COMMISSIONERS ABSENT: None NOTE: A TAPE RECORDING OF THIS MEETING IS ON FILE IN THE PLANNING DEPARTMENT OFFICE CONSENT CALENDAR: MINUTES: The Minutes of April 1, 1975, and April 15, 1975 were approved. CONDITIONAL USE PERMIT NO. 74-22 Applicant: Four Seasons Farms Continued to June 17, 1975. TENTATIVE TRACT MAP NO. 8821 Applicant: Lanco Engineering Continued to May 20, 1975. ON MOTION BY HIGGINS AND SECOND BY GEIGER THE ABOVE LISTED ITEMS ON THE CONSENT CALENDAR WERE APPROVED AS RECOMMENDED BY THE FOLLOWING VOTE: AYES: Geiger, Higgins, Kerins, Slates, Porter NOES: None .ABSENT: Bazil, Finley PC 5-6-75 Page 1 Minutes: Huntington Beach Planning Commission May 6, 1975 Page 2 REGULAR AGENDA ITEMS: TOWNLOT SPECIFIC PLAN AREA NO. 2 1 Ed Selich addressed the Commission and briefly discussed the changes which had been made in Draft 3. Commission discussed -the possibility of zoning for Planned Unit Development in this area on a half block parcel. There was further discussion on undergrounding of utilities and landscaping requirements. Chairman Kerins reopened the public hearing. Robert Jarrard addressed the Commission and stated that the amended version of the Townlot Specific Plan Area No. 2 had eliminated all his objections with the exception of the land- scaping requirements. He felt that the developer should be given options in the planting of trees to eliminate overcrowding. The Chairman closed the public hearing. There was further discussion on the Summary Report and the Assessment District. Alternatives I, II, III, III(A)., III(B), and III(C) were discussed. There was further discussion on undergrounding of utilities. Bill Hartge stated that Edison Company had advised him that the undergrounding cost breaks down to $30 per foot. ON MOTION BY SLATES AND SECOND BY HIGGINS TOWNLOT SPECIFIC PLAN AREA NO. 2 WAS APPROVED BY THE FOLLOWING VOTE: AYES: Geiger, Bazil, Higgins, Kerins, Finley, Slates, Porter NOES: None ABSENT: None There was discussion on the selection of the preferred alter- natives in the Assessment District. Commissioner Slates stated that he was opposed to the Assessment District because it was too costly and that the costs outweigh the benefits. PC 5-6-75.Page 2 Minutes: Huntington Beach Planning Commission May 6, 1975 Page 3 ON MOTION BY FINLEY AND SECOND BY PORTER COMMISSION ENDORSED MODIFIED ALTERNATIVE III (C) WITH THE FOLLOWING FINDINGS AND BY THE FOLLOWING VOTE: The Commission endorses the idea of undergrounding utilities as is done in the rest of the City. Possibly arterial street improvements can be accomplished in some other manner such as gas tax funds or HCD funding. AYES: Geiger, Bazil, Higgins, Kerins, Finley, Porter NOES: Slates ABSENT: None TENTATIVE TRACT MAP NO 8106 Applicant Edwin C. Ross In Conjunction With CONDITIONAL USE PERMIT NO. 75-03 Applicant: Ken Beideman Tentative Tract Map No. 8106 and Conditional Use Permit No. 75-03 are requests to permit an approximate 5 acre parcel of land to be developed as a 67 unit planned development. Subject property is located on the southwest corner of Sims and Pearce. Jim Palin noted that these applications had been continued from the April 15 Planning Commission meeting to allow applicant time to revise his plans. Commission discussion ensued on the revised plans. Chairman Kerins opened the public hearing on C.U.P. #75-03. Mr. Ed Ross, applicant, addressed the Commission and stated that he concurred with staff's conditibns of approval and that he had'attempted to provide a plan which would meet re- quirements previously discussed by the Commission. PC 5-6-75 Page 3 Minutes: Huntington Beach Planning Commission May 6, 1975 Page 4 Mr. Rene Romero, landscape architect, discussed the landscape plans and the types of plants he proposed to use. He stated that he had consulted with Tom Bushard-, Recreation and Parks Depart- ment,on the use of plant materials and that the plans were prepared in accordance with City Ordinances. He indicated that the entire project was designed to have a sprinkler system with the exception of the interior patio areas. The public hearing was closed. The Commission discussed the conditions of approval. ON MOTION BY SLATES AND SECOND BY HIGGINS CONDITIONAL USE PERMIT NO. 75-03 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL BY THE FOLLOWING VOTE: FINDINGS: 4 1. In accordance with Section 66474 of the Government Code, the Planning Commission hereby finds that the proposed sub- division, together with the provisions for its design and improvements, is consistent with the General Plan of Land Use of the City. 2. The subject site is suitable for the proposed type of dev- elopment. 