Vanderlaan, Fire Department MINUTES FOR APPROVAL: ON MOTION BY COPE AND SECOND BY CROSBY, MINUTES OF THE FEBRUARY 5, 1975, FEBRUARY 13, 1975, AND FEBRUARY 19, 1975 MEETINGS WERE APPROVED BY THE FOLLOWING VOTE: AYES: COPE, CROSBY, LIPPS NOES: NONE ABSENT: NONE REGULAR AGENDA ITEMS: USE PERMIT NO. 74-56 (Continued from February 19, 1975) Applicant: Standard Oil Company of California To permit drilling, redrilling, and operation for the discovery or production of oil, gas, hydrocarbons, and/or kindred substances in their natural state, including the installation and use of equipment, structures, tools, and other facilities incide;:tal, necessary, and accessory to the drilling, pro- duction, repressuring and processing of substances produced by such wells for shipment to pipeline. The subject property is located approximately 100 feet north of Quiet Surf Circle and 120 feet east of Island Bay Lane, in an R4-01, High Density Residential District. Acting Chairman Cope informed the Board that this application was granted Negative Declaration No. 75-1 by the Environmental Review Board on February 4, 1975. He further noted that the application had been continued from the February 19, 1975 meeting in order to allow for readvertisement to reflect detailed future plans for the entire island. Acting Chairman Cope opened the Public Hearing. Mr. Walter Gresch, representing the applicant, addressed the Board and offered a brief overview of the proposal. BZA 3-5-75 Page 1 Minutes: Huntington Beach Board of Zoning Adjustments March 5, 1975 Page 2 Use Permit No. 74-56 Mr. Silvio Palombi, adjoining property owner, addressed the Board, voicing opposition to the proposal and presenting the Board with an addendum to a previously submitted petition from property owners in the area. Mr. Palombi also stated that an additional petition from the homeowners had been sub- mitted to the City Council, requesting a rezoning of the area from R4-01 to R1-0. Mr. Russ DeLuca, adjoining property owner, addressed the Board and expressed opposition to the proposal. Mr. Bob Davis, City Oil Field Inspector, stated that per Article 968 of the Huntington Beach Ordinance Code, the applicant is not required to apply for a permit for the purpose of conducting maintenance and repair procedures on the island; in the present situation, the applicant is requesting a Use Permit in order to allow re -drilling procedures, which involve a substantially reduced length of time, thereby benefiting the homeowners. Mr. John Thomas addressed the Board, stating that his property abuts another island on which drilling procedures had taken place; he further stated that he had not experienced problems of any kind during the process. Discussion ensued regarding hours of operation for the drilling procedure. Mr. Palombi stated that, per Article 544 of the Ordinance Code, reference "Nuisances", the hours should be restricted to 7:00 A.M. to 6:00 P.M. However, Mr. Davis responded that Section 2336 of the Huntington Beach Oil Code permitted drilling procedures to be conducted between the hours of 7:00 A.M. and 9:00 P.M. There being no other parties present to speak for or• against the proposal, the Public Hearing was closed. The Board discussed the proposal, concurred on approval, and discussed Conditions of Approval. Board member Lipps recommended that the hours of operation be limited to 7:00 A.M. to 6:00 P.M. Mr. Gersch noted that this would necessarily prolong the operation, however, the majority of the homeowners present expressed a preference for the shorter hours; Board members were also in concurrence with the recommendation. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan received October 30, 1974 shall be the approved layout. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: Traffic circulation and drives; Parking layout; Lot area; Lot width and lot depth; Type of use and its relation to property and improvements in the immediate vicinity; Past administrative action regarding this property. 2. Fire protection systems, including automatic sprinkler systems, standpipe systems, fire hydrants, fire alarm systems, and any other required fire protection and detection devices or systems shall comply with the specifications of the Huntington Beach Fire Code. Plans for such systems and devices shall be submitted to the Fire Department and shall be subject to approval by the Departments of Fire and Public Works. B. GENERAL CONDITIONS: 1. The drilling and redrilling operations shall be limited to the hours of 7:00 A.M. to 6:00 P.M. 2. Noise attenuation measures shall be provided as required and approved by the Planning Department. 