This is a request to permit the construction of a duplex dwelling
unit, pursuant to Section 9161.2 of the Huntington Beach Ordinance
Code, located on the east side of 18th Street, approximately
50 feet north of Pecan Avenue, in an R2, Medium Density Residential
District.
Acting Chairman Cope informed the Board that this application
is a Categorical Exemption, Class III, California Environmental
Quality Act, 1970.
The Acting Chairman advised the Board that the applicant has
requested that this application be tabled indefinitely, pending
revisions.

DIVISION OF LAND NO. 75-4 (Continued from 3-12-75)
Applicant: Creative Homes
This is a request to permit the creation of two parcels of
land from one existing parcel, pursuant to Section 9811.2
of the Huntington Beach Ordinance Code, located at the southeast
corner of 17th Street and Huntington Avenue, in an R2, Medium
Density Residential District.

Acting Chairman Cope informed the Board that this application
is covered by Exemption Declaration No. 73-231, granted to
Use Permit No. 73-88 by the Environmental Review Board on
February 26, 1974.
The Acting Chairman stated that he had discussed the appli-
cation with the applicant's representative and indicated that
the driveways would essentially be the same as those in the
plans submitted for Use Permit No. 73-88. There was a dis-
cussion on access.
Walt Lipps noted that the applicant has been advised to inform
the new owner of the driveway locations, since it was his
understanding that the property is going to be developed by
persons other than the applicant.
Conditions of approval were discussed.
ON MOTION BY LIPPS AND SECOND BY CROSBY DIVISION OF LAND
NO. 75-4 WAS APPROVED WITH THE FOLLOWING CONDITIONS BY THE
FOLLOWING VOTE:
A. TO BE COMPLETED PRIOR TO USE OR OCCUPANCY OF SAID PARCELS)
FOR ANY PURPOSE:
1. This Division of Land shall not be effective until
a Covenant and Agreement furnished by the Huntington
Beach Planning Department is signed and recorded
with the Orange County Recorder agreeing to these
Conditions of Approval.
2. The tentative parcel map received by the Planning
Department on February 27, 1975 shall be the approved
layout (with the amendments as noted thereon).
3. A parcel map shall be filed with, and approved by,
the Department of Public Works, and recorded with the
Orange County Recorder (prior to issuance of a
Certificate of Occupancy).
4. A copy of the recorded parcel map and Covenant and
Agreement shall be submitted to the Planning Department.
5. A 20' radius at the angle point of Huntington and 17th
shall be dedicated to City standards at the time said
parcel(s) is/are developed.
6. Water supply shall be through the City of Huntington
Beach's water system at the time said parcel(s) is/are
developed (if such systems exist within 200 feet of
said parcel (s).

7. Sewage disposal shall be through the City of Huntington Beach's
sewage system at the time said parcel(s) is/are developed
(if such systems exist within 200 feet of said parcel (s) .
8. All utilities shall be installed underground at the time
said parcel(s) is/are developed.
9. All applicable City Ordinances shall be complied with.
10. The property shall participate in the local drainage assess-
ment district at the time said parcel(s) is/are developed.

Applicant: Energy Development Corporation
This is a request to permit the relocation of an existing over-
head electric utility pole, pursuant to Section 9730.9 of the
Huntington Beach Ordinance Code, located on the southwest corner
of 19th Street and Walnut Avenue, in an R4, High Density Resi-
dential District.
Acting Chairman Cope informed the Board that this application
is a Categorical Exemption, Class I, California Environmental
Quality Act, 1970.
Mr. Christy, one of the owners of the Energy Development
Corporation, addressed the Commission and discussed the request.
There was a discussion on the height of the proposed overhead
electric utility. Conditions of approval were discussed.
ON MOTION BY LIPPS AND SECOND BY CROSBY ADMINISTRATIVE REVIEW
NO. 75-25 WAS APPROVED WITH THE FOLLOWING CONDITIONS AND FINDINGS
BY THE FOLLOWING VOTE:
1. The Plot Plan received March 10, 1975 shall be the approved
layout.
2. The applicant shall install a service panel to facilitate
conversion to underground utilities at a future date,
pursuant to 5.9730.11 of the Huntington Beach Ordinance
Code.

FINDINGS OF THE BOARD:
The Board has considered all guidelines for approval of overhead
utilities and all criteria has been satisfied, pursuant to
Section 9730.10 of the Huntington Beach Ordinance Code.

