CONDITIONAL USE PERMIT NO. 75-05
Applicant: Barker and Ott,'Architects
John Cope addressed the Commission and stated that this item had
been continued from the May 20, 1975 Planning Commission meeting to
provide staff an opportunity to analyze traffic considerations.
Applicant has submitted a traffic study report, which has been re-
viewed by the Traffic Engineer.
Based on analysis of traffic, staff offered the following recom-
mendations:

1. An additional driveway approach to the site shall be constructed
on Heil Avenue. Location and standards of such drive shall be
subject to the approval of the Department of Public Works.
2. The existing drive on Bradbury Lane shall be permanently closed
and the driveway southerly of the closed access shall be retained
as it. presently exists. (This suggestion is a modification of
Condition 11 on the suggested Conditions of Approval.)
3. The 900 parking running from the east to Springdale Street just
south of the church shall be angled parking as shown on the amended
site plan. It is proposed to delete approximately 20 parking
spaces west of Bradbury Lane in order to provide better ingress -
egress, since this is the heaviest concentration of traffic to and
from the church.
4. An accessway into the large recreation area shall be implemented
as access to the overflow parking on the grassy area, if and when
the need arises.
5. At the time that the street medians are constructed on Springdale,
the existing access on Orlando Drive shall be relocated as close as
possible to an alignment with Angler Drive, precise location and
design to be subject to the approval of the Department of Public
Works.
Chairman Kerins opened the public hearing.
Mr. Robert Riffenbargh addressed the Commission,,stating that he is a
State -registered civil engineer and had prepared the traffic study
submitted by the applicant. He said he did not feel that construction
of the hall itself will cause additional traffic problems to the church
complex, and presented specific areas of disagreement_with staff.'_s__
recommendations: 1) the access to Heil would result in dander to people
using the existing bicycle trail in that street and also cause a hazard-
ous condition from automobiles attempting to make left turns out of
that exit, because of its proximity to the intersection of Heil and
Springdale; 2)the drive access on Orlando as modified in the suggested
conditions of approval would be too close to the intersection and
would make turning movements difficult; and 3) deletion of the parking
spaces is not necessary, since the traffic pattern of the church use is
basically one -directional, with in and out traffic not normally occurring
at the same time.
Sergio Martinez , 1651 Duchess Lane, addressed the Commission and pre-
sented a different approach to the traffic problems, designed to improve
inside circulation, improve safety, and protect the community as a
whole from effects of church -related traffic. Mr. Martinez proposed to
retain the access on Orlando and the two drives on Bradbury, delete the
southerly drive on Springdale, provide access to Springdale at the

northerly corner, and provide no access from Heil Avenue. The
proposed new building was moved to the front with parking pro-
vided in the rear; this aided in providing inner circulation among
the three main areas within the church complex. Mr. Martinez
said that these modifications would result in better circulation
on the arterials by avoiding the entrances close to intersections
and traffic signals; it would also mean that stacking of traffic
at peak traffic hours would take place within the parking lots
instead of in the streets.
The public hearing was closed.
Commission discussion ensued.
The Commission discussed with staff the various proposals for
ingress -egress, parking and deletion of parking, and the Commission
policy of minimizing curb cuts on arterials wherever possible. It
was the consensus that a revised plot plan should be submitted show-
ing the northerly entrance on Springdale, retaining the southerly
entrance on, Bradbury and the entrance on Orlando, adding an entrance
on Heil, and deleting the entrance nearest the school on Bradbury.
The application will be continued to the next meeting to permit
preparation of the revised plan; applicant concurred with the contin-
uance.

Chairman Kerins opened the public hearing . '
Don Smith, owner of Block 2204, a portion of the proposed Area "A,
addressed the Commission, stating that his only objection to the
rezone would be the resultant tax increase on his property, which
cannot be used due to uncompacted fill. Mr. Smith was advised to
seek relief through the Orange County Tax Assessor's office.
The public hearing was closed.
Commission discussion ensued.

