Applicant: Andy Lacono
To permit the construction of a 4,470 square foot commercial retail building,
pursuant to S.9430.2 of the Huntington Beach Ordinance Code, located at the
north side of Warner Avenue, approximately 110 feet west of Bolsa Chica, in
a C2, Community Business District.
Acting Chairman Cope informed the Board that this application was granted
Negative Declaration No. 75-10 by the Environmental Review Board on February
25, 1975.
The applicant, Mr. Andy Lacono, was present.
The Board reviewed the plot plan with the applicant, with discussion centering
on landscaping requirements, reciprocal access agreements, and trash area
enclosure. For aesthetic purposes, Acting Chairman Cope recommended that the
trash area enclosure be constructed of slump stone with a redwood gate; the
applicant stated that he would consider the recommendation. Conditions of
Approval were discussed.

WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE:
A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS:
1. The conceptual plot plan and elevations received February 5, 1975
shall be the approved layout, subject to the modifications described
herein:
a. A 6' wall with a solid gate of wall height shall be provided
around the proposed trash site and shall be subject to approval
by the Planning Department.
b. The precise location of the existing eucalyptus trees shall be
indicated on the site plan and shall be incorporated into a
landscape plan as required by the Planning Department.
A plan delineating said modifications shall be submitted to the
Secretary of the Board. If such plan complies with the modifications
outlined by the Board, said plan shall be approved and made a permanent
part of the administrative file.
In its approval action, the Board of Zoning Adjustments considered the
following issues relating to the conceptual plan:
Traffic circulation and drives;
Parking layout;
Lot area;
Lot width and lot depth;
Type of use and its relation to property and improvements in the
immediate vicinity;
Past administrative action regarding this property.
2. The following plans shall be submitted to the Secretary of the Board:
a. Landscape and irrigation plan complying with Article 979 of
the Huntington Beach Ordinance Code and landscaping specifi-
cations on file in the Department of Public Works.
b. Rooftop mechanical equipment screening plan. Said plan shall
indicate screening of all rooftop mechanical equipment and
shall delineate the type of material proposed to screen said
equipment.

3. Soil and compaction reports shall be submitted by a certified soils
engineer. Said reports shall be submitted to the Department of
Building and Community Development and shall be subject to approval
by that Department.
4. Fire protection systems, including automatic sprinkler systems,
standpipe systems, fire hydrants, fire alarm systems, and any
other required fire protection and detection devices or systems
shall comply with the specifications of the Huntington Beach
Fire Code. Plans for such systems and devices shall be submitted
to the Fire Department and shall be subject to approval by the
Departments of Fire and Public Works.
5. The developer shall participate in the local drainage assessment
district.
6. The developer shall participate in the Orange County Sanitation
District #11 Sewer Annex District.
B. TO BE COMPLETED PRIOR TO FINAL INSPECTION:
Warner Avenue shall be improved to the center line of such right-of-way.
Said improvement shall include sidewalks, street trees, street lights,
street signs, street drainage, and sewer and water main extensions, in
full compliance with the City of Huntington Beach street standards and
requirements.
C. GENERAL CONDITIONS:
1. Calculations fon footings and structural members to withstand
anticipated g-factors shall be submitted to the City for review.
2. If the developer proposes to provide air conditioning, the insulation
in ceilings and exterior walls shall be a minimum of R-19 and R-11,
respectively. If no air conditioning is to be provided, the insu-
lation in ceilings and exterior walls shall be a minimum of R-13 and
R-7, respectively.
3. All building spoils, such as'unusable lumber, wire, pipe, and
other surplus or unusable material, shall be disposed of at an
offsite facility 'equipped to handle them.
4. Reciprocal access agreements shall'4e provided prior to final
inspection.

To permit the construction of a duplex dwelling unit, pursuant to Section
9161.2 of the Huntington Beach Ordinance Code, located on the east side of
18th Street, approximately 50 feet north of Pecan Avenue, in an R2, Medium
Density Residential District.
Acting Chairman Cope informed the Board that this application is a
Categorical Exemption, Class III, California Environmental Quality
Act, 1970.
Mr. Norman Wallenfang represented the applicant.
Acting Chairman Cope informed the applicant's representative that revised
plans reflecting modifications in the area of lot coverage had been requested
by the Planning Staff and to date had not been received. Mr. Wallenfang
stated that the revised plans would be submitted and requested a one week
continuance of the application; Board members concurred with the request
for continuance.

