CONSENT CALENDAR: ON MOTION BY HIGGINS AND SECOND BY FINLEY THE FOLLOWING ITEMS ON THE CONSENT CALENDAR WERE APPROVED BY THE FOLLOWING VOTE: MINUTES The Minutes of March 25, 1975 were approved. CONDITIONAL USE PERMIT NO. 75-04 Applicant: William Carlberg Continued to May 6, 1975 AYES: Higgins, Kerins, Finley, Slates, Porter NOES: None ABSENT: Geiger, Bazil REGULAR AGENDA ITEMS: SPECIFIC PLAN TOWNLOT AREA NO. 2 Ed Selich addressed the Commission and stated that the public hearing was continued from March 18, 1975 meeting, at which time the Staff was directed to prepare a response to the issues raised. The issues raised concerned density, assessment district costs, parking court concept, and removal of a portion of the parkway. Chairman Kerins opened the public hearing. Mr. Woolsey addressed the Commission and indicated that he did not feel there is a traffic problem in this area. He felt that it was the City's responsibility to repair the streets and the property owners to repair the sidewalks. He felt that the City had accepted the financial responsibility when they accepted the subdivision originally. Minutes: H.B. Planning Commission Tuesday, April 15, 1975 Page 2 Mr. Wann addressed the Commission and referred to his statements at the March 18, 1975 meeting and indicated that he had not changed in the opinions he expressed at that meeting. Mr. E. N. Baumgardner spoke in opposition to the proposal. Mr. Jerry Jones discussed the drainage proposed for the Townlot area and the cost thereof. He felt the City should put in new paving and curbing with owners bearing the expense of a sidewalk cost. Bill Hartge, Director of the Department of Public Works, discussed the water lines. He stated that the existing surface drainage lines are substandard. Ed Selich indicated that the latest cost figures would be trans- mitted to the City Council. Ms. Mary Crog spoke in opposition to the Specific Plan for Townlot Area No. 2. She felt the area should be left alone and it would progress on its own. Ed Selich discussed the notification procedure. ' Mr. Mel Hoefflieger discussed the problems with the State Coastal Commission and their failure to approve development in the Townlot area. He felt that it was because the City of Huntington Beach has vacillated in their planning for the area. Ms. Gipple spoke in opposition to the plan and felt that the City should be responsible for maintaining the streets. The public hearing was closed. Commission discussion ensued. ON MOTION'BY HIGGINS AND SECOND BY BAZIL SPECIFIC PLAN TOWNLOT AREA NO. 2 WAS CONTINUED TO MAY 6, 1975 FOR DECISION ONLY BY THE FOLLOWING VOTE: AYES: Bazil, Higgins, Kerins, Finley, Slates, Porter NOES: None ABSENT: Geiger TENTATIVE TRACT NO. 8821 Applicant: Lanco Engineering Tentative Tract Map 8821, filed on November 5, 1974, is a request to permit the subdivision of approximately 3.1 acres of real property in a 16 lot single family development located on the south side of Warner Avenue, 1330 feet east of Bolsa Chica Street. .4 Minutes: H.B. Planning Commission Tuesday, April 15, 1975 Page 3 Jim Palin noted that this tract was continued from the April 1 meeting to allow applicant time to reassess the layout and design of the subdivision and possibly reduce the number of lots proposed. He advised the Commission that no communication had been received. As a result he had contacted the engineer. The engineer requested the Commission to continue the application and stated that a letter requesting the continuance would be forthcoming. ON MOTION BY FINLEY AND SECOND BY SLATES TENTATIVE TRACT 8821 WAS CONTINUED TO MAY 6, 1975 BY THE FOLLOWING VOTE: AYES: Bazil, Higgins, Kerins, Finley, Slates, Porter NOES: None ABSENT: Geiger TENTATIVE TRACT NO. 7079 Applicant: Charles O. Pawlowski Tentative Tract Map 7079, filed on February 18, 1975, is a request to permit a subdivision of approximately 4.97 acres of land into a six lot subdivision. Five of the lots are proposed for construction with single family dwellings. Applicant requests that parcel six be a residual part for future construction of a church facility. The property is located on the north side of Dorsett Drive approximately 200 feet east of Miramar Lane. Commissioner Slates requested to be excused from participating in the consideration of this application as he had been involved in the sale of the