Lindborg To permit the construction of a four-story commercial office building, pursuant to Section 9451 of the Huntington Beach Ordinance Code; located at the southeast corner of Second Street and Olive Avenue, in a C3 General Business District. The Chairman informed the Board that this application was granted Negative Declaration No. 75-37 by the Environmental Review Board on May 27, 1975. Mr. Rex Hoover was present to represent the applicant and re- quested a one -week continuance to June 25, 1975 on this matter. The Board concurred. Lindborg To permit the construction of an 18-unit apartment complex, pursuant to Section 9202.3.1.3 of the Huntington Beach Ordinance Code, and located on the west side of Hoyt Circle, approximately 100 feet north of Constantine Drive, in an R3, Medium -High Density Residential District. The Chairman informed the Board that this application was granted Negative Declaration No. 75-35 by the Environmental Review Board on May 27, 1975. The Chairman opened the Public Hearing. Mr. Rex Hoover was present to represent the applicant. The open space requirements were discussed and the applicant was requested to bring a revised layout showing walls and windows ad- jacent to open space areas. Discussion was held concerning the reciprocal drive agreement with the adjacent property owner. There being no other parties present to speak for or against the application, the Public Hearing was closed by the Chairman. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The revised conceptual plot plan and elevations received May 12, 1975, shall be the approved layout, subject to the modifications described herein: a. The corner of building unit number 12 shall reflect a drive width of not less than twenty-five feet; b. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: Traffic circulation and drives; Parking layout; Lot area; Lot width and lot depth; Type of use and its relation to property and improvements in the immediate vicinity; Past administrative action regarding this property. A. 2. The following plan shall be submitted to the Secretary of the Board: Landscape and irrigation plan complying with Article 979 of the Huntington Beach Ordinance Code and landscaping specifications on file in the Department of Public Works. 3. Soil and compaction reports shall be submitted by a certified soils engineer. Said reports shall be submitted to the Department of Building and Community Development and shall be subject to approval by that Department. 4. Fire protection systems, including automatic sprinkler systems, standpipe systems, fire hydrants, fire alarm systems, and any other required fire protection and de- tection devices or systems shall comply with the specifi- cations of the Huntington Beach Fire Code. Plans for such systems and devices shall be submitted to the Fire Depart- ment and shall be subject to approval by the Departments of Fire and Public Works. 5. The developer shall participate in the local drainage assessment district. 6. The developer shall participate in the Orange County Sani- tation District #3 Sewer Annex District. 7. The reciprocal agreements received by the Board on June 18; 1975 shall be recorded with the County of Orange, California. A copy of said recorded document shall be submitted to the Planning Department and the form and content of said agreement shall be subject to approval by the City Attorney. TO BE COMPLETED PRIOR TO FINAL INSPECTION: Hoyt Circle shall be improved to the centerline of such right- of-way. Said improvement shall include curbs, gutters, side- walks, paving, street trees, street lights, street signs, street drainage, and sewer and water main extensions, in full compliance with the City of Huntington Beach street standards and requirements. C. GENERAL CONDITIONS: 1. If the developer proposes to provide air conditioning, the insulation in ceilings and exterior walls shall be a minimum of R-19 and R-11, respectively. If no air conditioning is to be provided, the insulation in ceilings and exterior walls shall be a minimum of R-13 and R-7, respectively. 2. All building spoils, such as unusable lumber, wire, pipe and other surplus or unusable material, shall be disposed of at an offsite facility equipped to handle them. 3. Natural gas and 220V electrical shall be stubbed in at the location of clothes dryers, and natural gas shall be stubbed in at the locations of cooking facilities, water heaters, and central heating units. 4. Double -paned windows shall be installed within the units facing onto the adjacent arterial highway. 5. An engineering geologist shall be engaged to submit a report indicating the ground surface acceleration from earth movement for the project property. 6. All structures proposed for construction within this subdivision shall be constructed in compliance with the g-factors as indicated by the geologist's report. 7. Calculations for footings and structural member:; to withstand anticipated g-factors shall be submitted to the City for review. $. The structures on subject property, whether attached or detached, shall be constructed in compliance with the State acoustical standards set forth for all units that lie within the 60 CNEL contours of the property. FINDINGS OF THE BOARD: 1. In complying with the provisional development standards contained in Article 932, establishment, maintenance, and operation of this use will not be detrimental to the health and general welfare of persons residing or working in the vicinity, and said improvements will not degrade property and improvements in the vicinity of .the subject site. 1 BZA 6/18/75 -4- 1 Minutes: II.B. Inasmuch as the proposal is consistent with the Land Use Element of the General Plan, the granting of the Use Permit will not adversely affect the General Plan of the City of Huntington Beach. Lindborg To permit the construction of a single -story shopping center, pursuant to Section 9472.1 of the Huntington Beach Ordinance Code; located at the southwest corner of Warner and Springdale Streets, in a C4, Highway Commercial District. The Chairman informed the Board that Negative Declaration No. 75-36 was granted by the Environmental Review Board on May 27, 1975. The Public Hearing was opened. Mr. Rex Hoover was present to represent the applicant. Mr. Richard Rockwood was present and spoke about the noise factor disturbing the residents at the Huntington Continental Apartments on the south side of the proposed project. Mr. Sparks was present and also commented on the plan. There being no other persons present wishing to speak for or against the proposal, the Public Hearing was closed. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. In order to facilitate a drive pattern consistent with the existing parking and drive layout within the center, the developer shall provide'a landscaped planter at the northeast portion of the subject property as delineated on the approved conceptual plan. A plan delineating said modifications shall be submitted to the Secretary of the Board. If such plan complies with the modifications outlined by the Board, said plan shall be approved and made a permanent part of the administrative file. