Curtis To permit the construction and establishment of an office and commercial building, pursuant to Section 9471 of the Huntington Beach Ordinance Code; located on the southwest corner of Bolsa Chica Road and Warner Avenue, in a C4, Highway Commercial District. The Chairman informed the Board that this application was granted Negative Declaration No. 75-25 by the Environmental Review Board on April 15, 1975. He further noted that the application had been continued from the May 7, 1975 meeting in order to allow for sub- mittal of revised plans. The applicant, Mr. Robert Curtis, was present. The Board reviewed the revised plans. Discussion centered on landscaping requirements as well as locations and types of drive- ways for the proposal. The Chairman noted that reciprocal access agreements were not possible due to the location of a power pole on the property; he further noted that the applicant had submitted a notarized letter expressing the intent to provide an automatic fire sprinkler system throughout the complex. Conditions of Approval were discussed. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The revised conceptual plot plan and elevations received May 13, 1975 shall be the approved layout, subject to the modifications described herein: a. Radius type driveway approaches shall be provided at all points of access. b. Six percent (6%) of the site shall be landscaped. Said landscaped areas shall not include any areas proposed as automobile overhang areas. A plan delineating said modifications shall be sub- mitted to the Secretary of the Board. If such plan complies with the modifications outlined by the Board, said plan shall be approved and made a permanent part of the administrative file. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: Traffic circulation and drives; Parking layout; Lot area; Lot width and lot depth; Type of use and its relation to property and improvements in the immediate vicinity; Past administrative action regarding this property. 2. The following plans shall be submitted to the Secretary of the Board: a. Rooftop mechanical equipment screening plan. Said plan shall indicate screening of all rooftop mechanical equipment and shall delineate the type of material proposed to screen said equipment. 3. Soil and compaction reports shall be submitted by a certified soils engineer. Said reports shall be sub- mitted to the Department of Building and Community Development and shall be subject to approval by that Department. 4. Fire protection systems, including automatic sprinkler systems, standpipe systems, fire hydrants, fire alarm systems, and any other required fire protection and detection devices or systems shall comply with the specifications of the Huntington Beach Fire Code Plans for such systems and devices shall be sub- mitted to the Fire Department and shall be subject to approval by the Departments of Fire and Public Works. 5. The developer shall participate in the local drainage assessment district. B. GENERAL CONDITIONS: 1. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an offsite facility equipped to handle them. 2. Natural gas shall be stubbed in at the locations of cooking facilities, water heaters, and central heating units. 3. An engineering geologist shall be engaged to submit a report indicating the ground surface acceleration from earth movement for the project property. 4. All structures proposed for construction within this subdivision shall be constructed in compliance with the g-factors as indicated by the geologist's report. 5. Calculations for footings and structural members to withstand anticipated g-factors shall be submitted to the City for review prior to the issuance of building permits. The City of Huntington Beach is to be notified prior to any grading or surface disturbance, in order to arrange for a pre -grading conference among the con- tractor, ARI, and the Department of Environmental Resources. AYES: COPE, CROSBY, GERARDEN NOES: NONE ABSENT: NONE USE PERMIT NO. 75-18 (Continued from May 7, 1975) Applicant: Wilfrie L. Byer To permit an addition to a building having a nonconforming yard, pursuant to Section 9719 of the Huntington Beach Ordinance Code; located on the east side of England Street, approximately 58 feet north of Lincoln Street, in an R2, Medium Density Residential District. The Chairman informed the Board that this application is a Cate- gorical Exemption, Class III, California Environmental Quality Act, 1970. He further noted that the application had been con- tinued from the May 7, 1975 meeting in order to allow for sub- mittal of revised plans. Mr. Albert S. Andrews represented the applicant. The Chairman opened the continued Public Hearing; there being no parties present to speak for or against the proposal, the Public Hearing was closed. The Board reviewed the revised plans. Discussion centered on dedication requirements and conversion of one unit on the pro- perty into a two -car garage. The Chairman noted that site and setback dimensions on the plan were inaccurate, and stated that a modified plan depicting accurate dimensions would be required. Conditions of Approval were discussed. ON MOTION BY COPE AND SECOND BY CROSBY, USE PERMIT NO. 75-18 WAS APPROVED WITH THE FOLLOWING CONDITIONS AND FINDINGS, BY THE FOLLOWING VOTE: BZA 5-14-75 Page 4 Minutes: Huntington Beach Board of Zoning Adjustments May 14, 1975 Page 5 Use Permit No. 75-18 A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. Said reports shall be sub- mitted to the Department of Building and Community Development and shall be subject to approval by that Department. B. TO BE COMPLETED PRIOR TO FINAL INSPECTION: 1. The alley shall be improved to the center line of such right-of-way, as required by the Department of Public Works. Said improvement shall include curbs, gutters, sidewalks, paving, street trees, street lights, street signs, street drainage, and sewer and water main ex- tensions, in full compliance with the City of Huntington Beach street standards and requirements. 