Applicant: Bessie Daigle
To permit the 24-hour care of non -related persons in a single-
family residence, pursuant to Section 9730.27 of the Huntington
Beach Ordinance Code; located at the south end of Jeffrey Circle,
approximately 220 feet south of Terry Drive, in an Rl, Low
Density Residential District.
The Chairman informed the Board that this application is a Cate-
gorical Exemption, Class III, California Environmental Quality
Act, 1970.
The Chairman indicated to the Board that this application had been
continued from the May 28, 1975 meeting.
Ms. Bessie Daigle was present and spoke in favor of having the
one person in her home whom she has had for about eight years.
Agnes Merchant spoke about Ms. Daigle having people, who were
not, in her opinion, suitable for this type of care. Ms. Linda
Martinez of the Orange County Health Department reported that
her office had not received any complaints about the applicant,

and that the County is in the process of renewing the applicant's
license and along with this will have a site inspection.
Ms. Daigle has requested of the County that only persons with high
standards be submitted for her care. Ms. Martinez said they
probably will not be placing anyone else with Ms. Daigle because
at the present they have no one who meets Ms. Daigle's require-
ments.
Due to the large number of people present who were not in favor
of the subject application, the Chairman read the Huntington
Beach Ordinance Code requirements and outlined the appeal pro-
cedure to the Planning Commission and its cost.
ON MOTION BY SPENCER AND SECOND BY CROSBY, ADMINISTRATIVE REVIEW
NO. 75-67 WAS APPROVED WITH THE FOLLOWING GENERAL CONDITION:
In its approval action, the Board of Zoning Adjustments
requests that the applicant adhere to Section 9730.27.2
of the Huntington Beach Ordinance Code in her care of a
single, non -related person at the subject location.

The Chairman informed the Board that this application was granted
Negative Declaration No. 75-34 by the Environmental Review Board
on May 20, 1975.
Board Member Crosby stated that the existing power pole is close
to the proposed driveway, and that a radius driveway is required
for entry purposes. A further discussion of the plot plan was
held, with the Board pointing out to the applicant's representa-
tive, Mrs. H. H. Eighmy, that dimensions should be corrected on it.

ON MOTION BY COPE AND SECOND BY SPENCER, ADMINISTRATIVE REVIEW
NO. 75-51 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE
FOLLOWING VOTE:
A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS:
1. The conceptual plot plan and elevations received June 3,
1975 shall be the approved layout, subject to the
modifications described herein:
a. Sidewalk shall be shown as eight (8) feet.
b. The proper street section shall be indicated.
c. An eight (8) foot radius ingress driveway shall
be provided.
A plan delineating said modifications shall be sub-
mitted to the Secretary of the Board. If such plan
complies with the modifications outlined by the Board,
said plan shall be approved and made a permanent part
of the administrative file.
In its approval action, the Board of Zoning Adjustments con-
sidered the following issues relating to the conceptual
plan:
Traffic circulation and drives;
Parking layout;
Lot area;
Lot width and lot depth;
Type of use and its relation to property and improve-
ments in the immediate vicinity;
Past administrative action regarding this property.
2. The following plans shall be submitted to the Secretary
of the Board:
a. Landscape and irrigation plan complying with Article
979 of the Huntington Beach Ordinance Code and
landscaping specifications on file in the Depart-
ment of Public Works.
b. Rooftop mechanical equipment screening plan.
Said plan shall indicate screening of all rooftop

mechanical equipment and shall delineate the type
of material proposed to screen said equipment.
3. Soil and compaction reports shall be submitted by a
certified soils engineer. Said reports shall be submitted
to the Department of Building and Community Development
and shall be subject to approval by that Department.
4. Fire protection systems, including automatic sprinkler
systems, standpipe systems, fire hydrants, fire alarm
systems, and any other required fire protection and detection
devices or systems shall comply with the specifications
of the Huntington Beach Fire Code. Plans for such
systems and devices shall be submitted to the Fire
Department and shall be subject to approval by the
Departments of Fire and Public Works.
B. GENERAL CONDITIONS:
1. If the developer proposes to provide air conditioning,
the insulation in ceilings and exterior walls shall be
a minimum of R-19 and R-11, respectively. If no air
conditioning is to be provided, the insulation in ceilings
and exterior walls shall be a minimum of R-13 and R-7,
respectively.
2. All building spoils, such as unusable lumber, wire, pipe,
and other surplus or unusable material, shall be disposed
of at an offsite facility equipped to handle them.
3. Natural gas shall be stubbed in at the locations of water
heaters and central heating units.
4. An engineering geologist shall be engaged to submit a
report, indicating the ground surface acceleration from
earth movement for the subject property.
5. All structures proposed within this project shall be con-
structed in compliance with the g-factors as indicated
by the geologist's report.
6. Calculations for footings and structural members to
withstand anticipated g-factors shall be submitted to the
City for review.

USE PERMIT NO. 75-26
Applicant: Kimberly H. Gordon
To permit the establishment of a ski school, pursuant to Section
9472 of the Huntington Beach Ordinance Code; located at 19432
Beach Boulevard, on the east side of Beach Boulevard, approximately
190 feet north of Yorktown Avenue, in a C4, Highway Commercial
District.
The Chairman informed the Board that this application is a Categorical
Exemption, Class III, California Environmental Quality Act, 1970.
Mr. Kimberly H. Gordon was present.
The applicant stated that his proposed hours of operation would
be from approximately 9:00 a.m. to 10:00 p.m., depending on demand,
for five or six days a week.
The drainage fee was discussed and the applicant was advised it
would have to be paid prior to issuance of building permits. The
approach from Beach Boulevard was discussed, as well as bringing
the parking area up to standard to satisfy the Building Department.
The question of the amount of noise which would be created by the
machinery was brought up and the applicant responded that it
would be in an amount similar to an escalator.
ON MOTION BY SPENCER AND SECOND BY CROSBY, USE PERMIT NO. 75-26
WAS APPROVED WITH THE FOLLOWING CONDITIONS BY THE FOLLOWING VOTE:

The Chairman informed the Board that this application is a
Categorical Exemption, Class I, California Environmental Quality
Act, 1970.
Mr. Mike Templeton was present. He stated that his plans in
connection with the application are to enclose a patio.
The Board reviewed the application and concurred on its approval.

A discussion was held regarding the parking layout and the land-
scaping plan. The Chairman further discussed the need for the
building to be set back an additional five feet from that reflected
on the plot plan.