3. The site is physically suitable for the proposed density of the development., 4. Substantiated upon the Environmental Review Board's findings, the proposed improvements are,not likely to cause substantial environmental damage. S. The design of the proposed subdivision will not be detrimental to the health and general welfare of the vicinity. CONDITIONS OF APPROVAL: 1. The precise plan received and dated April 25, 1975 shall be 1 PC 5-6-75 Page 4 Minutes: Huntington Beach Planning Commission May 6, 1975 Page 5 the conceptual layout as amended to provide that two trash areas along the westerly driveway be designed to accept one receptacle each, with landscaping between said structure and the west property line. 2. A six foot high decorative masonry wall shall be con- structed along the southerly and westerly property lines for the proposed project. 3. The CC $ R's Association Rules shall restrict the storage and/or parking of recreational vehicles from within or upon all open parking spaces. 4. -If the developer proposes to provide air conditioning, the insulation in ceilings and exterior walls shall be a minimum of R-19 and R-11, respectively. If no air conditioning is to be provided, the insulation in ceilings and exterior walls shall be a minimum of R-13 and R-7, respectively. S. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them. 6. Natural gas and 220V electrical shall be stubbed in at the location of clothes dryers, and natural gas shall be stubbed in at the locations of cooking facilities, water heaters, and central heating units. 7. An engineering geologist shall be engaged to submit a report indicating the ground surface acceleration from earth movement for the project property. 8. All structures -proposed for construction within this subdivision shall be constructed in compliance with the g-factors as indicated by the geologist's report. 9. Calculations for footings and structural members to with- stand anticipated g-factors shall be submitted to the City Building Department for review prior to the issuance of building permits. The curb cuts for the private drive accessways shall be designed and constructed in conformance with Department of Public Works approval. 4. Street improvements on Pearce and Sims Streets shall be completed in accordance with Public Works requirements. 5. All required improvements shall be constructed under the inspection of and to the approval of the City Engineer. Cost of inspection shall be paid by the subdivider. Three and one-half percent (3-1/20) of the amount of the improvement bond shall be deposited with the City Engineer for inspection costs. (1903 - 3/74) 6. The sewer, water and fire hydrant system shall be designed to City Standards. 7. The water system shall be through the City of Huntington Beach's water system. 8. Sewage disposal shall be through the City of Huntington Beach's sewage system. 9. Subject property shall be subject to local drainage assessment district requirements and fees. 10. Drainage for the subdivision shall be approved by the Department of Public Works prior to recordation of a final map. This system shall be designed to provide for sil- tation and erosion control both during and after construction of the proposed development. 