Commercial District.
Acting Chairman Cope informed the Board that this application is a Categorical
Exemption, Class III, California Environmental Quality Act, 1970.
Mr. Fred Fountain represented the applicant and informed the Board that the
applicant had decided not to proceed with the proposal and therefore desired
to withdraw the application.

CONDITIONAL EXCEPTION NO. 75-8 (Continued from 4-2-75)
Applicant: Alva Wilson Company
To permit a reduction in the required 25 foot minimum building separation
to 10 feet for lots 41 and 42, in lieu of S.9310.19, and to permit a re-
duction in the required 20 foot average setback for structures from the
public right-of-way to 10 feet for the tennis courts, in lieu of S.9310.14
of the Huntington Beach Ordinance Code. The subject property (Tract 7771)
is located at the northwest corner of Newland Street and Ellis Avenue, in an
R1-PD, Low Density Planned Development District.
Acting Chairman Cope informed the Board that this application is covered by
Environmental Impact Report No. 72-4, granted to Tentative Tract No. 7771 by
the Environmental Review Board on February 21, 1973. He further informed the
Board that the application had been continued.from the April 2, 1975 meeting
in order to allow the applicant to submit further information to justify the
request for a Conditional Exception.
The Acting Chairman opened the Public Hearing.
Mr. Tom Shelton, representing the applicant, hddressed the Board and presented
an outline of the supplemental information submitted relating to peat condi-
tions and settlement in the proposed development area.
There being no other parties present to speak for or against the proposal,
the Public Hearing was closed.
Board discussion ensued, with Board member Crosby submitting a suggestion that
the three units in question be constructed on separate foundations, but as one
unit. Mr. Shelton responded that this recommendation had been taken into con-
sideration and was a definite possibility, providing that it was plausible
from an engineering standpoint. The Board discussed the topographical con-
siderations of the proposed tennis court location. Following further dis-
cussion, Board members concurred in that sufficient hardship existed to
warrant granting of the Conditional Exception.
ON MOTION BY CROSBY AND SECOND BY GERARDEN, CONDITIONAL EXCEPTION NO. 75-8
WAS APPROVED WITH THE FOLLOWING CONDITIONS AND FINDINGS, BY THE FOLLOWING
VOTE:
CONDITIONS OF APPROVAL:
1. Window locations on Units 41 and 42 shall be subject.to approval by the
Planning Department.
2. The tennis court shall be moved ten (10) feet to the South of the proposed
location on the approved site plan.

Conditional Exception No. 75-8
FINDINGS OF THE BOARD:
1. The subject site has recorded .50 feet of accumulated settlement since
August of 1973. The site is still experiencing settlement, .09 feet
since November of 1974. Separating the building into two three -unit
buildings will greatly reduce the possibility of structural damage
resulting from further settlement.
2. Building separations in both phases of the development range from ten
(10) feet to twenty-five (25) feet, and thus the granting of this
exception.will not be detrimental to the health, safety, and welfare
of the adjacent properties.

Applicant: Alva Wilson Company
To permit relocation of the tennis court, construction of an additional
swimming pool and recreation building, modification of the layout on
specific units, revision of the driveway setbacks, and revision of
parking, pursuant to 5.9811.4 of the Huntington Beach Ordinance Code.
Subject property is located at the northwest corner of Ellis Avenue
and Newland Street, in an Rl-PD, Low Density Residential, Planned
Development District.
Acting Chairman Cope informed the Board that this application is covered
by Environmental Impact Report No. 72-4, granted to Tentative Tract No. 7771
by the Environmental Review Board on February 21, 1973.
The Acting Chairman opened the Public Hearing.
Mr. Tom Shelton, representing the applicant, addressed the Board and offered
a brief overview of the proposal-.
There being no other parties to speak for or against the proposal, the Public
Hearing was closed.
Board discussion centered on the landscaping proposal in relation to screening
of the tennis court, and on off-street parking requirements. Captain Vanderlaan
expressed concern regarding the Larkstone Circle turn -around and stated that
issuance of a Certificate of Occupancy would be contingent on inspection and
approval of said turn -around by the Fire Department.

