REGULAR AGENDA ITEMS:
CONDITIONAL EXCEPTION NO. 75-14
Applicant: Award Builders
To permit a two foot (2') encroachment into the required ten foot
(101) rear yard setback, in lieu of S. 9103.3 of the Huntington
Beach Ordinance Code loacted on the northeast corner of Slater
Avenue and Mayor Lane, in an R1, Low Density Residential District.
Chairman Cope informed the Board that this item is a Class I Exemption,
California Environmental Quality Act.
Chairman Cope opened the Public Hearing.
Mr. Ed Cogert was present to represent the applicant. He explained
that there is a hardship situation with this property because of
the cul-de-sac which leaves a large side yard. He reported that if
the application were granted, the property would have a single
street address.
The Public Hearing was closed since there was no one else who wished
to speak on the subject.
The Board discussed the proposal, and concurred on approval which
was based on the fact that a hardship does exist because of the
lot configuration. Further it was felt that the granting of this
Conditional Exception will not be deemed a special privilege.
ON MOTION BY CROSBY, SECOND BY LIPPS, CONDITIONAL EXCEPTION NO.
75-14 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITION.
Findings
1. The granting of the Conditional Exception will not constitute a
grant of special privilege inconsistent upon other properties
in the vicinity and under an identical zone classification.
2. Because of special circumstances applicable to the subject
property, including size, shape, topography, location, or

surroundings, the strict application of the zoning ordinance
is found to deprive the subject property of privileges
enjoyed by other properties in the vicinity and under
identical zone classifications.
3. The granting of a Conditional Exception is necessary in order
to preserve the enjoyment of one or more substantial property
rights.
4. The granting of a Conditional Exception will not be materially
detrimental to the public welfare, or injurious to property in
the same zone classifications.
5. The granting of the Conditional Exception will not adversely
affect the Master Plan of the City of Huntington Beach.
Condition of Approval
The conceptual plot plan and elevations, received May 21, 1975,
shall be the approved layout.

USE PERMIT NO. 75-31
Applicant: James F. Starnes
To permit an alteration of a building having a nonconforming side
yard, pursuant to Section 9719 of the Huntington Beach Ordinance Code,
located at 5972 Langport Circle, (south side of Langport Circle,
approximately 350 feet east of Greenview Lane) in an R1, Low Density
Residential District.
The Chairman informed the Board that the application is a Class I
Exemption, California Environmental Quality Act.
Mrs. Lucille Starnes was present on behalf of the applicant.
The Chairman opened the Public Hearing. Mrs. Starnes said that
they are planning to build a second floor addition over their garage
and are not constructing any additional structures. There being no
parties to speak further for or against the proposal, the Public
Hearing was closed.
The Board reviewed the conceptual plans.

ON MOTION BY COPE AND SECOND BY CROSBY, USE PERMIT NO. 75-31
WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITION BY THE
FOLLOWING VOTE:
Findings
1. The establishment, maintenance, and operation of the use will
not be detrimental to:
a. The general welfare of persons residing or working in the
vicinity.
b. Property and improvements in the vicinity of such use or
building.
2. The granting of a Use Permit will not adversely affect the
Master Plan of the City of Huntington Beach.
3. The proposal is consistent with the City's General Plan of Land
Use.
Condition
1. The conceptual plot plan and elevations received May 23, 1975
shall be the approved layout.
In its approval action, the Board of Zoning Adjustments considered
the following issues relating to the conceptual plan:
. Traffic circulation and drives;
. Lot area, lot width, and lot depth;
. Type of use and its relation to property and improvements in the
immediate vicinity;
. Past administrative action regarding this property.

Applicant: Lu Anne Kleis
To permit the 24-hour care of non -related persons, pursuant to
S. 9730.27 of the Huntington Beach Ordinance Code, located on the
west side of Shorewood Circle, approximately 420 feet'.south of
Adams Avenue, in an R1, Low Density Residential District.
The Chairman informed the Board that the project was categorically
exempt, California Environmental Quality Act.