11. A chemical analysis as well as tests for physical properties of the soil on subject property shall be submitted to the City for review prior to the issuance of building permits. The facility is proposed to contain five classrooms, an administrative office,'off-street parking and outdoor' play — areas. It is located -at 15761 Goldenwest Street. An aerial photograph was presented. The Commission engaged in a discussion of access into°the' property and questioned the'-need'for two driveways. Chairman Kerins opened,the''public' hearing: - Mr. Carlberg; the applicant, -addressed the Commission and dis- cussed with them the operation of the school,'which included the maximum number of'children on playground'at any one time being 30, stacking`of'cars, noise generated, and present .traffic situation on Goldenwest. Mr. Carlberg stated that a prerequisite for -obtaining a State License was, approval by the -City. ' Ms. Barbara Willis spoke in`opposition to"the-proposed use citing noise level and traffic problems that could result from it. Mrs. L. Korba advised the Commission that she did not-feelt'hat particular site - was proper for the type of school--proposed.-'She�''; felt that the school actually"would'be-a day care center. She also pointed out that there are.existing parking problems and the school would"add to them George Willis spoke in oppo§ition-to the use and felt that the proposed use would reduce the value of his property. A resident of Moonbeam'Drive'spoke against the' -proposed use citing traffic problems;already'exis'ting in the area. -- The Chairman closed the public hearing. The Commission discussed the'proposed-project'in relation to surrounding property. PC-5-6-75 Page 8 Minutes: Huntington Beach Planning Commission May 6, 1975 Page 9 ON MOTION BY SLATES AND SECOND BY PORTER CONDITIONAL USE PERMIT NO. 75-4 WAS DENIED FOR THE FOLLOWING REASONS BY THE FOLLOWING VOTE: 1. The proposed use has a detrimental effect upon the general health, welfare, safety and convenience of persons residing in the neighborhood. 2. The proposed use is not compatible with existing uses in the neighborhood which are residential. 3. The access to and parking for the proposed use creates an undue traffic problem. AYES: Geiger, Bazil, Higgins, Kerins, Finley, Slates, Porter NOES: None ABSENT: None CONDITIONAL USE PERMIT NO. 75-05 Applicant: Barker and Ott, Architects Conditional Use Permit No. 75-05 is a request for the construction of an assembly hall at an existing church facility. The proposed hall will be used for an assembly area for school children and for meetings and social events of the local parishioners. The property is located at 16400 Springdale Street. John Cope addressed the Commission and discussed additional conditions of approval recommended by the staff concerning hours of operation and traffic problems which might arise. There was a discussion among the Commissioners concerning possibility of moving the assembly hall forward and provide parking in the rear. Further discussion ensued on traffic problems and additional parking requirements which could present a problem. Chairman Kerins opened the public hearing. He felt that the relation of the buildings to each other would be aesthetically spoiled by changing them. Commissioner Slates suggested that access be provided,to Heil Avenue. Commissioner Bazil felt that parking would be better in the rear. Jack Wallace addressed the.Commission,and stated that he attended the Church, and stated opposition to parking in the rear. Father Duffey addressed the,Commission and stated,that he.felt a deeper study. should be ,made of . the ,-traffic problems:. , He -felt, that if the building was,moved:forward.it would not relate pro-; perly to the Church. ,Charles Carey addressed , the .Commiss.ion , and .stated ;that .he did not feel a parking problem would be created. Sergio Martinez, 16331 Duchess'Lane, addressed the Commission;,-. • and expressed.his,concern over -problems of circulation and traffic at the corner of Heil Avenue and Springdale Street when the Church is, conducting. services. The -public hearing was closed. A lengthy discussion ensued on :traffic,and,.circulation problems, and the possibility of access to Heil Avenue. ON MOTION BY1GEIGER AND SECOND BY.SLATES CONDITIONAL USE PERMIT NO. 75--05 WAS CONTINUED �TO MAY 20., ,19.75 TO, ALLOW APPLICANT TO MAKE A FURTHER,STUDY,OF THE PLANS AND WORK.WITH STAFF BY THE FOLLOWING VOTE: .