property. The Chairman opened the hearing to the public. An aerial slide was shown. Mr. Paul Barrios, Engineer, addressed the Commission, and informed them that he agreed to all of the conditions of approval with the exception of the second condition which stated that parcel #3 shall be combined with parcel #6 and be shown as not -a -part parcel of the subdivision. He stated he had contacted the Superintendent of schools and had been advised by him that there would be no problems insofar as burdening the schools. Mr.. Rogers, principal of the school, informed the Commission that he had no objections to the proposed use but would be concerned if a street was proposed to be constructed between Atlanta and Dorsett. Captain Vanderlaan, Fire Department, discussed emergency access. Mrs. Moduri spoke in favor of the project, stating that to close off access to the vacant property facing Atlanta would enhance the safety of the school children who play in the area. Minutes: H.B. ON MOTION BY PORTER AND SECOND BY FINLEY TENTATIVE TRACT 7079 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS AS AMENDED BY THE FOLLOWING VOTE: FINDINGS: 1. In accordance with Section 66474 of the Government Code, the Planning Commission hereby finds that the proposed subdivision, together with the provisions of its design and improvements, is consistent with the objectives policies. General land uses and programs are as specified within the Land Use Element of the General Plan of the City of Huntington Beach. 2. The subject site is suitable for the proposed type of development. 3. The site is physically suitable for the proposed density of the development. 4. Substantiated upon the Environmental Review Board's findings, the proposed improvements are not likely to cause substantial environmental damage. 5. The design of the proposed subdivision will not be detrimental to the health and general welfare of the vicinity. • CONDITIONS OF APPROVAL: 1.. The tentative map received and dated February 18, 1975 shall be the approved layout. 2. Parcel #3 shall be held out and shown as not -a -part parcel of this subdivision. 3. Dorsett Drive shall be fully improved to the Department of Public Works standards and specifications, except that in the front of lot 3, this condition shall only require improvements to and including curb line. 4. The sewer, water and fire hydrant system shall be designed to City standards. 5. The water system shall be through the City water system. 6. The sewage disposal system shall be through the City of Huntington Beach sewage system. 7. Subject property shall be subject to the local drainage assess- ment district requirements and fees. 8. Drainage for the subdivision shall be approved by the Department of Public Works prior to the recordation of a final map. This system shall be designed to prevent siltation and provide erosion control both during and after construction of the project. Minutes: H.B. Planning Commission Tuesday, April 15, 1975 Page 5 9. If the developer proposes to provide air conditioning, the insulation in ceilings and exterior walls shall be a minimum of R-19 and R-11, respectively. If no air conditioning is to be provided, the insulation in ceilings and exterior walls shall be a minimum of R-13 and R-7, respectively. 10. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an offsite facility equipped to handle them. 11. Natural gas and 220V electrical shall be stubbed in at the location of clothes dryers, and natural gas shall be subbed in at the locations of cooking facilities, water heaters, and central heating units. 12. An engineering geologist shall be engaged to submit a report indicating the ground surface acceleration from earth movement for the project property. 13. All structures proposed for construction within this subdivision shall be constructed in compliance with the g-factors as indicated by the geologist's report. 14. Calculations for footings and structural members to withstand anticipated g-factors shall be submitted to the City Building Department for review prior to issuance of building permits. 15. A chemical analysis, as well as tests for physical properties of the soil on subject property, shall be submitted to the City for review prior to the issuance of building permits. 