To permit the construction of a Mobile Home Park, pursuant to S.9242.1 of the Huntington Beach Ordinance Code; located on the west side of Newland Avenue, abutting Ellis and Modale Drive, in an MH-Mobile Home District. The Chairman informed the Board that this application is covered by Environmental Impact Report No. 74-11, adopted by the Environmental Review Board on February 20, 1975. He further noted that the application had been continued from the April 16, 1975 meeting in order to allow the applicant to submit revised plans for the proposal. The Chairman opened the Public Hearing. Mr. Tom Shelton represented the applicant and offered a brief overview of the revised plans, noting that code requirements stipulated 49 guest parking areas, and that the plan provided a possibility of 51 bay spaces. Mr. Clinton Sherrod, Planning Director, City of Fountain Valley, addressed the Board and expressed opposition to the proposal, stating that the proposed use was not appropriate for the property and that it should be developed as an R1, Single Family dwelling area. He further referred to a memorandum submitted by the Fountain Valley City Engineer's office, dated April 25, 1975, citing --- - ------------------------------ --- BZA 4-30_75 Page 1 Minutes: Huntington Beach Board of Zoning Adjustments April 30, 1975 Page 2 Use Permit No. 74-17 deficiencies in the proposal. He requested that the standards referred to in the memorandum be incorporated in the Conditions of Approval, if such action occurred, and further requested that the City of Fountain Valley Planning Department receive a copy of such Conditions of Approval, as well as ins- tructions regarding appeal procedures. There being no other parties present to speak for or against the proposal, the Chairman closed the Public Hearing. The Board discussed the proposal extensively and concurred on conditional approval of same; Conditions of Approval were discussed with Mr. Shelton. ON MOTION BY SPENCER AND SECOND BY CROSBY, THE BOARD OF ZONING ADJUSTMENTS ADOPTED ENVIRONMENTAL IMPACT REPORT NO. 74-11 BY THE FOLLOWING VOTE: AYES: COPE, CROSBY, SPENCER NOES: NONE ABSENT: NONE ON MOTION BY SPENCER AND SECOND BY CROSBY, USE PERMIT NO. 74-17 WAS APPROVED WITH THE FOLLOWING CONDITIONS AND FINDINGS, BY THE FOLLOWING VOTE: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The revised conceptual plot plan and elevations received April 30, 1975 shall be the approved layout, subject to the modifications described herein: a. A pedestrian access gate providing access to the proposed bike trail shall be provided. b. An outside turning radius of 45' shall be provided between lots 121 and 126. c. A six (6) foot wide (inside dimension) landscaped planter shall be provided from the ultimate right-of-way line on Ellis Avenue, Newland Street, and Modale Drive, and the location of the screening wall on such streets. A plan delineating said modifications shall be submitted to the Secretary of the Board. If such plan complies with the modifica- tions outlined by the Board, said plan shall be approved and made a permanent part of the administrative file. BZA 4-30-75 Page 2 1 II Minutes: Huntington Beach Board of Zoning Adjustments April 30, 1975 Page 3 Use Permit No. 74-17 In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: Traffic circulation and drives; Parking layout; Lot area; Lot width and lot depth; Type of use and its relation to property and improvements in the immediate vicinity; Past administrative action regarding this property. A. 2. The following plan shall be submitted to the Secretary of the Board: Landscape and irrigation plan complying with Article 979 of the Huntington Beach Ordinance Code, and landscaping specifications on file in the Department of Public Works. 3. In accordance with the City's Master Plan of Streets and Highways, an additional twenty (20) feet of right-of-way on Ellis Avenue and Newland Street, and thirty (30) feet of right-of-way on Modale, shall be dedicated. 4. Soil and compaction reports shall be submitted by a certified soils engineer. Said reports shall be submitted to the Department of Building and Community Development and shall be subject to approval by that Department. 5. Fire protection systems, including automatic sprinkler systems, standpipe systems, fire hydrants, fire alarm systems, and any other required fire protection and detection devices or systems shall comply with the specifications of the Huntington Beach Fire Code. Plans for such systems and devices shall be submitted to the Fire Department and shall be subject to approval by the Departments of Fire and Public Works. 6. The developer shall participate in the local drainage assessment district. 7. The developer shall participate in the Orange County Sanitation District #3 Sewer Annex District. 8. A grading plan shall be submitted to the Department of Public Works and Planning Department for review and approval. 9. The support structures for the recreation building and mobile homes shall be subject to approval by the Department of Building and Community Development. 