Plot Plan Amendment No. 75-1
ON MOTION BY COPE AND SECOND BY GERARDEN, PLOT PLAN AMENDMENT NO. 75-1 WAS
APPROVED WITH THE FOLLOWING CONDITIONS AND FINDINGS, BY THE FOLLOWING. VOTE:
A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS:
1. The conceptual plot -plan and elevations received April 2, 1975
shall be the approved layout, subject to the modification
described herein:
A revised plan showing the precise location of the
tennis court shall be submitted to the Secretary of
the Board. If such plan complies with the modification
outlined by the Board, said plan shall be approved and
made a permanent part of the administrative file.
In its approval action, the Board of Zoning Adjustments considered
the following issues relating to the conceptual plan:
Traffic circulation and drives;
Parking layout;
Lot area;
Lot width and lot depth;
Type of use and its relation to property and improvements in the
immediate vicinity;
Past administrative action regarding this property.
2. The applicant shall comply with all Conditions of Approval of the
original Tentative Tract application (No. 7771).
3. The applicant shall submit a landscape plan delineating the proposed
screening of the tennis court on Newland Avenue. Said plan shall be
subject to Planning Department and Public Works Department approval.
4. The applicant shall comply with off-street parking requirements as
delineated in Article 979 of the Huntington Beach Ordinance Code.
5. The 40' turn -around on Larkstone Circle shall be subject to Fire
Department inspection and approval prior to issuance of Certificate
of Occupancy.
FINDINGS OF THE BOARD:
1. The proposed use remains the same.
2. The unit density is not increased.
3. The amendment has resulted in an improved plan.
4. The amendment has not resulted in a substantial change.

ADMINISTRATIVE REVIEW NO. 75-22 (Continued from 4-9-75)
Applicant: W. Sterling Buck and Associates
To permit the construction of an office building, pursuant to Section 9451
of the Huntington Beach Ordinance Code, located on the west side of Main
Street, approximately 150 feet south of Pecan Avenue, in a C3, General
Business District.
Acting Chairman Cope informed the Board that this application was granted
Negative Declaration No. 75-20 by the Environmental Review Board on March
25, 1975.
The applicant, Mr•. W. Sterling Buck, was present.
The Acting Chairman noted that this application had been continued from the
April 9, 1975 meeting in order to allow for Planning Commission discussion
regarding parking plans for the entire downtown area; he further noted that
this topic had been discussed by the Planning Commission on April 15th and
that they had concurred in the opinion that parking access should be main-
tained from the alley. As a result, the applicant was informed that the
following would be necessary: an additional five (5) feet of dedication on
the alley, modification of the parking layout in order to eliminate accessi-
bility problems, and replotting of the landscape and trash areas. The
applicant stated that he was amenable to these modifications.

shall be the approved layout, subject to the modification

The parking area shall be redesigned to incorporate
90 degree parking as indicated on the approved plan.
A plan delineating said modification shall be submitted to the
Secretary of the Board. If such plan complies with the modi-
fication outlined by the Board, said plan shall be approved and
made a permanent part of the administrative file.

Administrative Review No. 75-22
In its approval action, the Board of Zoning Adjustments considered
the following issues relating to the conceptual plan:
Traffic circulation and drives;
Parking layout;
Lot area;
Lot width and lot depth;
Type of use and its relation to property and improvements in the
immediate vicinity;
Past administrative action regarding this property.
2. The following plans shall be submitted to the Secretary of the Board:
a. Landscape and irrigation plan complying with Article 979
of the Huntington Beach Ordinance Code and landscaping
specifications on file in the Department of Public Works.
b. Rooftop mechanical equipment screening plan. Said plan
shall indicate screening of all rooftop mechanical equipment
and shall delineate the type of material proposed to screen
said equipment.
3. In accordance with the City's Master Plan of Streets and Highways,
an additional 72 feet of right-of-way on the alley shall be dedi-
cated.
4. Soil and compaction reports shall be submitted by a certified soils
engineer. Said reports shall be submitted to the Department of
Building and Community Development and shall be subject to approval
by that Department.
5. Fire protection systems, including automatic sprinkler systems,
standpipe systems, fire hydrants, fire alarm systems, and any
other required fire protection and detection devices or systems
shall comply with the specifications of the Huntington Beach
Fire Code. Plans for such systems and devices shall be submitted
to the Fire Department and shall be subject to approval by the
Departments of Fire and Public Works.
B. TO BE COMPLETED PRIOR TO FINAL INSPECTION:
The alley and Main Street shall be improved to the center line of such
right-of-way. Said improvement shall include curbs, gutters, sidwalks,
paving, street trees, street lights, street signs, street drainage, and
sewer and water main extensions, in -full compliance with the City of
Huntington Beach street standards and requirements.

