The plot plan was reviewed and the findings of the Board were dis- cussed.` ON MOTION BY EADIE AND SECOND BY CROSBY, USE PERMIT NO. 75-30 WAS APPROVED WITH THE FOLLOWING FINDINGS, BY THE FOLLOWING VOTE: FINDINGS OF THE BOARD: 1. At the present time, there is not an over -concentration of truck loading facilities on the subject street which the property abuts. 2. Landscaping which is displaced by the loading facility is pro- vided elsewhere on the project. 3. The proposed operation meets City criteria from a safety aspect. 4. For the above -stated reasons, the proposed Use Permit will not be detrimental to: a. The general welfare of persons residing or working in the vicinity. .b. Property and improvements in the vicinity of such use or building., 5. The granting of this Use Permit will not adversely affect the Master Plan of the City of Huntington Beach. 6. The proposal is consistent with the City's General Plan of Land Use. The Chairman informed the Board that this application is a Categ- orical Exemption, Class I, California Environmental Quality Act, 1970. Terry Canales was present on behalf of the D.W. McFerran Company to represent the applicant. The plan was reviewed and the code requirements were explained to the representative. ON MOTION BY CROSBY AND SECOND BY SPENCER, ADMINISTRATIVE REVIEW NO. 75-86 WAS APPROVED WITH THE FOLLOWING CONDITIONS AND FINDING, AND BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: .1. The plot plan received June 17, 1975, shall be the approved layout. FINDINGS OF THE BOARD: The Board has considered all guidelines for approval of overhead utilities, and all criteria have been satisfied, pursuant to Section 9730.10 of the Huntington Beach Ordinance Code. AYES: CROSBY, EADIE, SPENCER NOES: NONE ABSENT: NONE CONDITIONAL EXCEPTION NO. 75-20 Applicant: Mr. and Mrs. Michael E. Reynolds To permit a 216" encroachment into the required 15 foot front yard setback, in lieu of Section 9103.1 of the Huntington Beach Ordinance Code; located at 16872 Stiles Circle, approximately 210 feet south of Trumbull Dirve, in an Rl, Low Density Residential District. The Chairman informed the Board that this application is a Categori- cal Exemption, Class III, California Environmental Quality Act, 1970. The Chairman opened the Public Hearing. Mr. Richard Spencer, architect, was present to represent the applicant. The Chairman stated that there was a letter filed with the Planning Department from Ms. Newman of 17102 Courtney Lane registering oppo- sition, due to the fact that there is no hardship demonstrated by the applicant to justify his request. Mr. Knox was present and stated his opposition to the request. There being no other parties to speak for or against this proposal, the Chairman closed the Public Hearing. The Board explained its feelings about the project, and Chairman Eadie questioned why a reasonably sized room could not be built for the dwelling without the requested encroachment. ON MOTION BY CROSBY AND SECOND BY EADIE CONDITIONAL EXCEPTION NO. 75-20 WAS DENIED WITH THE FOLLOWING FINDINGS, BY THE FOLLOWING VOTE: FINDINGS OF THE BOARD: 1. The proposed encroachment, while aligning the existing architec- tural features, is not predicated upon a physical hardship, and an average -sized room addition can be built under the existing Code requirements. No further justification for the hardship has been demon- strated. AYES: CROSBY, EADIE, SPENCER NOES: NONE ABSENT: NONE CONDITIONAL EXCEPTION NO. 75-21 Applicant: Golden State Bank To permit construction of a 52 square foot monument -type sign within an existing shopping center. Said sign exceeds the maximum permitted sign area for said center by 52 square feet, in lieu of Section 9764.3.1.1 of the Huntington Beach Ordinance Code; located on the south side of Warner Avenue, approximately 370 feet east of Springdale Street, in a C2, Community Business District. The Chairman informed the Board that this application is a Categori- cal Exemption, Class V, California Environmental Quality Act, 1970. The Chairman opened the Public Hearing. Mr. William Hardy, manager of the Golden State Bank, and Mr. Bob Van Gerpen, representing the sign company, were present. Mr. Van Gerpen said that the bank would like to exchange its larger sign on the pylon sign for the center for a slightly smaller size sign in front of the bank. Mr. Hardy spoke about the difficulty people have in identifying the bank location. As there were no other parties present to speak for or against the proposal, the Chairman closed the Public Hearing. Board discussion followed. ON MOTION BY EADIE AND SECOND BY SPENCER, CONDITIONAL EXCEPTION NO. 75-21 WAS APPROVED WITH THE FOLLOWING CONDITIONS AND REASONS BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: 1. The sign copy advertising the bank on the existing pole sign shall be removed. 2. The existing pole sign shall comply with the Huntington Beach Ordinance Code in all respects, including height, prior to com- pletion of the monument sign. Construction of the new sign does not result in a substantial increase in the sign overage for the entire center, as the ex- isting pole sign area for the bank will be removed. 2. The existing sign does not clearly represent the business by virtue of its location. 3. Placement of the proposed sign would not be materially detri- mental to the shopping center or other properties within the immediate vicinity. 4. The granting of this Conditional Exception with the conditions imposed will result in a positive sign modification as the ex- isting sign will be brought into conformance with the Huntington Beach Ordinance Code. The Chairman informed the Board that this application had been granted Negative Declaration No. 75-41 by the Environmental Review Board on June 3, 1975. Mr. Buck was present at the meeting. The Board discussed the plan and requested a revision showing dedi- cation and the turning radius. Mr. Buck stated that there would not be any access to the development from Pacific Coast Highway. ON MOTION BY EADIE AND SECOND BY SPENCER, ADMINISTRATIVE REVIEW NO. 75-62 WAS APPROVED WITH THE FOLLOWING CONDITIONS BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS. 1. The conceptual plot plan and elevations received May 14, 1975, shall be the approved layout, subject to the modifi- cations described herein. a. Plan to show dedication and turning radius require- ments correctly. A plan delineating said modifications shall be submitted to the Secretary of the Board. If such plan complies with the modifications outlined by the Board, said plan shall be approved and made a permanent part of the admin- istrative file. C. GENERAL CONDITIONS: 1. If the developer proposes to provide air conditioning, the insulation in ceilings and exterior walls shall be a minimum of R-19 and R-11, respectively. If no air conditioning is to be provided, the insulation in ceilings and exterior walls shall be a minimum of R-13 and R-7, respectively. 2. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an offsite facility equipped to handle them. 3. An engineering qeologist shall be engaged to submit a report indicating the ground surface acceleration from earth move- ment for the project property. 4. All structures proposed for construction within this project shall be constructed in compliance with the g-factors as in- dicated by the geologist's report. 5. Calculations for footings and structural members to with- stand anticipated g-factors shall be submitted to the City for review. 6. Access shall be prohibited from Pacific Coast Highway to the property. Mrs. and Mrs. Collins, Mr. and Mrs. Zweibel, and Mr. Borden were present on behalf of the applicant. The representatives requested a one -week continuance of this matter, in order to allow time to submit a revised plan.