3. Drilling and redrilling permits shall not be issued if a change of zoning occurs cii the property which does not permit drilling and redrilling operations. 4. Waste water shall be disposed of in a manner that meets the approval of the Department of Public Works and the Orange County Sanitation District. FINDINGS OF THE BOARD: 1. The establishment, maintenance, and operation of the use will not be detrimental to: a. The general welfare of persons residing or working in the vicinity. b. Property and improvements in the vicinity of such use or building. 2. The granting of a Use Permit will not adversely affect the Master Plan of the City of Huntington Beach. 3. The proposal is consistent with the City's General Plan of Land Use. Carter To permit the construction of a sixty-two (62) unit apartment complex, pursuant to S.9202.3.1.3 of the Huntington Beach Ordinance Code, located on the south side of Constantine Drive, approximately 143 feet west of Lister Lane, in an R3, Medium High Density Residential District. Acting Chairman Cope informed the Board that this application was granted Negative Declaration No. 75-4 by the Environmental Review Board on February 11, 1975. The applicant, Mr. James Carter, was present. Acting Chairman Cope opened the Public Hearing; there being no parties present to speak for or against the proposal, the Public Hearing was closed. The Board reviewed the revised plans and noted that the necessary modifi- cations had been made in order for the proposal to comply with code re- quirements. Conditions of Approval were discussed with the applicant. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: I. The revised conceptual plot plan and elevations received March 4, 1975 shall be the approved layout. Landscape and irrigation plan complying with Article 979 of the Huntington Beach Ordinance Code, and landscaping speci- fications on file in the Department of Public Works. b. Rooftop mechanical equipment screening plan. Said plan shall indicate screening of all rooftop mechanical equipment and shall delineate the type of material proposed to screen said equipment. 3. In accordance with the City's Master Plan of Streets and Alleys, an additional thirty (30) feet of right-of-way on Constantine shall be dedicated. 4. Soil and compaction reports shall be submitted by a certified soils engineer. Said reports shall be submitted to the Department of Building and Community Development and shall be subject to approval by that Department. 5. Fire protection systems, including automatic sprinkler systems, standpipe systems, fire hydrants, fire alarm systems, and any other required fire protection and detection devices or systems shall comply with the specifications of the Huntington Beach Fire Code. Plans for such systems and devices shall be submitted to the Fire Department and shall be subject to approval by the Departments of Fire and Public Works. 6. The developer shall participate in the local drainage assessment district. 7. The developer shall participate in the Orange County Sanitation District #3 Sewer Annex District. B. TO BE COMPLETED PRIOR TO FINAL INSPECTION: Constantine Drive shall be improved to the center line of such right-of- way. Said improvement shall include curbs, gutters, sidewalks, paving, street trees, street lights, street signs, street drainage, and sewer and water main extensions, in full compliance with the City of Huntington Beach street standards and requirements. R. Montague, Jr. To permit the relocation of an overhead electrical service, pursuant to S.9730.9(e) of the Huntington Beach Ordinance Code, located on the east side of Steiner Circle, approximately 200 feet south of Armada Drive, in an R1, Low Density Residential District. Acting Chairman'Cope informed the Board that this application is a Categorical Exemption, Class I, California Environmental Quality Act, 1970. Mrs. K. R. Montague, Jr., co -applicant, was present. The Board reviewed the proposal and discussed Conditions of Approval with Mrs. Montague. ON MOTION BY LIPPS AND SECOND BY COPE, ADMINISTRATIVE REVIEW NO. 75-17 WAS APPROVED WITH THE FOLLOWING CONDITIONS AND FINDINGS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: 1. The plot plan received February 19, 1975 shall be the approved layout. 