16. The structures on subject property, whether attached or detached, shall be constructed in compliance with the State acoustical standards set forth for all units that lie within the 60 CNEL contours of the property. 17. The side yard setback on lot 5 shall be a minimum of 10 ft. on that side abutting the rear yards of the adjacent tract. 18. A six (6) foot high fence shall be constructed across the area shown as lot 3 to prohibit pedestrian access. 19. Ten (10) ft. side yard setbacks shall be provided on lots 2 and 4 for those side yards abutting the area shown as lot 3, to provide 10 ft. exterior side yard setback should a public street be constructed across said property. Ross IN CONJUNCTION WITH: CONDITIONAL USE PERMIT NO. 75-03 Applicant: Ken Beideman, Architect Tentative Tract Map 8106 and Conditional Use Permit No. 7.5-03 are requests to permit an approximate 5 acre parcel of land to be developed as a 67 unit planned development. Subject property is located on the southwest corner of Sims and Pearce. A vugraph was shown as well as an aerial photograph. The public hearing was opened on Conditional Use Permit No. 75-03. Jim Palin noted that Ken Beideman, Architect, had reworked the site plan which was posted for viewing by the Commission. It was noted that Tract Map 8000 was posted for review. This property is immediately to the west of Tract 8106. I Ed Ross and Ken Beideman were present and discussed the plans with the Commission. There was a discussion on the need for more vertic landscaping in the rear, separation of units to include no more tha 8 units in sequence, pulling the rear buildings forward 5 feet, better overall landscaping, possible offsetting of buildings to eliminate bulky appearance, and consideration given to better design and location of the trash areas. The public hearing was closed. There was a discussion on continuing the application to allow applicant more time to work on improving the plans. Mr. Ross was agreeable to a continuance. Mr. Ross was agreeable to a continuance. Planning Commission Tuesday, April 15, 1975 Page 7 CONDITIONAL USE PERMIT NO. 75-02 Applicant: Calvary Baptist Church Conditional Use Permit No. 75-02 is a proposal for the construction of a new sanctuary and administrative offices, additional off-street parking, and the remodeling and enlargement of existing church facilities. It is located on the northwest corner of Garfield and Gregory Lane. John Cope addressed the Commission and discussed the Conditions of Approval. A vugraph and aerial photograph were shown. The Chairman opened the public hearing. Mr. Dennis Orr, representative of the architect, addressed the Commission. There was a discussion on ingress and egress and the need for access from Lister Lane. The size of the existing Garfield driveway was also discussed. Mr. Will Deming, Pastor of the Church, advised the Commission that he felt that the need to have ingress and egress on Lister Lane was mandatory. Mr. Don Motlel, a member of the church, discussed the traffic problems in connection with Lister Lane. Mr. Morgan Beisy, a resident of Gregory Lane, indicated that he represented the 18 property owners in that area and they were not opposed to the Church. He expressed concern about the traffic on Gregory Lane which is a substandard street and the need to limit such traffic to ingress only. The Chairman closed the public hearing. The Commission discussed the suggested conditions of approval and findings. ON MOTION BY SLATES AND SECOND BY HIGGINS CONDITIONAL USE PERMIT NO. 75-02 WAS APPROVED AS AMENDED WITH THE FOLLOWING FINDINGS AND CONDITIONS BY THE FOLLOWING VOTE: FTmnTTT(,S 1. The proposed use is in substantial conformance with the Huntington Beach Ordinance Code. 2. The proposed use is compatible with the surrounding uses. Minutes: H.B. Planning Commission Tuesday, April 15, 1975 Page 8 CONDITIONS OF APPROVAL: 1. The conceptual plot plan received April 9, 1975 shall be the approved layout as amended. In its approval action, the Planning Commission considered the following issues relating to the conceptual plan: . Traffic Circulation and drives • Parking layout . Lot area, width and depth . Type of use and its relation to property and improvements in the immediate vicinity. The conceptual plan is reviewed as a basic request for entitle- ment of the use applied for in relation to the vicinity in which it is proposed. The conceptual plan should not be construed as a precise plan reflecting conformance to all ordinance code requirements. 