Vanderlaan PRESENT: Fire Department MINUTES FOR APPROVAL: ON MOTION BY CROSBY AND SECOND BY LIPPS, MINUTES OF MARCH 12, 1975 MEETING WERE APPROVED AS TRANSCRIBED, BY THE'FOLLOWING VOTE: AYES: Cope, Crosby, Lipps NOES: None ABSENT: None REGULAR AGENDA ITEMS: ADMINISTRATIVE REVIEW NO. 75-18 Applicant: W. Sterling Buck & Associates To permit the construction of a professional office building, pursuant to S.9430.1 of the Huntington Beach Ordinance Code located on the east side of Springdale Street, approximately 150 feet south of Bolsa Avenue, in a C2, Community Business District. Acting Chairman Cope informed the Board that this application was granted Negative Declaration No. 75-16 by the Environmental Review Board on March 11, 1975. Mr. John Cowles, representing the applicant, and Mr. Sterling Buck, the applicant were present. The Board reviewed the plot plan with the applicant and his representative. Discussion ensued regarding the provision of proper turning radius and site angle. Board recommended flipping the plan to bring plans within ordinance code conformance. Fire Marshall Vanderlaan discussed the relocation of the fire hydrant with the applicant. Further discussion ensued regarding possible reciprocal agreements. It was the consensus of the Board and the applicant to continue this application until the April 9, 1975 Board of Zoning Adjustments meeting to allow the applicant to pursue his plans further and to submit revised plot plans. Minutes: Huntington Beach Board of Zoning Adjustments Wednesday, March 26, 1975 Page 2 ON MOTION BY COPE AND SECOND BY LIPPS, ADMINISTRATIVE REVIEW NO. 75-18 WAS CONTINUED TO APRIL 9, 1975 BY THE FOLLOWING VOTE: AYES: Cope, Crosby, Lipps NOES: None ABSENT: None USE PERMIT NO. 75-6 Applicant: Breuer -Harrison, Inc. To permit the construction and development of a 15,000 square foot commercial building, pursuant to Section 9472 of the Huntington Beach Ordinance Code located on the east side of Beach Boulevard, approximately 80 feet north of Holland Drive, in a C4, Highway Commercial District. Acting Chairman Cope informed the Board that this application was granted Negative Declaration No. 75-8 by the Environmental Review Board on March 11, 1975. Mr. Dave Kirchner, representing the applicant, was present. The Acting Chairman opened the public hearing. Mr. Kirchner presented revised plans to the Board pointing out the modifications that had been made in the parking layout. Board discussed parking modifications with the applicant as well as a differencd in the grading of the property. Mr. Kirchner pointed out that he had obtained a reciprocal agreement with his neighbor (Pizza Hut) for ingress and egress purposes. Mr. Kirchner informed the Board that he was increasing the landscaping on the proposed use, subsequently, various proposals of landscaping were discussed. Acting Chairman Cope further stated that the landscape plan would be required to show plant materials that are considered by the applicant. There being no parties present to speak in favor or opposition to the proposed plan, the Acting Chairman closed the public hearing. Board discussion followed. It was the consensus of the Board and the applicant to continue this application until the April 2, 1975 Board of Zoning Adjustments Meeting to pursue his plans further and to submit revised plot plans. ON MOTION BY LIPPS AND SECOND BY CROSBY USE PERMIT NO. 75-6 WAS CONTINUED TO APRIL 2, 1975 BY THE FOLLOWING VOTE: AYES: Cope, Crosby, Lipps NOES: None ABSENT: None BZA 3/26/75 -2- Minutes: Huntington Beach Board of Zoning Adjustments Wednesday, March 26, 1975 Page 3 OIL WELL ACTIVATION PERMIT NO. 75-1 Applicant: Robert W. Shull To permit the reactivation of an oil well, pursuant to S.2392 of the Huntington Beach Ordinance Code located on the northeast corner of Springfield Avenue and California Street, in an R2-0, Medium Density Residential District combined with oil production. Acting Chairman Cope informed the Board that this application was granted Negative Declaration No. 75-13 by the Environmental Review Board on March 11, 1975. Mr. Robert Shull, the applicant, was present. Board discussed proposal with applicant. Acting Chairman Cope outlined the transmittal from the Oilfield Inspector, stating that the proposal is within Huntington Beach Ordinance Code conformance. Recommendations of the Environmental Review Board were discussed and subsequently made part of the conditions of approval. ON MOTION BY COPE AND SECOND BY LIPPS NEGATIVE DECLARATION NO. 75-13 WAS ADOPTED BY THE BOARD OF ZONING ADJUSTMENTS BY THE FOLLOWING VOTE: AYES: Cope, Crosby, Lipps NOES: None ABSENT: None ON MOTION BY COPE AND SECOND BY LIPPS OIL WELL ACTIVATION PERMIT NO. 75-1 WAS APPROVED WITH THE FOLLOWING CONDITIONS BY THE FOLLOWING VOTE: 1. Applicant shall pursue all applicable provisions of the Huntington Beach Ordinance Code. 2. Applicant shall bury all flow and gas lines for Ensign No. 1 to the storage facilities. 