Carl Wieland To permit a one foot (110") encroachment into the required twenty - foot (20') minimum dimension for open space, in lieu of Section 9103.3.1.1.2 of the Huntington Beach Ordinance Code located on the west side of Honolulu Lane at the west end of Kaui Drive, in an R1, Low Density Residential District. The Chairman informed the Board that this application is a Categorical Exemption, Class III, California Environmental Quality Act, 1970. The Chairman opened the Public Hearing. Mr. Wieland was present and explained the hardship was caused due to his lot being on a cul-de-sac. There being no other parties to speak for or against the application, the Chairman closed the Public Hearing. The Board discussed the 550 foot addition and why one foot would make a great deal of difference to the applicant. ON MOTION BY COPE AND SECOND BY SPENCER, CONDITIONAL EXCEPTION NO. 75-18 WAS APPROVED WITH THE FOLLOWING FINDINGS, BY THE FOLLOWING VOTE: Minutes: H.B. Board of Zoning Adjustments Wednesday, July 2, 1975 Page 2 FINDINGS OF THE BOARD: 1. The granting of this Conditional Exception will not constitute a grant of a special privilege inconsistent upon other properties in the vicinity and under an identical zone classification. 2. Because of special circumstances applicable to the subject property, including size and shape, the strict application of the zoning ordinance is found to deprive the subject property of privileges enjoyed by other properties in the vicinity and under identical zone classifications. 3. The granting of the Conditional Exception is necessary in order to preserve the enjoyment of one or more substantial property rights. 4. The granting of the Conditional Exception will not be materially detrimental to the public welfare, or injurious to property in the same zone classifications. 5. The granting of the Conditional Exception will not adversely affect the Master Plan of the City of Huntington Beach. The Chairman informed the Board that this application is a Categorical Exemption, Class III, California Environmental Quality Act, 1970. The applicant, L. Carl Wieland, was present. The Chairman opened the Public Hearing. There being no one to speak for or against the request, the Public Hearing was closed. The Board reviewed the proposal and discussed the Conditions of Approval with the applicant. Board of Zoning Adjustments Wednesday, July 2, 1975 Page 3 CONDITIONS OF APPROVAL: 1. The conceptual plot plan and elevations received May 28, 1975 shall be -the approved layout. In its approval action, the Board of Zoning Adjustments con- sidered the following issues relating to the conceptual plan: Lot area; Lot width and lot depth; Type of use and its relation to property and improvements in the immediate vicinity; Past administrative action regarding this property. FINDINGS OF THE BOARD: 1. The establishment, maintenance, and operation of the use will not be detrimental to: a. The general welfare of persons residing or working in the vicinity. b. Property and improvements in the vicinity of such use or building. 2. The granting of a Use Permit will not adversely affect the Master Plan of the City of Huntington Beach. 3. Carl Wieland To permit the relocation of an existing overhead electrical service, pursuant to Section 9730.9 of the Huntington Beach Ordinance Code located on the west side of Honolulu Lane, at the west end of Kaui Drive, in an Rl, Low Density Residential District. The Chairman explained that this application is a Categorical Exemption, Class I, California Environmental Quality Act, 1970. The applicant was present. He explained that his request was due to a room addition being made to his present residence. The Board reviewed the proposal and discussed the Conditions of Approval with the applicant. Board of Zoning Adjustments Wednesday, July 2, 1975 Page 4 ON MOTION BY COPE AND SECOND BY CROSBY, ADMINISTRATIVE REVIEW NO. 75-77 WAS APPROVED WITH THE FOLLOWING CONDITIONS AND FINDINGS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: 1. The plot plan received May 28, 1975 shall be the approved layout. 2. The applicant shall install a service panel to facilitate con- version to underground utilities at a future date, pursuant to Section 9730.11 of the Huntington Beach Ordinance Code. FINDINGS OF THE BOARD: The Board has considered all guidelines for approval of overhead utilities, and all criteria have been satisfied, pursuant to Section 9730.10 of the Huntington Beach Ordinance Code. AYES: Cope, Crosby, Spencer NOES: None ABSENT: None USE PERMIT NO. 75-27 (Cont. from June 25, 1975) Applicant: Don Jones Realty To permit the construction of a commercial complex, pursuant to Section 9472 of the Huntington Beach Ordinance Code located at the southwest corner of Beach Boulevard and Talbert Avenue, in the C4, Highway Commercial District. The Chairman informed the Board that the Environmental Review Board granted Negative Declaration No. 75-40 on June 3, 1975. The Chairman opened the Public Hearing. Mr. and Mrs. Collins, Mr. and Mrs. Zweibel, and Mr. Borden were present on behalf of the applicant. The Collins and the Zweibels are the owners of the property and Mr. Borden is their architect. The Public Hearing was closed as no one wished to speak for or against the project. The Board discussed the revised plan. The possibility of eliminating one driveway on Beach and one on Talbert was discussed as there are no median breaks on Beach Boulevard. The driveway on the south side of the property on Beach should be 24 feet. The small building setting by itself as shown on the plan was discussed and the applicants explained that the intention was to have some sort of drive -through operation. Board of Zoning Adjustments Wednesday, July 2, 1975 Page 5 ON MOTION BY CROSBY AND SECOND BY COPE, USE PERMIT NO. 75-27 WAS APPROVED WITH THE FOLLOWING CONDITIONS AND FINDINGS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The revised plot plan and elevations received June 30, 1975 shall be the approved layout, subject to the modification described herein. a. The southerly driveway on Beach Boulevard shall be a minimum of 24 feet. A plan delineating said modification shall be submitted to the Secretary of the Board. If such plan complies with the modification outlined by the Board, said plan shall be approved and made a permanent part of the administrative file. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: Traffic circulation and drives; Parking layout; Lot area; Lot width and lot depth; Type of use and its relation to property and improvements in the immediate vicinity; Past administrative action regarding this property. 2. The following plans shall be submitted to the Secretary of the Board: a. Landscape and irrigation plan complying with Article 979 of the Huntington Beach Ordinance Code and land- scaping specifications on file in the Department of Public Works. b. Rooftop mechanical equipment screening plan. Said plan shall indicate screening of all rooftop mechanical equipment and shall delineate the type of material proposed to screen said equipment. C. Elevations shall be subject to approval by the Planning Department. 3. Said reports shall be submitted to the Department of Building and Community Development and shall be subject to approval by that Department. 5. Fire protection systems, including automatic sprinkler systems, standpipe systems, fire hydrants, fire alarm systems, and any other required fire protection and detection devices or systems shall comply with the specifications of the Huntington Beach Fire Code. Plans for such systems and devices shall be submitted to the Fire Department and shall be subject to approval by the Departments of Fire and Public Works. 6. The developer shall participate in the local drainage assessment district. 7. The developer shall participate in the Orange County Sani- tation District #3 Sewer Annex District. 8. All applicable fees shall be paid prior to issuance of building permits. B. TO BE COMPLETED PRIOR TO FINAL INSPECTION: 1. Talbert and Beach Boulevard shall be improved to the center- line of such right-of-way to City and State requirements. Said improvement shall include curbs, gutters, sidewalks, paving, street trees, street lights, street signs, street drainage, and sewer and water main extensions, in full compliance with the City of Huntington Beach street standards and requirements. C. GENERAL CONDITIONS: 1. If the developer proposes to provide air conditioning, the insulation in ceilings and exterior walls shall be a minimum of R-19 and R-11, respectively. If no air conditioning is to be provided, the insulation in ceilings and exterior walls shall be a minimum of R-13 and R-7, respectively. 2. All building spoils, such as unusable lumber, wire, pipe and other surplus or unusable material, shall be disposed of at an offsite facility equipped to handle them. 3. An engineering geologist shall be engaged to submit a report indicating the ground surface acceleration from earth move- ment for the project property. 4. The Chairman informed the Board that the Environmental Review Board granted Negative Declaration No. 75-45 on June 17, 1975. The Chairman opened the Public Hearing. Mr. George Alvarez was present at the meeting to represent the applicant. The representative showed the elevations to the Board. The Public Hearing was closed. The Board discussed the deficiency in the plans insofar as the front yard setback on Florida Street not being the average of 11 feet. The Chairman informed the Board that the Environmental Review Board granted Negative Declaration No. 75-45 on June 17, 1975. Mr. George Alvarez was present to represent the applicant. The procedures for filing a tentative parcel map were discussed with the representative. ON MOTION BY COPE AND SECOND BY CROSBY, TENTATIVE PARCEL MAP NO. 75-2 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: 1. The tentative parcel map received by the Planning Department on May 29, 1975 shall be the approved layout. 2. A final parcel map shall be filed with, and approved by, the Department of Public Works, and recorded with the Orange County Recorder (prior to final inspection). 3. The site plan was discussed with the applicant by the Board, which also advised the applicant concerning the Conditions of Approval and their Findings. The Board discussed the plot plan and the Conditions of Approval, especially in regard to the turning radius to be provided, the dedication and improvement of the alley, and the drainage fee. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. To permit the construction of a fast food restaurant, pursuant to Section 9430 of the Huntington Beach Ordinance Code located on the east side of Magnolia Avenue, approximately 210 feet south of Garfield Avenue, in a C2 Community Business District. The Chairman informed the Board that the Environmental Review Board granted Negative Declaration No. 75-44 on June 17, 1975. Mr. Jack R. Dixon was present, and explained that the owner is in the process of getting a permit for a lot split on the property. Board Member Crosby explained to Mr. Dixon that the legal description on the plan submitted is incorrect and should be corrected. Mr. Dixon agreed. The fire code requirements were explained by Captain Vanderlaan and the applicant explained that a fire wall would be constructed, as well as sprinklering the part of the building which is to be used immediately and providing facilities for sprinklering at a future date in the balance of the building.
