicants.
The Board reviewed the revised plan and concurred that five feet of landscaped
area on Talbert Avenue as proposed on the plan was insufficient, and recommended
a revision on the plan to reflect ten (10) feet of landscaping on Talbert and
deletion of the landscaping in the rear. Dr. Miller was amenable to this
revision.
There being no other parties present to speak for or against the proposal, the
Chairman closed the Public Hearing.

Applicant: Whitehead and Miller
To permit the construction of a professional office building, pursuant to
S.9401 of the Huntington Beach Ordinance Code, located on the northwest
corner of Talbert Avenue and Bell Circle, in an R5, Office Professional
District.
The Chairman informed the Board that this application is a Categorical
Exemption, Class III, California Environmental Quality Act, 1970.
Dr. Bruce Miller and Mrs. Doris Martinez represented the applicants.
The Board reviewed the plan and noted that the revision regarding the landscaped
area on Talbert Avenue, as discussed in relation to the Conditional Exception
application heard in conjunction with this application, would be incorporated
as a Condition of Approval for the Administrative Review. Additional Conditions
of Approval were discussed with the representatives.
ON MOTION BY GERARDEN AND SECOND BY CROSBY, ADMINISTRATIVE REVIEW NO. 75-1
WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE:
A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS:
1. The revised conceptual plot plan and elevations received January 27,
1975 shall be the approved layout, subject to the modifications
described herein:
a. The building setback along Bell Circle shall be not less
than five (5) feet.
b. The building setback along Talbert Avenue shall be not less
than ten (10) feet.

C. If, at the time of issuance of building permits, the applicant
has not obtained ownership of the parcel at the intersection of
Bell Circle and Talbert Avenue, a setback from said property
shall be not less than five (5) feet.
A plan delineating said modifications shall be submitted to the
Secretary of the Board. If such plan complies with the modifications
outlined by the Board, said plan shall be approved and made a permanent
part of the administrative file.
In its approval action, the Board of Zoning Adjustments considered the
following issues relating to the conceptual plan:
Traffic circulation and drives;
Parking layout;
Lot area;
Lot width and lot depth;
Type of use and its relation to property and improvements in
the immediate vicinity;
Past administrative action regarding this property.
2. The following plans shall be submitted to the Secretary of the Board:
a. Landscape and irrigation plan complying with Article 979 of the
Huntington Beach Ordinance Code and landscaping specifications
on file in the Department of Public Works.
b. Rooftop mechanical equipment screening plan. Said plan shall
indicate screening of all rooftop mechanical equipment and shall
delineate the type of material proposed to screen said equipment.
3. Soil and compaction reports shall be submitted by a certified soils
engineer. Said reports shall be submitted to the Department of
Building and Community Development and shall be subject to approval
by that Department.
4. Fire protection systems, including automatic sprinkler systems,
standpipe systems, fire hydrants, fire alarm systems, and any other
required fire protection and detection devices or systems shall
comply with the specifications of the Huntington Beach Fire Code.
Plans for such systems and devices shall be submitted to the Fire
Department and shall be subject to approval by the Fire Department
and Department of Public Works.
5. The developer shall participate in the local drainage assessment
district.
6. The developer shall participate in the Orange County Sanitation District
#3 Sewer Annex District.

B. TO BE COMPLETED PRIOR TO FINAL INSPECTION:
1. Bell and Talbert shall be improved to the center line of such right-
of-way. Said improvement shall include curbs, gutters, sidewalks,
paving, street trees, street lights, street signs, street drainage,
and sewer and water main extensions, in full compliance with the
City of Huntington Beach street standards and requirements.
2. The developer shall provide a fire hydrant at the corner of Bell Circle
and Talbert Avenue. (Contact the Public Works Department for additional
information regarding installation of same).

DIVISION OF LAND NO. 74-42
Applicant: Gerald A. Jones
To permit the division of one (1) parcel of land into seven (7) parcels,
pursuant to 5.9811.3 of the Huntington Beach Ordinance Code, located on
the south side of Talbert Avenue, approximately 640 feet east of Gothard,
in an MI -A, Restricted Manufacturing District.
The Chairman informed the Board that this application was granted Exemption
Declaration No. 74-169 by the Environmental Review Board on January 14, 1975.
The applicant, Gerald Jones, was present.
The Board reviewed the tentative map submitted by the applicant and noted
that the final parcel map would require revisions to reflect the following
corrections:
1) The street width shall be reflected as 45', with 5' public utility
easements on either side;
2) The property line radius at the street intersection shall be revised;
3) The property line on Parcel 4 shall be eliminated.
Conditions of Approval were discussed with the applicant.