3. The conditions imposed in the granting of Exemption Declaration No. 74-18 for the Tanguay No. 4 location, shall be complied with: a. abandonment and scrapping of tanks is to be completed within 90 days of Board of Zoning Adjustments action regarding this application ND 75-13. b. the tie-in between Tanguay No. 4 and De Long tank farm shall also be completed within 90 days of BZA action. (Ref. BZA Conditions of Approval, March 6, 1974) AYES: Cope, Crosby, Lipps NOES: None ABSENT: None BZA 3/26/75 -3- Minutes: Huntington Beach Board of Zoning Adjustments Wednesday, March 26, 1975 Page 4 CONDITIONAL EXCEPTION NO. 75-7 Applicant: California Neon Products To permit two 36 ft. high identification signs, in lieu of S.9764.3.2 of the Huntington Beach Ordinance Code, which permits a maximum height of signs of 25 feet located on the west side of Gothard Street, approximately 220 ft. north of Edinger Avenue, in a C4, Highway Commercial District. Acting Chairman Cope informed the Board that this application is a Categorical Exemption, Class V, California Environmental Quality Act, 1970. Mr. Lon Wallace, the applicant, was present. The Public Hearing was opened by the Acting Chairman. Mr. Wallace outlined his proposal stating that the overall view of the sign would be hidden at a 25 ft. level, thereby requesting a variance for a 36 ft. high sign. He further reiterated that his neighbors have signs of equal or greater height than his proposed 36 ft. high sign. Mr. Wallace further stated that the building was constructed with a large sign in mind, thereby, the proposed 36 ft. height would be more architecturally pleasing than a smaller sign would be. Acting Chairman Cope and Board Member Crosby made a field check on the proposed site and found that a 25 ft. high sign would not get enough exposure on the particular location, thereby being in favor of a higher sign to gain better exposure for the use. Board Member Lipps was in opposition to the proposed variance, and felt that a 25 ft. high sign would be sufficient for the use and would also be within ordinance code conformance. As there were no parties present to speak in favor or opposition to the proposal, the Acting Chairman closed the public hearing. Findings and Conditions of Approval were discussed. ON MOTION BY CROSBY AND SECOND BY COPE APPROVED WITH THE FOLLOWING CONDITION, VOTE: CONDITION OF APPROVAL CONDITIONAL EXCEPTION NO. 75-7 WAS REASONS AND FINDINGS, BY THE FOLLOWING 1. The 36 ft. high identification sign, approved by the Board of Zoning Adjustments on March 26, 1975 shall be the only signing permitted for the particular use. REASONS 1. The granting of the Conditional Exception will not constitute a grant of special privilege inconsistent upon other properties in the vicinity and under an identical zone classification. 1 BZA 3/26/75 -4- Minutes: Huntington Beach Board of Zoning Adjustments Wednesday, March 26, 1975 Page 5 2. Because of special circumstances applicable to the subject property, including size, shape, topography, location, or surroundings, the strict application of the zoning ordinance is found to deprive the subject property of privileges enjoyed by other properties in the vicinity and under identical zone classifications. 3. The granting of a Conditional Exception is necessary in order to preserve the enjoyment of one or more substantial property rights. 4. The granting of a Conditional Exception will not be materially detrimental to the public welfare, or injurious to property in the same zone classification. 5. The granting of the Conditional Exception will not adversely affect the Master Plan of the City of Huntington Beach. FINDINGS 1. Identification of the subject property is hindered by existing commercial developments resulting from the height and location of such developments. 