Applicant: Alva Wilson Company
To permit relocation of the tennis court, construction of an additional swimming
pool and recreation building, modification of the layout on specific units, re-
vision of the driveway setbacks, and revision of parking, pursuant to S.9811.4
of the Huntington Beach Ordinance Code. The subject property is located at the
northwest corner of Ellis Avenue and Newland Street, in an R1-PD, Low Density
Residential, Planned Development District.
Acting Chairman Cope informed the Board that this application is covered by
Environmental Impact Report No. 72-4, granted by the Environmental Review
Board on February 21, 1973. He further informed the Board that the applicant
had requested a three week continuance pending the filing of a Conditional
Exception application to be heard in conjunction with the above noted request
for a plot plan amendment; Board members concurred with the request for con-
tinuance.

USE PERMIT NO. 75-9
Applicant: Ingrid Wolter
To permit retail sales in a portion of an industrial building, pursuant to
S.9511.1 of the Huntington Beach Ordinance Code, located on the south side
of McFadden Avenue, between Producer and Product Lanes, in a 100-M1-A-20,000
Restricted Manufacturing District.
Acting Chairman Cope informed the Board that this application is within the
area covered by Environmental Impact Report No. 73-16, approved by the City
Council on March 18, 1974.
The Public Hearing was opened by the Acting Chairman; there being no one
present to speak for or against the proposal, the Public Hearing was closed.
The applicant, Ms. Ingrid Wolter, was present and offered the Board a brief
overview of the proposal, stating that it would be comprised of retail and
wholesale sale of items manufactured on the site. She further stated that
the wholesale and retail sales areas would be separated by a wall with a
doorway.
Board members reviewed the plan. Acting Chairman Cope stated that the
applicant had complied with all requirements for retail sales in an indus-
trial building, and recommended approval of the proposal.
ON MOTION BY COPE AND SECOND BY LIPPS, USE PERMIT NO. 75-9 WAS APPROVED WITH
THE FOLLOWING CONDITIONS AND FINDINGS, BY THE FOLLOWING VOTE:
CONDITIONS OF APPROVAL:
A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS:
1. The conceptual plot plan received February 25, 1975 shall be the
approved layout.
In its approval action, the Board of Zoning Adjustments considered the

The applicant shall comply with all provisions of Section 9511.1(b)
of the Huntington Beach Ordinance Code.
FINDINGS OF THE BOARD:
1. The establishment, maintenance, and operation of the use will not be
detrimental to:
a. The general welfare of persons residing or working in the vicinity.
b. Property and improvements in the vicinity of such use or building.
2. The granting of a Use Permit will not adversely affect the Master Plan
of the City of Huntington Beach.
3. The proposal is consistent with the City's General Plan of Land Use.

of Feola Circle, approximately 220 feet south of Breezlan Street.
Acting Chairman Cope informed the Board that this application is a Categorical
Exemption, Class I, California Environmental Quality Act, 1970.
The applicant was not represented at the meeting.
The Board reviewed the proposal and concurred on approval of same.
ON MOTION BY LIPPS AND SECOND BY CROSBY, ADMINISTRATIVE REVIEW NO. 75-20 WAS
APPROVED WITH THE FOLLOWING CONDITIONS AND FINDINGS, BY THE FOLLOWING VOTE:
CONDITIONS:
1. The plot plan received March 3, 1975 shall be the approved layout.
2. The applicant shall install a service panel to facilitate conversion to
underground utilities at a future date, pursuant to S.9730.11 of the
Huntington Beach Ordinance Code.

Avenue, in an R3-0, Medium High Density District, combined with oil production.
Acting Chairman Cope informed the Board that this application is a Categorical
Exemption, Class I, California Environmental Quality Act, 1970.
Mr. J. T. Hudson represented the applicant.
The Board reviewed the proposal and discussed Conditions of Approval with
Mr. Hudson.

DIVISION OF LAND NO. 75-4
Applicant: Creative Homes
To permit the creation of two parcels of land from one existing parcel, pursuant
to Section 9811.2 of the Huntington Beach Ordinance Code, located at the south-
east corner of 17th Street and Huntington Avenue, in an R2, Medium Density
Residential District.
Acting Chairman Cope informed the Board that this application is covered by
Exemption Declaration No. 73-231, granted to Use Permit No. 73-88 by the
Environmental Review Board on February 26, 1974.
Mr. Guy Gardner represented the applicant and offered the Board a brief
overview of the request, stating that the original proposal had been for
a 12-unit project. He further stated that the developer now wished to
construct two four-plex units, thus necessitating the Division of Land
application.
Board discussion centered on feasible means of access to parcel #1, and
concurred that a preliminary development plan specifically showing access
to same should be submitted prior to further consideration of the Division
of Land request. The applicant's representative was requested to submit a
site plan for review by Board members, Fire Department staff, and the
Traffic Engineer. Mr. Gardner stated that he would comply, and requested
a one week continuance.