1. This Division of Land shall not be effective until a Covenant and
Agreement furnished by the Huntington Beach Planning Department
is signed and recorded with the Orange County Recorder, agreeing
to these Conditions of Approval.
2. The tentative parcel map received by the Planning Department on
December 18, 1974 shall be the approved layout (with the amendments
as noted thereon).
3. A parcel map shall be filed with, and approved by, the Department
of Public Works, and recorded with the Orange County Recorder
(prior to issuance of a Certificate of Occupancy).
4. A copy of the recorded parcel map and Covenant and Agreement shall
be submitted to the Planning Department.
5. Talbert Avenue and Redondo Drive shall be dedicated to City standards
at the time said parcels are developed.
b. Water supply shall be through the City of Huntington Beach's water
system at the time said parcels are developed (if such systems
exist within 200 feet of said parcels).
7. Sewage disposal shall be through the City of Huntington Beach's

8. All utilities shall be installed underground at the time said
parcels are developed.
9. All applicable City Ordinances shall be complied with.

CONDITIONAL EXCEPTION NO. 75-2
Applicant: Thomas C. Waller, III
To permit two real estate signs for each street abutting a parcel of land,
for Tract 8694, a proposed industrial development, in lieu of S.9764.5.4
of the Huntington Beach Ordinance Code, which provides for the placement
of a maximum of one real estate sign for each street abutting a parcel of
land. The freestanding signs are proposed at the following locations:
1) The south side of Bolsa Avenue, approximately 600'-east of Bolsa Chica
Street. -
2) South side of Bolsa Avenue, approximately 600' west of Graham Street;
3) South side of Bolsa Avenue, approximately 600' east of Graham Street;
4) South side of Bolsa Avenue, approximately 600' west of Springdale Street;
5) West side of Springdale Street, approximately 600' south of Bolsa Avenue;
6) West side of Springdale Street, approximately 600' south of proposed
Street "B";
7) North side of McFadden Avenue, approximately 300' west of Springdale Street;
8) North side of McFadden Avenue, approximately 600' east of Graham Street.
The Chairman informed the Board that this application is a Categorical
Exemption, Class V, California Environmental Quality Act, 1970.
The Chairman opened the Public Hearing.
The applicant, Mr. Thomas C. Waller, III, was present; also representing the
applicant were Mr. J. Valencia and Mr. C. Rinehart.
Mr. Waller addressed the Board and offered a brief overview of his request,
citing as his justification for the request the fact that one sign per
street frontage is not adequate for the amount of area involved; therefore,
the resulting lack of identification would prove detrimental to the develop-
ment. Mr. Waller offered photographs of the proposed signs for the Board's
review.
There being no other parties present to speak for or against the proposal,
the Chairman closed the Public Hearing.
Board member John Cope noted that the request for the Conditional Exception
had been erroneously advertised and stated that it would be necessary to
clarify the request to adjoining property owners by readvertising. He
therefore recommended that the application be continued to February 13,
1975 to allow for the readvertising process to transpire; the Board members
concurred.

CONDITIONAL EXCEPTION NO. 75-3
Applicant: Harbour Pacific, Ltd.
To permit a temporary directional sign to be located closer than the minimum
200 feet setback from a lot zoned for residential use (non -model home asso-
ciated) in lieu of 5.9763.1.5.2 of the Huntington Beach Ordinance Code,
located on the south side of Edinger Avenue, approximately 210 feet west
of Santa Barbara Lane, in an Rl, Low Density Residential District.
The Chairman informed the Board that this application is a Categorical
Exemption, Class V, California Environmental Quality Act, 1970.
The Chairman opened the Public Hearing.
Representing the applicant were Mr. Darryl Rowe and Mr. William Duncan.
Mr. Duncan addressed the Board and presented a brief overview of his request,
citing as his justification for same the fact that compliance to code regu-
lations would necessitate placement of the directional sign in a location
not easily discernible from trafficked areas, thereby creating a hardship to
prospective sales within the development.
There being no other parties present to speak for or against the proposal,
the Chairman closed the Public Hearing.
Board members discussed the request and concurred that sufficient justifi-
cation of hardship had been demonstrated to warrant granting of the
Conditional Exception.
ON MOTION BY GERARDEN AND SECOND BY CROSBY, CONDITIONAL EXCEPTION NO. 75 3
WAS APPROVED WITH THE FOLLOWING FINDINGS, BY THE FOLLOWING VOTE:
1. The surrounding property within the area of the subdivision prohibits
the erection of this type of sign, thereby depriving the developer of
equal advertising opportunities as enjoyed by other subdivisions.
2. Strict compliance with the terms of the Code would result in substantial
economic hardship to the applicant.
3. The sign will not adversely affect other lawfully erected signs in the
same area.
4. The granting of the Conditional Exception will not be detrimental to property
located in the vicinity, or to the property on which said sign is located.
5. The sign will not obstruct pedestrian or vehicular traffic vision.