The applicant was present at the meeting.
The Chairman opened the Public Hearing. The Board requested evidence
that a license for the requested care would be granted by the State
of California. The applicant stated that she had received a tele-
phone call from the State this date and they informed her that the
license was available, but she did not have time to pick it up prior
to attending this meeting. Mr. Walter Van Alstyne, a neighbor,
said it is an R1 residential neighborhood and that he has a petition
from everyone on the street, except for three residents against the
application. His petition was submitted for filing with the Board.
Another neighbor, Martha Lynch reports that prior occupants had
moved residents in during the night who were sometimes women and
sometimes men. Several homes in the neighborhood have baby sitting
licenses and Mr. R. C. Schweitzer reports that the women from this
residence walk up and down the street and frighten the children
in the neighborhood.' -
The applicant said they are only taking three girls, ages approxi-
mately 25 years, who have had emotional problems. The applicant
said she will be living in the home herself.
The Board explained to those present that as long as the applicant
meets the Code requirements, it has no alternative but to approve
the request. The Public Hearing was closed.
The Board discussed the Conditions of Approval with the applicant.
ON MOTION BY LIPPS, SECOND BY CROSBY, ADMINISTRATIVE REVIEW NO. 75-78
WAS APPROVED WITH THE FOLLOWING CONDITIONS BY THE FOLLOWING VOTE:
A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS:
1. The conceptual plot plan received May 29, 1975 shall be the
approved layout.
In its approval action, the Board of Zoning Adjustments considered
the following issues relating to the conceptual plan:
. Lot area;
. Lot width and lot depth;
. Type of use and its relation to property and improvements in
the immediate vicinity.
B. GENERAL CONDITION:
1. Prior to the expiration of the ten-day appeal period, evidence
of licensing by the State of California must be submitted
to the Planning Department for review and approval.

ADMINISTRATIVE REVIEW NO. 75-70
Applicant: Sid Lance Construction
To permit the construction of two (2) tilt -up industrial buildings
pursuant to S. 9511 of the Huntington Beach Ordinance Code located
on the northwest corner of Research Drive and Product Lane, in an
100-M1-A-20,000 Restricted Industrial District.
Mr. Lance was present.
The Chairman explained that Administrative Review No. 75-70 would
be heard in conjunction with Use Permit No. 75-29 and Conditional
Exception No. 75-15.
The Public Hearing was opened. Mr. Russ Conners, architect, was
present on behalf of the applicant and spoke concerning the setbacks
having been changed. The new plans have been submitted. The
encroachment was reviewed. The Board discussed the fact the applicant
does not demonstrate sufficient hardship for his request. Further
review seemed to be in order as the Planning Commission should give
some direction in regard to an industrial development criteria of
this type. There being no further persons to speak for or against
the proposal, the Public Hearing was closed.
ON MOTION BY COPE AND SECOND BY CROSBY, ADMINISTRATIVE REVIEW NO.75-70
WAS CONTINUED FOR ONE WEEK UNTIL JUNE 25, 1975 BY THE FOLLOWING VOTE:

Environmental Impact Report No. 73-16, approved by the Environ-
mental Review Board on March 18, 1974, covers the subject
property.
Mr. Sid Lance was present, as well as the architect, Russ Connors.
The applicant requested a continuance of the application for one
week in order to submit revised plans.
The Board concurred with this request.

the plans submitted by the applicant and indicated that they did
not demonstrate sufficient hardship to warrant granting of this
Conditional Exception.

The Chairman informed the Board that this application has an
EIR'No.73-16 covering it which was approved by the Environmental
Review Board on March 18, 1974.

To permit the relocation of an existing overhead service, pursuant
to S. 9730.9(a)(c) of the Huntington Beach Ordinance Code, located
on the north side of Raphael Drive, approximately 340 feet west of
Wrightwood Lane, in an Rl, Low Density Residential District.
The Board was informed that this application is a Class I categorical
exemption, California Environmental Quality Act.
D.D. Sikosky was present in behalf of the applicant and stated that
the relocation was necessary in order to construct a room addition
to the existing structure.

NO. 75-84 WAS APPROVED WITH THE FOLLOWING CONDITIONS AND

The Board has considered all guidelines for approval of overhead
utilities and all criteria have been satisfied, pursuant to
Section 9730.10 of the Huntington Beach Ordinance Code.
Conditions

layout.

To permit a parking lot sale at 7800 Edinger Street.
Mr. Larry Reagan was present on behalf of the applicant. He
explained that the applicant desires to have a parking lot sale
on July 3, 4, 5, and 6, 1975. The Board discussed the Conditions
of Approval with him.