2. The applicant shall install a service panel to facilitate conversion to underground utilities at a future date, pursuant to S.9730.11 of the Huntington Beach Ordinance Code. FINDINGS OF THE BOARD: The Board has considered all guidelines for approval of overhead utilities, and all criteria has been satisfied, pursuant to Section 9730.10 of the Huntington Beach Ordinance Code. AYES: COPE, CROSBY, LIPPS NOES: NONE ABSENT: NONE ADMINISTRATIVE REVIEW NO. 75-19 Applicant: Linda Lee Thomas To permit the development of a vehicle storage yard and crane service, pursuant to S. 9511 of the Huntington Beach Ordinance Code, located on the east side of Goldenwest Street, approximately 445 feet north of Garfield Avenue, in an M1-A-CD, Restricted Industrial District. Acting Chairman Cope informed the Board that this application is covered by Exemption Declaration No. 73-115, granted to Administrative Review No. 73-112 by the Environmental Review Board on July 3, 1973. 1 BZA 3-5-75 Page 6 Minutes: Huntington Beach Board of Zoning Adjustments March 5, 1975 Page 7 Administrative Review No. 75-19 Mr. Frank Thomas represented the applicant. Acting Chairman Cope questioned the necessity of signs at two locations within the project; Mr. Thomas stated that he was amenable to eliminating one. Construction material for the wall was discussed and a recommendation made that it be constructed totally of slump stone; Mr. Thomas concurred with this recommendation. Further discussion centered on the need for demolishing the existing one-story structure situated on the adjoining property; Captain Vanderlaan stated that the Fire Department would follow-up on this matter. Conditions of Approval were discussed with Mr. Thomas. ON MOTION BY LIPPS AND SECOND BY CROSBY, ADMINISTRATIVE REVIEW NO. 75-19 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan and elevations received March 3, 1975 shall be the approved layout. Acting Chairman Cope informed the Board that this application is covered by Exemption Declaration No. 74-158, granted to Administrative Review No. 74-166 by the Environmental Review Board on November 5, 1974. He further noted that this application was filed in order to comply with Condition A.l.a. of Administrative Review No. 74-166. The Board reviewed the proposal and discussed Conditions of Approval with Mr. Johnson. ON MOTION BY LIPPS AND SECOND BY COPE, DIVISION OF LAND NO. 75-3 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: A. TO BE COMPLETED PRIOR TO USE OR OCCUPANCY OF SAID PARCEL FOR ANY PURPOSE: 1. This Division of Land shall not be effective until a Covenant and Agreement furnished by the Huntington Beach Planning Department is signed and recorded with the Orange County Recorder, agreeing to these Conditions of Approval. 2. The tentative parcel map received by the Planning Department on February 24, 1975 shall be the approved layout. 3. A parcel map shall be filed with, and approved by, the Department of Public Works, and recorded with the Orange County Recorder (prior to issuance of a Certificate of Occupancy). 4. A copy of the recorded parcel map and Covenant and Agreement shall be submitted to the Planning Department. 5. Gothard Street and Palmdale Street shall be dedicated to City standards at the time said parcel is developed. 6. Water supply shall be through the City of Huntington Beach's water system at the time said parcel is developed (if such system exists within 200 feet )f said parcel). 7. Sewage disposal shall be through the City of Huntington Beach's sewage system at the time said parcel is developed (if such system exists within 200 feet of said parcel). 8. All utilities shall be installed underground at the time said parcel is developed. 9. All applicable City Ordinances shall be complied with. 10. Beko To permit an existing six (6) foot high fence to remain within the required 10 foot by 10 foot triangular reverse corner cut-off, in lieu of S.9104.1.1 of the Huntington Beach Ordinance Code, located at the northeast corner of Cotuit Circle and Humboldt Drive, in an Rl, Low Density Residential District. Acting Chairman Cope informed the Board that this application is a Categorical Exampeiton, Class V, California Environmental Quality Act, 1970. The Public Hearing was opened by Acting Chairman Cope. The applicant, Mr. Norman J. Beko, was present and offered the Board an explanation of the request, stating that the contractor had failed to comply with City Code by not obtaining a permit prior to construction of the fence, and by not providing an angular corner to same. He stated that modification of the fence would involve substantial expense and would reduce the amount of privacy provided to his rear yard. Further, he stated that the fence had existed for two years and had not created