10. An on -site parking management plan shall be filed and approved by the Planning Department and the Fire Department. TO BE COMPLETED PRIOR TO FINAL INSPECTION: Ellis Avenue, Newland Street, and Modale Avenue shall be improved to the center line of such right-of-way. Said improvement shall include curbs, gutters, sidewalks, paving, street trees, street lights, street signs, street drainage, and sewer and water main extensions, in full compliance with the City of Huntington Beach street standards and requirements. C. GENERAL CONDITIONS: 1. The mobile home units and attached structures, including carports and patio covers, shall only have roofing material consisting of shake, cedar, or composition. 2. Roof mounted air conditioners, air blowers, and/or evaporative coolers shall be prohibited. 3. The design, location, and materials for the screening walls on Ellis Avenue, Newland Street, and Modale Street shall be subject to review and approval by the Planning Department and the Department of Public Works. FINDINGS OF THE BOARD: 1. The establishment, maintenance, and operation of the use will not be detrimental to: a. The general welfare of persons residing or working in the vicinity. b. Property and improvements in the vicinity of such use or building. 2. The granting of a Use Permit will not adversely affect the Master Plan of the City of Huntington Beach. 3. The proposal is consistent with the City's General Plan of Land Use. The Chairman opened the Public Hearing; there being no parties present to speak for or against the proposal, the Public Hearing was closed. The applicant was not present. The Board reviewed the plan and discussed Conditions of Approval. ON MOTION BY COPE AND SECOND BY CROSBY, USE PERMIT NO. 75-12 WAS APPROVED WITH THE FOLLOWING CONDITIONS AND FINDINGS, BY THE FOLLOWING VOTE: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan and elevations received March 27, 1975 shall be the approved layout, subject to the modifications described herein: a. Deletion of the planter area at the rear of the building. b. All reciprocal parking and access ways shall be shown. A plan delineating said modifications shall be submitted to the Secretary of the Board. If such plan complies with the modifi- cations outlined by the Board, said plan shall be approved and made a permanent part of the administrative file. The Chairman informed the Board that this application is a Categorical Exemption, Class III, California Environmental Quality Act, 1970. The Chairman opened the Public Hearing; there being no parties present to speak for or against the proposal, the Public Hearing was closed. The applicant, Mr. Bennie Storey, was present and offered a brief overview of the proposal. The Board reviewed the proposal and discussed Conditions of Approval. The plot plan dated April 9, 1975 shall be the approved layout. 2. The proposal shall be subject to review and approval by the Huntington Beach Police Department. FINDINGS OF THE BOARD: 1. The establishment, maintenance, and operation of the use will not be detrimental to: a. The general welfare of persons residing or working in the vicinity. b. Property and improvements in the vicinity of such use or building. 2. The granting of a Use Permit will not adversely affect the Master Plan of the City of Huntington Beach. 3. The proposal is consistent with the City's General Plan of Land Use. AYES: COPE, CROSBY, SPENCER NOES: NONE ABSENT: NONE USE PERMIT NO. 75-17 Applicant: Sheldon Grossman, dba Huntington Center Car Wash To permit the establishment of retail sales at an existing car wash, pursuant to Section 9472 of the Huntington Beach Ordinance Code; located at the northwest corner of Aldrich Street and Beach Boulevard, in a C4, Highway Commercial District. The Chairman informed the Board that this application is a Categorical Exemption, Class III, California Environmental Quality Act, 1970. The Chairman opened the Public Hearing; there being no parties present to speak for or against the proposal, the Public Hearing was closed. The applicant, Mr. Sheldon Grossman, was present and offered a brief overview of the proposal, stating that the sales would consist primarily of turquoise items. Further Board discussion centered on signing for the proposal. ON MOTION BY SPENCER AND SECOND BY CROSBY, USE PERMIT NO. 75-17 WAS APPROVED WITH THE FOLLOWING CONDITIONS AND FINDINGS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: 1. The plot plan dated April 10, 1975 shall be the approved layout. 2. Signs for the proposal shall comply with all requirements of Article 976 of the Huntington Beach Ordinance Code. FINDINGS OF THE BOARD: 1. The establishment, maintenance, and operation of the use will -not be detrimental to: a. The general welfare of persons residing or working in the vicinity. b. Property and improvements in the vicinity of such use or building. 2. The granting of a Use Permit will not adversely affect the Master Plan of the City of Huntington Beach. 