C. GENERAL CONDITIONS:
1. All building spoils, such as unusable lumber, wire, pipe, and
other surplus or unusable material, shall be disposed of at an
offsite facility equipped to handle them.
2. Natural gas shall be stubbed in at the locations of cooking
facilities, water heaters, and central heating units.

Applicant: Alpine Civil Engineers, Inc
To permit the construction of a Mobile Home Park, pursuant to S.9242.1 of the
Huntington Beach Ordinance Code, located on the west side of Newland Avenue,
abutting Ellis and Modale Drive, in an MH-Mobile Home District.
Acting Chairman Cope informed the Board that this application is covered by
Environmental Impact Report No. 74-11, adopted by the Environmental Review
Board on February 20, 1975.
The Acting Chairman opened the Public Hearing.
Mr. Tom Shelton, representing the applicant, addressed the Board and offered
a brief overview of the proposal. He noted that the property owners had
annexed the property from the City of Fountain Valley with the expressed
intention of constructing a Mobile Home Park.
Mrs. S. Economarkis addressed the Board, stating that she was in favor of the
proposal.
Mr. Paul Economarkis addressed the Board, stating that he was in favor of the
proposal.
Mr. Clinton Sherrod, Director of Planning, City of Fountain Valley, addressed
the Board and expressed opposition to the proposal, referring to the reasons
stated in his correspondence to the City of Huntington Beach Planning Department
dated April 14, 1975. He further stated that the site plan for the proposal
was unsatisfactory in its present form and requested that the Fountain Valley
Planning Department be afforded the opportunity to review any revised plans
for the proposal.
There being no other parties present to speak for or against the proposal, the
Public Hearing was closed.

Board discussion ensued and resulted in the recommendation that the applicant
submit revised plans addressing the following areas of concern: parking issues,
including the need for additional parking bays and additional parking at the
recreation facility; plotting of a pedestrian walkway system; location of trash
areas; indication of grading that may be necessary in order to accommodate
storage areas; a method of continuation of the present bicycle trail system.

the southeast corner of Newland Street and Garfield Avenue, in an R1,
Low Density Residential District.
Acting Chairman Cope informed the Board that this application is a Categorical
Exemption, Class V, California Environmental Quality Act, 1970.
The Acting Chairman opened the Public Hearing; there being no parties present
to speak for or against the proposal, the Public Hearing was closed.
Board member Crosby noted that the applicant was not represented and re-
commended a one week continuance in order to allow the applicant to be
represented at the meeting.

CONDITIONAL EXCEPTION NO. 75-12
Applicant: Jurgen Bohm
To permit a 200 square foot addition to an existing commercial building,
pursuant to Section 9472.1 of the Huntington Beach Ordinance Code, located
on the northwest corner of Edwards Street and McFadden Avenue, in a C4,
Highway Commercial District.
Acting Chairman Cope informed the Board that this application is a Categorical
Exemption, Class III, California Environmental Quality Act, 1970.
The Acting Chairman opened the Public Hearing; there being no parties present
to speak for or against the proposal, the Public Hearing was closed.
Acting Chairman Cope noted that the proposal consisted of an addition to an
existing liquor store and beauty salon; further that there were major con-
cerns on the proposal regarding parking requirements. Following further
discussion, the Board concurred in the opinion that the plot plan as
submitted did not provide sufficient information to allow the Board to
take action on the proposal; Acting Chairman Cope therefore recommended a
two week continuance in order to allow the applicant time to submit a
revised plot plan.

Acting Chairman Cope informed the Board that this application is a Categorical
Exemption, California Environmental Quality Act, 1970.
The Acting Chairman opened the Public Hearing; there being no parties present
to speak for or against the proposal, the Public Hearing was closed.
Mr. Cope noted that the proposal was of a temporary nature and that any im-
provements on the site would be implemented by private enterprises.
The Board reviewed the plan and concurred on approval of same.

ON MOTION BY GERARDEN AND SECOND BY COPE, USE PERMIT NO. 75-14 WAS APPROVED
WITH THE FOLLOWING CONDITIONS AND FINDINGS, BY THE FOLLOWING VOTE:
CONDITIONS OF APPROVAL:
1. The plot plan dated April 8, 1975 shall be the approved layout.
2. The applicant shall comply with all provisions of Section 9730.28
of the Huntington Beach Ordinance Code.
FINDINGS OF THE BOARD:
1. The establishment, maintenance, and operation of the use will not be
detrimental to:

WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE:
A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS:

The Board reviewed the proposal and concurred on approval of same.