any problems. Mr. Gilbert Fujimoto, adjoining property owner, addressed the Board and voiced opposition to the request, stating that it should not be granted primarily due to the safety hazards that it presents. Mr. Fuj.imoto offered photographs to substantiate his opinion. Mr. Don Hartfelder, adjoining property owner, addressed the Board and expressed opposition to the request for safety and aesthetic reasons. Mr. George Leonard, adjoining property owner, addressed the Board and expressed opposition to the request for safety reasons. Mrs. J. Sutton, adjoining property owner, addressed the Board and expressed opposition to the request, stating that the applicant should be required to comply to Code requirements. Mrs. Frank Yamada addressed the Board and expressed opposition to the request for safety reasons. There being no other parties present to speak for or against the proposal, the Chairman closed the Public Hearing. The Board discussed the proposal and concurred that the applicant had failed to demonstrate sufficient hardship to warrant granting of the exception. ON MOTION BY CROSBY AND SECOND BY COPE, REVISED PLANS FOR USE PERMIT NO. 74-58 WERE APPROVED WITH THE FOLLOWING CONDITIONS AND FINDINGS, BY THE FOLLOWING VOTE: REVISED CONDITIONS OF APPROVAL A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The modified conceptual plan received February 19, 1975 shall be the approved layout and shall nullify the previously approved plans (Use Permit No. 74-34). The modified conceptual plan shall be sub- ject to the modifications described herein: a. A plan for a decorative masonry wall fronting on Alhambra Avenue shall be submitted to the Planning Department for review and approval action. b. Trash locations shall be indicated. A plan delineating said modifications shall be submitted to the Secretary of the Board. If such plan complies with the modifica- tions outlined by the Board, said plan shall be approved and made a permanent part of the administrative file. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: Traffic circulation and drives; Parking layout; Lot area; Lot width and lot depth; Type of use and its relation to property and improvements in the immediate vicinity; Past administrative action regarding this property; Landscaping allocations. 2. The following plan shall be submitted to the Secretary of the Board: Landscape and irrigation plan complying with Article 979 of the Huntington Beach Ordinance Code, and landscaping specifications on file in the Department of Public Works. Soil and compaction reports shall be submitted by a certified soils engineer. Said report shall be submitted to the Department of Building and Community Development and shall be subject to approval by that Department. 6. Fire protection systems, including automatic sprinkler systems, standpipe systems, fire hydrants, fire alarm systems, and any other required fire protection and detection devices or systems shall comply with the specifications of the Huntington Beach Fire Code. Plans for such systems and devices shall be sub- mitted to the Fire Department and shall be subject to approval by the Fire Department and Department of Public Works. B. TO BE COMPLETED PRIOR TO FINAL INSPECTION: Beach and Alhambra shall be improved to the center line of such right-of-way. Said improvement shall include curbs, gutters, sidewalks, paving, street trees, street lights, street signs, street drainage, and sewer and water main extensions, in full compliance with the City of Huntington Beach street standards and requirements. C. GENERAL: 1. Any future construction shall require a subsequent Use Permit. 2. All lighting shall be directed upon the subject property and shielded away from the abutting residences. 3. All speakers to be used shall be housed in an all -enclosed building. 4. Separating walls shall be required between residences and the facility, to conform to building standards. 5. All building spoils, such as unusable lumber,-.wi-re, pipe, and other surplus or unusable material shall be disposed of at an offsite facility equipped to handle them. The establishment, maintenance, and operation of the use will not be detrimental to: a. The general welfare of persons residing or working in the vicinity. b. Property and improvements to the vicinity of such use or building. 3. The granting of a Use Permit will not adversely affect the Master Plan of the City of Huntington Beach. 4. The site layout and design is compatible with the surrounding vicinity by virtue of parking allocations and location of sales area.