ADMINISTRATIVE REVIEW NO. 75-26
Applicant: Joe Smith's ARCO Service
This is a request to permit the storage of rental and utility
trailers, pursuant to Section 9481.4(b) of the Huntington Beach
Ordinance Code, located on the northeast corner of Pacific Coast
Highway and Huntington Avenue, in a C4, Highway Commercial
District.
Acting Chairman Cope informed the Board that this application
is a Categorical Exemption, Class III, California Environmental
Quality Act, 1970.
Mr. Fred Fountain, Manager of Joe Smith's ARCO Service, was
present to represent the applicant.
The Acting Chairman informed Mr. Fountain that the plan was not
in conformance with requirements of the Ordinance Code. There-
fore, no action could be taken.
There was a discussion on the number of utility trailers that
could be stored on the property, and the area designated for
storage. Screening of the storage area was discussed.
It was the consensus of the Board that a continuance be recom-
mended to allow applicant time to submit proper plans.
Mr. Fountain concurred.

CONDITIONAL EXCEPTION NO. 75-6
Applicant: Mark C. Bloome
This is a request to permit a 28'6" encroachment into required
sight angle cut-off, in lieu of S.9432.8.1 of the Huntington
Beach Ordinance Code, located on the west side of Beach
Boulevard, approximately 50 feet north of Main Street, in a
C4, Highway Commercial District.

Acting Chairman Cope informed the Board that this application
is a Categorical Exemption, Class V, California Environmental
Quality Act, 1970.
The public hearing was opened by the Acting Chairman.
Mr. Mark C. Bloome, Jr., was present and discussed the hard-
ships existing on the property.
The public hearing was closed.
The Board noted that a letter is on file in the Planning Department
from Denny's, Inc., indicating that they, as adjoining property
owners, have no objection to the plan.
Board discussion ensued.
ON MOTION BY CROSBY AND SECOND BY LIPPS CONDITIONAL EXCEPTION
NO. 75-6 WAS APPROVED WITH THE FOLLOWING FINDINGS AND FOR THE
FOLLOWING REASONS BY THE FOLLOWING VOTE:
FINDINGS:
1. The topographical features of the site restrict the placement
of the proposed building.
2. The orientation of the subject site to the corner creates
an odd shape lot and thus the placement alternatives for
the building are limited.
BASED ON THE ABOVE FINDINGS, THE CONDITIONAL EXCEPTION WAS APPROVED
FOR THE FOLLOWING REASONS:
1. The granting of the Conditional Exception will not constitute
a grant of a special privilege inconsistent upon other
properties in the vicinity and under an identical zone
classification.
2. Because of special circumstances applicable to the subject
property, including size, shape, topography, location, or
surroundings, the strict application of the zoning ordinance
is found to deprive the subject property of privileges enjoyed
by other properties in the vicinity and under identical zone
classifications.
3. The granting of a Conditional Exception will not be
materially detrimental to the public welfare, or injurious
to property in the same zone classifications.
4. The granting of a Conditional Exception is necessary in order
to preserve the enjoyment of one or more substantial property
rights.

5. The granting of the Conditional Exception will not adversely
affect the Master Plan of the City of Huntington Beach.

ADMINISTRATIVE REVIEW NO. 74-82 - REVISED PLANS
The Board discussed the revised plans and agreed that the
plans dated March 13, 1975 should be the approved layout.
MISCELLANEOUS
REQUEST FOR SPECIAL EVENT
Applicant: Fair Time Shows
This is a request for permission to conduct a Carnival at
the Two Guys Department Store located on Brookhurst and
Adams on the following dates: Thursday, 3/27, 4 p.m. to
10 p.m., Friday, 3/28, 11 a.m. to 10 p.m., Saturday, 3/29,
10 a.m. to 10 p.m., and Sunday, 3/30, 11 a.m. to 10 p.m.
The above request was approved with the following conditions
of approval:
1. The plot plan received March 19, 1975 shall be the ap-
proved layout.
2. Dates and times of the sales shall be limited to those
noted in Request (above).
3. An on -site inspection by the Fire Department shall be
required prior to the events.
4. The applicant shall obtain all necessary electrical
permits.
SIGNS:
Applicant: H. Toji & Company
This is a request for a wall sign 3' x 21', 63 sq. ft.,
located at 8881 Warner Avenue.
Board discussed the proposed sign.