2. Soil reports as required by the Department of Building and Community Development and the Department of Public Works shall be submitted to such departments prior to the issuance of building permits. 3. Those parking stalls indicated on the site plan as numbers 14 and 15 shall be deleted. This area shall be landscaped and indicated as such on an approved landscape plan. 4. The maximum occupancy for the sanctuary shall not exceed 558 persons, unless determined to be less by the Fire Department. 5. A six (6) foot high masonry wall, commencing 485 ft. north of Garfield Avenue, shall be provided on the north, east, and west property lines. The design and materials for said wall shall be subject to approval by the Planning Department. 6. Prior to -final inspection for any building, a landscape plan depicting plant type, size, location, and plan for irrigation shall be submitted to the Planning Department for approval. 7. Overnight storage of transportation vehicles exceeding 6500 gross pounds shall be prohibited. 8. Fire protection systems shall comply with the specifications of the Huntington Beach Fire Code. Plans for such systems and devices shall be submitted to the Fire Department and shall be subject to approval by the Fire Department and Department of Public Works. 9. On -street parking on Gregory Lane and Garfield Avenue shall be restricted as determined by the Department of Public Works. 10. Lister Lane shall be dedicated and improved as required and approved by the Department of Public Works. Minutes: H.B. Planning Commission Tuesday, April 15, 1975 Page 9 11. The north acre of subject site shall be subject to local drainage assessment district requirements and fees. 15. Traffic directional signs shall be provided at the points of ingress and egress as indicated on the site plan. 16. Additional landscaping shall be provided on the Garfield driveway access, subject to the approval of the Planning Depart- ment and Fire Department. 17. Gregory Lane access shall be for ingress only and the Garfield access shall be for egress only. 18. A revised plan indicating the location of the Lister Lane driveway shall be submitted to the Planning Department for approval. 19. Violation of any of the above conditions shall result in an additional review of the use by the Planning Commission. AYES: Bazil, Higgins, Kerins, Finley, Slates, Porter NOES: None ABSENT: Geiger CODE AMENDMENT NO. 75-1 "SERVICE STATION STANDARDS REVISION" To provide more flexible development standards relating to improve- ment of existing service station sites and to amend certain develop- ment standards to be commensurate with state laws regulating service station operations. The Chairman opened the hearing to the public. Mr. Ken Denny, representative from Western Oil and Gas Co., addressed the Commission. He expressed his appreciation for the work that Staff has accomplished and indicated that he was basically in support of the proposal. Minutes: H.B. Planning Commission Tuesday, April 15, 1975 Page 10 Mr. Ralph Edwards, representing Mobil Oil Corporation, addressed the Commission and discussed major identification signs under S. 9481.17.1 concerning the horizontal dimension of such signs. The public hearing was closed. There was a discussion concerning amendments to the Code Amendment. ON MOTION BY SLATES AND SECOND BY PORTER CODE AMENDMENT NO. 75-1 WAS APPROVED AS AMENDED BY THE FOLLOWING VOTE: AYES: Bazil, Higgins, Kerins, Finley, Slates, Porter NOES: None ABSENT: Geiger MISCELLANEOUS: TENTATIVE TRACT NO. 5189 Subdivider: Robert Stellrecht An informal discussion was held between Commission and Mr. Stellrecht. This application will be heard under "Miscellaneous Items" at the April 22, 1975 meeting. Staff will be reviewing a proposal and preparing a transmittal for Commission's review on proposed development in Fountain Valley. COMMISSIONERS' COMMENTS: Commissioner Finley felt that more care should be exercised in making motions so that the Commission's position could be.more clearly understood. There was a discussion on the increasing significance of findings, and the difference in findings and conclusions. STAFF'S COMMENTS: Captain Vanderlaan reported on the City's actions in regard to the cave in which two children were recently killed.