Chairman Kerins opened the public hearing.
E.V. Mitchell, of the Mitchell Land Improvement Company, addressed
the Commission, stating his opposition to the change from M1 to R2. It
is his feeling that commercial or multi -unit residential would be more
in keeping with the surrounding areas.
The public hearing was closed.
The Commission discussed the zone change, informing Mr. Mitchell that
this rezone is required to bring the zoning into compliance with the
master plan, but that it does not necessarily -preclude different zoning
at some future date.

Dick Hammond, General Manager of Cambro Manufacturing, addressed the
Commission and requested consideration of some sort of cul-de-sacs or

wall buffering treatment between the Cambro plant and future
apartment projects, in order to avoid future problems which
could result.
Fred M. Culmann, 2215 Grandview Avenue, Manhattan Beach (truck
dealer within the proposed zone change) addressed the Commission
regarding dedication and street improvements for future apart-
ments on Oregon Street.
The public hearing was closed.

"B," "D," and "E" WAS APPROVED WITH THE FOLLOWING FINDINGS BY THE

Chairman Kerins reviewed briefly the history of the application.
Jim Palin presented a vu-graph of the layout delineating the
common boundary line and presenting the two alternative layouts
for construction with Slater Avenue deleted and as it is presently
planned. The area to the north of the common boundary line lends
itself to an either/or situation, with no record map to be allowed
until such time as a determination has been made on Slater.
Chairman Kerins opened the public hearing.
George Stringer, Engineer for the project, addressed the Commission
stating that the applicant is in concurrence with the procedure
as outlined by staff.
The public hearing was closed.

ON MOTION BY SLATES AND SECOND BY BAZIL TENTATIVE TRACT NO. 8630
WAS APPROVED WITH THE FOLLOWING FINDING AND CONDITIONS AND BY THE
FOLLOWING VOTE:
FINDING:
The proposed subdivision is consistent with the objectives, policies,
and general land uses specified in the General Plan adopted by the
City.
CONDITIONS OF APPROVAL:
1. Tentative Map received and dated February 14, 1975, shall be the
approved layout. Prior to the recordation of any final map on
the area north of the line delineated as "Common Layout Limits,"
a determination shall be made upon the Circulation Element, either
for retaining of Slater and/or removal from such element. Should
Slater be deleted from the Circulation Element, a final map for
the area north of the "Common Layout Limits" shall be recorded in
compliance with Alternate B. However, if Slater Avenue is retained
at its present configuration on the Circulation Element, a final
map for the area north of the line designated "Common Layout
Limits" shall be recorded in compliance with Alternate A.
2. The proposed bicycle path along the northerly property line should
be of sufficient width to accommodate maintenance equipment to
maintain the Slater flood control channel, as well as provide ade-
quate access for bicycles should Slater Avenue be deleted from
the arterial system.
3. All required improvements shall be constructed under the inspec-
tion of and to the approval of the City Engineer. Cost of inspec-
tion shall be paid by the subdivider. Three and one-half percent
(3-1/2%) of the amount of improvement bond shall be deposited
with the City Engineer for inspection costs.
4. The City sewer, water, and fire hydrant systems shall be designed
to City standards.
5. The water system shall be through the City of Huntington Beach's
water system.
6. Sewage disposal shall be through the City's sewage disposal sys-
tem.
7. Subject property shall be subject to the local drainage assessment
district requirements and fees.
8. Subject property shall be subject to the Orange County Sanitation
District requirements and fees.
9. ,All utilities shall be installed underground.

10.
Drainage for the subdivision shall be approved by the Depart-
ment of Public Works prior to recordation of a final map.
This system shall be designed to provide for siltation and
erosion control both during and after construction of the
proposed development.
11.
A decorative masonry wall shall be constructed to City spec-
ifications along Graham Street and Slater Avenue. Said wall
shall be 6 inches wide and 6 feet high. The height of said
wall shall be measured from whichever side is higher at fin-
ished grade. The architectural design of said wall shall
be approved by the Planning Department. Structural design
shall be approved by the Department of Public Works and shall
be included as a part of the street improvement plans. The
intent of this condition is to improve t_h_e____s_treet scene
along arterial highways.
12.
A landscape planter shall be provided along__Graham Street and
Slater Avenue. Such -planter sfall conform to the plans and
specifications on file -in the Department of Public Works and the
requirements of the Planning Commission.
13.
A 14-foot setback shall be provided from the ultimate right-
of-way of the adjacent arterial highway to the living quar-
ters of the units adjacent to such highway.