The Board discussed the proposed directional sign for the development.
ON MOTION BY GERARDEN AND SECOND BY CROSBY, THE ABOVE -NOTED DIRECTIONAL
SIGN WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE:
1. The copy and sign design dated January 13, 1975 shall be the
approved copy and design.
2. The sign location shall be within the landscaped area on the
southeast corner of Bonaire and Edinger.
3. A time limit of one year shall be imposed; the sign shall be
removed within one year of the date of approval, or at such time
as there are no units remaining for sale for the first time.

Applicant: Huntington Beach Company
To permit the division of one legal parcel of land into two parcels, pursuant
to S.9811.3 of the Huntington Beach Ordinance Code, located on the northwest
corner of Mansion Avenue and Main Street, in a C2-0-CD, Community Business,
Oil and Civic Districts.
The Chairman informed the Board that this application is covered by Environmental
Impact Report No. 74-5, which was approved by the Environmental Review Board on
December 24, 1974.
Representing the applicant were Mr. Richard Kinz, Mr. Bill Blakely, and Mr.
John Mandrell.
The Chairman noted that this application was filed in order to comply with
Condition A.9 of Administrative Review No. 74-224.
The Board reviewed the proposal and discussed Conditions of Approval.
The Chairman informed the representatives that the new subdivision act which
becomes effective March 1, 1975 would require dedication of the entire parcel;
should the final parcel map be recorded prior to that date, dedication re-
quirements would remain as stated on the Conditions of Approval for Administrative
Review No. 74-224.

Applicant: Juan Pantoja
To permit the relocation of existing overhead utilities on a lot, pursuant
to S.9730.9(d) of the Huntington Beach Ordinance Code, located at the
northeast corner of Goodwin Lane and Ellis Avenue, in an R1, Low Density
Residential District.
The Chairman informed the Board that this application is a Categorical
Exemption, Class I, California Environmental Quality Act, 1970.
Mr. Leonard Pantoja represented the applicant.
Board member Cope noted that Division of Land No. 74-1, relating to this
property, had been conditionally approved with one of the requirements
being that all utilities be installed underground upon subsequent develop-
ment of this parcel. He further noted that undergrounding of the utilities
would require minimal trenching as well as minimal financial expenditure;
in view of these facts, he stated that he was of the opinion that there
was no justification for waiving the Division of Land requirement as pre-
viously noted, and that undergrounding of the utilities should be pursued.
ON MOTION BY COPE AND SECOND BY GERARDEN, ADMINISTRATIVE REVIEW NO. 75-4
WAS DENIED WITH THE FOLLOWING FINDINGS, BY THE FOLLOWING VOTE:
1. The proposed new structures are located on parcels both of which
have separate utility sources and thus easily provide for the
undergrounding of the utilities.
2. The location of the existing electrical sources would necessitate
only minimal construction costs for undergrounding the utilities.

Mr. Eddie Spagnell represented the applicant. Mr. Spagnell stated that
the property owners were adding a patio to the residence; further that
the relocation of the utilities was necessary for purposes of accessi-
bility pursuant to a regulation of the National Electric Code.
The Board reviewed the plan and discussed Conditions of Approval.

Coast Highway, in an R2, Medium Density Residential District.
The Chairman informed the Board that this application is a Categorical
Exemption, Class V, California Environmental Quality Act, 1970.
The applicant was represented by Mr. Darryl Rowe and Mr. William Duncan.
Board member Cope noted that the plan did not reflect information regarding
parking layout, sign locations, and intended use of the units. Mr. Duncan
stated that he would submit a revised plan indicating the above noted areas.

Board member Gerarden informed the representatives that re -addressing of
the units would be necessary due to a duplication of a street name; they
were advised to contact the Huntington Beach Fire Marshal's office to
obtain an alternate street name as soon as possible.

WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE:

subject to submittal of a revised plan delineating:
a. Individual units and use of same.
b. Parking layout.

2. Occupancy shall not be permitted within any building which serves as
a sales office or model.

Board member Gerarden advised the Board that the Department of Building
and Community Development had issued an order for correction of electrical
deficiencies at this property, such order calling for the relocation of the
existing service. He further stated that the upgrading to this system and
its relocation is for the purpose of maintenance only and will not increase
the number of poles or lines. Due to the fact that the electrical service
will be mounted on the exterior surface of the building, it was recommended
that the requirement for stubbing out for future undergrounding be deleted
as such work at this time would be of no benefit and could be readily
accomplished at a future date due to the positioning of the electrical
service. Board members were in concurrence.

The commercial center has an adopted sign program specifying size, shape, and
color for all signs within the center. This sign program was adopted by the
Board of Zoning Adjustments at its meeting of December 19, 1973. The proposed
change of colors for the Sherwin-Williams sign is contrary to the adopted color
theme for the center.
