The public hearing was opened by the Acting Chairman. Mr. Mark C. Bloome, Jr., was present and discussed the hard- ships existing on the property. The public hearing was closed. ON MOTION BY CROSBY AND SECOND BY LIPPS CONDITIONAL EXCEPTION NO. 75-6 WAS APPROVED WITH THE FOLLOWING FINDINGS AND FOR THE FOLLOWING REASONS BY THE FOLLOWING VOTE: FINDINGS: 1. The topographical features of the site restrict the placement of the proposed building. 2. The orientation of the subject site to the corner creates an odd shape lot and thus the placement alternatives for the building are limited. BASED ON THE ABOVE FINDINGS, THE CONDITIONAL EXCEPTION WAS APPROVED FOR THE FOLLOWING REASONS: 1. The granting of the Conditional Exception will not constitute a grant of a special privilege inconsistent upon other properties in the vicinity and under an identical zone classification. 2. Because of special circumstances applicable to the subject property, including size, shape, topography, location, or surroundings, the strict application of the zoning ordinance is found to deprive the subject property of privileges enjoyed by other properties in the vicinity and under identical zone classifications. 3. The granting of a Conditional Exception will not be materially detrimental to the public welfare, or injurious to property in the same zone classifications. 4. The granting of a Conditional Exception is necessary in order to preserve the enjoyment of one or more substantial property rights. Minutes: H.B. Board of Zoning Adjustments Wednesday, March 19, 1975 Page 7 5. The granting of the Conditional Exception will not adversely affect the Master Plan of the City of Huntington Beach.