The structures shall be constructed in compliance with the
State acoustical standards set forth for multi- or attached
units, for all units that lie within the 60 CNEL contours
on this property.
15.
If the developer proposes to provide air conditioning, the
insulation in ceilings and exterior walls shall be a mini-
mum of R-19 and R-11, respectively. If no air conditioning
is to be provided, the insulation in ceilings and exterior
walls shall be a minimum of R-13 and R-7, respectively.
16.
All building spoils, such as unusable lumber, wire, pipe,
and other surplus or unusable material, shall be disposed
of at an offsite facility equipped to handle them.
17.
Natural gas and 220V electrical shall be stubbed in at the
location of clothes dryers, and natural gas shall be
stubbed in at the locations of cooking facilities, water
heaters, and central heating units.
18.
An engineering geologist shall be engaged to submit a report
to the City indicating the ground surface acceleration from
earth movement for subject property.

19. All structures proposed for construction within this subdivision
shall be constructed in compliance with the g-factors as indi-
cated by the engineering geologist's report.
20. Calculations for footings and structural members to withstand
anticipated g-factors shall be submitted to the City for review.
21. A chemical analysis as well as tests for physical properties of
the soils on subject property shall be submitted to the City for
review prior to the issuance of building permits.

CONDITIONAL EXCEPTION NO. 75-12 - APPEAL

John Cope reviewed the application for the Commission and presented
reasons for Board of Zoning Adjustments denial.
Chariman Kerins opened the public hearing.
Howard Stinson, contractor for the project, addressed the Commission
explaining the location of the easement and noting that the sign height
could be raised to a higher elevation and the sign moved back further
from the property line. He also noted that the sign in this location
for a bank previously occupying the site had presented no particular
traffic or aesthetic problems.
The public hearing was closed.
Commission discussion followed.
ON MOTION BY GEIGER AND SECOND BY HIGGINS THE APPEAL ON CONDITIONAL
EXCEPTION NO. 75-12 WAS DENIED FOR THE FOLLOWING REASONS AND BY THE
FOLLOWING VOTE:
REASONS FOR DENIAL:
1. Applicant has failed to demonstrate that strict compliance with
.the terms of the Ordinance Code regarding sign code provisions
will result in a substantial economic hardship to the applicant or
that the applicant will suffer great financial loss thereby.
2. Applicant has not demonstrated that the proposed sign will not
adversely affect other lawfully erected signs in the same area.
3. Applicant has not demonstrated that the sign variance applied for
will not be detrimental to the property located in the vicinity
of the property on which said sign would be located.

4. The proposed sign would be an off -site sign, since it is not
-located on the development site it is intended to serve, as re-
quired by S.9764.6.

REPORT ON THE GENERAL PLAN
Monica Florian addressed the Commission to bring members up to
date on the progress and reorganization that has taken place in con-
nection with the General Plan. A recent extension of time has
permitted more flexibility in Staff's approach, which will no longer
entail adoption on an element -by -element basis. Instead, review of
each element will occur as each is prepared, with Planning Commission
and City Council adoption of the comprehensive General Plan when all
elements are completed.
Ms. Florian presented the reasons Staff feels that this approach
will give the best opportunity to examine all the issues and prob-
lems of the City and come up with a General Plan which will take into
consideration the interrelated nature of the individual elements.
The Commission discussed the reorganization and target completion
dates with Staff.
ORAL COMMUNICATIONS
Mrs. Dale Menzies, 18664 Applewood Circle, addressed the Commission
in regard to tot lots to be constructed in the tract in which she lives.
Commission and staff discussed with Mrs. Menzies the criteria to be
set up for safety, durability, and use of playground equipment. Consen-
sus decision was that staff would meet with the Classic Development
Corporation on the subject, and recommendations would be taken to the
Recreation and Parks Department for their concurrence.

Ed Selich addressed the Commission in regard to the recommended
modifications to the Orange County Transit District bus routes
within Huntington Beach. Due to delays in implementation, these
changes will not be coming on the line until early July.
OCTD has requested that the recommendations be reiterated in a
letter from the City Administrative office.