- . AYES: Geiger, Bazil, Higgins, Kerins, Finley, Slates, Porter NOES: None ABSENT: None CONDITIONAL USE PERMIT -.NO. 75-06 Applicant: Jack E- Wheelhouse Conditional Use Permit No. 75;-06 is a request to gain approval to extend the use of an existing retail nursery which was originally established under a Conditional Exception application PC 5-6-75-Page 10 Minutes: Huntington Beach Planning Commission May 6 , 1975 Page 11 in 1969 and was expanded in 1970 under a Conditional Ex- ception. These applications will expire on January 1, 1976. The property is located south of Pearce Street and east of Bolsa Chica Road. Dave Eadie stated that there was no additional information to be added to the staff report. The Chairman opened the public hearing. Mr. Jack Wheelhouse, applicant, was present and expressed approval of conditions. There was some discussion on street improvements. An aerial slide of the property was shown. The public hearing was closed. Commission discussion ensued. ON MOTION BY SLATES AND SECOND BY HIGGINS CONDITIONAL USE PERMIT NO. 75-06 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS BY THE FOLLOWING VOTE: R TMnTM(.q - 1. The existing nursery operation is not offensive to surrounding properties. 2. From a Land Use standpoint, the operational characteristics and appearance of this use is acceptable at this location. 3. The existing access and parking layout has proved sufficient in accommodating vehicular traffic. CONDITIONS OF APPROVAL: 1. The conceptual plan received March 24, 1975 shall be the approved layout. Lot area, width and depth . Type of use and its relation to property and -improvements in the•immediate-vicinity - The conceptual plan ;is -reviewed as ' a basic request- titlement, of',the use •applied for; in relation to the vicinity in which it is proposed. The conceptual plan should not be construed -as a precise,plan•reflecting conformance to all ordinance code requirements.'' 2. Storage of all 'fertilizer and related materials shall.con- tinue to be accommodated in areas on site which will in- hibit problems associated with odor. 3. Pearce Street shall be improved to'City standards as such time the Director of Public Works determines necessity. A bond shall be posted with the Department of Public Works to insure future improvements on Pearce Street. Applicant: `Signal Landmark, -Inc,.: This application is a proposal for a minor modification to the existing zoning alignments of property -located at the northwest intersection of Adams Avenue and Newland Street and the south- west intersection of Yorktown Avenue and -Newland Street. -The petition requests a change of zone on four small narrow sections contiguous to one another and presently zoned R2, Rl, C2 and C2 respectively. The proposed zoning for the four sections is R1, R2, R2 and R1, respectively. This results in -three quarters of the 91.7 acre site zoned as R1 and the remainder R2. John Cope stated that by applying the'Planned Development Suffix to Parcel II, environmental issues could be more easily addressed PC 5-6-75 Page 12 Minutes: IIuntington Beach Planning Commission May 6, 1975 Page 13 and also would provide the development flexibility that may be necessary on the site. The Planning staff recommended Parcel I be rezoned from R2 and C2 to R1; and that Parcel II be rezoned from R1 and C2 to R2-PD. He noted that the re- quests are not in conflict with the General Plan and are suitable zoning designations for the parcels. The Chairman opened the public hearing. Mr. George Stringer, representing Signal Landmark, Inc., stated that the staff's recommendation met with his approval, and that the zoning would give more flexibility in development. There was a discussion on the marsh and the bluff area. Mr. Stringer felt that a plan could be designed to accommodate the bluff area and not destroy it. The public hearing was closed. There was a discussion on the Environmental Impact Report prepared for this development. ON MOTION BY SLATES AND SECOND BY PORTER ENVIRONMENTAL IMPACT REPORT NO. 74-12 WAS ADOPTED BY THE FOLLOWING VOTE: AYES: Geiger, Bazil, Higgins, Kerins, Finley, Slates, Porter NOES: None ABSENT: None ON MOTION BY SLATES AND SECOND BY KERINS ZONE CHANGE NO 74-18 WAS APPROVED AS AMENDED WITH PARCEL I TO BE ZONED FROM R2 AND C2 TO R1 AND PARCEL II TO BE ZONED FROM R1 AND C2 TO R2-PD WITH THE FOLLOWING FINDINGS BY THE FOLLOWING VOTE: 1 The requests are not in conflict with the General Plan and are suitable zoning designations for the parcels.