3. Curtis To permit the construction and establishment of an office and commercial- buildinq, pursuant to Section 9471 of the Huntington Beach Ordinance Code; located at the southwest corner of Bolsa Chica Road and Warner -Avenue, in a C4, Highway Commercial District. The Chairman informed the Board that this application was granted Negative Declaration No. 75-25 by the Environmental Review Board on April 15, 1975. The applicant, Mr. Robert Curtis, was present. The Chairman informed Mr. Curtis that there were several areas of concern on the plan, and requested that the applicant submit a revised plan addressing the following: recommendations of the Traffic Engineer which had been previously discussed with the applicant; location of the supporting posts in relation to parking; correct location of curb and gutter, provision of 19' parking stalls; 45' outside and 17' inside turning radiuses. The applicant agreed to submit a revised plan and requested a one week con- tinuance for same. ON MOTION BY COPE AND SECOND BY SPENCER, ADMINISTRATIVE REVIEW NO. 75-36 WAS CONTINUED TO MAY 7, 1975 BY THE FOLLOWING VOTE: AYES: COPE, CROSBY, SPENCER NOES: NONE ABSENT: NONE BZA 4-30-75 Page 8 Minutes: Huntington Beach Board of Zoning Adjustments April 30, 1975 Page 9 ADMINISTRATIVE REVIEW NO. 75-45 Applicant: Foxx Development Corporation To permit the construction of a three -unit apartment building, pursuant to Section 9231.6 of the Huntington Beach Ordinance Code; located on the south- west corner of 17th Street and Olive Avenue, in an R4, High Density Resi- dential District. The Chairman informed the Board that this application is a Categorical Exemption, Class III, California Environmental Quality Act, 1970. Mr. Bob Jarrard represented the applicant and offered a brief overview of the proposal, stating that approval of the project by the State Coastal Commission was pending. The Board reviewed the proposal and discussed Conditions of Approval with Mr. Jarrard. ON MOTION BY CROSBY AND SECOND BY SPENCER, ADMINISTRATIVE REVIEW NO. 75-45 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan received April 18, 1975 shall be the approved layout. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: Traffic circulation and drives; Parking layout; Lot area; Lot width and'lot depth; Type of use and its relation to property and improvements in the immediate vicinity; Past administrative action regarding this property. 2. Elevations shall be submitted for approval by the Secretary of the Board. 3. In accordance with the City's Master Plan of Streets and Highways, an additional 2 1/2 feet of right-of-way on the alley shall be dedicated, and a'20' corner radius shall be provided at the intersection of Seventeenth and Olive Avenue. 4. The existing power pole on the alley shall be relocated. Said location shall be subject to approval by the Planning Department. AYES: COPE, CROSBY, SPENCER NOES: NONE ABSENT: NONE CONDITIONAL EXCEPTION NO. 75-12 Applicant: Coy Ziegler To permit one off -site sign, in lieu of S.9764.6 of the Huntington Beach Ordinance Code; and to permit the reduction of the required 10 foot (10') ground clearance and twenty foot (20') interior side yard, in lieu of Section 9763.3 (a), (b), of the Huntington Beach Ordinance Code; located on the north side of Warner, approximately 140 feet east of Goldenwest, in a C4, Highway Commercial District. The Chairman informed the Board that this application is a Categorical Exemption, Class V, California Environmental Quality Act, 1970. The Chairman opened the Public Hearing; there being no parties present to speak for or against the proposal, the Public Hearing was closed. The applicant was not present. ON MOTION BY COPE AND SECOND BY SPENCER, CONDITIONAL EXCEPTION NO. 75-12 WAS DENIED FOR THE FOLLOWING REASON, BY THE FOLLOWING VOTE: REASON FOR DENIAL: The applicant failed to demonstrate sufficient hardship, as indicated by the application submitted. AYES: COPE, NOES: NONE ABSENT: NONE MISCELLANEOUS: CROSBY, SPENCER ADMINISTRATIVE REVIEW NO. 75-50 Applicant: James D. Waide To permit retail sales of surfboards and other plastic products in an existing second story building, pursuant to S.9451 of the Huntington Beach Ordinance Code; located on the east side of Main Street, approximately 125 feet north of Pacific Coast Highway, in a C3, General Business District. The Chairman informed the Board that this application is a Categorical Exemption, Class III, California Environmental Quality Act, 1970. The applicant, Mr. James Waide, was present and offered a brief overview of the proposal. In response to questioning by the Board, the applicant stated that there would be no manufacturing processes on site, and that storage would consist of finished products only. The Board reviewed the proposal and discussed Conditions of Approval with Mr. Waide. ON MOTION BY COPE AND SECOND BY CROSBY, ADMINISTRATIVE REVIEW NO. 75-50 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: 1. The conceptual plot plan and elevations received April 25, 1975 shall be the approved layout. 2. No manufacturing or repair of surfboard or plastic products shall be permitted on site. . 3. Storage of flammable materials shall be subject to approval by the Fire Department. 4. The site shall be subject to occupant load approval by the Department of Building and Community Development prior to occupancy.