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: Traffic circulation and drives; Parking layout; Lot area; lot width and lot depth; Type of use and its relation to property and improvements in the immediate vicinity; Past administrative action regarding this property. 2. The following plans shall be submitted to the Secretary of the Board: a. Rooftop mechanical equipment screening plan. Said plan shall indicate screening of all rooftop mechanical equip- ment and shall delineate the type of material proposed to screen said equipment. 3. Soil and compaction reports shall be submitted by a certified soils engineer. Said reports shall be submitted to the Depart- ment of Building and Community Development and shall be subject to approval of that Department. 4. Fire protection systems, including automatic sprinkler systems, standpipe systems, fire hydrants, fire alarm systems, and any other required fire protection and detection devices or systems shall comply with the specifications of the Huntington Beach Fire Code. Said agreement shall offer ir- revocable rights to parking, ingress/egress and circu- lation throughout the remainder of the shopping center and shall provide for modifications to landscaping and parking space striping to facilitate the Conditions of Approval required herein. B. GENERAL CONDITIONS: 1. If the developer proposes to provide air conditioning, the insulation in ceilings and exterior walls shall be a minimum of R-19 and R-11, respectively. If no air conditioning is to be provided, the insulation in ceilings and exterior walls shall be a minimum of R-13 and R-7, respectively. 2. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an offsite facility equipped to handle them. 3. Property and improvements in the vicinity of such building are based on the following conclusions: (1) The site layout and design most closely mitigates possible traffic hazards, and (2) Adequate parking facilities are provided to handle the anticipated increase in vehicular traffic. The Chairman informed the Board that this application was issued Negative Declaration No. 75-38 which was granted by the Environmental Review Board on May 27, 1975. Mr. Jack Wallace was present in behalf of the applicant. The Board discussed the Conditions of Approval with the representative. If, after a period of six (6) months' testing, the oil well becomes an idle well, the well shall be abandoned to City and State standards. There being no one to speak for or against the proposal, the Chairman closed the Public Hearing. ON MOTION BY EADIE AND SECOND BY CROSBY, CONDITIONAL EXCEPTION NO. 75-19 WAS APPROVED WITH THE FOLLOWING CONDITIONS AND FINDINGS BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: The conceptual plot plan received June 2, 1975 shall be the approved layout. In its approval action, the Board of Zoning Adjustments con- sidered the following issues relating to the conceptual plan: Traffic circulation and drives; Lot area; Lot width and lot depth; Type of use and its relation to property and improvements in the immediate vicinity; Past administrative action regarding this property. FINDINGS OF THE BOARD: 1. The granting of this Conditional Exception does not constitute a special privilege inconsistent upon other properties in the vicinity and only establishes parity. 2. Because of the lot width, strict application of the zoning ordinance deprives the subject property of privileges enjoyed by other properties in the vicinity. 3. Because a less desirable and narrow building plan could only be obtained if the Conditional Exception were not approved, the granting of said application is necessary in order to preserve the enjoyment of this property right. 4. Inasmuch as subsequent zoning ordinances relating to other areas of the Townlot allow a three foot (31) setback or less in certain cases, the granting of this Conditional Exception will not be materially detrimental to the public welfare or injurious to property in the same zone classification. Schley To permit the construction of a single-family residence on an R4 lot, pursuant to Section 9231.1 of the Huntington Beach Ordinance Code located on the east side of 21st Street, approximately 100 feet south of Olive Avenue in an R4, High Density Residential District. The Chairman informed the Board that this application is a Categorical Exemption, Class III, California Environmental Quality Act, 1970. The Chairman opened the Public Hearing. Mr. and Mrs. Schley were present. A discussion was held by the Board with the applicant concerning the right-of-way on the alley to be dedicated. Further discussion was held on the plot plan. Therefore, if the developer cannot provide said turning radius, the proposed structure shall be adjusted to accommodate said turning radius. 3.- Soil and compaction reports shall be submitted by a certified soils engineer. Said reports shall be sub- mitted to the Department of Building and Community Development and shall be subject to approval by that Department. 4. The developer shall participate in the local drainage assessment district. B. TO BE COMPLETED PRIOR TO FINAL INSPECTION: Twenty-first Street and alley shall be improved to the center- line of such right-of-way. Board of Zoning Adjustments Wednesday, June 18, 1975 Page 12 The Chairman informed the Board that this application was granted Negative Declaration No. 75-33 by -the Environmental Review Board on May 27, 1975. The Chairman opened the Public Hearing. Mr. Albert L. De Guglielmo was present. A discussion was held on the submitted plot plan. The outside banking facilities were discussed, as well as the required amount of land- scaping. It was suggested that the applicant or his representative pursue the sign plan in order to insure that it meets Huntington Beach Ordinance Code requirements. The applicant mentioned that the owner of the Warnerdale Square had looked at the plan and approved it. A rendering of the site was also reviewed. There being no other persons to speak for or against the proposal, the Public Hearing was closed by the Chairman. ON MOTION BY CROSBY AND SECOND BY EADIE, USE PERMIT NO. 75-20 WAS APPROVED WITH THE FOLLOWING CONDITIONS AND FINDINGS BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan and elevations received April 30, 1975 shall be the approved layout, subject to the modifications described herein: a. Six parking spaces located at the northeast portion of the property shall be redistributed to the area shown on the approved conceptual plot plan. The area created by the removal of the parking spaces shall be paved as a main access to the outside banking facilities in accordance with the City specifications. b. Landscaped planters and walkways abutting the area devoted to drives for ingress and egress to the outside banking facilities shall be altered to provide a better turning radius into said facilities. C. Revised landscaping allocations shall be delineated on the revised plan, indicating compliance with the Ordinance Code. A plan delineating said modifications shall be submitted to the Secretary of the Board.
