MINUTES FOR APPROVAL: Minutes of February 5, 1975 were deferred for approval
to the meeting of February 26, 1975.
REGULAR AGENDA ITEMS
USE PERMIT NO. 74-56 (Continued from December 4, 1974)
Applicant: Standard Oil Company of California
To permit the redrilling of Well 116A from Island R, pursuant to S.9685 of the
Huntington Beach Ordinance Code, located approximately 100 feet north of
Quiet Surf Circle and 120 feet east of Island Bay Lane, in an R4-01, High
Density Residential District.
Acting Chairman Cope informed the Board that this application had been continued
from December 4, 1974 in order to allow for filing of appropriate environmental
documents; he further noted that the application had subsequently been granted
Negative Declaration No. 75-1 by the Environmental Review Board on February
4, 1975. He then stated that it was his opinion that the application should
be amended and readvertised, reflecting detailed future plans for the entire
island, rather than for the sole purpose of the redrilling intentions on Well
116A, as the application now reads. He substantiated this opinion by noting
that the Board could approve or deny an application for an oil operation site,
but could not grant a Use Permit for one well alone. Further, by following
the above course of action, the use would be established on the entire drilling
island and would apply to all future operations on the site. In view of the
above, Acting Chairman Cope recommended a two -week continuance on the application
in order to allow for readvertising.
Mr. Walter Gresh and Mr. Alec Henderson, representing the applicant, concurred
with this recommendation and agreed to amend the application accordingly.
The Chairman opened the Continued Public Hearing.

Use Permit No. 74-56
Mr. Silvio Palombi, adjoining property owner, addressed the Board and expressed
opposition to the proposal, stating that the proposed use is incompatible with
existing residential surroundings. He further stated that a poll had been con-
ducted among the surrounding property owners and indicated that out of 22 home-
owners questioned, 20 had voiced opposition to the proposal and had requested
its denial. Board member Crosby advised Mr. Palombi that an approval action
by the Board would be in conjunction with adequate conditions to ensure
against any undesirable aspects or consequences to the adjoining homeowners.
Following additional discussion between the applicant's representatives, Mr.
Palombi, Board members, and Mr. Davis, City Oil Field Inspector, it was
mutually agreed that several areas of the proposal should be clarified in
order to alleviate possible areas of misapprehension among the homeowners.
Acting Chairman Cope stated that he would attempt to coordinate all available
information regarding the proposal and would relate this information to Mr.
Palombi prior to the next hearing of this application.
There being no other parties present to speak for or against the proposal,
the Public Hearing was closed.

CONDITIONAL EXCEPTION NO. 75-4
Applicant: Creative Communities, Inc.
To permit an encroachment of approximately ten (10) inches into the required
five foot side yard setback, in lieu of Section 9103.2.1 of the Huntington
Beach Ordinance Code, located at the northwest end of Maruffa Circle,
approximately 375 feet north of Mistral Drive, in an R1, Low Density
Residential District.
The Acting Chairman informed the Board that this application is a Categorical
Exemption, Class V, California Environmental Quality Act, 1970.
The Acting Chairman opened the Public Hearing.
Mr. William Ashby, representing the applicant, addressed the Board and
offered a brief overview of the proposal, citing the irregular lot configu-
ration as justification for the request.
There being no other parties present to speak for or against the proposal,
the Public Hearing was closed.

Conditional Exception No. 75-4
Board members reviewed the request and concurred that sufficient justification
existed to warrant granting of the exception.
ON MOTION BY CROSBY AND SECOND BY LIPPS, CONDITIONAL EXCEPTION NO. 75-4 WAS
APPROVED WITH THE FOLLOWING FINDINGS, BY THE FOLLOWING VOTE:
1. Exceptional circumstances exist in that when the tract was originally
recorded, the lot lines were very irregular, making the lots unsellable.
A parcel map was filed to change the lot configuration for better usage
of the lot, however, the modified lot configuration remained irregular
and did not allow the property owner to enjoy the same benefits as
adjacent property owners.
2. The granting of the Conditional Exception is necessary in order to pre-
serve the enjoyment of substantial property rights.
3. There are exceptional and extraordinary circumstances or conditions
applicable to the land involved.
4. Granting of the Conditional Exception will not prove detrimental to
adjacent property owners.

The Acting Chairman informed the Board that this application is a Categorical
Exemption, Class III, California Environmental Quality Act, 1970. He further
noted that the applicant had requested a one week continuance in order to
allow for plot plan revisions relating to lot coverage. Board members con-
curred with the applicant's request.

Exemption, Class III, California Environmental Quality Act, 1970. He further
noted that the applicant had requested a one week continuance in order to

ADMINISTRATIVE REVIEW NO. 75-15
Applicant: L. D. Zehnder
To permit the construction of a four (4) unit apartment building, pursuant
to Section 9231.6 of the Huntington Beach Ordinance Code, located at the
northwest corner of 14th Street and Walnut Avenue, in an R4, High Density
Residential District.
The Acting Chairman informed the Board that this application is a Categorical
Exemption, Class III, California Environmental Quality Act, 1970.
The applicant, Mr. L. D. Zehnder, was present.
Board discussion centered on the need for a modification on the plan in
order to provide a 25' turning radius for the driveway leading to the
attached two -car garage; the applicant was amenable to the modification.
Conditions of Approval were discussed.
ON MOTION BY LIPPS AND SECOND BY CROSBY, ADMINISTRATIVE REVIEW NO. 75-15 WAS
APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE:
A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS:
1. The conceptual plot plan and elevations received February 11, 1975
shall be the approved layout, subject to the modification described
herein:
All on -site parking shall be provided with a twenty-five
foot (25') turning radius.
In its approval action, the Board of Zoning Adjustments considered the
following issues relating to the conceptual plan:
Traffic circulation and drives;
Parking layout;
Lot area;
Lot width and lot depth;
Type of use and its relation to property and improvements in the
immediate vicinity;
Past administrative action regarding this property.
2. In accordance with the City's Master Plan of Streets and Alleys, an
additional 22 feet of right-of-way on the alley shall be dedicated.
3. Soil and compaction reports shall be submitted by a certified soils
engineer. Said reports shall be submitted to the Department of
Building and Community Development and shall be subject to approval
by that Department.

A. 4. Fire protection systems, including automatic sprinkler systems,
standpipe systems, fire hydrants, fire alarm systems, and any
other required fire protection and detection devices or systems
shall comply with the specifications of the Huntington Beach
Fire Code. Plans for such systems and devices shall be submitted
to the Fire Department and shall be subject to approval by the
Departments of Fire and Public Works.
B. GENERAL CONDITIONS:
The building shall be set back an additional 22 feet from the property
line if the property to the west has not dedicated the required 22 feet
for future alley right-of-way.