2. The existing two car garage shall be modified to serve of off-street parking, with access directly from the alley. The establishment, maintenance, and operation of the use will not be detrimental to: a. The general welfare of persons residing or working in the vicinity. b. Property and improvements in the vicinity of such use or building. 2. The granting of a Use Permit will not adversely affect the Master Plan of the City of Huntington Beach. 3. The proposal is consistent with the City's General Plan of Land Use. AYES: COPE, CROSBY, GERARDEN NOES: NONE ABSENT: NONE USE PERMIT NO. 75-11 Applicant: W & D Commercial Properties To permit the construction and establishment of a shopping center, pursuant to Section 9472 of the Huntington Beach Ordinance Code; located on the southwest corner of Edinger Avenue and Sher Lane, in a C2, Community Business District. The Chairman informed the Board that this application was granted Negative Declaration No. 75-26 by the Environmental Review Board on April 29, 1975. Representing the applicant were: Mr. Jerry Dicker, Mr. Al Cruz, Mr. Steve Powers, and Mr. Mark Thompson. The Chairman opened the Public Hearing; there being no parties present to speak for or against the proposal, the Public Hearing was closed. The Board reviewed the proposal. The Chairman suggested that the applicant be granted a parking percentage Allowance based on storage needs for the complex, thus allowing the elimination of parking stalls along the south property line. He stated that elimination of said parking stalls would result in an improved plan and would allow for improved circulation for the project. The applicant's representatives expressed agreement with this suggestion. Mr. Dicker stated that it was their intent to provide same for the large buildings in the complex only; however, the Fire Department representative stated that, pending further review by his Department, automatic fire sprinklers would be required throughout the entire complex. Board member Crosby expressed concern regarding the 12' wide driveway on the proposal. Following discussion, it was decided that disposition of the driveway would be subject to review and approval by the Traffic Engineer. Conditions of Approval were discussed. ON MOTION BY GERARDEN AND SECOND BY CROSBY, THE BOARD OF ZONING ADJUSTMENTS ADOPTED NEGATIVE DECLARATION NO. 75-26 BY THE FOLLOWING VOTE: AYES: COPE, CROSBY, GERARDEN NOES: NONE ABSENT: NONE ON MOTION BY GERARDEN AND SECOND BY CROSBY, USE PERMIT NO. 75-11 WAS APPROVED WITH THE FOLLOWING CONDITIONS AND FINDINGS, BY THE FOLLOWING VOTE: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The revised conceptual plot plan received May 12, 1975 shall be the approved layout, subject to the modifica- tion described herein: Deletion of the parking spaces abutting the south property line. A plan delineating said modification shall be sub- mitted to the Secretary of the Board. If such plan complies with the modification outlined by the Board, said plan shall be approved and made a permanent part of the administrative file. The Chairman informed the Board that this application is a Categorical Exemption, Class III, California Environmental Quality Act, 1970. Mr. Bob Jarrard represented the applicant. The Board reviewed the proposal and discussed Conditions of Approval with Mr. Jarrard. ON MOTION BY CROSBY AND SECOND BY COPE, ADMINISTRATIVE REVIEW NO. 75-52 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan, received May 2, 1975, shall be the approved layout, subject to the modifica tions described herein: a. A 25' turning radius shall be provided for all parking entered directly from the alley. b. A landscape plan shall be submitted to the Planning Department and the Department of Public Works for review and approval. C. Building elevations shall -be submitted to the Board for review and approval. A plan delineating said modifications shall be submitted to the Secretary of the Board. If such plan complies with the modifications outlined by the Board, said plan shall be approved and made a permanent part of the administrative file. The Chairman informed the Board that this application is a Categorical Exemption, Class I, California Environmental Quality Act, 1970. Mr. Robert Redalli represented the applicant. The Board reviewed the proposal and concurred on approval of same. ON MOTION BY GERARDEN AND SECOND BY CROSBY, ADMINISTRATIVE REVIEW NO. 75-55 WAS APPROVED WITH THE FOLLOWING CONDITIONS AND FINDINGS, BY THE FOLLOWING VOTE: BZA 5-14-75 Page 14 F-J 1 Minutes: Huntington Beach Board of Zoning Adjustments May 14, 1975 Page 15 Administrative Review No. 75-55 CONDITIONS OF APPROVAL: 1. FINDINGS OF THE BOARD: The Board has considered all guidelines for approval of overhead utilities, and all criteria have been satisfied, pursuant to Section 9730.10 of the Huntington Beach Ordinance Code. The Chairman informed the Board that this application is a Categorical Exemption, Class I, California Environmental Quality Act, 1970. Mrs. Jeannette Miller represented the applicant. The Board reviewed the proposal and concurred on approval of same.
