Conditional Use Permit No. 74-21 is a request to permit con-
struction of a 12 unit planned residential development.
Tentative Tract No. 8270 is a request for 13 lots of 1.25 gross
acres located on the southwest corner of Constantine Drive
and Lister Lane.
Conditional Exception No. 74-67 is a request to permit a total
of two covered parking spaces per unit and to permit less
required open space.
Mr. Jim Palin stated that staff had no further information to
report to Commission at this time. He presented a vugraph and
aerial views of the property.
The Chairman reopened the public hearing on Conditional
Exception No. 74-67.
Mr. Jim Chaffin, representing the applicant, addressed the
Commission and stated that he had nothing further to add to
his previous comments but would be willing to answer any
questions.
The public hearing was closed.

Commissioner Bazil felt that there was a hardship on the property
and stated that insofar as parking problems were concerned he
felt that the tenants would not tend to park in their garages
but would prefer to park on the street. He felt that parking was
adequate.
Chairman Kerins discussed the recreation area and felt that it
was not adjacent to units to the south for easy access.
Commissioner Higgins concurred with Commissioner Bazil on parking.
A MOTION WAS MADE BY BAZIL AND SECONDED BY HIGGINS TO CONDITIONALLY
APPROVE CONDITIONAL EXCEPTION NO. 74-67 WITH THE FOLLOWING FINDINGS:
1. The amount of property deleted from this acreage per street
frontage in proportion to size of overall plot creates a
substantial hardship.
2. The project has been approved at a previous meeting by this
Commission as it exists.
3. The number of off street parking spaces required are dis-
proportionate to the size of piece of property being created.

ABSENT: Porter
THE MOTION FAILED.
A MOTION WAS 14ADE BY KERINS AND SECONDED BY GEIGER TO DENY
CONDITIONAL EXCEPTION NO. 74-67 ON THE BASIS THAT NO HARDSHIP
HAS BEEN SHOWN.
VOTE:

ABSENT: Porter
THE MOTION FAILED.
The Chairman noted that for approval or denial to be effected
four votes would be required. There was a discussion on
reconsideration of the vote.

ZONE CASE NO. 74-22 '
Applicant: Virginia Staudinger and Ralph Ashton
This is a request to change the zone from RA-OCD to RA-0-1-CD
on the north side of Schliecher Rd., a private street, 1300 ft.
east of Edwards Street, 990 ft. west of Golden West.
Mr. John Cope stated that staff has requested a continuance on
this zone change to allow the staff an opportunity to certify
through the City Attorney's office the legality of the lease
arrangement proposed to satisfy Section 9685.3 of the Huntington
Beach Ordinance Code.
The Chairman opened the public hearing.

Mr. Plager addressed the Commission and stated that he was
the owner of the property. He spoke in favor of the zone change
and noted various improvements which had been made on the property
as well as proposed improvements.
The public hearing was closed.

CODE AMENDMENT NO. 74-17
"Upgrading of Automobile Development Standards"
Mr. John Cope stated that at request of the Commission further
revisions to this Code Amendment have been made since the
January 21, 1975 meeting. He noted that there would be, as
one of the revisions, a requirement for approval of a Conditional
Use Permit for such use. Commission discussed the Code Amendment.

PLANNING COMMISSION WORK PROGRAM FOR 1975 (Cont'd from 2/4/75
There was a discussion on the Work Program. The status was
eliminated on all the projects. Discussion ensued on priority
ranking on Code Amendments with no resulting changes. The staff
is to prepare schedules on the projects and will bring back for
discussion sometime in March.
ORAL COMMUNICATIONS:
David Dahl spoke in behalf of Four Seasons Farms and other
developers concerning the equestrian ordinance. He requested
the setback requirement from property that is zoned residential
be reduced from 300 ft. to 100 ft.

MISCELLANEOUS:
MEMO FROM H. E. HARTGE, DIRECTOR OF PUBLIC WORKS, suggesting
that Condition No. 9 be deleted from Conditions of Approval for
Tract 8025 or attempt to have Mr. Stellrecht apply to the Edison
Co. for undergrounding per Section C of Rule No. 20.
Commission discussion ensued.
ON MOTION BY BAZIL AND SECOND BY KERINS ITEM 9 WAS DELETED FROM
CONDITIONS OF APPROVAL IMPOSED ON TRACT 8025 BY THE FOLLOWING

CONCEPTUAL PLAN SUBMITTED FOR REVIEW BY DON E.''WOODWARD
Mr. Woodward met with staff and indicated that he would like to

discuss with the Planning Commission the proposed development. One
approach would be to purchase property currently zoned R-2 or R-3
and subdivide with 25 or 27 foot lots, then to convert back to
acreage and re -subdivide underneath the concept as submitted.
Mr. Palin addressed the Commission and gave square footage of
units and noted that the price range would be in the middle of
the $30,000 to $40,000. The developer felt that there was a need
for housing in this price range with smaller square footage. The
Commission concurred in their wishes to pursue this concept further.
COMMISSIONERS' COMMENTS
Commissioner Finley inquired about the reissuance of flood maps
referred to in the EIR for Classic's development. She also ex-
pressed some concern over whether or not PRD's were properly
signed for emergency purposes. Captain Vanderlaan stated that
the City has blown up maps of areas for their purposes and have
made efforts to provide ambulance service with this information.
Commissioner Porter referred to draft letter to Board of Directors,
Orange County Transit District, and noted that he was editing for
final typing. There was a discussion on possibility of Mayor Coen
transmitting a letter with attachments from the Planning Commission.
There was a discussion on the labor camps and the fact that they
are still in existence under a non -conforming use with expired
applications. Captain Vanderlaan stated that they would soon be
making a periodic check for fire safety purposes and would report
back to the Commission.

Chairman Kerins noted that he might be out of town at the
next meeting.
STAFF' S COMMENTS
Secretary Harlow reported on City Council meeting of February 18,
1975.