2. The location of the subject property is such that it is sufficiently removed from the main commercial traffic flow. This in turn results in a hardship in properly identifying the commercial business. Tanaka To permit the relocation of an existing electric overhead service pursuant to S.9730.9(f) of the Huntington Beach Ordinance Code located on the south- west corner of Slater Avenue and Newland Street in an R-2, Medium Density Residential District. Acting Chairman Cope informed the Board that this application is a Categorical Exemption, Class I, California Environmental Quality Act, 1970. Mr. Taylor, contractor for the applicant, was present. The Board reviewed the proposal and discussed Conditions of Approval with Mr. Taylor. ON MOTION BY LIPPS AND SECOND BY CROSBY ADMINISTRATIVE REVIEW NO. 75-28 WAS APPROVED WITH THE FOLLOWING CONDITIONS AND FINDINGS, BY THE FOLLOWING VOTE: BZA 3/26/75 -5- Minutes: Huntington Beach Board of Zoning Adjustments Wednesday, March 26, 1975 Page 6 rmmnTTTnNC The plot plan received March 17, 1975 shall be the approved layout. 2. The applicant shall install a service panel to facilitate conversion to underground utilities at a future date, pursuant to S.9730.11 of the Huntington Beach Ordinance Code. FINDINGS The Board has considered all guidelines for approval of overhead utilities, and all criteria has been satisfied, pursuant to Section 9730.10 of the Huntington Beach Ordinance Code. AYES: Cope, Crosby, Lipps NOES: None ABSENT: None ADMINISTRATIVE REVIEW NO. 75-29 Applicant: Glenn L. Quinliven To permit the continued use of existing overhead electrical service pursuant to S.9730.9(f) of the Huntington Beach Ordinance Code located on the west side of Pine Street, approximately 140 ft. south of Adams Avenue in an R-1, Low Density Residential District. Acting Chairman Cope informed the Board that this application is a Categorical Exemption, Class I, California Environmental Quality Act, 1970. Mr. Glenn Quinliven, the applicant, was present. The Board reviewed the proposal and discussed Conditions of Approval with Mr. Quinliven. ON MOTION BY COPE AND SECOND BY LIPPS, ADMINISTRATIVE REVIEW NO. 75-29 WAS APPROVED WITH THE FOLLOWING CONDITIONS AND FINDINGS, BY THE FOLLOWING VOTE: rmmnTTTntic 1. AYES: Cope, Crosby, Lipps NOES: None ABSENT: None USE PERMIT NO. 75-10 Applicant: Fotomat Corp. To permit the establishment of a fast service photo booth in an existing shopping center parking lot pursuant to S.9430 of the Huntington Beach Ordinance Code located on the east side of Beach Blvd., approximately 480 ft. south of Heil Avenue in the C4 Highway Commercial District. Acting Chairman Cope informed the Board that this application is a Categorical Exemption, Class III, California Environmental Quality Act, 1970. Mr. Jim Fisher, representing Fotomat Corporation, the applicant, was present. The Acting Chairman opened the public hearing. Acting Chairman Cope stated that he and Board Member Crosby had made a field investigation on the proposed site and found the proposed location to be inappropriate due to an already insufficient parking situation. Mr. Cope further reiterated that the proposal would contribute to an already existing poor circulation problem. Board discussed the relocation of the proposed use to a more appropriate location with Mr. Fisher, and Mr. Fisher agreed to search out a different location for his proposal. There being no parties present to speak in favor or opposition to the proposal, the Acting Chairman closed the public hearing. Board discussion followed. It was the consensus of the Board to deny the application due to poor traffic circulation problems already existing, and also due to the fact that the proposal would decrease the number of parking spaces in the center. ON MOTION BY LIPPS AND SECOND BY CROSBY USE PERMIT NO. 75-10 WAS DENIED FOR THE FOLLOWING REASONS BY THE FOLLOWING VOTE: REASONS FOR DENIAL 1. Request: Permission to conduct Outdoor Camp Show to be held April 16th through April 20th, 1975. Location: Parking Lot of Huntington Beach Zodys Department Store The applicant was not present. The Board reviewed the proposed special event and discussed Conditions of Approval. ON MOTION BY COPE AND SECOND BY CROSBY, THE ABOVE NOTED REQUEST FOR A SPECIAL EVENT WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: 1. The plot plan received March 24, 1975 shall be the approved layout. 2. The applicant shall obtain all necessary electrical permits. 3. The sign plan received March 24, 1975 shall be the approved layout. 2. The applicant shall comply with all requirements of Article 976 of the Huntington Beach Ordinance Code.
